Although academic freedom and university autonomy are legally and constitutionally recognized, public policies and ‘new legisla- tion’ undermine them. Military and paramilitary forces violently repress student protests. Frequent- ly, students are arbitrarily detained, physically attacked, and psychologically pressured through in- terrogations about their political views and their supposed "plans to destabilize the government". A parallel system of non-autonomous universities has been created under a pensée unique established by the Socialist Plans of the Nation.     Cuestiones Jurídicas Revista de Ciencias Jurídicas de la Universidad Rafael Urdaneta Vol. XIII, Núm. 2 Julio - Diciembre 2019 ISSN 2343 - 6352 Academic Freedom in Venezuela: Context, Restrictions and Challenges*36 David Gómez**37 Abstract This article aims to analyze the situation regarding academic freedom and autonomy within higher education institutions in Venezuela between 2010-2018, identifying main restrictions, reprisals, threats and challenges. The research is focused on the grounds of international human rights law standards. Likewise, it analyzes the legislative and institutional framework in Venezuela and assesses the compatibility of domestic law and the practice from the branches of the Public Power with international standards on academic freedom and autonomy of higher education institutions. The research identified a restrictive policy against academic freedom and university autonomy in Venezuela, which is made visible through the normative-institutional framework, budget asphyxiation against universities, criminalization of protest and discrimination against professors and university students, the usurpation by ministerial authorities within the competences of the Public Autonomous Universities, the siege of the Judicial Power against universities and generalized practices to intervene higher education institutions. However, the situation has worsened in the context of the complex humanitarian emergency in Venezuela, which comprehensively affects the University as a key institution for democracy and its key actors: professors-researchers and students. Methodologically, the research is document-based. For the analytical process, this research made used of comparison and qualitative strategies. SAR gratefully acknowledges the substantial research and drafting work of Ghent faculty and students.* 4. This submission focuses on Venezuela’s compliance with its obligations under international law to protect and promote academic freedom and related rights within its territory. For more than two decades, scholars, students and higher education institutions in Venezuela have faced systemic pressures, including severe encroachments on university autonomy, targeted denials of funding to disfavored institutions, and individual attacks, such as arbitrary detention, arrest, and violence.
