RESOLUTION RATIFYING AN EMERGENCY CONTRACT AWARD TO DERRICK CASANOVA TO PROVIDE CONSTITUENT OUTREACH AND ASSISTANCE TO THE HOUSELESS POPULATION IN JOURNAL SQUARE AS PART OF THE CITY’S ONGOING RESPONSE TO THE CORONAVIRUS EPIDEMIC

COUNCIL offered and moved adoption of the following resolution:

WHEREAS, the Coronavirus outbreak began in early 2020 with an epicenter in the New York City metropolitan region, including the City of Jersey City (City); and

WHEREAS, as a result of the pandemic, the Director of the Department of Health & Human Services notified the Purchasing Agent that an emergency existed because of the need to provide assistance, education, and personal protective equipment (PPE) to the houseless individuals whose primary place of residence is the Journal Square plaza in order to help stop the spread of the virus; and

WHEREAS, the Purchasing Agent was satisfied that an emergency existed; and

WHEREAS, it was necessary to have this outreach work conducted as soon as possible in order to protect and promote the public health, safety and welfare; and

WHEREAS, on March 15, 2020 the Purchasing Agent instructed Derrick Casanova to perform this work; and

WHEREAS, the New Jersey State Treasurer has determined that contracts awarded under emergency conditions pursuant to N.J.S.A. 40A:11-6 and N.J.A.C. 5:34-6.1 et seq. may be awarded without complying with the Pay to Play Law, N.J.S.A. 19:44A-20.4 et seq.; and

WHEREAS, the total cost to utilize the services of Derrick Casanova for 5 months will not exceed $16,250.00; and

WHEREAS, funds in the amount of $5,000.00 are available in Account No. 01-201-38-911-699, PO #: 138311; and

NOW, THEREFORE, BE IT RESOLVED by the Municipal Council of the City of Jersey City that;

1. Because of the above stated reasons which are incorporated herein, an emergency contract award to Derrick Casanova (286 Grove Street, Jersey City, NJ 07302) made pursuant to N.J.S.A. 40A:11-6 and N.J.A.C. 5:34-6.1 et seq. to conduct outreach, education and material assistance to the houseless population in Journal Square for 5 months is hereby ratified;

2. The total cost of the emergency contract is $16,250.00;

3. Pursuant to N.J.A.C. 5:30-5.5(d), the continuation of the contract after the expenditure of funds encumbered in the 2020 fiscal year temporary budget shall be subject to the availability and appropriation of sufficient funds in the 2020 fiscal year permanent budget and in the subsequent fiscal year budget;

4. The Director of the Department of Health & Human Services shall reduce to writing her notification to the Purchasing Agent of the emergency and file it with the Purchasing Agent; and

4. The Purchasing Agent and Business Administrator are authorized to take such other actions as may be necessary to effectuate the purposes of this resolution.

App.A.:9-33 et seq. and a Public Health Emergency as contemplated by N.J.S.A. 26:13—1et seq., which action invoked the authority and powers contemplated by N.J.S.A. 26213-3, the Emergency Health Powers Act.

The City is working with federal, state and county officials and authorities on a daily basis on prevention and mitigation activities that include providing critical information to the public about COVID-19to provide facts and avoid unnecessary fear, training emergency responders and health professionals about the disease and investigating suspected, presumptive and confirmed cases. A significant part of this work has involved conducting targeted outreach to houseless individuals living in Journal Square.

4. Due to the need to ensure all residents of Jersey City have access to personal hygiene facilities, PPE,and education about COVID—19,and pursuant to N.J.S.A.40A:11—6,an emergency situation exists that justifies the emergency award of a contract for the provision of outreach services for the houseless living in Journal Square.

9. I have deemed that the services of DerrickCasanova (the "Consultant”), a Jersey City resident with an address at 246 Grove Street, Jersey City, NJ 07302, is a consultant capable of providing the above described COVID—19outreach services.

The contractor or subcontractor agrees to inform in writing its appropriaterecruitment agencies including, but not limited to, employment agencies, placement bureaus, colleges, universities,and labor unions, that it does not discriminate on the basis of age, race, creed, color, national origin, ancestry, marital status, affectional or sexual orientation, gender identity or expression, disability, nationality or sex, and that it will discontinuethe use of any recruitment agency which engages in direct or indirect discriminatorypractices.

The contractor or subcontractoragrees to revise any of its testing procedures,if necessary, to assure that all personneltesting conforms with the principles of job-related testing,as establishedby the statutes and court decisions of the State of New Jersey and as establishedby applicable Federal law and applicable Federal court decisions.

The contractor and its subcontractors shall furnish such reports or other documentsto the Division of Purchase & Property, CCAU, EEO Monitoring Program as may be requestedby the of?ce from time to time in order to carry out the pulposes of these regulations, and public agencies shall furnish such information as may be requested by the Division of Purchase & Property, CCAU, EEO MonitoringProgram for conductinga compliance investigation pursuant to Subchapter 10 of the Administrative Code at N.J.A.C. 17:27.
