If there are too many roads, please provide the top 20, or failing that the top 10. Please provide this for the most recent year of data you have, e.g. November 2019 – November 2020. If it is not possible to provide all the information requested, please provide as much as available. Please find attached the location details of all the Police Officer initiated speeding offences during the requested period. West Yorkshire Police are unable to provide you with the complete information as requested as this is exempt by virtue of Section 31 (1) (a) (b) (c) Law Enforcement. Please see Appendix A, for the full legislative explanation as to why West Yorkshire Police are unable to provide the information. Appendix A The Freedom of Information Act 2000 creates a statutory right of access to information held by public authorities. A public authority in receipt of a request must, if permitted, state under Section 1(a) of the Act, whether it holds the requested information and, if held, then communicate that information to the applicant under Section 1(b) of the Act. The right of access to information is not without exception and is subject to a number of exemptions which are designed to enable public authorities, to withhold information that is unsuitable for release. Importantly the Act is designed to place information into the public domain. Information is granted to one person under the Act, it is then considered public information and must be communicated to any individual, should a request be received. DECISION Your request for information has been considered and I regret to inform you that West Yorkshire Police cannot comply. This letter serves as a Refusal Notice under Section 17 of the Freedom of Information Act 2000. Section 17 of the Act provides: (1) A public authority which, in relation to any request for information, is to any extent relying on a claim that information is exempt information must, within the time for complying with Section 1(1), give the applicant a notice which:- (a) States the fact, (b) Specifies the exemption in question, and (c) States (if that would not otherwise be apparent) why the exemption applies. REASONS FOR DECISION The reason that we are unable to provide you with this information is covered by the following Exemption: Section 31 (1) (a) (b) (c) Law Enforcement Section 31 is a qualified prejudice based exemption and therefore I am required to articulate the harm (prejudice) and conduct a public interest test, below are my considerations. Harm To release the data showing the locations of our most active speed cameras for the last 12 months would interfere with and undermine the policing purpose. The frequency of speed camera activations could be misinterpreted by the public to highlight certain cameras that may be less active. This information may be used by road users to alter their journeys avoiding cameras deemed ‘most active’. This alteration to avoid detection would place other road users and members of public at risk from those intent on exceeding the speed limits. Cameras are deployed at locations where there have been a high number of serious injuries and deaths caused by collisions where speed was a contributing factor. Additionally, a number of speed cameras have been subject to vandalism attacks in recent years and have been put out of action until they could be repaired or replaced. This leaves these locations without a speed cameras and this increases the risks that there will be further deaths and serious injuries due to collisions at these locations. Factors favouring disclosure Disclosing the locations of most active speed cameras would ensure a better informed public allowing for a more accurate public debate. Factors favouring non-disclosure To disclose the locations of speed cameras in which the most offences are captured would undermine the policing purpose of the deployment of cameras. Speed cameras are placed in locations identified as having a high number of serious injuries and deaths caused by collisions where speed was a contributing factor. Therefore, disclosing the locations of those activated most frequently would potentially leave these sites vulnerable to attacks. Cameras that are attacked and damaged leave that road or location at risk of further serious injuries or deaths. Balance test West Yorkshire Police is tasked with the prevention and detection of crime, whilst striving to remain open and transparent with the public this must be weighed against the potential of undermining any policing purpose. In this case disclosure of the requested information would undermine the use of speed cameras as a detection and prevention method against speeding drivers. Disclosure also risks leaving certain sites subject to vandalism, leaving the camera damaged and increasing the number of serious injuries or deaths on that road. It is for this reason I believe balance lies in favour of non-disclosure at this time.     DEATH ON THE HOME FRONT Pam Brooke Much has been written about the Military Service Act and the operation of Tribunals however this has mostly focused on the outcome for conscientious objectors and little has been written about those who sought exemption on other grounds.1 One particularly tragic case from the Colne Valley illustrates the wide repercussions that the refusal of one man’s application for exemption had on both his family and the wider community. On Wednesday 28 November 1916, at Slaithwaite Town Hall, 62-year-old James Shaw, blacksmith and hill farmer appeared before the local Tribunal to request an extension to his son’s Exemption Certificate. Charles, aged 28, he said, was his only son and worked with him in the blacksmith shop and on the farm. Depicting himself to be ‘a poor talker’ James presented his case in a written statement which the military representative described as ‘resembling a sermon’. In response James explained that he was a regular worshipper at Pole Moor Baptist Chapel, Scammonden.2 New Gate Farm cottage as seen today. West Yorkshire Police receive reports of crimes that have occurred following a victim having their drink spiked, crimes such as rape, sexual assault, violence with or without injury and theft. West Yorkshire Police take all offences seriously and will ensure that all reports are investigated. Specifically for victims of rape and serious sexual offences, depending on when the offence occurred, they would be offered an examination at our Sexual Assault Referral Centre, where forensic samples, including a blood sample for toxicology can be taken, with the victim’s consent, if within the timeframes and guidance from the Faculty for Forensic and Legal Medicine. An Ofsted report reflects the moment in which a school was inspected and provides a clear outline of the next steps for any school on its journey. Birdsedge was last inspected in September 2006 when it was judged to be Outstanding. In the interim 12 years there have been many changes both in school and to the Ofsted framework. Birdsedge has always been, and remains to be, a wonderful school with a child centred ethos; putting children and families at the heart of all decision making. This is very evident in the recent Ofsted judgement for Personal Development and Welfare which is ‘Good’. The inspection report has identified areas for improvement, however these had already been identified by myself and leaders from the Trust and work has already begun on these improvements. The report provides the impetus to move the school forward quickly and we are really excited to pull together, making the necessary changes and making Birdsedge the fantastic school I know it can be. Ms Spark has agreed to take on a leadership position in school and will be driving forward writing across all classes. Aspects in Early Years identified around progress are historical issues. We have a fantastic teacher in Miss Hutton who will now work with Early Years leaders at Shelley First School to ensure children are challenged to reach the highest levels possible and get the strongest start they need in their education.
