BBC Radio Devon Star for Christmas Competition 2018 New closing date: Tuesday 13th November at 5pm Terms and Conditions 1. The competition is open to all schools of primary age children in the county of Devon. The children of BBC or BBC Group company employees, or those of anyone connected with the competition cannot be part of the school’s entry. Student participation in any stage of the competition will require parental or guardian consent which will be the responsibility of the entrant school. Proof of age, identity and eligibility may be required. 2. The competition will open on September 7th 2018. All entries will need to have been submitted by 17.00 on 13th November 2018. Entries outside of the period will not count. 3. The school must upload a recording of their choir singing a Christmas carol or Christmas song. The audio file must be accompanied by a completed entry form to be an eligible entry. No other method of entry will be accepted. Only one entry is allowed per school (the first, any subsequent entries will be disregarded). The choir must be accompanied by live music which can be performed at our Christmas Day Service recording at Exeter Cathedral on 18th December 2018. 4. The entries will be split into two categories depending on the number of children attending the school. Fewer than 150 will enter the small schools category, more than 150 the large school category. 5. The entries will be listened to and marked using the criteria below by a panel including a BBC Radio Devon presenter and a senior editorial person - technical skill, musicality, and energy of performance. The panel will produce a shortlist of up to 4 entries for each category plus several ranked back-ups. 6. The 8 finalist choirs (4 from each category) will be contacted to check eligibility and availability which may include discussions on licensing and parental permissions. If one of the 8 finalist choirs is not available or eligible then the next best back-up will be contacted, until a list of 8 verified and checked finalist choirs is completed. A public online vote will run from 30th November – 6th December 2018. With the winning Choir announced on Friday 7th December 2018. Vote terms will be published separately prior to the vote. 7. Entrants must be available via the contact information they have provided. If, after reasonable attempts an entrant cannot be contacted, that entrant’s participation in the competition ends. If an entrant cannot take up the prize as stated, then that entrant’s participation in the competition ends. 8. The Prize consists of the opportunity for the winning choir in each category to sing their song at the Christmas Service on 18th December 2018 at Exeter Cathedral. (Service 19.00 – 20.30) It is expected that the concert will be broadcast on BBC Radio Devon during the morning of 25th December 2018. For the avoidance of doubt no travel, accommodation or any other expenses will be covered by the BBC. 9. The prize is stated as above. There is no cash alternative and the prize cannot be sold or transferred in any circumstances. 10. The BBC's decision as to entrants taking part and winner is final. No correspondence relating to the competition will be entered into. 11. Entrants agree to take part in any post-competition publicity if required; this may include TV and BBC Radio Devon social media. 12. Entrants retain the copyright in their original submissions but grant to the BBC a perpetual non-exclusive royalty-free licence to broadcast their entry across all media, use it on any online platform as part of any BBC programme or service and in exploitation of such programme or service. For the avoidance of doubt, no fees or expenses will be paid for the creation of any part of the entry. 13. Entrants permit the BBC to edit or change entries in any way it may, in its sole discretion, consider necessary for the purposes of use in the competition. 14. This competition is conducted in line with the BBC's code of conduct for competitions, which can be found on http://www.bbc.co.uk/editorialguidelines/guidelines/appendix2 15. The BBC reserves the right to: (i) amend these terms and conditions and vary the competition rules including but not limited to the opening and closing times; (ii) disqualify any entrant who breaches the rules, displays rude, insulting or inappropriate behaviour at any point (including prize fulfilment) or has acted fraudulently in any way or; (iii) cancel the competition, at any stage, if in its opinion it is deemed necessary or if circumstances arise outside its control. 16. The BBC, its sub-contractors, subsidiaries and/or agencies cannot accept any responsibility whatsoever for any technical failure, loss of data via use of a third party email platform or malfunction or any other problem which may result in any loss of data before it is received by the BBC, its sub-contractors, subsidiaries and/or agencies, or any entry being lost or not properly registered before it is received by the BBC, its sub-contractors, subsidiaries and/or agencies. 17. Entrants will be deemed to have accepted these rules and to agree to be bound by them when registering. 18. The competition is run by the BBC. The applicable law is that of England and Wales. You can find out more about your information and privacy here. What personal information we collect and how we will use it? The BBC will collect and process the personal information that you have provided to us about yourself and the school you represent. This is your name email address, school details including name of school, address and telephone number, pupils’ names and audio file of the pupils’ performance. The BBC is the “data controller” of the personal information you provide. This means that the BBC decides how your personal data is used. We are relying on your consent as a parent or guardian to process your child’s personal data to ensure we can run this competition. Our judges will create an initial shortlist, at this point we will contact your nominee using the contact details that you have provided. If the nominee consents to be considered for the Challenge, then their application will proceed. Please be aware from 20th November 2018 your parental consent cannot be withdrawn. How long we will retain your information? The BBC will retain your personal data and the nominated party personal data until 30th December 2018. At this time it will be destroyed in line with the BBC’s Data Retention & Minimisation Policy. The BBC will keep the details of the winning choir for a period of two years and then securely destroy it. Sharing your information Your data will be shared with Monterosa, a third party supplier hosting the online form on behalf of the BBC. The BBC will not share your personal data with any other third parties without your permission except required by the law.
