PROPOSED INTERVENOR-RESPONDENT DNC’S APPLICATION FOR LEAVE TO INTERVENE Proposed-Intervenor DNC Services Corp. / Democratic National Committee (“DNC”) hereby submits this Application for Leave to Intervene, and states the following in support: I. INTRODUCTION Petitioners seek to retroactively invalidate millions of mail-in ballots and enjoin the Commonwealth from finalizing its presidential electors and certifying the remainder of its races. While Petitioners’ claims are meritless, the requested relief, if granted, would significantly impair the electoral prospects of the DNC’s candidates and disenfranchise more than a million of its voters. No party to this proceeding adequately represents the DNC’s interests. Respondents have the duty to enforce Pennsylvania law, which is distinct from the DNC’s particularized interest in having its candidates assume office and its voters’ ballots counted. The DNC’s interests could also break sharply from Respondents’ interests in the event Act 77 is found unconstitutional under Pennsylvania law and the Court must devise an appropriate remedy. This is evident in the parties’ briefs below at the Commonwealth Court, wherein the DNC highlighted the federal constitutional rights which the requested relief would violate—an issue that no other party directly raised. -

The Council reports biennially on its dual constitutional responsibilities of nominating candidates for judicial vacancies and of making reports and recommendations to the supreme court and legislature. The report also covers the statutory mandate to evaluate judges standing for retention and applicants for the Public Defender. This report includes a brief narrative section that summarizes Council activities during 1991 and 1992, and a series of appendices. The appendices include a current listing of statutory and constitutional law affecting the Judicial Council, a log of judicial applicants, nominees and appointees, a log of all sitting judges and their retention election dates, and summaries of Council procedures for judicial selection and retention evaluation. It brings trouble. Look at this locura—waste, corruption, consumption, our public services falling apart. And debt, debt we shall have for years.” So warned Juan Pablo Pérez Alfonso, a Venezuelan founder of OPEC. A September 24, 2004, article in the British magazine The Economist elaborates further on Pérez Alfonso: During the heady oil boom of the mid-1970s . he was seen as an alarmist. In fact, he was astonishingly prescient. Oil producers vastly expanded domestic spending, mostly on gold- plated infrastructure projects that set inflation roaring and left mountains of debt. Worse, this did little for the poor. Venezuela had earned over $600 billion in oil revenues since the mid- 1970s but the real income per person of Pérez Alfonso’s compatriots fell by 15% in the decade after he expressed his disgust. The picture is similar in many OPEC countries. Members of the House and Senate from the Great State of Alaska, thank you for inviting me to speak to you. Thanks also to each member of the Legislature and your staffs for your service to our state. It’s always great to be back home and see some old friends and new faces. And it’s really, really heartening to see healthy faces. On the airplane from Anchorage last night, I saw Senator Shelley Hughes and former Senator Albert Kookesh, dear friends to many of us here. They both looked strong and told me they were winning their fights against cancer. Congratulations! There’s a few people here with me in the gallery today that I’d like to introduce. Everyone knows Connie McKenzie. Amanda Coyne is still helping me instead of writing about you. Matt Shuckerow is my new press secretary. I stole him from Congressman Young—with his permission of course. Renee Reeve, who is no stranger to many of you, is my new state director. Larry Burton is my new chief of staff, who many of you know from his time working for Congressman Young and Senator Stevens. And of course, the most important person in my life, and the love of my life, my wife Julie is here with me. I always view my address to the Legislature as the most important speech I give all year. I don’t have to tell all of you, but being in elected office, we can get caught up in the news of the day— sometimes as a result of an intemperate tweet or two… or three, or four. -

Representative Morris King Udall of Arizona climbed out of the Army helicopter, took a long look at the Nizina and Chitina canyons below him, gazed at the snow-capped peaks of 16,000- foot mountains above him, spread out his arms in ecstasy, and said: "I want it all!" The occasion was Udall's first extensive trip to Alaska, two weeks that represent what he says were the "most exciting" days of his life. The visit led, ultimately, to Udall's proudest achievement, passage of the Alaska lands bill that set aside 104.3 million acres with some of the most spectacular scenery in the world for the benefit of all of us, forever. He didn't get it "all," of course (though he did get what he saw from the plateau in the Wrangell Mountains that day). When the legislation was in place, containing weaker language passed by the Senate, he said he "shed a tear" for southeastern Alaska, because the bill allows timber interests to chop up 300-year-old trees and "send them to Japan to make plywood." But he figures he got 85 to 90 percent of what he was after, and he is enough of a philosopher to know that's better than what most people get out of life. "Mo" Udall, the chairman of the House Committee on Interior and Insular Affairs, may not be the best friend the environmental movement has in high places, but it would be difficult to find anyone more important. -

Uncharted Waters: Alaska’s 2015 Budget Process Glenn Wright University of Alaska Southeast Jerry McBeath University of Alaska Fairbanks Introduction Fiscal year 2015 was an eventful one in Alaska contrary to expectations during the 2014 leg- islative session. In 2014, Republican Governor Sean Parnell proposed a conservative budget with few major changes from the previous year, and the legislature passed the governor’s budget with only minor alterations. One possible major change did not materialize when, in an August refer- endum, voters failed to repeal the More Alaska Production Act (MAPA)—a reform of Alaska’s oil tax laws passed by the state legislature in April 2013 that increased the marginal rate at which petroleum firms are taxed when oil prices are low and decreased marginal rates when prices are high. In late August, Alaska’s bland gubernatorial race was shaken up by the emergence of a “uni- ty ticket” in which two opponents to Republican Sean Parnell—Independent Bill Walker and Democrat Byron Mallott—joined forces and the Walker/Mallott ticket ultimately defeated Par- nell in the general election. Also in August, global prices for oil began a rapid decline with prices for Alaska North Slope Crude dropping about 50 percent by late December 2014. As revenues from oil make up more than 90 percent of the state government budget, this drop has substantial fiscal implications for Alaska. Going forward, the Walker Administration will likely propose significant cuts to operating budgets and eliminate funding for several large infrastructure pro- jects in 2015. This paper describes the process leading to the Alaska FY 2015 budget and important chang- es since the adoption of the 2015 budget in spring 2014.
