United States Association Incorporated (USTA) ATHLETE SELECTION PROCEDURES 2020 - Tokyo Tennis February 20, 2020 Amended October 26, 2020 Amended May 11, 2021

Following the IOC’s announcement that the Olympic Games Tokyo 2020 have been rescheduled to take place July 23 – August 8, 2021, it was confirmed that these Games would still be referred to as the Olympic Games Tokyo 2020. Therefore, any references to the Olympic qualification system, Olympic Team, Olympic Trials and Olympic Games still reflect ‘2020’ in these selection procedures.

1. SELECTION SYSTEM

1.1. Provide the minimum eligibility requirements for an athlete to be considered for selection to the Team:

1.1.1. Nationality/Passport requirements:

Athlete must be a national of the at the time of nomination.

Athlete must hold a valid U.S. passport that will not expire for six months after the conclusion of the 2020 Olympic Games.

1.1.2. Minimum International Olympic Committee (IOC) standards for participation:

Any competitor in the Olympic, Paralympic, Pan American or must be a national of the country of the National Olympic Committee (NOC) or National Paralympic Committee (NPC) which is entering such competitor. For additional information regarding an athlete who is a national of two or more countries, has changed his or her nationality or acquired a new nationality, refer to the (Rule 41), the IPC Handbook (Section 2, Chapter 3.1), or the PASO Statutes (Article XXII, Sections 4 and 5).

1.1.3. Minimum International Federation (IF) standards for participation (if any):

1.1.4. Other requirements (if any):

• Players must be a current APT or WTA Tour player with an ATP singles rank in the top 500, a WTA Tour singles rank in the top 300 including utilization of protected , if applicable, or have an ATP/WTA doubles rank in the top 10, or if nominated by the USTA as a double specialist’s playing partner, a recognized international singles or doubles as of June 14, 2021 June 7, 2021 June 8, 2020. • Players must be actively enrolled and in good standing with TADP’s or USADA’s Out of Competition anti-doping testing pool. • Players must be in good standing with USTA and the ITF (as defined in the ITF’s Olympic Eligibility documents (Attachment B)) and meet the and Fed Cup Eligibility Rule for the Olympic Tennis Event via https://www.itftennis.com/media/267450/267450.pdf • Upon request by the USTA, players agree to submit and pass a physical evaluation conducted by a USTA designated physician. Failure to submit to and pass a physical evaluation may result in the determination that the player has a disabling injury. • Any athlete age 18 or older will be required to undergo a background screen in accordance with the current U.S. Olympic & Paralympic Committee (USOPC) Background Check Policy. • Any athlete age 18 or older as of the Closing Ceremony will be required to complete the U.S. Center for SafeSport’s online training.

1.2. Tryout Events:

1.2.1. Provide the event names, dates and locations of all trials, events and camps to be used as part of the selection process.

• A list of ATP/WTA events can be found at: www.atpworldtour.com or www.wtatennis.com. • For the purposes of clarity, the USTA does not conduct trials, events, or camps as part of the selection process.

1.2.2. Provide event names, dates, locations and description of how athletes qualify for the trials, events and camps listed above in 1.2.1. (if any).

• Players may earn an ATP/WTA ranking through participation at any event where ATP/WTA points are awarded. • For the purposes of clarity, the USTA does not conduct trials, events, or camps as part of the selection process.

1.3. Provide a comprehensive, step-by-step description of the method that explains how athletes will go through the selection process (include maximum Team size).

1. Pursuant to the ITF Qualification System (Attachment A) and all updates since June 2020 as provided by or posted by the ITF, during the week of on June 16, 2021 June 10, 2021 June 11, 2020 the ITF will extend an invitation to the USTA for those players (male and female) who, as of June 14, 2021 June 7, 2021 June 18, 2020, are ranked in the top 56 according to the ATP/WTA rankings (including utilization of protected rankings, if applicable). These players qualify for selection by their National Olympic Committees ("NOCs"). Tied rankings, if applicable, will be determined by the ITF who utilize the singles and doubles computer rankings systems adopted by the Board.

If the United States has 4 or fewer players who qualify for selection per gender (i.e., receive invitations from the ITF the week of on June 16, 2021 June 10, 2021 June 11, 2020), the USTA will nominate each of those players who have qualified. If the United States has more than 4 players qualify for selection per gender (i.e., receive invitations from the ITF the week of on June 16, 2021 June 10, 2021 June 11, 2020), the USTA will nominate the top 4 players from that pool based on their June 14, 2021 June 7, 2021 June 8, 2020 ranking in the ATP/WTA rankings. Tied rankings, if applicable, will be determined by the ITF who utilize the singles and doubles computer rankings systems adopted by the Grand Slam Board.

