Department of Planning, Industry and Environment Animal Dealer (Live Bird) Licence Biodiversity Conservation Act 2016 The following licence conditions are current at the time of publication and are subject to change at any time. Schedule A Animal Dealer (Live Bird) Licence Conditions Definitions for the purpose of this class of biodiversity conservation licence and conditions Animal Welfare Code of Practice No 4 – Keeping and Trading of Birds means the Department of Primary Industries' code regulating the keeping and trading of birds. Animal dealer means a person who buys, sells or trade in native animals and exercises or carries on the business of an animal dealer at a registered premise associated with an animal dealer licence. Bird means a bird as defined in Schedule 5 of the BC Act. Licensee means the person licensed under this licence to buy, sell or trade in native animals as an animal dealer. NPWS means National Parks and Wildlife Service. Registered premises means premises that are registered under the BC Act and the Regulations at which the licensee can buy, sell or trade in native animals. Secretary means the Secretary of the Department of Planning, Industry and Environment. The BC Act means the Biodiversity Conservation Act 2016 The Department means the Department of Planning, Industry and Environment. The Regulations means the Biodiversity Conservation Regulation 2017. Trade of Native Animals Policy means the Department of Planning, Industry and Environment policy regulating the trade of live native animals in New South Wales. General conditions 1. The licensee must not buy or sell native animals other than the birds the licensee is authorised to buy and sell under this licence. 2. The licensee must not buy, sell or trade in native animals on any premises that are not registered premises. 3. The licensee must only acquire a bird from a person who is licensed to keep that species of bird. 4. The licensee must sight a customer's licence to keep birds before selling a bird to them. Record keeping conditions 5. The licensee must keep at the registered premises an accurate and up-to-date record of all acquisitions (including purchase and breeding), disposals (including sales, deaths and escapes) and movements (including for veterinary treatment) of birds held under this licence. The record must include: a) date of acquisition, disposal or movement of birds b) species and number of birds acquired, disposed of or moved c) name and licence number of the person from whom the birds have been acquired and to whom the birds have been disposed of, or moved to d) method by which each individual bird has been acquired or disposed of (e.g. purchased, bred, returned by customer or sold). 6. The licensee must provide to the Wildlife Team, National Parks and Wildlife Service on behalf of the Secretary a copy of the records required by clause 5, in an approved electronic format or in a paper animal record book, on 1 July each year and/or at the expiry or cancellation of this licence, or to a NPWS officer when requested. 7. When a bird is purchased from the licensee the purchaser must be offered a copy of the DPI Animal Welfare Code of Practice No 4 - Keeping and Trading of Birds. Warning: It is a licensee’s responsibility to ensure that they are familiar with any other statutory or regulatory provisions relevant to this licence such as local council, building and health requirements and codes of practice under the Prevention of Cruelty to Animals Act 1979. On the expiration of your licence the onus is on you, the licensee to renew. While the Department forwards licence renewal notices to licensees, it will not be responsible for the non-receipt of such a notice. Schedule B: Registration Certificate Conditions Definitions for the purpose of this registration certificate and conditions Animal Welfare Code of Practice No 4 – Keeping and Trading of Birds means the Department of Primary Industries' code regulating the keeping and trading of birds. Animal dealer means a person who buys, sells or trade in native animals and exercises or carries on the business of an animal dealer at a registered premise associated with an animal dealer licence. Bird means a bird as defined in Schedule 5 of the BC Act. Cage and enclosure means receptacles for confining birds. Licensee means the person licensed to buy, sell or trade in native animals as an animal dealer. Registered premises means premises that are registered under the BC Act and the Regulations at which the licensee can buy, sell or trade in native animals. Secretary means the Secretary of the Department of Planning, Industry and Environment. The BC Act means the Biodiversity Conservation Act 2016. The Department means the Department of Planning, Industry and Environment. The Regulations means the Biodiversity Conservation Regulation 2017. General conditions 1. The licensee must display a copy of this registration certificate, at the registered premises, in a conspicuous position. 2. Birds held under the licence must only be kept at the licensee's registered premises unless receiving treatment at a veterinary practice. 3. The licensee must not have any species of bird which cannot be bought or sold under the licence at their registered premises or advertise any such species for sale. Animal welfare conditions 4. Birds kept at this registered premises must comply with the mandatory requirements and conditions set out in the Animal Welfare Code of Practice No 4 - Keeping and Trading of Birds. Warning:
