Questo volume raccoglie le principali attività e iniziative realizzate dalla commissione agricoltura e sviluppo rurale che ho avuto l’onore di presiedere durante l’intero corso della VII legislatura europea. L’avvio della nuova legislatura è coinciso con la chiusura del processo di ratifica del Trattato di Lisbona e l’entrata in vigore della procedura della codecisione, che ha assegnato al Parlamento Europeo nuovi poteri e nuove competenze nell’ambito dei processi legislativi. Tra le politiche trattate la Politica Agricola Comunitaria, appena riformata, ha sottolineato il ruolo che il Parlamento Europeo ha rivestito nella collaborazione all'elaborazione dei testi definitivi della riforma garantendo agli agricoltori e ai cittadini europei un nuovo quadro di riferimento per lo sviluppo di un settore che è cruciale in termini economici, ambientali e sociali. Non ci siamo occupati solo della riforma della PAC, ma di una serie di altre tematiche quali le nuove regole contrattuali della filiera lattiero-casearia e la rinnovata politica di qualità dei prodotti agricoli. Infine, non si può tralasciare l’importante ruolo consultivo e di controllo svolto dalla commissione agricoltura su determinate materie di portata strategica, come la sicurezza alimentare, la gestione delle emergenze alimentari e gli impegni a sostegno del benessere degli animali, dei cittadini indigenti e delle crisi di mercato. In definitiva, quelli trascorsi, sono stati cinque anni in cui il lavoro parlamentare è stato intenso all’interno di un percorso portato avanti con impegno e responsabilità per la realizzazione di risultati concreti a salvaguardia e tutela del sistema agricolo comunitario.

Le présent document reprend les principales activités et initiatives de la commission de l'agriculturee et du développement rural que j'ai eu l'honneur de présider tout au long de la 7 législature du Parlement européen. Le début de la nouvelle législature coïncida avec l'achèvement du processus de ratification du traité de Lisbonne et l'entrée en vigueur de la procédure de codécision, qui confère au Parlement européen de nouveaux pouvoirs et de nouvelles compétences dans le cadre des processus législatifs. Parmi les politiques abordées, la politique agricole commune, qui vient d'être réformée, a mis en évidence le rôle joué par le Parlement européen dans l'élaboration des textes définitifs de la réforme, garantissant aux agriculteurs et aux citoyens 5 européens un nouveau cadre de référence pour le développement de ce secteur de premier plan, aux niveaux économique, environnemental et social. Nous nous sommes non seulement occupés de la réforme de la PAC, mais aussi d'une série d'autres thématiques, telles que le nouveau cadre contractuel de la filière laitière et la politique de qualité des produits agricoles révisée. Enfin, on ne peut ignorer le rôle important, aux niveaux consultatif et de contrôle, exercé par la commission de l'agriculture dans des domaines stratégiques précis tels que la sécurité alimentaire, la gestion des situations d'urgence alimentaire et les engagements en faveur du bien- être animal, des citoyens les plus démunis et des crises qui affectent le marché. En définitive, les cinq années écoulées ont été marquées par un travail parlementaire intense, mené avec engagement et responsabilité, en vue d’aboutir à des résultats concrets pour sauvegarder et protéger le système agricole communautaire.

Foreword by Mr Paolo De Castro

This document gives an overview of the main activities and initiatives of the Committee on Agriculture and Rural Development, which it has been my privilege to chair, during the 7th term of the European Parliament. The beginning of that parliamentary term coincided with the completion of the Lisbon Treaty ratification process and application of the codecision procedure, giving Parliament new powers and remits in the legislative process in this area. It was perhaps the common agricultural policy and its recent reform that highlighted better than any other dossier the role played by Parliament, which helped draft the final texts on the reform and provide farmers and the European public with a new reference framework for the development of a sector that is crucial in economic, environmental and social terms. However, besides the reform of the CAP, we also addressed a range of other themes such as the new rules on contracts in the dairy sector and updating of the policy on agricultural product quality. Last but not least, the Committee played an important advisory and monitoring role in certain dossiers of strategic interest such as food safety, the management of food crises and commitments in support of animal welfare, the poorest members of society and market crises. In short, the past five years have been ones of intensive parliamentary work which the Committee has performed with diligence and responsibility, moving matters forward to achieve tangible results to protect and safeguard the EU's agricultural system.