Additionally, if players ranked in the top 56 according to the ATP/WTA rankings (including utilization of protected rankings, if applicable), are not nominated by their respective NOCs by June 22 17, 2021 June 18, 2020, or if the top 56 is extended due to NOCs exceeding their maximum of 4 singles allocations within the top 56, or if a nominated player becomes unable to participate prior to a date certain as determined by the ITF to the next highest ranked player. In such a case, if the U.S. has a player who receives, or players who receive, an invitation from the ITF based on the reallocation process, and the USTA has nominated less than 4 singles players, the USTA will nominate the reallocated player or players to the U.S. Olympic Tennis Team so as to bring its team size to the maximum 4 singles players per gender provided that such nomination does not exceed the maximum team size of six (6) players per gender.

Finally, the ITF may issue invitations for six (6) final qualification places to NOCs who have not reached their maximum team size of four (4) singles players based on four factors (set forth in the ITF Qualification System (Attachment A)). In such a case, if the U.S. has a player who receives/or players who receive an invitation from the ITF as part of this process, the USTA will nominate that player /those players to the U.S. Olympic Tennis Team so as to bring its team size to the maximum four (4) players provided that such nomination does not exceed the maximum team size of six (6) players per gender.

2. Doubles

As per the ITF Qualification System for the 2020 Olympic Games and updates as provided by the ITF (Attachment A), during the week of on June 16, 2021 June 10, 2021 June 11, 2018 those players (male and female) ranked in the top 10 according to the ATP/WTA doubles ranking will qualify for selection by their National Olympic Committees ("NOCs") to the Olympic Games provided that: a. Their nominated partner has a minimum ranking of 300 on the Singles and/or Doubles ranking as of June 14, 2021 June 7, 2021 June 8, 2018; and b. They and their partner have been nominated as a doubles team by their respective National Association/National Olympic Committee; and c. The nomination does not bring the total number of competitors to more than six (6).

Depending on: a.) the number of singles players, for each gender who qualify for selection and are nominated to the U.S. Olympic Tennis Team; and b.) a determination by USTA as to the best combination of players for the greatest potential to medal at the Olympic Games; the USTA may elect not to nominate any doubles players, or to nominate 1, 2, 3, or 4 doubles players (per gender). After it receives its singles and doubles invitations from the ITF the week on June 16, 2021 June 10, 2021 June 8, 2020, the respective coaches of the 2020 Men's and Women's U.S. Olympic Tennis Teams will appraise the need for doubles players after reviewing the names of the singles players and doubles players who receive invitations by the ITF.

The USTA will use the following criteria listed in no priority order in determining whether or not to nominate any doubles players to the US Olympic Team: • Number of singles players receiving invitations from the ITF; • Ability of singles players to play doubles events; • The ability of doubles players; • Compatibility of players (doubles and singles); • Success of players in doubles events; • Aptitude for specific Tokyo event conditions (which include court surface, prior results at the venue, ball type, playing environment, and competition format); • Estimated performance at the Games (most likely combination of players to win medals in the doubles events); • Doubles rankings (ATP and WTA Tour respectively) as of June 14, 2021 June 7, 2021 June 8, 2020 including utilization of protected rankings, if applicable; • Historical doubles performance in Grand Slams, Davis Cup/Fed Cup and Olympic competition from 2016 through the date of nomination in 2021 2020; • Physical health at the date of nomination as determined by a USTA designated physician; • Prior playing experience and results with other nominated American doubles/singles players; • Recommendation and input from doubles player/s on desired playing partner/s; and/or • Likelihood of acceptance by the ITF into the doubles competition.

After making their appraisal, the respective men's coach and women's coach shall make a recommendation to the USTA Olympic Selection Oversight Committee (as defined in see Section 2.3) as to the number of doubles players to be nominated to the U.S. Olympic Team. Further, provided that the coaches decide to recommend the nomination of any doubles players to the U.S. Olympic Tennis Team, the coaches shall determine who to recommend to the USTA Olympic Selection Oversight Committee (as defined in Section 2.3; see Section 2.3 for approval process). It shall be the intent to nominate doubles players who have the greatest potential to medal at the Olympics (see Section 2, Discretionary Selection) as determined by USTA. The USTA Olympic Selection Oversight Committee (as defined in Section 2.3) shall review the recommendations of the respective coaches (whether to nominate any doubles players, or whether to nominate some doubles players and who will be nominated, if anyone) and to make nominations to the USOPC. No later than June 22 17, 2021 June 18, 2020 each NOC, including the USOPC, shall confirm to the ITF the names of those doubles players, if any, who will participate in the Olympic Games.

