APOLOGIES FOR ABSENCE EAP33/03 The Borough Secretary and Solicitor reported apologies for absence from Councillor Smith. MINUTES OF THE MEETING HELD ON 4 AUGUST 2003 EAP34/03 The Minutes of the meeting, held on Monday 4 August 2003, were agreed. PLANNING APPLICATIONS (030826/EAP010) EAP35/03 RESOLVED – That the Schedule of Planning Applications, as set out in the appendix to these minutes, be determined as shown therein. GREENSIDE COTTAGE, LAMBERHURST GOLF CLUB EAP36/03 The Head of Planning and Building Control Services submitted a report (030826/EAP011) that sought approval to amend the terms of a Section 106 Agreement signed in 1992 to allow Greenside Cottage to be now let to a person who is not a member of staff employed full time by the Golf Club. RESOLVED – That the Borough Secretary and Solicitor be authorised: (1) To negotiate a Deed of variation to the Section 106 Agreement to permit occupation of Greenside Cottage by the named person currently in occupation, even though he is not employed full time by Lamberhurst Golf Club; and (2) To pay the Council’s reasonable legal costs for the preparation and completion of this Deed. WALL AT CHURCH COTTAGES, KILNDOWN, GOUDHURST EAP37/03 The Borough Secretary and Solicitor and the Head of Planning and Building Control Services submitted a joint report (030826/EAP012) that informed Members on the compliance with a Breach of Condition Notice relating to the wall at Church Cottages, Kilndown, Goudhurst. Members were informed that part two of the Breach of Condition had not been complied with in that the materials were still on site, therefore Members asked that officers pursue part two and report back to the Committee in the Enforcement Review report. RESOLVED – That the report be noted. EXEMPT ITEM LOCAL GOVERNMENT ACT 1972, SECTION 100A(4) RESOLVED – That, under section 100A(4) of the Local Government Act 1972, the public be excluded from the meeting for the following item of business on the grounds that it may involve the likely disclosure of exempt information as defined in Part I of Schedule 12A of the Act, namely:- Minute EAP38/03 Paragraph (14) - Any action taken or to be taken in connection with the prevention, investigation or prosecution of crime. -E42- -E43- SHALLEE, FRIEZLEY LANE, CRANBROOK EAP38/03 The Borough Secretary and Solicitor and the Head of Planning and Building Control Services submitted a joint report (030826/EAP013) that informed Members of the current situation in respect of a mobile home situated at Shallee, Friezley Lane, Cranbrook. Consideration was given to revoking a previous decision of the Committee. RESOLVED – (1) That the Borough Secretary and Solicitor be instructed to write to the current owner of the site, advising her of the terms of the enforcement notice and the subsequent resolution of the Council whereby Mrs ‘C’ alone would be allowed to remain in the mobile home during her lifetime and accordingly that she would be in breach of the notice if she allowed anyone else to live there; and (2) That if within three months of the current owner receiving a letter to the above effect there is not compliance with the terms of the enforcement notice and the subsequent resolution, the Borough Secretary and Solicitor be authorised to institute legal proceedings in the Magistrates’ Court to enforce the same. He withdrew from the meeting and Councillor Cunningham took the Chair during consideration of those items. (2) Before the development is commenced a detailed method statement for the complete demolition and removal from the site of the existing buildings and yard, including foundations, shall be submitted to and -E45- approved in writing by the Local Planning Authority, and no work shall commence on site until the buildings and yard have been removed in accordance with those approved details.
