ROAD RACES ACT 1982

THE TOURIST TROPHY MOTOR CYCLE RACES ORDER 2003

Coming into Operation: 26th April 2003

In exercise of the powers conferred on the Department of Transport by Sections 1 and 2 of the Road Races Act 1982 1 , and of all enabling powers, the following Order is hereby made :- S Introductory

1. Citation and commencement

This Order may be cited as the Tourist Trophy Motor Cycle Races Order 2003 and shall come into operation on the 26 th April 2003.

2. Interpretation

(1) In this Order -

"the Act" means the Road Races Act 1982;

"the Clerk of the Course" means the individual so designated as Clerk of the Course by the promoter in . the Official Programme of the 2003 TT Races and includes any deputy or assistant Clerk of the Course so designated;

"closure period" means any period during which an authorisation under Article 3 or 4 is in force in relation to the Course or any part of the Course;

references to a constable shall be construed in accordance with section 3 of the Act (appointment of marshals);

"the Course" means the roads specified in Schedule 1;

"the Department" means the Department of Transport;

"postpone", in relation to a race, includes declaring void a race which has already begun.

"the promoter" means the Auto Cycle Union;

"race" includes any parade held in connection with the race and any practice preliminary to the race;

"the senior police officer" means a member of the Constabulary of the rank of sergeant or above who is authorised by the Chief Constable to act as senior police officer under this Order.

(2) As respects any part of the Course, a race or practice shall be treated as completed for the purposes of this Order when (and only when) an official motor vehicle displaying in a prominent position a notice with the words "Roads Open" has passed along that part of the Course in accordance with Article 14.

Authorisation to use roads for races etc.

3. Authorisation of use of Course for practices

(1) The promoter is authorised to use the Course for racing practices for motor-cycles at the time's specified in Table 1 in Schedule 2.

(2) The promoter may for any reason -

(a) cancel such a practice, or any practice postponed under this paragraph, or

(b) postpone such a practice from a time specified in Table 1 -

(i) to any other time so specified, or

(ii) to a time specified in Table 2 or 3 in Schedule 2.

(3) Where the promoter cancels or postpones a practice under paragraph (2) and notifies the • senior police officer of such cancellation or postponement -

(a) the relevant authorisation under paragraph (1) or this paragraph shall cease to have effect, and

(b) in the case of a postponement under paragraph (2)(b)(ii), the promoter is instead authorised to use the Course for racing practices for motor-cycles at the relevant time specified in Table 3 in Schedule 2.

(4) The postponement of a practice from the afternoon to the evening of Thursday 29 th May 2003 shall be notified under paragraph (3) not later than 12 noon on that day.

4. Authorisation of use of Course for races

(1) The promoter is authorised to use the Course for motor-cycle races at the times specified in Table 3 in Schedule 2.

(2) The promoter may for any reason — 2

(a) cancel such a race, or any race postponed under this paragraph, or

(b) postpone such a race from a time specified in Table 3 or Table 4 in Schedule 2 to a time specified in Table 4.

(3) Where the promoter cancels or postpones a race under paragraph (2) and notifies the senior police officer of such cancellation or postponement -

(a) the relevant authorisation under paragraph (1) or this paragraph shall cease to have effect so far as it relates to that race, and

(b) in the case of a postponement under paragraph (2)(b), the promoter is instead authorised to use the Course for that race at the relevant time specified in Table 4 in Schedule 2.

(4) An authorisation under paragraph (1) or (2) shall not have effect during any period which falls within a time specified in Table 3 in Schedule 2 and during which the Course is being used for a practice postponed to that time under Article 3(2)(b).

Regulation of traffic etc.

5. Suspension of right of way etc.

Subject to Articles 7 and 8, during any closure period in relation to any part of the Course -

(a) the right of way over it is suspended; and

(b) no traffic may pass onto or over it.