3. Mixed Doubles

Mixed doubles teams will be derived from those players already on site at the Olympic Tennis Event. The respective coaches of the 2020 Men's and Women's U.S. Olympic Tennis Teams shall nominate the players for approval by the ITF with the intent of nominating the players who have the greatest potential to medal. In formulating their nomination, the coaches of the 2020 Men's and Women's U.S. Olympic Tennis Teams will use discretionary selection procedures outlined in Section 2.2 below, mixed doubles. In the event that the respective coaches of the 2020 Men's and Women's U.S. Olympic Tennis Teams do not agree on the nomination of players for approval by the ITF, the respective coaches of the 2020 Men's and Women's U.S. Olympic Tennis Teams shall submit their respective nominations to the USTA Olympic Selection Oversight Committee (as identified below in Section 2.3) for a final determination with the intent of nominating the players who have the greatest potential to medal. The ITF will select the mixed doubles teams taking into account the recognized international singles and doubles computer rankings as of June 14, 2021 June 7, 2021 June 8, 2020. A maximum of 4 players, 2 mixed doubles teams, from any one NOC may compete in the mixed doubles tennis event.

Pursuant to Attachment A, the ITF will retain and nominate four (4) ITF final qualification places. The ITF will select the remaining mixed doubles teams from nominations received from NOC's/National Associations, taking into account recognized world rankings and geographic location.

4. Reallocation of unused IF Quota places

For clarification, if any players/ teams are not entered by the respective NOC/National Associations by July 5, 2021 July 6, 2020, the places shall be reallocated to the next highest ranked player/team up until a date as determined by the ITF when any unused quota places shall be replaced by players/teams already on site.

2. DISCRETIONARY SELECTION (if applicable)

a. Provide rationale for utilizing discretionary selection (if any):

While the ITF and international ranking dictate how the Singles players for the 2020 U.S. Olympic Tennis Team will be selected, in the instances where the most competitive doubles and mixed doubles teams may be fielded through a combination of qualified singles and qualified doubles and mixed doubles players, the USTA will use discretionary selection to select those doubles and mixed doubles players who have the greatest potential to medal as determined by the USTA.

b. List the discretionary criteria and explain how they will be used (if any):

Doubles The respective coaches of the 2020 Men's and Women's U.S. Olympic Tennis Teams shall recommend the players/teams to the USTA Olympic Selection Oversight Committee (as defined in see Section 2.3) for approval with the intent of nominating the players/teams who have the greatest potential to medal based on the factors below in no priority order. • Number of singles players receiving invitations from the ITF; • Ability of singles players to play doubles events; • The ability of doubles players; • Compatibility of players (doubles and singles); • Success of players in doubles events; • Aptitude for specific Tokyo event conditions (which include court surface, prior results at the venue, ball type, playing environment and competition format); • Estimated performance at the Games (most likely combination of players to win medals in the doubles events); • Doubles rankings (ATP and WTA Tour respectively as of June 14, 2021 June 7, 2021 June 8, 2020 including utilization of protected rankings, if applicable; • Historical doubles performance in Grand Slams, Davis Cup/Fed Cup and Olympic competition from 2016 through the date of nomination in 2021 2020; • Physical health at the date of nomination as determined by a USTA designated physician; • Prior playing experience and results with other nominated American doubles/singles players; • Recommendation and input from doubles player/s on desired playing partner/s; and/or • Likelihood of acceptance by the ITF into the doubles competition.

Mixed Doubles The respective coaches of the 2020 Men's and Women's U.S. Olympic Tennis Teams shall nominate the players/ teams to the ITF for approval with the intent of nominating the players/ teams who have the greatest potential to medal based on the factors below in no priority order.

c. Provide the name of the committee that will be responsible for making discretionary selections, along with a complete list of the members’ titles currently serving on the committee:

Should any individual listed above be unable to on the Committee for whatever reason, they will be replaced accordingly.

d. Specify the process that will be used to identify and handle any potential conflicts of interest involving a member of the committee.

Any member of the selection committee that has a possible conflict of interest must disclose it. If such conflict exists, the selection committee member must recuse him/herself from committee discussions and voting. Further, the committee member should not otherwise influence other members of the committee in the selection process. However, a committee member who recused him/herself, but who has relevant and necessary information with respect to athlete performance, for example a national team coach or high performance director, may, if requested by the selection committee, provide such information to the committee so long as such information is provided in a fair and unbiased manner and the committee member who declared the conflict of interest does not vote toward the final decision.

3. REMOVAL OF ATHLETES

a. Prior to entry by name to the Local Organizing Committee by the USOPC, the NGB/HPMO has jurisdiction over potential nominees.

