ROAD RACES ACT 1982

THE TOTruST TROPITY MOTOR CYCLE RACES ORDER 2OO4

Coming into Operation: til MaY 2004

In exercise of the porilers conferred on the Deparhnent of Transport by Sections 1 and 2 of the Road Races Act 79821, and of all enabling powers, the following Order is hereby made :-

Introductory

1. Citation and commencement

This Order may be cited as the Tourist Trophy Motor Cycle Races Order 2004 and, shall come into operation on the l't May 2004.

2. fnterpretation

(1) In this Order -

"the Act" means the Road Races Act1982;

"the Clerk of the Course" means the individual so designated as Clerk of the Course by the promoter in the Official Programme of the 2004 TT Races and includes any depufy or assistant Clerk of the Course so designated;

'tlosure period" means any period during which an authorisation under A¡ticle 3 or 4 is in force in relation to the Course or any part of the Course; references to a constable shall be construed in accordance with section 3 of the Act (appointment of marshals);

"the Course" means the roads specified in Schedule 1;

"the Department" means the Department of Transport;

'þostpone", in relation to a race, includes declaring void atace which has already begun, tlgï2 c.lA Price: f1.70 Price Code: B "the promoter" means the Manx Motor Cycle Club Limited;

"race" includes any parade held in connection with the race and any practice preliminary to the race;

,.the senior police officer" means a member of the Constabulary of the rank of sergeant or above who is authorised by the Chief Constable to act as senior police officer under this Order.

(Z) As respects any part of the Course , a t^ce or practice shall be treated as completed for the purposes of this Order when (and only whÐ an official motor vehicle displaying in a prominent position ã r,ótir. with ttre words "Roads Open" has passed along that part of the Course in accordance with Article t4.

Authorisation to use roads for races etc.

3. Authorisation of use of Course for practices

(1) The promoter is authorised to use the Course for racing practices for motor-cycles at the times specified in Table 1 in Schedule 2'

(2) The promoter may for any reason -

(a) cancel such a practice, or any practice posþoned under this paragraph, or

(b) postpone such a practice from a time specified in Table 1 -

(Ð to any other time so specified, or

(iÐ to a time specified in Table 2 or 3 in Schedule 2.

(3) Where the promoter cancels or posþones a practice r¡nder paragraph (2) and notifies the senior police officer of such cancellation or postponement -

(a) the relevant authorisation under paragraph (1) or this paragraph shall cease to have effect, and

(b) in the case of a posþonement under paragraph (2XbXiÐ, the promoter is instead authorised to use the Course for racing practices for motor-cycles at the relevant time specified in Table 3 in Schedule 2.

(4) (a) The cancellation of practices scheduled for the momings of Wednesday 2nd and Friday 4th Jwe2O04 shall be notified under paragraph (3) not later than 4.00 pm the previous day.

(b) The posþonement of a practice from the afternoon to the evening of Thursday 3'd June 2004 shall be notified under paragraph (3) not later than 12 noon on that day.

4. Authorisation of use of Course for races

(1) The promoter is authorised to use the Course for motor-cycle races at the times specified in Table 3 in SchedtIe2.

(2) The promoter may for any reason -

,, (a) cancel or annul such a race, or any race posþoned under this paragraph, or

(b) posþone such a race from a time specified in Table 3 or Table 4 in Schedule2to a time specified in Table 4. (2) (3) Where the promoter cancels, annuls or posþones a race under paragraph and notifies the senior police officer of such cancellation, annulment or posþonement -

(a) the relevant authorisation under paragraph (1) or this paragraph shall cease to have effect so far as itrelates to thatrace, and

(b) in the case of a posþonement under paragraph (2Xb), the promoter is instead authorised to use ihr Co*r. for that race at the relevant time specified in Table 4 in Schedule 2.

(4) An authorisation under paragraph (1) or (2) shalt not have effect during any period which falls within a time specified in Table 3 in Schedule 2 and during which the Course is being used for a practice posþoned to that time under Article 3(2Xb).

Regulation of trffic etc.

5. Suspension of right of waY etc.

Subject to Articles 7 md8, during any clostue period in relation to any part of the Course -

(a) the right ofway over it is suspended; and

(b) no traffic maypass onto or over it.

6. Regulation of traffic on side roads

Subject to Articles 7 and 8, no person shall during any closure period without the permission of a constable -

(a) go or remain on,

O) drive any vehicle or cause or permit any vehicle to be driven on,

(c) allow any vehicle to wait on, or

(d) allow anY animal to go on,

úLy püt of a road leading on to the Course within 92 metres of its junction with the Course, being apart ináiðated by barriers or signs in accordance with Article 15 as closed to traffic'

7. Exemptions from Articles 5 and 6

(1) Articles 5(a) and 6 do not apply to the following persons -

(a) the Clerk of the Course;

(b) persons appointed by the Clerk of the Course as officials for the purpose of the practice or race in question, , (c) constables;

(d) persons lawfully taking part in the practice or race in question and their attendants;

(e) the Governor, persons in attendance on him and members of his party;

(Ð media representatives and photographers approved by the promoter and bearing an offrcial badge or armlet issued by the promoter;

(e) persons driving or being carried in ambulances, medical vehicles, fire brigade vehicles, police vehicles or highway maintenance vehicles in use for emergency purposes and authorised by the Clerk of the Course, and highway maintenance vehicles authorised by the Clerk of the Course to travel between specific locations before the start of any race;

(h) any other person authorised in writing by the Department or the Chief Constable.

