A nível infraconstitucional, dispõe a Lei nº 12.016/2009 que o “mandado de segurança para proteger direito líquido e certo, não amparado por habeas corpus ou habeas data, sempre que, ilegalmente ou com abuso de poder, qualquer pessoa física ou jurídica sofrer violação ou houver justo receio de sofrê-la por parte de autoridade, seja de que categoria for e sejam quais forem as funções que exerça.” (art. 1º). Acerca da competência original e exclusiva desta Suprema Corte, assim dispõe de forma clara o art. 102, I, “d” da CRFB/88, Art. 102. Compete ao Supremo Tribunal Federal, precipuamente, a guarda da Constituição, cabendo-lhe: I - processar e julgar, originariamente: d) o habeas corpus , sendo paciente qualquer das pessoas referidas nas alíneas anteriores; o mandado de segurança e o habeas data contra atos do Presidente da República, das Mesas da Câmara dos Deputados e do Senado Federal, do Tribunal de Contas da União, do Procurador-Geral da República e do próprio Supremo Tribunal Federal; No mais, a lei não excluirá da apreciação do Poder Judiciário lesão ou ameaça a direito, inclusive, as supostamente emanadas por Comissão Parlamentar de Inquérito, não sendo a intenção da presente impetração questionar a competência dessas para decretar a quebra de sigilo de comunicações, matéria já pacificada, mas sim, os seus limites, em respeito ao que reza a lei e a Constituição da República. O Supremo Tribunal Federal é a única autoridade competente para julgar a impetração do presente Mandado de Segurança, conforme prevê o artigo 102, inciso I, alínea “d”, da Constituição Federal, e (MS36.518/DF, Rel. II –DA COMISSÃO PARLAMENTAR DE INQUÉRITO – CPI DA PANDEMIA DO SENADO FEDERAL – APURAÇÃO DE FATO DETERMINADO (ART. 58, §3°, DA CONSTITUIÇÃO DA REPÚBLICA) Consigna-se que ao ser chamado a julgamento a medida cautelar no Mandado de Segurança nº 37.760, o Plenário dessa Suprema Corte, por maioria de votos, ratificou a liminar deferida pelo Sr. Ministro Relator LUÍS ROBERTO BARROSO para determinar ao Presidente do Senado Federal a adoção das providências necessárias à criação e instalação de comissão parlamentar de inquérito, na forma do Requerimento SF/21139.59425-24. Dando azo a decisão judicial, o Presidente do Senado Federal, Senador Rodrigo Pacheco, promoveu a instalação da Sessão e deliberação em plenário, destinado a analisar e aprovar o Requerimento SF/21139.59425-24, em conjunto com o Requerimento SF/21259.95668-45, delimitando o objeto da investigação da CPI – Pandemia, nos seguintes termos: “Apurar, no prazo de 90 dias, as ações e omissões do Governo Federal no enfrentamento da Pandemia da Covid-19 no Brasil e, em especial, no agravamento da crise sanitária no Amazonas com a ausência de oxigênio para os pacientes internados; e as possíveis irregularidades em contratos, fraudes em licitações, superfaturamentos, desvio de recursos públicos, assinatura de contratos com empresas de fachada para prestação de serviços genéricos ou fictícios, entre outros ilícitos, se valendo para isso de recursos originados da União Federal, bem como outras ações ou omissões cometidas por administradores públicos federais, estaduais e municipais, no trato com a coisa pública, durante a vigência da calamidade originada pela Pandemia do Coronavírus 'SARS-CoV-2', limitado apenas quanto à fiscalização dos recursos da União repassados aos demais entes federados 3 [email protected] SAULO SALLES, ADVOCACIA E CONSULTORIA para as ações de prevenção e combate à Pandemia da Covid-19 , e excluindo as matérias de competência constitucional atribuídas aos Estados, Distrito Federal e Municípios. Verifica-se, pois, que os fatos que são objeto de investigação pela Comissão Parlamentar de Inquérito – CPI DA PANDEMIA, estão delimitados em eventuais ações e omissões do Governo Federal no combate a pandemia do Covid-19 e no colapso de oxigênio em Manaus, além eventuais fraudes e desvios de recursos públicos federais destinados à saúde. Sobre esses fatos determinados é que a CPI DA PANDEMIA deve debruçar as suas ações investigativas e consequentemente todos os seus requerimentos probatórios, sob pena de ampliar de