6 INTRODUCTION

The Committee on Agriculture and Rural Development (AGRI) is primarily responsible for examining and, where necessary, amending the European Commission's legislative proposals by preparing reports on agricultural policy for subsequent adoption by the European Parliament in plenary.

Under Annex VII of the Rules of Procedure, the Committee on Agriculture is responsible for: - the operation and development of the common agricultural policy; - the rural development, including the activities of the relevant financial instruments; - legislation on: a) veterinary and plant-health matters, animal feedingstuffs provided such measures are not intended to protect against risks to human health, b) animal husbandry and welfare; - the improvement of the quality of agricultural products; - supplies of agricultural raw materials; -the Community Plant Variety Office; - forestry.

The powers and responsibilities of this committee are more important than ever now that, since the entry into force of the Treaty of Lisbon, the European Parliament has the power of codecision, with the Council of Agriculture Ministers, on the common agricultural policy (CAP). HIGHLIGHTS

REFORM OF THE COMMON AGRICULTURAL POLICY

The adoption of the reform of the Common Agricultural Policy (CAP) for 2014-2020 - the first CAP reform to be decided by co-decision - was without doubt the main challenge faced by the AGRI Committee and the European Parliament in the agricultural field during the 7th legislative term. Prior to the formal adoption of the proposal by the European Commission in October 2011, the Committee outlined its position by adopting a series of own-initiative reports in 2010 and 2011. In addition, during the autumn of 2011, the Committee organised a series of public events to discuss the Commission's proposals. During the same period, EP rapporteurs were named and started to work on the four main legislative proposals: Luis Manuel Capoulas Santos (S&D, PT) for the proposals related to direct aids to farmers and rural 7development support, Michel Dantin (EPP, FR) for the common organisation of the agricultural markets, and Giovanni La Via (EPP, IT) for the horizontal rules of the CAP including the financial rules. The rapporteurs presented their draft reports in the spring 2012. Not surprisingly, both the Commission proposals and the draft reports by the EP rapporteurs elicited a great deal of interest and in July 2012, almost 8 000 amendments - a record number in Parliament - were tabled by MEPs to the whole package prior to the vote in the AGRI Committee. Furthermore between April and June 2013, more than 40 trilogues were held between the Parliament, the Council, and the Commission in order to find a global agreement on the whole package. A political agreement was reached on most of the proposed elements of the reform on 26 June 2013 and a final agreement on the outstanding issues related to the negotiations on the Multi-annual Financial Framework (MFF) for 2014-2020 was reached during a final trilogue meeting on 25 September 2013. Subsequently the legislative texts were formally approved by Parliament and Council in November-December 2013. THE DAIRY PACKAGE

The dairy package (Rapporteur: James Nicholson, ECR - UK) agreed in December 2011 between Parliament and Council negotiators was the first major CAP file agreed under the codecision procedure introduced by the Lisbon Treaty. The key aim of this package, which was the institutions’ answer to the 2009 milk crisis, was to boost dairy farmers' bargaining power by giving them the tools to negotiate fairer contracts with dairies, and thus ensure fairer prices for the raw milk they produce and help them to prepare for the end of milk quotas in 2015. In 2013, these new rules were integrated into the new common market organisation in 2013 within the context of the CAP reform. QUALITY SCHEMES

Another important piece of legislation adopted by the Parliament under the 7th legislature is the new regulation on quality schemes (Rapporteur: Iratxe García Pérez, S&D - ES). This regulation was agreed in plenary in September 2012, following a first- reading agreement with the Council. These new rules include simpler registration procedures for the European quality label schemes. A new label for mountain products was also introduced at the request of the Parliament. THE ANIMAL TESTING DIRECTIVE

In September 2010, the Parliament adopted a directive on the use of animals in scientific experiments, which aimed at striking a better balance between animal welfare and the need for research into diseases (Rapporteur: Elisabeth Jeggle, EPP – DE). This directive requires national authorities to assess the animal welfare implications of each experiment, with a view to promoting alternative testing methods and reducing the level of pains inflicted on animals. At Parliament’s insistence, the Council agreed to introduce a system to classify uniformly the severity of procedures.