An athlete who is to be nominated to the Team by the NGB/HPMO may be removed for any of the following reasons, as determined by the NGB/HPMO:

i. Voluntary withdrawal. Athlete must submit a written letter to the USTA CEO/Executive Director with a copy to the USTA Team Leader; ii. Injury or illness as certified by a USTA designated physician (or medical staff) approved by the USTA. If an athlete refuses verification of his/her illness or injury by a USTA physician (or medical staff) approved by the USTA, his/her injury will be assumed to be disabling and he/she may be removed. iii. Violation of the USTA’s Rules of Player Conduct (Attachment B). iv. Adjudicated Violation of the World Anti-Doping Agency (WADA), the United

States Anti- Doping Agency (USADA), the United States Olympic & Paralympic Committee (USOPC), or the ITF/ATP/WTA doping regulations (the Tennis Anti- Doping Program “TADP”). In such instances, the adjudication process will be managed by USADA or the Anti-Doping Organization responsible for results management.

An athlete who is removed from the Team pursuant to this provision has the right to a hearing per the USTA’s Constitution and USTA Bylaws, Section 43 or USOPC Bylaws, Section 9 (with the exception of 3.a.iv.).

b. Once athlete entries have been submitted to the Local Organizing Committee by the USOPC, the USOPC has jurisdiction over the Team, at which time, in addition to any applicable NGB/HPMO Code of Conduct, the USOPC’s Code of Conduct and Grievance Procedures apply. c. An athlete may be removed as a nominee to the Team or from the Team for an adjudicated violation of IOC, PASO, IPC, WADA, IF, USADA and/or USOPC anti-doping protocol, policies and procedures, as well as the U.S. Center for SafeSport Code, the USOPC Athlete Safety Policy and USTA Safe Play, as applicable.

4. REPLACEMENT OF ATHLETES

a. Describe the selection and approval process for determining replacement athlete(s) should a vacancy occur:

i. prior to submission of Entries by Name to the Local Organizing Committee, including any applicable group or committee:

• The respective coaches of the 2020 Men's and Women's U.S. Olympic Tennis Teams will have the responsibility of selecting the respective 2020 Olympic replacement team members (subject to the USTA Olympic Selection Oversight Committee's approval as defined herein) for nomination to the USOPC with the intent of selecting male and female players who have the greatest potential to medal at the Olympics and who meet the eligibility requirements as outlined in Section 1. • The factors considered for the selection of male and female replacement singles and doubles players include the below (in no priority order):

o Rankings (as of June 14, 2021 June 7, 2021 June 8, 2020 from the ATP and WTA Tour respectively) including utilization of protected rankings, if applicable; o Historical performance in Grand Slams, Davis Cup/Fed Cup and Olympic

competition from 2016 through the date of nomination in 2021 2020; o Aptitude for specific Tokyo event conditions (which include court surface, prior results at the venue, ball type, playing environment, and competition format); o Physical health at the date of nomination as determined by a USTA designated physician; o Prior playing experience and results with other singles/doubles players (for doubles selection); and/or o Recommendation/input from doubles player/s on desired playing partner/s.

ii. after submission of Entries by Name to the Local Organizing Committee, including any applicable group or committee:

5. SUPPORTING DOCUMENTS

The USTA will retain the approved Selection Procedures and all supporting documents, including scouting or evaluation forms, etc., and data from the selection process for six months past the date of the Closing Ceremony of the Games.

6. REQUIRED DOCUMENTS

In addition to the USOPC Code of Conduct, the following documents are required to be signed by an athlete as a condition of nomination to the Olympic Games and are included as attachments: • USTA’s Rules of Players Conduct (see Attachment C); and • 2020 Olympic Games Consent & Waiver Form (see Attachment D).

7. PUBLICITY/DISTRIBUTION OF PROCEDURES

The USOPC approved Selection Procedures (complete and unaltered) will be posted/published by the USTA in the following locations:

These procedures will be posted as soon as possible, but not more than five business days following notice of approval by the USOPC.

8. DATE OF NOMINATION

The Nomination of Athletes form, including replacements, will be announced to all athletes and submitted to the USOPC on or before:

July 3, 2021 June 17, 2021 July 3, 2020.

9. MANDATORY TRAINING AND/OR COMPETITION

10. ANTI-DOPING REQUIREMENTS

Athletes must adhere to all IOC, IPC, PASO, WADA, IF, USADA and USOPC anti-doping protocols, policies and procedures, as applicable. This includes participation in Out-of-Competition Testing as required by the IOC, IPC, PASO, WADA, IF, USADA and USOPC Rules, as applicable.