forma irregular um dos 03 (três requisitos taxativos) constitucionais da CPI, (i) requerimento de um terço dos membros da Casa Legislativa; (ii) prazo certo e (iii) apuração de fato determinado. Data máxima vênia, conforme será descortinado abaixo, respeitosamente aponta-se que a CPI DA PANDEMIA, quando a análise e aprovação do requerimento n° 0015/2021, que tratou da quebra de sigilo bancário, fiscal, telefônico e de dados telemáticos do impetrante, incorreu em excesso nos avanços das investigações, conforme será descortinado abaixo: III. DO ATO COATOR. APROVAÇÃO DO REQUERIMENTO nº 00615/2021. QUEBRA DE SIGILO BANCÁRIO, FISCAL, TELEFÔNICO E DE DADOS TELEMÁTICOS DO IMPETRANTE Sabe-se que, de acordo com o parágrafo 3º do artigo 58, da Constituição, as CPIs possuem “poderes de investigação próprios das autoridades judiciais” para “apuração de fato determinado”, entretanto, tais trazem automaticamente as normas limitadoras das cautelares especiais inerentes dos “meios de obtenção de prova”, o que implicaria, para todo o efeito, a aplicação, sem exceções, das normas processuais penais no desenvolvimento de 4 [email protected] SAULO SALLES, ADVOCACIA E CONSULTORIA seus atos, sobretudo quando se trata de decisões que invadam à privacidade e a intimidade dos cidadãos, direito talhado na Carta Magna, em seu art. 5ª, XII. Assim, o Senado Federal, dentro da sua importante quadra no Estado Democrático de Direito, durante a execução perene do trabalho constitucionais, não pode se furtar em respeitar estritamente o processo constitucional, ainda mais quando se está em voga, as garantias basilares de qualquer cidadão. Ocorre que, no dia 30 de junho de 2021 foram aprovadas, em bloco, a transferência de sigilo de seus dados bancários, fiscais, telefônicos e telemáticos de GEORGE DA SILVA DIVÉRIO, ex-Superintendente Estadual do Ministério da Saúde no RJ, conforme justificativa apresentada pelo Exmo. My family and I are asking that Ohio HB248 be passed in order to protect the individual freedoms we currently have as American citizens. I work in a corporate setting and my husband owns a small business. We have two young daughters who are relying on us to provide for them and protect their rights. I support this bill in hopes that they can grow up with the same liberties we have had. Segregation and discrimination over individual health choices should be taken seriously and passing this bill is key to avoiding those types of issues in the future. I am not a scientist, but I am a mom, a wife, and a daughter who takes the health of my family very seriously. I have done extensive amounts of research on the SARS-COV2 virus and subsequent vaccines. There are also many health experts that provide me with helpful information. I am sure you are receiving many testimonies about the large numbers of vaccine injuries and even deaths that have occurred during this vaccine campaign. Personally, I know two women who have had severe menstrual issues (requiring surgery) that they can connect back to occurring right after the vaccine. My friends’ cousin passed away at only 23 years old from an enlarged heart after receiving the vaccine. The stories go on and on. The point is that no legislation should force my family and I to inject ourselves with substances that have side effects such as this.

Yolande’s video was quickly removed from YouTube and I understand that she has since fled with her family from Canada to Mexico because of the attacks upon her family, I’m speculating because of her uncompromising, informed and articulate stand and message.

We extend here the Benford method after having detected particular properties for the Fibonacci values 1, 2, 3, 5 and 8 of the first decimal of 10 runs of official epidemiological data published in France and Italy (positive cases, intensive care, and deaths) for the periods of March 1 to May 30, 2020 and 2021, each with 91 raw data. This new method – called “BFP” for Benford-Fibonacci-Perez - is positive in all 10 cases (i.e. 910 values) with an average of favorable cases close to 80%, which, in our opinion, would validate the reliability of these basic data.