6. Regulation of traffic on side roads

Subject to Articles 7 and 8, no person shall during any closure period without the permission of a constable -

(a) go or remain on,

(b) drive any vehicle or cause or permit any vehicle to be driven on,

(c) allow any vehicle to wait on, or

(d) allow any animal to go on,

any part of a road leading on to the Course within 92 metres of its junction with the Course, being a part indicated by barriers or signs in accordance with Article 15 as closed to traffic.

7. Exemptions from Articles 5 and 6

(1) Articles 5(a) and 6 do not apply to the following persons -

(a) the Clerk of the Course; 3 (b) persons appointed by the Clerk of the Course as officials for the purpose of the practice or race in question;

(c) constables;

(d) Persons lawfully taking part in the practice or race in question and their attendants;

(e) the Governor, persons in attendance on him and members of his party;

(f) media representatives and photographers approved by the promoter and bearing an official badge or armlet issued by the promoter;

(g) persons driving or being carried in ambulances, medical vehicles, fire brigade vehicles, police vehicles in use for emergency purposes and authorised by the Clerk of the Course, and highway maintenance vehicles authorised by the Clerk of the Course to travel between specific locations before the start of any race;

(h) any other person authorised in writing by the Department or the Chief Constable.

(2) Articles 5(b) and 6 do not apply to the following vehicles -

(a) vehicles for the conveyance of persons mentioned in paragraph (1)(a) or (e);

(b) vehicles approved by the Clerk of the Course or the senior police officer for the conveyance of persons mentioned in paragraph (1)(b), (c), (f) or (g);

(c) motor cycles engaged in the practice or race in question.

8. Temporary opening of Course to traffic

(1) This Article has effect notwithstanding anything in Articles 3 to 6.

(2) If any practice or race is temporarily postponed or suspended during a closure period, the S senior police office may, with the consent of the Clerk of the Course, authorise traffic, in accordance with the directions of a constable, to cross or proceed along such part of the Course, and at such times, as that officer may specify.

(3) In any interval between practice or races during a closure period, the senior police officer may, with the consent of the Clerk of the Course, -

(a) authorise pedestrians, in accordance with the directions of a constable, to cross or proceed along the Course at such places, and at such times, as that officer may specify; or

(b) authorise vehicular traffic, in accordance with the directions of a constable, to cross or proceed along the Course at the places specified in Schedule 3, at such times as that officer may specify.

(4) Articles 5 and 6 shall not have effect in relation to traffic crossing or proceeding along any • part of the Course pursuant to an authorisation under paragraph (2) or (3) and in accordance with the directions of a constable.

4 (5) Nothing in paragraph (2) or (3) permits traffic to proceed in the reverse direction of the Course except with the express authorisation of the Clerk of the Course.

(6) No person shall during a closure period drive any vehicle, or cause or permit any vehicle to be driven, on any part of the Course which is the subject of any authorisation under paragraph (2) or (3), otherwise than puisuant to that authorisation and in accordance with the directions of a constable.

(7) The Road Traffic Regulation Act 1985 2, the Licensing and Registration of Vehicles Act 1985 3 and the Road Traffic Act 1985 4 apply to any part of the Course which is the subject of an authorisation under paragraph (2) or (3).

9. One-way traffic on mountain road

(1) The senior police officer may direct that, on the expiry of the closure period in relation to any practice or race, traffic shall not proceed on the Snaefell Mountain road and the Bemahague road between the Bungalow and Governor's Bridge otherwise than in the direction from Ramsey to Douglas, for such time (not exceeding one hour from the expiry of that period) as he may direct.

(2) No person shall drive any vehicle, or cause or permit any vehicle to be driven, otherwise than' in the direction from Ramsey to Douglas, on the road referred to in paragraph (1) while a direction under that paragraph is in force.

10. Footbridges

(1) Nothing in Articles 3 to 6 prevents a pedestrian crossing the Course by means of a footbridge erected for the purpose, unless he is forbidden by a constable to do so.