If any force of nature, or force majeure, should cause the alteration or cancellation of any of the selection events listed in this document, these selection procedures will be revised, pursuant to their resubmission to the USOPC.

C. ATHLETE ELIGIBILITY

All athletes must comply with the provisions of the Olympic Charter currently in force, including but not limited to, Rule 41 (Nationality of Competitors) and Rule 43 (World Anti-Doping Code and the Olympic Movement Code on the Prevention of Manipulation of Competitions). Only those athletes who comply with the Olympic Charter may participate in the Olympic Games Tokyo 2020 (the “Olympic Games”).

Additional IF Eligibility Criteria: To be eligible to participate in the Tokyo 2020 Olympic Games, all athletes must fulfil additional minimum requirements outlined here: http://www.itftennis.com/media/267450/267450.pdf Only NOCs with National Associations which have been members of the ITF prior to 1 January 2021 may nominate athletes for participation in the Tokyo 2020 Olympic Games Tennis event. The allocation of any quota place (i.e. Direct Acceptance, Host Country Places, and Final Qualification Places) is conditional upon the athlete meeting these athlete eligibility requirements.

D. QUALIFICATION PATHWAY

In this Qualification System, the following definitions are used:

Singles Ranking means the ATP or WTA singles rankings which is published weekly according to the relevant body’s rule book as published on 14 June 2021.

Doubles Ranking means the ATP or WTA doubles rankings which is published weekly according to the relevant body’s rule book as published on 14 June 2021.

Singles Priority Following allocation of the first 24 Direct Acceptance places, should the quota of 86 athletes per gender not yet be reached, additional places will continue to be allocated based on the above ‘Combined Ranking’ process. At the that the quota is reached, any remaining team places in the Doubles event will be allocated according to the below, in priority order: i) Highest combined ranked teams with both athletes accepted into the singles event ii) Highest combined ranked teams with one athlete accepted into the singles event iii) Highest combined ranked teams remaining

Combined Ranking Direct Acceptance places will be allocated to the highest ranked teams based on the Combined Ranking of each team on 14 June 2021. A maximum of four (4) athletes (i.e. two (2) teams) from any one NOC may enter the Mixed Doubles event.

Note: In the event of tied combined rankings in doubles events the ITF will implement the relevant Grand Slam rules in force as at 14 June 2021 to resolve the tie(s).

E. CONFIRMATION PROCESS FOR QUOTA PLACES

By no later than 16 June 2021, the ITF shall confirm to NOCs/National Associations the names of athletes qualified for Direct Acceptance and Final Qualification Places (ITF Places) for Singles and/or Doubles based on this Qualification System. By no later than 22 June 2021, the NOCs/National Associations shall confirm to the ITF if they wish to use these quota places, as detailed in paragraph G. Qualification Timeline.

If an allocated quota place(s) is not confirmed by the NOC/National Association by the confirmation of quota place deadline (22 June 2021) or is declined by the NOC/National Association, the following process will be followed for reallocation.

Direct Acceptances for the Singles Events will be reallocated to the next highest ranked athlete according to the Singles Rankings of 14 June 2021. Direct Acceptances for the Doubles Events will be reallocated to the next highest ranked team according to the ‘Singles Priority’ process above.

Final Qualification Places (ITF Places) and Host Nation Places will be reallocated according to the below criteria: 1. Host Nation place – reallocated to the next highest ranked athlete/team on the applicable Singles Rankings (for Singles events) or Combined Rankings (for Doubles events) of 14 June 2021. 2. Continental Qualification places: - , Asian Games or African Games place(s) – reallocated to the next highest placed athlete in the respective tournament (e.g. Asian Games Silver Medallist) who must have a minimum ranking of 300 in the Singles Rankings of 14 June 2021. Should the next athlete be equal-placed with another (e.g. two losing semi-finalists), reallocation will go to the athlete ranked highest on the Singles Rankings of 14 June 2021. If there are no athletes with a minimum ranking of 300, the place will be reallocated to the next highest ranked athlete on the Singles Rankings of 14 June 2021 notwithstanding the continent from which such athlete comes, respecting the maximum number of quota places per NOC. - Europe or Oceania place – reallocated to the next highest ranked athlete on the Singles Rankings of 14 June 2021 (who must have a minimum ranking of 300) from an NOC of the relevant continent not yet represented. If there are no athletes meeting this criteria, the place will be reallocated to the next highest ranked athlete on the Singles Rankings of 14 June 2021 notwithstanding the continent from which such athlete comes, respecting the maximum number of quota places per NOC. 3. Olympic Gold Medallist/Grand Slam Champion place – reallocated to the next highest ranked Olympic Gold Medallist or Grand Slam Champion on the Singles Rankings of 14 June 2021 (who must have a minimum ranking of 300 in the Singles Rankings of 14 June 2021). If there are no athletes meeting this criteria, the place will be reallocated to the next highest ranked athlete on the Singles Rankings of 14 June 2021 not yet qualified, respecting the maximum number of quota places per NOC.

