PURPOSE OF THE DOCUMENT

The main purpose of this document is to comprehensively record the Stakeholder Engagement Process (SEP) and document all comments and responses gathered during the Public Participation Process (PPP) undertaken for the Environmental Impact Assessment (EIA) and Water Use License Application (WULA) process for the proposed Eastern Platinum Limited (EPL) Chrome Plant.

GLOSSARY AND TERMINOLOGY

Applicant – A person who has submitted or intends to submit an application to the Department in compliance with the provisions of the NEMA EIA Regulations.

Days – Calendar days.

Environment - The surroundings within which humans exist and that are made up of: i. the land, water and atmosphere of the earth; ii. micro-organisms, plant and animal life; iii. any part or combination of (i) and (ii) and the interrelationships among and between t them; and iv. the physical, chemical, aesthetic and cultural properties and conditions of the foregoing that influence human health and well-being. This includes the economic, social, cultural, historical and political circumstances, conditions and objects that affect the existence and development of an individual, organism or group.

Environmental impact assessment (EIA) - An Environmental Impact Assessment (EIA) refers to the process of identifying, predicting and assessing the potential positive and negative social, economic and biophysical impacts of any proposed project, plan, programme or policy which requires authorisation of permission by law and which may significantly affect the environment. The EIA includes an evaluation of alternatives. As well as recommendations for appropriate mitigation measures for minimising or avoiding negative impacts, measures enhancing the positive aspects of the proposal and environmental management and monitoring measures.

Environmental management plan (EMP) - An environmental management tool used to ensure that undue or reasonably avoidable adverse impacts of the construction, operation and decommissioning of a project are prevented; and that the positive benefits of the projects are enhanced.

Interested and Affected Party (I&AP) – An interested and affected party contemplated in section 24(4)(d) of the Act, and which in terms of that section includes any person, group of persons or organisations interested in or affected by an activity and any organ of state that may have jurisdiction over any aspect of the activity.

Public participation process - A process of involving the public in order to identify issues and concerns, and obtain feedback on options and impacts associated with a proposed project, programme or development. Public Participation Process in terms of NEMA refers to: a process in which potential interested and affected parties are given an opportunity to comment on, or raise issues relevant to specific matters.

Registered Interested and Affected Parties – All persons who, as a consequence of the public participation process conducted in respect of an application, have submitted written comments or attended meetings with the applicant or EAP, all persons who, after completion of the public participation process, have requested the applicant or the EAP managing the application, in writing, for their names to be placed on the register, and all organs of state which have jurisdiction in respect of the activity to which the application relates.

Stakeholders – Stakeholders are persons or groups who are directly or indirectly affected by a project, as well as those who may have interests in a project and/or the ability to influence its outcome, either positively or negatively. Stakeholders may include locally affected communities or individuals and their formal and informal representatives, politicians,

religious leaders, civil society organisations and groups with special interests, the academic community, or other businesses.

Scoping Report - A scoping report is a report whose purpose is to describe the methodology and range of activities of the appraisal work to be done in order to begin the process of collating information on relevant plans and programmes and is Finaled in accordance to regulation R 982 dated 4 December 2014.

1 INTRODUCTION AND BACKGROUND

Lonmin is the third largest producer of Platinum Group Metals (PGMs) and associated minerals in the world and has an employee number of about 24 000. The company is listed on the London Stock Exchange with a secondary listing on the Johannesburg Stock Exchange. The company owns the Operations as well as the Baobab operation situated in the Limpopo Province and the Precious Metal Refinery (PMR) located in Brakpan.

The Lonmin Platinum Operations in Marikana are divided into Western Platinum Limited (WPL) and Eastern Platinum Limited (EPL) with the Mining Rights area covering approximately 10,418 Ha (WPL) and 4,099 Ha (EPL). The Lonmin Platinum Mine Operations in Marikana stretches over approximately 35km situated immediately north of the National route (also known as the Bakwena Highway). The entire mining area is situated between Marikana to the west and stretches another 4km past Bapong to the east.