(2) Nothing in Articles 3 to 6 prevents a pedestrian, in accordance with the directions of a constable, passing along the footway on the western side of Bray Hill, Douglas, between the footbridge at St Ninian's crossroads and the entrance to Garden City Lane.

(3) No person shall during a closure period stop or loiter on any footbridge or footway referred • to in paragraph (1) or (2).

11. Prohibited areas

No person shall during a closure period enter or remain on any area of land specified in Schedule 4 and indicated by notices bearing the words "Prohibited Area".

12. Parking on ambulance access routes

No person shall during a closure period without the permission of a constable cause a vehicle (other than an ambulance) to wait on a road specified in Schedule 5 within 100 metres of any barrier erected on that road in accordance with Atticle 15.

Administration

• 13. Publicity for cancellation etc.

(1) Where the senior police officer is notified of the cancellation or postponement of a practice or race under Article 3(3) or 4(3), he shall take such measures as he considers appropriate to inform the public of the effect of it.

(2) The senior police officer shall take such measures as he considers appropriate to inform the public of -

(a) any authorisation under Article 8(2) or (3)(a), and

(b) any direction under Article 9(1). (3) The Department shall cause public notice of any authorisation under Article 8(3)(b) to be given - III (a) in one or more newspapers published and circulating in the Island, and (b) on Manx Radio.

14. Notification of end of closure

(1) At the end of the practice or race for which an authorisation under Article 3 or 4 is in force -

(a) the Clerk of the Course, or

(b) the senior police officer after consulting the Clerk of the Course,

shall arrange for one or two motor vehicles, marked as mentioned in Article 2(2), to travel the Course in accordance with paragraph (2) or (3), as the case may be. • (2) If one vehicle travels the course, it shall depart from the top of Bray Hill, Douglas, and proceed via to Ramsey and thence via the Snaefell Mountain road to the top of Bray Hill, Douglas. (3) If 2 vehicles travel the Course -

(a) one shall depart from the top of Bray Hill, Douglas, and proceed via Ballacraine to Ramsey;

(b) the other shall depart from Ramsey and proceed via the Snaefell Mountain road to the top of Bray Hill, Douglas.

15. Erection of barriers and signs -

(1) The promoter shall secure that barriers, diversion signs and closure signs are erected and • maintained on all roads leading on to the Course immediately before, or as soon as possible after, the beginning of every closure period, and in any event before the relevant part of the Course is used for a practice or race. 6 (2) Where traffic is authorised to cross or proceed along the Course under Article 8(2) or (3), the promoter shall secure -

(a) that barriers are erected and closure signs are displayed on the Course, to indicate to persons taking part in practices or races that the part of the Course in question is closed for that purpose, and

(b) that suitable signs are displayed on any road giving vehicular access to the Course, to indicated that vehicular traffic may cross or proceed along the Course, as the case may be.

(3) Where a direction under Article 9(1) is in force, the senior police officer shall cause that suitable signs are displayed on any road giving vehicular access to the road referred to in Article 9(1) to indicate that vehicular traffic must proceed in the direction there referred to.

(4) The barriers referred to in paragraphs (1) and (2)(a) shall consist of -

(a) tubular steel structures supplied by the Department with suitable signs attached, in • any case where the Department so directs; or

(b) such other barriers as may be approved by the Department, or a rope across the road with a suitable red flag attached, in any other case.

(5) The closure signs referred to in paragraphs (1) and (2)(a) shall be of the size, colour and type shown in diagram 616 in Schedule 2 to the Traffic Signs Regulations and General Directions 1994 5 .

(6) The promoter shall secure that all barriers, diversion signs and closure signs are removed at the end of every closure period.

16. Insurance

The promoter shall secure adequate insurances and indemnities against injury or damage to persons or property arising out of the conduct of the practices, races and parades and the arrangements 411 incidental thereto to a limit of £30 Million.

17. Restriction on road works

Paragraph 9(1) of Schedule 4 to the Highways Act 1986 6 applies to the Course for the period beginning on the 26 th April 2003 and ending on the 7 th June 2003.