If reallocated places are not confirmed by the NOC/National Association by the ITF-specified deadline (confirmed at the time of notification), the above reallocation process will continue up until the Sport Entries Deadline (following which the late reallocation procedure will come into effect).

ELIGIBILITY FOR THE OLYMPIC TENNIS EVENT, TOKYO 2020

Amendments to the Eligibility Criteria are in red.

1) Save as provided in these rules, to be eligible to be nominated for and participate in the Olympic Tennis Event at the Tokyo 2020 Olympic Games a player must fulfil the following eligibility criteria:

i) The player must satisfy and comply with the provisions of the Olympic Charter in force from time to time, including but not limited to Rule 41 of the Olympic Charter (Nationality of Competitors) or any replacement or successor provision.

ii) The player must be in good standing with his/her National Association and the ITF in accordance with the ITF Davis Cup Regulations or the ITF Regulations in force at the time of the Tokyo 2020 Olympic Games.

iii) The player must be eligible to represent the country of the National Association and National Olympic Committee that nominates the player by satisfying the Eligibility to Represent a Nation rule contained in the ITF Davis Cup Regulations and the ITF Billie Jean King Cup Regulations in force at the time of the Tokyo 2020 Olympic Games.

iv) The player must have reached the age of fourteen (14) years for the men’s events and fifteen (15) years for the women’s events by the opening day of the Olympic Tennis Event.

v) The player must have fulfilled the minimum participation requirement in the ITF Davis Cup or ITF Billie Jean King Cup Competitions during the Olympic Cycle, by being either:

a) part of the final nominated Davis Cup or Billie Jean King Cup team at the time of the draw and present at the tie on a minimum of three (3) occasions during the Olympic Cycle, provided that one of those occasions is in either 2019 or 2020; or

b) part of the final nominated Davis Cup or Billie Jean King Cup team at the time of the draw and present at the tie on a minimum of two (2) occasions during the Olympic Cycle, provided that one of those occasions is in either 2019 or 2020, if the player falls within either of the following categories:

(I) Length of Service: The player has reached the milestone of 20 weeks in their Davis Cup or Billie Jean King Cup career, with each home and away tie and each round-robin event counting as a single week; or

(II) Zone Group Round Robin Event: A player whose National Association competes for four (4) or three (3) years in the Zone Group Round Robin format with the remaining year/s in the home and away format.

2) Where the player has not met the minimum participation requirement set out at paragraph v) above, the relevant decision-maker (the “Panel”) as specified in the Regulations for the Olympic Tennis Event may exercise its discretion to rule that a player who satisfies all other eligibility criteria is considered eligible for nomination for and participation in the Olympic Tennis Event when taking into consideration special circumstances including, but not limited to, the following:

a) Injury/Illness: The injury or illness must be evidenced through authorised medical records, clearly identifying the period of absence from all competitive tennis.

b) Newcomer to Davis Cup or Billie Jean King Cup Competition: A player only reaches a ranking level sufficient for Davis Cup or Fed Cup selection by his/her National Association during the latter part of the Olympic Cycle.

c) Strength of Nation: A National Association has a large number of highly-ranked players resulting in competition for selection, which limits a player’s opportunities to participate in Davis Cup or Billie Jean King Cup Competition.

d) Commitment to the Olympic Tennis Event and/or Davis Cup or Billie Jean King Cup: A player’s historical participation in one or both competitions.

e) COVID-19: Failure to participate in Davis Cup or Billie Jean King Cup ties as a result of postponement or cancellation of such ties due to COVID-19.

For the purpose of these rules, Olympic Cycle means the period commencing on Monday 15 August 2016, being the day following the day of the conclusion of the Rio 2016 Olympic Tennis Event, and ending on 8 June 2020.

The ITF will publish the Regulations for the Olympic Tennis Event (the “Regulations”) that will set out, among other things:

• these eligibility rules, subject to any amendment as issued by the IOC and/or the ITF;

• conditions of entry to the event, binding upon the National Olympic Committees, National Associations and players; and

• the requirements for the filing of any application to the Panel.

The ITF will publish the Qualification System for the Olympic Tennis Event (the “Qualification System”) that will set out, among other things, the rules, procedures and criteria for qualification to participate in the Olympic Tennis Event.

