This is the Privacy Notice relating to BBC Radio Devon’s Star for Christmas Competition 2019.

The BBC is committed to keeping your personal data secure. The BBC is the controller of your personal information.

The BBC will process the personal information that you provide to us when you submit an entry, including your name, email address, telephone number, and school as well as the audio files of the choir recording. Please do not disclose any further personal details of the children participating in the choir.

We have a legitimate interest this information: to increase audience interaction with the BBC and ensure that we can consider your application and deliver our competition. We will not process your personal information where your rights override our interests.

If you are unsuccessful, the BBC will delete your data on or by 30/12/19.

Winners' personal information will be stored for a period of two years for regulatory purposes. The winners’ audio recordings and related online content will be archived and stored in perpetuity.

Terms and Conditions

1. The competition is open to all schools of primary age children in the county of Devon. The children of BBC or BBC Group company employees, or those of anyone connected with the competition cannot be part of the school’s entry. Student participation in any stage of the competition will require parental or guardian consent which will be the responsibility of the entrant school. Proof of age, identity and eligibility may be required.

2. The competition will open on Friday 4th October 2019. All entries will need to have been submitted by 16.00 on 22nd November 2019. Entries outside of the period will not count.

The school must upload a recording of their choir singing a Christmas song. The audio file must be accompanied by a completed entry form to be an eligible entry.

No other method of entry will be accepted. Only one entry is allowed per school (the first, any subsequent entries will be disregarded).

3. The choir must be accompanied by live music which can be performed at our event at the Torquay Riviera Centre on 18th December 2019. BBC Radio Devon Star for Christmas Competition 2019 Privacy Notice and Terms & Conditions 4. The entries will be split into two categories depending on the number of children attending the school. Fewer than 150 will enter the small schools category, more than 150 the large school category.

5. The entries will be listened to and marked using the criteria below by a panel including a BBC Radio Devon presenter and a senior editorial person - technical skill, musicality, and energy of performance.

The panel will produce a shortlist of up to 4 entries for each category plus several ranked back-ups.

6. The 8 finalist choirs (4 from each category) will be contacted to check eligibility and availability which may include discussions on licensing and parental permissions. If one of the 8 finalist choirs is not available or eligible then the next best back-up will be contacted, until a list of 8 verified and checked finalist choirs is completed. A public online vote will run from 8.30am Tues 10th December – 8.30am Wednesday 18th December 2019. The public vote will count towards 50% of the final score; the other 50% will come from the judges’ decision on the final performance. 1st place 40 points

The winning Choir announced on Wednesday 18th December and on air on Thursday 19th December. Vote terms will be published separately prior to the vote.

7. Entrants must be available via the contact information they have provided. If, after reasonable attempts an entrant cannot be contacted, that entrant’s participation in the competition ends. If an entrant cannot take up the prize as stated, then that entrant’s participation in the competition ends.

8. The Prize consists of a trophy and the opportunity for the winning choir in each category to sing their song on BBC1’s Spotlight in the run up to Christmas. It is expected that the concert will be broadcast on BBC Radio Devon during the Christmas period. For the avoidance of doubt no travel, accommodation or any other expenses will be covered by the BBC.

9. The prize is stated as above. There is no cash alternative and the prize cannot be sold or transferred in any circumstances.

10. The BBC's decision as to choirs taking part and winner is final. No correspondence relating to the competition will be entered into.

11. Entrants agree to take part in any post-competition publicity if required; this may include TV and BBC Radio Devon social media.

Entrants retain the copyright in their original submissions but grant to the BBC a perpetual non-exclusive royalty-free licence to broadcast their entry across all media, use it on any online platform as part of any BBC programme or service and in exploitation of such programme or service. For the avoidance of doubt, no fees or expenses will be paid for the creation of any part of the entry.

13. Entrants permit the BBC to edit or change entries in any way it may, in its sole discretion, consider necessary for the purposes of use in the competition.

14. This competition is conducted in line with the BBC's code of conduct for competitions, which can be found on https://www.bbc.com/editorialguidelines/guidance/code-of-conduct

15. The BBC reserves the right to: (i) amend these terms and conditions and vary the competition rules including but not limited to the opening and closing times; (ii) disqualify any entrant and/or who breaches the rules, displays rude, insulting or inappropriate behaviour at any point (including prize fulfilment), brings the BBC into disrepute (in the BBC’s sole discretion) or has acted fraudulently in any way or; (iii) cancel the competition, at any stage, if in its opinion it is deemed necessary or if circumstances arise outside its control.

16. The BBC, its sub-contractors, subsidiaries and/or agencies cannot accept any responsibility whatsoever for any technical failure or malfunction or any other problem which may result in any entry not being properly registered or received by the BBC, its sub- contractors, subsidiaries and/or agencies.

17. Entrants will be deemed to have accepted these rules and to agree to be bound by them when registering.

18. The competition is run by the BBC. The applicable law is that of England and Wales.