The core business focus of Lonmin plc includes Platinum Group Metals (PGMs) such as platinum (Pt), palladium (Pd), rhodium (Rh), iridium (Ir), ruthenium (Ru), and gold (Au). Other refined by-products that are produced include copper, nickel sulphate and chromite. WPL and EPL are currently mining both the Merensky and Upper Group 2 Reef (UG2). The UG2 Reef is approximately 0.9 m – 1.1 m thick and runs parallel to and lies underneath the Merensky Reef (approximately 130 m to 210 m below). Together these two Reefs contain most of the world's known reserves of platinum group metals (PGMs) or platinum group elements (PGMs) Platinum, Palladium, Rhodium, Ruthenium, Iridium, Osmium and Gold.

Lonmin has a New Order Mining Licence for their core operations valid until 2037 and is renewable to 2067. Eastern Platinum Limited (EPL) is a subsidiary of Lonmin Platinum and has an approved Environmental Management Plan (EMP) dated 2012.

It is the intention of EPL to conduct an Environmental Impact Assessment in terms of the National Environmental Management Act (Act No. 107 of 1998) EIA Regulations as amended, and a Water Use License Application in terms of the National Water Act, 1998 (Act 36 of 1998) to allow for the construction and operation of the extension to the EPL Chrome Plant. The 2012 EMP will be updated as to include the construction of the proposed extension of the EPL Chrome Plant for life of mine operations.

1.2 Legislative Requirements

The below table provides a limited summary of the legislative background for the undertaking of the Public Participation Process for the EPL Chrome Plant.

Legislation Section Requirement 3(1) Subject to sub-regulations (2) and (3), when a period of days must in terms of these Regulations be reconed from or after a particular day, that period must be reconed as from the start of the day following that particular day to the end of the last day of the period, but if the last day of the period falls on a Saturday, Sunday or public holiday, that period must be extended to the end of the next day which is not a Saturday, Sunday or public holiday. (2) For any action contemplated in terms of these Regulations for which a timeframe is prescribed, the period of 15 December to 5 January must be excluded in the reckoning of days. (3) Unless justified by exceptional circumstances, as agreed by the competent authority, the proponent and applicant must refrain from conducting any public participation process during the period of 15 National December to 5 January. Environmental (4) When a State department is requested to comment in terms of these Management Regulations, such State department must submit its comments in writing Act, 1998 (Act within 30 days from the date on which it was requested to submit No. 107 of 1998) Chapter 2 comments and if such State department fails to submit comments within (NEMA) such 30 days, it will be regarded that such State department has no

comments. EIA Regulations – (5) Where a prescribed timeframe is affected by one or more public 4 December 2014 holidays, the timeframe must be extended by the number of public Regulation R 982 holidays falling within that timeframe. (6) The competent authority must acknowledge receipt of all applications and documents contemplated in regulations 16, 19, 21, 23, 29, 30, 31, 32 and 34 within ten days of receipt thereof. (7) In the event where the scope of work must be expanded based on the outcome of an assessment done in accordance with these Regulations, which outcome could not be anticipated prior to the undertaking of the assessment, or in the event where exceptional circumstances can be demonstrated, the competent authority may, prior to the lapsing of the relevant prescribed timeframe, in writing, extend the relevant prescribed timeframe and agree with the applicant on the length of such extension. (8) Any public participation process must be conducted for a period of at least 30 days.

Legislation Section Requirement (41) (4) A responsible authority may, at any stage of the application process, require the applicant— (a) to give suitable notice in newspapers and other media - (i) describing the licence applied for; (ii) stating that written National Water objections may be lodged against the application before a specified date, Act, 1998 (Act Chapter 4 which must be not less than 60 days after the last publication of the notice; (iii) giving an address where written objections must be lodged; and (iv) No. 36 of 1998) Part 7 containing such other particulars as he responsible authority may require; (NWA) (b) to take such other steps as it may direct to bring the application to the attention of relevant organs of state, interested persons and the general public; and (c) to satisfy the responsible authority that the interests of any other person having an interest in the land will not be adversely affected.