These eligibility rules are subject to such further supplementary, additional or amending rules as are issued by the International Olympic Committee and/or the ITF in the Regulations, the Qualification System or otherwise prior to the commencement of the Tokyo 2020 Olympic Tennis Event.

USTA RULES OF PLAYER CONDUCT 2020 Olympic Games; Tokyo,

I, (print name), pledge to uphold the spirit of this Code of Conduct (“Code”), which offers a general guide to my conduct as a member of the US Olympic Team (“Team”) as selected by the United States Tennis Association Incorporated (“USTA”). By signing the Code, I accept nomination and, if accepted, selection as a member of the Team for the 2020 Olympic Games (“Olympic Games”), and agree to abide by this Code. I understand that I will be required to sign the United States Olympic & Paralympic Committee (“USOPC”) Code of Conduct (“USOPC Code”), and that any provisions in the USOPC Code that may be in conflict with this Code shall be governed by the USOPC Code. Further, I understand that non-compliance with this Code may result in my removal as a player for the Team or other disciplinary measures as determined in the discretion of the USTA and the USOPC. I and the USTA acknowledge that I have a right to a hearing before being denied the opportunity to participate or if I am charged with a violation of this Code.

I have familiarized myself with the Code and understand that acceptance of its provisions as written is a condition of my selection to the Team. THIS CODE OF CONDUCT MUST BE SIGNED IN AN UNALTERED FORM IN ORDER FOR AN INDIVIDUAL TO BECOME A MEMBER OF THE TEAM.

As a Member of the Team, I hereby promise and agree that I:

• have abided by all rules related to the selection procedures as determined by the USTA;

• have acted and will act in a sportsmanlike manner consistent with the spirit of fair play and responsible conduct at all times;

• will maintain a level of readiness and preparedness that will permit my officiating abilities to be at the maximum of my abilities;

• will submit to a physical examination by USTA designated physician if my ability to complete is compromised due to physical injury and I understand that such injury may be cause for my not being selected to the Team, being removed from the Team, or not being allowed to participate if I remain on the Team;

• will not commit a doping violation as defined by the International Olympic Committee (IOC), International Paralympic Committee (IPC), Pan American Sports Organization (PASO), World Anti-Doping Agency (WADA), United States Anti-Doping Agency (USADA), Tennis Anti- Doping Program (TADP), International Tennis Federation (ITF), USTA, or USOPC rules;

• am not currently serving a suspension because of an anti-doping rule violation and have no pending or unresolved anti-doping rule violation, except as I have listed separately, and I understand that such suspension, or pending or unresolved anti-doping rule violation may be cause for my not being selected to the Team;

Further, I will not violate the USOPC Safe Sport Policy, and understand that any violation of this policy may be cause for denying my selection as a member, or my deselection to the Team;

• will not engage in any conduct that is criminal under any laws applicable to me, including, but not limited to laws governing the possession and use of drugs and alcohol and providing of drugs to any person and of alcohol to minors;

• will refrain from participating in or aiding and abetting, directly or indirectly, any form of gambling or betting on tennis or the 2020 Olympic Games or any event related thereto;

• have never been convicted of violating a criminal law and have no pending indictment or a pending charge, except as I have listed separately (except for misdemeanors, which, if known, would not be a factor in my selection to the Team or convictions as a minor which have been legally sealed), and I understand that such conviction, indictment or criminal charge may be cause for my not being selected to the Team;

• am in possession of a valid USA passport that will not expire prior to six (6) months following the Closing Ceremonies of the 2020 Olympic Games, with no travel restrictions at the time of nomination;

• will refrain from conduct detracting from my ability or that of my Team to attain peak performance, including, by way of example, violating establish curfews;

• will respect the property of others whether personal or public;

• will respect members of my Team, other teams, spectators and officials, and engage in no form of discriminatory behavior or verbal, physical or sexual harassment or abuse;

• will adhere to the rules of tennis and follow all implemented Team procedures;

• will abide by the IOC Charter currently in force and, in particular, with provisions of the IOC Charter regarding edibility for the Olympic Games, and rules concerning allowable trademark identification on clothing and equipment worn or used at the Olympic Games;

• will in-process and out-process with the USOPC in conjunction with my sport, and will attend any USOPC pre-briefing or post-briefing sessions, unless granted written authorization by the USOPC Chef de Mission, or his or her designee;

• am aware that USOPC sponsors, suppliers and licensees provide critical support for the Team and, in recognition of this fact, I will wear designated USOPC apparel at (1) all Olympic Games functions and events, including Opening, Closing, and Medal Ceremonies (with the understanding that, in instances where medals are awarded at the venues immediately following a competition, the USOPC will consider waivers of this requirement on a case by case basis); and (2) at media events (including press conferences) hosted by the USOPC or the Local Organizing Committee for the Olympic Games. I also understand that the USOPC strongly encourages me to wear designated USOPC apparel whenever possible, and that I will be expected to wear designated USOPC apparel at USOPC hospitality functions;