The CAP reform of 2014-2020 Reports under the ordinary legislative procedure (COD) Common agricultural policy (CAP): direct payments to farmers under support schemes 2014-2020 -

2011/0280(COD) Rapporteur: Luís Manuel Capoulas Santos http://www.europarl.europa.eu/oeil/popups/ficheprocedure.do?reference=2011/0 280(COD)&l=en Following extensive negotiations, in November 2013, the European Parliament adopted its first reading position on a regulation establishing rules for direct payments to farmers under support schemes within the framework of the common agricultural policy (CAP) for the years 2014-2020. The amendments adopted in plenary were the result of a compromise reached between the European Parliament and the Council and concerned the main elements of regulation, including the definition of an active farmer, internal and external convergence, the basic payment scheme, greening payments, payments for young farmers, and the small farmers' scheme.

9 Common organisation of the markets in agricultural products (Single CMO Regulation) 2014-2020 -

2011/0281(COD) Rapporteur: Michel Dantin http://www.europarl.europa.eu/oeil/popups/ficheprocedure.do?reference=2011/0 281(COD)&l=en In November 2013, after numerous trilogue meetings, the European Parliament adopted its first reading position on the proposal for a regulation establishing a common organisation of the markets in agricultural products (Single CMO Regulation) for the period 2014-2020. The amendments adopted in plenary were the result of a compromise reached between the European Parliament and the Council and concerned the major changes brought about by this Regulation, including strengthening the role of producer organisations in collective negotiations, the modernisation of market intervention tools, the introduction of new crisis management tools, the end of the milk and sugar quotas in 2015 and 2017 respectively, and the introduction of a more flexible system for vine planting. European Agricultural Fund for Rural Development (EAFRD): support for rural development (RD) 2014-2020 -

2011/0282(COD) Rapporteur: Luís Manuel Capoulas Santos http://www.europarl.europa.eu/oeil/popups/ficheprocedure.do?reference=2011/0 282(COD)&l=en Simultaneously with the other files of the CAP reform, in November 2013, the European Parliament adopted its first reading position on a regulation on support for rural development by the European Agricultural Fund for Rural Development (EAFRD). The amendments adopted in plenary reflected the political agreement found between the European Parliament and the Council. Under this regulation, Member States will be required to spend at least 30% of their rural development funding from the EU budget on certain measures related to land management, forestry and the fight against climate change and at least 5% on the EU LEADER programme approach (linking rural economy and development actions). Common agricultural policy (CAP): financing, management and monitoring 2014-2020 -

2011/0288(COD) Rapporteur: Giovanni La Via http://www.europarl.europa.eu/oeil/popups/ficheprocedure.do?reference=2011/0 288(COD)&l=en The European Parliament also adopted its first reading position on a regulation on the financing, management and monitoring of the common agricultural policy in November 2013. The amendments adopted in plenary were the result of a compromise reached between the European Parliament and the Council and concerned key elements of the proposal, such as cross-compliance (the mechanism that ties direct payments and certain rural development and wine sector payments to compliance with standards of environmental care and public/animal/plant health and animal welfare), the monitoring and evaluation of the CAP, the Farm advisory system and the establishment of a reserve for crises in the agricultural sector.

10 Transitional provisions on support for rural development by the European Agricultural Fund for Rural Development (EAFRD) -

2013/0117(COD) Rapporteur: Albert Deß http://www.europarl.europa.eu/oeil/popups/ficheprocedure.do?reference=2013/0 117(COD)&l=en Also in November 2013, the European Parliament adopted its first reading position on a regulation laying down certain transitional provisions on support for rural development by the European Agricultural Fund for Rural Development (EAFRD) and amending Regulation (EU) No [RD] as regards resources and their distribution in respect of the year 2014 and amending Council Regulation (EC) No 73/2009 and Regulations relating to the new Common Agricultural Policy (CAP) as regards their application in the year 2014. This regulation provides transitional provisions for 2014 regarding certain rules relating to the Common Agricultural Policy (CAP), in particular the system of direct payments. Transitional rules are needed to define technical arrangements which will permit a smooth adaptation to the new rules, whilst at the same time ensuring continuity of the different forms of support under the CAP. The amendments adopted in plenary were the result of a compromise reached between the European Parliament and the Council. Own-initiative reports (INI) The CAP towards 2020: Meeting the food, natural resources and territorial challenges of the future -

