Filomin Candaliza-GutieRRez Sociological Time Travel: Criminality and Criminologists in the Philippine Past This essay is a reflexive assessment of the authors’ research experiences crossing from sociology to history and back for her Ph.D. dissertation on criminality using old archival documents. It highlights the differences in the methodological approaches and data collection practices between the two disciplines, from notions of sampling to the regard of what constitutes authoritative sources data. More importantly, it recognizes the common quest of historical sociology and social history to draw intellectual inspiration and fresh research impetus from the orientations and techniques from one another’s discipline. Finally, the piece narrates her post-dissertation work on the history of knowledge production on criminality in the Philippines, a project that necessitated the historical grounding of biographies, social scientific knowledge, and of research itself. For many Filipino researchers in sociology, S the ‘biography-history’ or the ‘troubles-issues’ guidepost of C.W. Mills (1959) translates well to locating individuals in their contemporary milieu rather than in sustained temporal continuities that engage social life in the Philippine past. Doing the latter is typically entrusted to historians. Much of the sociological researchers in the Philippines have the tendency to relegate the history of the topic being studied as a section allotted to the background, providing some cursory context of what had happened in the past about such a problem. -

BERNAD I N 1958 I had the privilege of visiting the island of Borneo. With me, as my companion and assistant, was a man who has since become my boss: Father Francisco Araneta. We I were guests of the Sarawak Museum, and our expenses while on the island were paid for by the Sarawak Government. Through the kindness of our hosts, and ably chaperoned by two guides- one a Muslim Malay and the other a Catholic Iban- we travelled about in two of the three northern regions of that great and mysterious island, namely in Sarawak and in Brunei. We travelled by landrover, by motorboat up the rivers into the interior, and also (leas extensively) on foot. Borneo (as is well known) is inhabited by people of many tribes or ethnic groups. -

Collaborative Production of “Civilizing Spaces” in Spanish Philippines: The Longos-Paete Land Dispute in Laguna in the Seventeenth to 1 Eighteenth Centuries Grace Liza Y. Concepcion Abstract This paper aims to present the land dispute between Longos and Paete in the province of Laguna de Bay from 1733 to 1734. The objective of the paper is to show how contested lands lying in the border of towns were adjudicated via collaboration among the native elite or principalía, the Church authorities and Spanish civil authorities. Such collaborative interactions gave rise to those pueblos as “civilizing spaces” that the colonial government wished to establish in the Philippines. Spanish authorities believed that these towns were the best way to instill civilization in the natives. The towns eventually became sites of encounter among the natives and colonial authorities, both secular and religious. It was through these encounters that such civilizing spaces were produced not just physically but also socially. These encounters did not come merely in the form of resistance but also of collaboration. Thus the natives, represented primarily by the elite class, contributed to the process of town foundation. Woods Lecturer California State University; UCLA Lecture delivered at the UCLA Center for Southeast Asian Studies February 3, 2005 Much of what has been written about the Philippines, particularly its history, has been produced either by outsiders, or for outsiders—using their categories, their languages, their terms and often informed by their own agenda, specifically economic and/or political. Unwilling or unable to appreciate the fluid, even ambiguous nature of Tagalog social structure before and after the Spanish intrusion, writers of Philippine history have presented a deeply flawed vision of that society. The desire to view pre-hispanic and early Spanish Philippine societies in primarily institutional and political terms has resulted in a static and consequently mistaken representation of that society as is demonstrated in the concept of barangay. Beginning with institutional reports for the Spanish government and continuing to the present with theoretically based reconstructions, the barangay is presented as the basic unit in early Tagalog society and is constructed as containing various aspects of Western society, including class structure and entrenched leadership. Few have bothered to ask how it is that baranggay, a Spanish corruption of the Tagalog balangay, described the basic unit in that society. In the project of rewriting Philippine history, baranggay is representative of the problem and bayan the solution; 1 baranggay as an imagined and imposed view—based on a report from an outsider, and bayan as a fluid and evolving basis of Tagalog identity—found in Tagalog sources. -

The history of the Islands before that time is barely sketched in- the lifeless annals of bureaucracy in an insignificant backwater of the Spanish Empire. Tt is a history in ,,·hich Filipinos rarely make an appC'arance. and which is therefore apparently not thought to he a sub ject of much potential interest to Filipino students today. This is un fortunate, if history is important for filling in the details of a n:ttional self-conception and self-respect, because it lea\'Cs the Filipino people with very little of it. There are presumably people still ali\'e today ,,·ho ,,·c·n~ growing up at the time of the Cavile \lutiny. There was, of comse, a great deal of Filipino history before 1Ri2, and c\·en before the arrival of Spanish colonialism with Legaspi in 1571.' The problem for social historians is how to \\Tile the Filipinos, and in particular the Filipino peasants (the great majority of Filipinos at any time in history), into it. This is a difficult task. because of the scarcity of archi\'al resources and the primiti,·e stage of such auxiliary studies as the history of land use, historical archeology and historical demography. But there are some elementary jobs of conventional his torical research which can be done \\·ith materials available in libraries, and which ought to be done as soon as possible to lay the ground for more ambitious projects. -

CUMMINS and NICHOLAS P. CUSHNER LABOR IN THE PHILIPPINES The stabilization of Spain's empire in America depended in great part upon the utilization of native labor. Mines, haciendas, cattle ranches and estates required laborers and when it was found that the Indian was unsuitable for sustained work and the population was actually diminishing, the African slave trade supplied the required hands. In Spain's outpost in the Pacific, the Philippines, native labor was not required to stabilize the colony. There were no mines and relatively few haciendas and cattle ranches. But labor was needed for the shipyards construct- ing the galleons which crossed the Pacific to Acapulco, for public works projects, for building and maintaining churches and for personal services rendered to crown and ecclesiastical officials.' Labor in the Philippines, then, while not essential to the existence of the Pacific colony, was nevertheless of para- mount importance to its relatively smooth functioning. -

chapter 8 “Mirando las cosas de cerca”: Indigenous Marriage in the Philippines in the Light of Law and Legal Opinions (17th– 18th Centuries) Marya Camacho 1 Introduction When authorities, both ecclesiastical and secular, in the early colonial Philippines had to grapple with questions related to marriage, they could count on analogous experiences in Spanish America and how Church law had been applied there, as well as on the law of the Indies, depending on which aspect posed a problem. In the process, they legislated for the specific local circumstances of the Philippines and solicited opinions from moral theolo gians, who deliberated with prudent consideration of local custom. This chap ter inquires into the mediating role of law, legal opinions, and moral cases in the attempts to reshape indigenous marriage: primarily, the interpretation and translation of indigenous notions and customs to Spanish, Catholic norma tive concepts and practices, which were strongly imbued with the Council of Trent; and, to some extent, the modes of negotiation and indications of assim ilation. Specifically, it examines selected writings of two Dominicans – mainly the legal opinions or consultas of Juan de Paz from the 17th century and moral cases by Francisco Martínez from the late 18th century – in two aspects: the application of European sources to Philippine questions and their contextu alisation in local laws and institutions. The consultas and moral cases selected for this paper pertain less to canonical marriage and more to marriage related questions with distinctively indigenous features. They constitute cases of normative encounter in the realm of canon and civil law and moral theology.