• will not conceal or cover-up any USOPC sponsor, supplier or licensee brand or other identification appearing on my delegation apparel during Opening, Closing, or Medal Ceremonies or at any other function or event where designated USOPC apparel is required;

• will not use or authorize the use of the following items for the purpose of trade, without the prior written consent of the USOPC and the USTA (which consent shall not be unreasonably withheld) (1) photographs, films, videos, or other images of myself in the apparel or equipment provided by the USOPC for the Olympic Games; (2) photographs, films, videos, or other images of myself from the Olympic Games; (3) any Games medals; and (4) photographs, films, videos, or other images of myself with any Games medals;

• will not act as a journalist, media liaison or in any other media capacity during the period of the Olympic Games unless otherwise authorized by the International Olympic Committee;

• will attempt to participate in media and sponsor-related activities if compatible with the Team’s training and competition schedule, when requested by the USOPC Chef de Mission, or his or her designee;

• will act in a way that will bring respect and honor to myself, the Team, the USOPC, the USTA, the United States, and the Olympic Games;

• understand that if I require legal representation because I am accused of a doping violation or criminal misconduct, or if for any other reason I require the services of an attorney, I will be personally responsible for securing the services of said attorney and for payment of all such legal fees and expenses; and

• will remember that at all times I am an ambassador for my sport, my country, and the Olympic Games Movement.

I have read and understand the USTA Code of Conduct and will adhere to them at all times in connection with the 2020 Olympic Games.

CONSENT AND WAIVER FORM 2020 Olympic Games; Tokyo, Japan

I, (Print First and Last Name) in consideration of acceptance of my participation in the 2020 Olympic Games (“Olympic Games”), understand and agree to the following: 1. The United States Tennis Association Incorporated (“USTA”) shall have the right in perpetuity, for the purpose of the promotion and/or the advertising of any National Team Event in which I am a player or am a member of the USTA Games Staff (Team Leader, Team Administration, Athletic Trainer, Physical Therapist, Sports Medicine Professional, Coach, or other as applicable), to use my name, photograph, likeness, biography, voice or other identification, in print, film, radio, television, social media, Internet and/or any other media and in all other publicity and promotional materials and media, including the right to use and/or sublicense such right to use the same on event posters, photos, programs, merchandise and other materials. The USTA shall have the right in perpetuity, without additional compensation, to make, use, show and/or license for any purpose, still pictures, motion pictures, live or delayed on television and/or any other media, including the Internet, of me taken during the Olympic Games, provided that such use is consistent with the mission of the USTA, “To promote and develop the growth of tennis.” However, notwithstanding anything set forth herein, the use of my identification (e.g. name, photograph, likeness, biography, voice, etc.) shall not be identified as or represented to be an endorsement by me of any product, service or company.

2. As a condition of my participation in the Olympic Games, I, for myself and my executors, administrators, heirs, personal representatives, successors and assigns, waive any and all claims of any kind, nature and description, including post, present or future claims and injuries, if any, sustained in traveling to or from or participating in the Olympic Games and/or any of its related activities and/or while in the location of the Olympic Games, as against the USTA, International Tennis Federation (“ITF”), United States Olympic & Paralympic Committee (“USOPC”), Local Organizing Committee, promoters, sponsors, television licensees, vendors, venues, local organizers and others connected with such Olympic Games, including their employees, officers, directors, and representatives.

3. The USTA and I shall at all times be independent contractors and my agreement to participate in the Olympic Games shall not in any way create or form an employer-employee relationship or a partnership or joint venture between us.

4. As a condition of my participation in the Olympic Games, I hereby authorize medical personnel (including trainers) to provide medical or diagnostic services to me in the event that I become ill or sustain an injury in connection with my participation.

5. The Olympic Games are governed by and conducted pursuant to the regulations promulgated and amended from time to time by the International Olympic Committee (“IOC”). The IOC regulations may include a provision relating to drug testing and other medical examinations. If applicable, I agree to be bound by the IOC regulations, current copies of which will be

made available to me upon request. The Olympic Games are also governed by and conducted pursuant to the regulations promulgated and amended from time to time by the USOPC (“USOPC Regulations”) which also include a Code of Conduct, a general release and a dispute resolution process, collectively the Games Forms. If applicable, I agree to be bound by the USOPC Regulations, current copies of which will be made available to me upon request.