1.3 Project Description

The EPL operations are managed in terms of an approved 2012 EMP and include the following existing infrastructure:

TD1 Easterns Bulk Tailings Treatment Plant o Waste Rock Dumps located at each shaft area;  EPL Waste Water Treatment Works;  E3 Waste Water Treatment Works  General Waste Disposal Site; o EPL General Waste Disposal Site (mothballed);  Infill Apartments and family units  Various extensive pipeline and road networks This EIA focusses on the EPL operations which will be expanded with the construction of a proposed extension to the EPL Chrome Plant which will receive tails from EPL Concentrators via pipelines. The purpose of the Chrome Plant is to receive tails from Lonmin Concentrators

via pipelines. Chromium (III) Oxide (Cr2O3) will be beneficiated by various gravity separation techniques and therefore the proposed Chrome Plant will be managed and operated by

Glencore. Cr2O3 concentrate will be partially dewatered via cyclones and deposited on a concrete slab, where once it has dried it will be loaded on side tipper trucks and removed from site. The tailings of the proposed plant will be returned to Lonmin Tailings Treatment Plant (TTP) for additional PGM recovery.

The development of the Chrome Plant will include the following additional infrastructure to be constructed at the Eastern Platinum Limited Concentrator (EPL Concentrator) area:

 Site Offices;  Chrome Processing Plant consisting of: o a chrome ore spiral plant; o thickeners; o product storage areas;  Related infrastructure such as: o Storm Water Management facilities (Storm Water Dam and associated clean and dirty water separation infrastructure such as trenches, berms etc.); o Laydown area to be later used as a parking area; o Truck staging area (maximum 15 trucks);  Security o Security and perimeter fence.

Services to the proposed Chrome Plant:

 Water Supply o Potable water is supplied by the Rand Water Board (RWB). o Process Water - The Chrome Plant makes use of a closed water system entailing that water is constantly re-used and not disposed of. Water from the thickeners are removed and temporarily stored in the process water tanks before re-used in the process. Lonmin supplies the plant with process water from their concentrator plant.  Power Supply o Eskom power is supplied via overhead lines to the area. The existing connection at the mine will be used with no additional power supply required  Access Road o The existing Lonmin road network will be used for access to the Chrome Plant. No new roads would be required.  Sewage Disposal o Sewage effluent will be connected to the exiting effluent pipelines and treated at the Licensed Eastern Platinum Limited Waste Water Treatment Works.

The current EMP dated 2012 have been incorporated during this process as to form one consolidated EMP for the EPL operations. Should the EMP be approved it will replace the 2012 EMP. Therefore the EMP consists of:

 The construction phase impacts focussing on the development of the proposed new Chrome Plant;  The operational phase impacts which takes into account the existing operations inclusive of the operation of the proposed Chrome Plant; and  The closure phase impacts associated with the closure of the entire operations.

The adjoining Western Platinum Limited (WPL) operations are in possession of a separate Environmental Management Programme (EMP) and are excluded from this process.

1.4 Project Phases

The below figure represents the Public Participation Process as part of the Environmental Impact Assessment for the EPL Chrome Plant.

1.4.1 Scoping Phase

The scoping process is the first phase of the EIA and aims to identify significant issues and determine the scope of the subsequent Impact Assessment phase. The scoping process culminates in the compilation of a scoping report, which includes a description of the environmental issues, potential impacts, potential alternatives and a detailed plan of study for the EIA phase.

The Scoping Report aims to:

• Provide an outline of the proposed project; • Provides an outline of the proposed process to be followed; • Identify all environmental impacts of the proposed project;

• Identify issues and concerns raised by Interested and Affected Parties (I&APs) and stakeholders; • Identify potential alternatives of the proposed project; and • Focus on significant environmental impacts for further study in the Environmental Impact Report.