2011/2051(INI) Rapporteur: Albert Deß http://www.europarl.europa.eu/oeil/popups/ficheprocedure.do?reference=2011/2 051(INI)&l=en Adopted in June 2011, this own-initiative report was the EP's formal response to the Commission's Communication of November 2010 on the CAP towards 2020. Following up on the Lyon report on the future of the CAP, this report argued that the EU's agriculture spending should remain unchanged until 2020 in view of the many challenges facing EU agriculture, such as food security, climate change, environment, biodiversity, and territorial balance. The EP supported a strong and sustainable CAP, a fair distribution of CAP funding, a 'degressivity' system according to farm size for direct payments, an EU-wide incentivisation scheme for further "greening", and retaining the existing two pillars structure with some adaptations for a better targeting of measures. Simplifying the CAP rules and guaranteeing the high standards of EU agriculture at global level were also central elements of the Dess report. The future of the CAP after 2013 -

2009/2236(INI) Rapporteur: George Lyon http://www.europarl.europa.eu/oeil/popups/ficheprocedure.do?reference=2009/2 236(INI) This own-initiative report, adopted in July 2010, aimed to provide the Parliament's position prior to the adoption of the 2011 CAP reform package. In it the EP considers that the CAP must remain a common policy and not be renationalised. It also argues that direct support should remain fully financed by the EU budget, rejecting any 11 further co-financing which could harm fair competition within the Single Market. In addition, the CAP should ensure the coexistence of i) high-added-value farming with high-quality primary and processed products, giving it a strong position on world markets; ii) farming open to regional markets; and iii) farming geared to local markets. Simplification of the CAP - : 2009/2155(INI) Rapporteur Richard Ashworth http://www.europarl.europa.eu/oeil/popups/ficheprocedure.do?reference=2009/2 155(INI) In May 2010, the Parliament adopted this own-initiative report, which underlines that further simplification of the CAP is necessary to reduce its implementation costs for the EU institutions, Member States and the beneficiaries themselves. Reports under the ordinary legislative procedure (COD) Common agricultural policy (CAP): adjustment rate to direct payments in respect of the year 2013 -

2013/0087(COD) Rapporteur: Luís Manuel Capoulas Santos http://www.europarl.europa.eu/oeil/popups/ficheprocedure.do?reference=2013/0 087(COD)&l=en In June 2013, the Parliament adopted its report on a proposal fixing an adjustment rate to direct payments for the calendar year 2013, known as 'financial discipline'. The proposed regulation set out a cut of 4.98% to direct payments in excess of EUR 5,000 to be granted to farmers' applications lodged in calendar year 2013. Its objective was to reduce the total amount of direct payments by EUR 1,471.4 million in order to respect the EAGF net ceiling for financial year 2014 and to establish a reserve for crises in the agricultural sector (EUR 424.5 million). In its report, the Parliament rejected the cut of about 5% to direct payment claims, largely because at that time it had not yet struck a deal with the Council on the Multiannual Financial Framework (MFF) for the 2014-20 period, which took place only a few weeks later. In October 2013 the Commission finally set the cut at 2.45% for payments superior to EUR 2,000 in the context of the annual budgetary procedure. Common agricultural policy (CAP): application of direct payments for farmers in respect of the year 2013 -

13 Amendment of Regulation (EC) No 378/2007 on rules for the implementation of voluntary modulation of direct payments under the common agricultural policy -

A technical correction had to be introduced to the calculation formula of Article 11 (Financial discipline). In addition, an adjustment of Article 69(5) was proposed in order to comply with point 6.6 of the Final Presidency compromise on Health Check proposals, and to provide support to the beef and veal sector. Common Agricultural Policy (CAP): repealing obsolete Council acts -

In this context, this proposal aimed to repeal those legislative acts which no longer had any real effects.

15 The dairy farming sector

Report under the ordinary legislative procedure (COD) Contractual relations in the milk and milk products sector

- 2010/0362(COD) Rapporteur: James Nicholson http://www.europarl.europa.eu/oeil/popups/ficheprocedure.do?reference=2010/0 362(COD)&lg=en In February 2012, the Parliament adopted its position at first reading under the ordinary legislative procedure on the proposal for a regulation of the European Parliament and of the Council amending Council Regulation (EC) No 1234/2007 as regards contractual relations in the milk and milk products sector. The amendments adopted in plenary were the result of a compromise negotiated between the European Parliament and the Council. The adopted regulation provides for optional written contracts between milk producers and processors to be drawn up in advance of deliveries, which should include details of price, timing and volume of deliveries, and duration. In order to rebalance bargaining power in the supply chain, the text also foresees allowing farmers to negotiate contracts collectively through producer organisations. In addition, appropriate quantitative limits to the volume of this negotiation will put farmers on equal footing with the major dairies while maintaining an adequate competition in the raw milk supply.