Ø Articles 5(b) and 6 do not applyto the following vehicles -

(a) vehicles for the conveyance of persons mentioned in paragraph (1)(a) or (e);

(b) vehicles approved by the Clerk of the Course or the senior police offrcer for the conveyance of persons mentioned in paragraph (1)(b), (c), (Ð or (g);

(c) motor cycles engaged in the practice or race in question.

8. Temporary opening of Course to traffïc

(1) This Article has effect notwithstanding anything in Articles 3 to 6.

(2) If any practice or race is temporarily posþoned or suspended during a closure period, the senior police officer may, with the consent of the Clerk of the Course, authorise traffic, in accordance with the directions of a constable, to cross or proceed along such part of the Course, and at such times, as that officer may speciff.

(3) kr any interval between practice or races dwing a closure period, the senior police officer may, with the consent of the Clerk of the Course, -

(a) authorise pedestrians, in accordance with the directions of a constable, to cross or proceed along the Course at such places, and at such times, as that officer may speciff; or

(b) authorise vehicular traf{rc, in accordance with the directions of a constable, to cross or proceed along the Course at the places specified in Schedule 3, at such times as that officer may speciff.

(4) Articles 5 and 6 shall not have effect in relation to traffic crossing or proceeding along any part of the Course pursuant to an authorisation under paragraph Q) or (3) and in accordance with the directions of a constable.

(5) Nothing in pangraph (2) permits traffic to proceed in the reverse direction of the Course except with the express authorisation of the Clerk of the Course.

4 (6) No person shall during a closure period drive any vehicle, or cause or permit any vehicle to be driven, on any part of the Course which is the subject of any authorisation under paragraph (2) or (3), othelwise than pursuant to that authorisation and in accordance with the directions of a constable.

(7) The Road Traffic Regulation Act 19852, the Licensing and Regishation of Vehicles Act 19853 and the Road Traffic Act 19854 apply to ar part of the Cowse which is the subject of an authorisation under paragraph (2) or (3).

9. One-way traffic on mountain road

(1) The senior police officer may direct that, on the expiry of the Closwe period in relation to any practice or race, traffic shall not proceed on the Snaefell Mountain Road and the Bemahague Road between the Bungalow, including the exit from Murrays Motorcycle Museum, and Governor's Bridge otherwise than in the direction from Ramsey to Douglas, for such time (not exceeding one hour from the expiry of that period) as he may direct.

(2) No person shall drive any vehicle, or cause or permit any vehicle to be driven, otherwise than in the direction from Ramsey to Douglas, on the road referred to in paragraph (l) while a direction under thatparagtaph is in force.

10. Footbridges

(1) Nothing in A¡ticles 3 to 6 prevents a pedestrian crossing the Course by means of a footbridge erected for the purpose, unless he is forbidden by a constable to do so.

(2) No person shall dwing a closure period stop or loiter on any footbridge referred to in paragraph (1).

11. Prohibited areas

No person shall during a closure period enter or remain on any area of land specified in Schedule 4 and indicated by notices bearing the words "Prohibited Area".

12, Parking on ambulance access routes

No person shall during a closure period without the permission of a constable cause a vehicle (other than an ambulance) to wait on a road specified in Schedule 5 within 100 mehes of any ba¡rier erected on that road in accordance with Article 15.

Admínistration

13. Publicity for cancellation etc.

(l) Where the senior police officer is notified of the cancellation or posþonement of a practice or race under Aficle 3(3) or 4(3), he shall take such measures as he considers appropriate to inform the public of the effect of it.

(2) The senior police officer shall take such measures as he considers appropriate to inform the public of -

14. Notification of end of closure under Aficle 3 or 4 is in force - (1) At the end of the practice or race for which an authorisation

(a) the Clerk of the Course, or

(b) the senior police officer after consulting the Clerk of the Course,

mentioned in Article 2(2), to travel the Course in shall a:range for one or two motor vehicles, marked as accordance with paragraph (2) or (3), as the case may be' the.top of , Douglas, and (2) If one vehicle travels the course, it shall depart from road to the top of Bray Hill, proceed via to Ramsey and thence via the snáefell Mountain Douglas.

(3) If 2 vehicles travel the Course - proceed via Ballacraine to (a) one shall depart from the top of Bray Hill, Douglas, and Ramsey; Mountain road to (b) the other shall depart from Ramsey and proceed via the snaefell the top of BraY Hill, Douglas.

15. 6 'Where (3) a direction under Article 9(1) is in force, the senior police officer shall cause that suitable signs are displayed on any road giving vehicular access to the road referred to in Article 9(1) to indicate that vehicular traffic must proceed in the direction there referred to.

(4) The barriers referred to in paragraphs (1) and (2Xa) shall consist of -

(a) tubular steel structu¡es supplied by the Department with suitable signs attached, in any case where the Departrnent so directs; or

(b) such other barriers as may be approved by the Deparhrent, or a rope across the road with a suitable red flag attached, in any other case.

(5) The closure signs referred to in paragraphs (1) and (2Xa) shall be of the size, colour and type shown in diagram 616 in Schedule 2 to lhe Traffic Signs Regulations and General Directions 2002s.

(6) The promoter shall secure that all barriers, diversion signs and closure signs are removed at the end of every closure period.

16. fnsurance

The promoter shall socure adequate insurances and indemnities against injury or damage to persons or property arising out of the conduct of the practices, races and parades and the arrangements incidental thereto to a limit of f30 Million.

17. Restriction on road works

Paragraph 9(1) of Schedule 4 to the Highways Act 19866 applies to the Course for the period beginning on the l't May 2O04 andending on the 12th June 2004.