With the completion of the Scoping Phase, all comments received on the Draft Scoping Report is documented in an Issues and Response Register which is appended to the Scoping Report allowing it to be finalised for submission to the regulatory authorities for comment and decision making. Once the Scoping Report has been approved, the process may continue into the Impact Assessment Phase.

1.4.2 EIA Phase

The EIA is the detailed study of the significant issues raised during the Scoping Phase. The main objectives of the EIA report are:  To provide the decision maker with sufficient, quality information to enable him/her to make an informed decision;  To ensure that the key issues and concerns raised by the interested and affected parties have been properly and meaningfully addressed;  To continue providing information about the project to the interested and affected parties and other key stakeholders and to obtain their comments on alternatives and proposed mitigation; and  To provide input to the project feasibility study to assist the project proponent in his decision making

The outcome of the EIA phase is an EIA Report or Statement, which should include issues raised during the entire impact assessment process, demonstrated responses, a detailed project description, a detailed evaluation of project alternatives, specialist studies, an integrated synthesis of the specialist reports and a clear and concise summary of the impacts of the project on the receiving environment. The EIA report also provides suggested mitigation measures, and impacts are rated on the basis of their significance before and after the recommended mitigation are applied.

1.5 Locality

EPL is situated approximately 46km from Pretoria and 45km from within the Bojanala Platinum District Municipality, in the North West Province. It is located within the Madibeng Local Municipal area.

The EMP amendment process is applicable to the EPL Mining Rights Area (MRA) only and is located within the boundaries of the Madibeng Local Municipality which forms part of the Bojanala Platinum District Municipality (BPDM). Although EPL has a number of Mining Rights over the eastern part of the Marikana operations, the following farm portion is relevant to the project is situated on the following farms (Refer to Figure 2.1 for a locality map).

2 STAKEHOLDER ENGAGEMENT PROCESS

The objectives of the Stakeholder Engagement process include the following:

 To provide opportunities for the public and stakeholders a better understanding of the proposed project and its possible impacts;  Provide an opportunity as to draw knowledge and experience of the stakeholders as to improve planning and decision-making;  To build relationships with the public and stakeholders that lead to mutual support and confidence; and  To enable Lonmin Plc – EPL to meet its legal and regulatory responsibilities.

At a high level, the Project EIA process is undertaken in five key phases, in accordance with the EIA Regulations (GNR. 982) of December 2014, as amended.

 Application Phase – identify listed activities that are triggered by the Project and submit an application for EA to the competent authority.

 Scoping Phase - identify interactions of project activities and environmental and social resources to determine which should be included in the scope of the impact assessment.

 Environmental Impact Reporting Phase - the characteristics of the potential effects of project activities on bio-physical and social resources and features are evaluated and quantified to determine potential impact significance (or importance) taking into account the sensitivity of the particular resource or receptor. This phase also includes the identification of mitigation/management measures and the development of an Environmental Management Programme.

 Competent Authority Decision – the decision on the Project will be distributed to all project interested and affected parties and informed of the appeal process.

The public consultation activities undertaken during the EIA process is described under each phase. The Project is currently at the Scoping Phase.

2.1 Notification of I&AP’s

In accordance to the EIA Regulations, the applicant / environmental assessment practitioner (EAP) must give notice to all potential I&APs of the application. AvD Environmental notified I&AP’s by means of the following methods:

2.1.1 Notification Letters

Notification letters were sent to all stakeholders available on the existing stakeholder database. These stakeholders were invited to register as Interested and Affected Parties for the proposed project going forward.

These notification letters were accompanied by a Background Information Document explaining the project as well as the legislative processes. Interested and Affected Parties whom have registered were notified in writing of all available documentation once placed in the public domain as well as the required response periods. In accordance to the regulatory requirements, written notice was given to:  Land Owners and occupiers adjacent to and within 100 metres of the boundary of the site as well as alternative sites being considered;

 The municipal councilor of the ward in which the site as well as alternative sites being considered are situated and any organisation of ratepayers that represents the community in the area;  The municipality which has jurisdiction in the area (both Local Municipality and District Municipality); and  Any organ of state having jurisdiction in respect of any aspect as the activity.

2.1.2 Site Notices

The placement of Site Notices is a requirement in terms of the National Environmental Management Act, 1998 (Act No. 107 of 1998) (NEMA) and the Publication of Public Participation Guide, (GN 35769 dated 10 October 2012. Based on the EIA Regulations, the minimum size for the notice boards must be 60cm by 42cm and must display the required information in lettering and in a format as may be determined by the Competent Authority.

2.1.3 Newspaper Advertisement

According to the EIA Regulations, the advertisement should indicate the duration of a commenting period. In accordance with the minimum requirements of the promotion of Administrative Justice Act, 2000 (Act No 3 of 2000) (PAJA), all interested and affected parties must be provided with a reasonable opportunity to make representations. This reasonable period is 30 (thirty) days. Should there be a public meeting, then the notice for this meeting should be 14 (fourteen) days.

2.2 Stakeholder Engagement during Scoping and EIA Phase

Before submission of the Final Scoping and Environmental Impact Assessment/ Environmental Management Plan Reports, the competent authority regulates that an allowance must be made to give registered interested and affected parties access to, and an opportunity to comment on the reports in writing. A registered interested and affected party is entitled to comment on all written submissions made to the competent authority by the applicant or the EAP managing the application, and to bring to the attention of the competent authority any issues which the registered interested and affected party believe may be of significance to the consideration of the application. These comments were submitted within the specified timeframes. The Departments reference number is quoted in all correspondence.

Only if there are substantial changes to the Draft Scoping and Environmental Impact Assessment/ Environmental Management Plan Reports should it be made available to the registered interested and affected parties prior to submission otherwise it may be submitted together with the Issues and Response Report to the competent authority.

Discussion EIA and Authorisation Process  No additions to the Agenda were proposed.  The committee members have been to a public consultation meeting for an environmental process before at Samancor.  The proposed EPL Chrome Plant will be situated next the EPL Concentrator where this meeting took place.  The project is now in the Scoping Phase. The Scoping Phase is when a plan of study is proposed to the competent authority on how the Environmental Impact Assessment phase will be conducted as well as all the specialist studies which will be done. The Scoping Phase is also the introduction of the project to the public. This is the first change for the public to comment on the proposed project.  The draft Scoping Report was placed in public places around the area on 19 March 2018.  The EPL Chrome Plant will be on the Lonmin site, but will be constructed and managed by Glencore.  EPL will amend their existing EMP to include the new Chrome Plant.  Environmental Authorisation must also be obtained from the Department of Mineral Resources before the construction of the EPL Chrome Plant can commence.  The National Environmental Management Act (NEMA) determines through published listed activities whether an application will have to undergo a Basic Assessment Process or an Environmental Impact Assessment Process.  The development of the EPL Chrome Plant triggered the need to follow a full Environmental Impact Assessment Process.  With an Environmental Impact Assessment (EIA) Process the first phase is the Scoping Phase where the competent authority can give their input into the specialist’s studies to be co nducted etc. and approve the plan of study for the Environmental Impact Assessment phase.  The EIA Process takes up to 18 months to complete.  During the Impact Assessment phase the specialists will look at possible impacts on aspects such as the groundwater, surface water, heritage sites, etc.  The whole Marikana Area is falls within the Marikana Thornveld area and any development within this demarcated area must apply for authorization.  The Department of Mineral Resources will approve the whole application and the Environmental Impact Assessment (EIA) and Environmental Management Programme (EMP) and provide authorization for the project to start once the whole process has been completed.  There is a similar process which needs to be completed at the Department of Water and Sanitation for the approval of a Water use Licence. The Water Use Licence approval process takes up to 300 days.  Not only water uses are seen as a water use which requires a Water Use Licence. Activities which might have the possibility on impacting on water resources could also require a Water use Licence. Such as working within 100m of a water resource, working within 500m of a wetland or containment facilities which contain substances which could contaminate ground or surface water resources if spilled.  The EPL Chrome Plant will be applying for a Water Use Licence not only for the storm water dam, but also because the Plant will be constructed within a 100m of a drainage line and within 500m of a wetland Discussionarea. Chrome Plant Infrastructure  Lonmin has a Notarial Lease Agreement with the Bapo-Mogale Tribe for the Turffontein property on which the project will take place.

 The Chrome Plant will consist of the plant area and the site offices and associated infrastructure.  The Chrome Plant is proposed to remove the chrome product from the slurry from the existing concentrator plants before the remainder is pumped to the existing Tailings Dam.  The Chrome Plant uses gravity feed to spate the chrome product from the waste prod uct.  Aspects such as storm water must be managed on site. Storm water run-off from a plant area is seen as contaminated and cannot be released into the environment and therefore a storm water containment dam is proposed for the site.  Looking at the picture provided in the slide one can see that the whole plant area is an impermeable surface to prevent environmental and product contamination.  The whole Plant area is also fences off.  There is a lot of moisture in the product, so not a lot of dust is generated.  Closure financial provision must be provided for which is made available for rehabilitation upon Discussion Draft Scoping Report and Public Commenting Period closure.  The Draft Scoping Report is currently in the public domain for commenting until 23 April 2018.  Anyone can still provide comments throughout the whole process.  The Draft Scoping Report contains all the specialists’ studies which will be conducted during t he Environmental Impact Assessment Phase.  To become part of the process you must register as an Interested and Affected Party (I&AP).  Interested and Affected Parties (I&APs) will be kept informed throughout the whole process.  AvDE will register the people attending the Meeting today as Interested and Affected Parties.  I&APs call provide comments via email, phone, fax or letter.  All comments and concerns are incorporated into an issues and response report.  All comments and concerns from this meeting will be captured in the Social Engagement Report as an Annexure to the Final Scoping Report and the Environmental Impact Assessment report.  To notify the public of this process, all people on the existing Lonmin Database was send notifications. Site notices was put at the site, And an Advertisement was placed in the local newspaper.  The Councilor wanted to know why were only been made aware of the project last week. It was explained that they have never before registered as I&APs on any project and therefore n o information of their interest has been recorded.  Everyone in this meeting will now also be added to the database for future notifications.  The committee believes the Draft Scoping Report at the Segwaelane Clinic has been removed.  Two copies of the Draft Scoping Report will be provided to the ward committee. Discussion Community Meeting

 The Ward Committee indicated that they want the team to come and present the EPL Chrome Plant Project to the community during once of their community meetings.  The community would want to be informed of the heritage impacts etc.  All the possible Impacts will only be available with the Draft Impact Assessment Report.  It was decided that the meeting should take place once the specialist studies has been concluded to ensure that all the possible impacts could be discussed with the community.  The community meetings are held in the community hall.  There are no chairs or electricity in the hall.  Chairs could be arranged.  Electricity can be laid on from the neighboring houses.  There need to be arranged for a sound system.  A date will be set once the Draft Impact Assessment Report has been compiled with all the possible impacts and results from the specialist studies.  Need to also arrange water for the community.

Conclusions  Two copies of the Draft Scoping Report will be given to the ward committee by tomorrow. Give to Kenneth Maebane, he lives close by.  A community meeting must be set up with the councilor once the possible impacts of the project are known.  For the community meeting the following must be arranged beforehand:  Date and time of the meeting;  Water for the community;  PA System; Chairs; and  Electricity Action Items Person Deadline Responsible Alata van Dyk  Provide two copies of the Draft Scoping Report 20 April Environmental to Kenneth Maebane of the ward committee at Ponti’s Ark. 2018 Consultants.
