ORDER IN COUNCIL/DÉCRET ______The Provincial Lands Act ______[O.C. 441/2003] 11 June 2003 TO THE HONOURABLE THE LIEUTENANT GOVERNOR IN COUNCIL The undersigned has the honour to report that: 1 Section 3 of The Forest Resources Management Regulations provides, in part, as follows: 3(2) The Minister may withdraw land from a provincial forest with the written approval of the Lieutenant Governor in Council. (3) Where land is withdrawn from a provincial forest by the Minister: (a) the written approval of the Lieutenant Governor in Council and the reasons for withdrawing the land are to be published in the Gazette; and (b) the areas described in Part III are deemed to be amended accordingly. 2 Section 20 and 22 of The Provincial Lands Act provides, in part, as follows: 20(1) The Lieutenant Government in Council may: (e) set aside out of the unoccupied provincial lands transferred to the province under the agreement of transfer such areas as the Government of in agreement with the Minister may select as necessary to enable Canada to fulfill its obligations under the treaties with the Indians of the province; 962 THE SASKATCHEWAN GAZETTE, JUNE 20, 2003

Section 22 of The Provincial Lands Act provides, in part, as follows: 22.1(1) The Lieutenant Governor in Council may make orders: (a) prescribing matters or things that are, in the opinion of the Lieutenant Governor in Council, necessary to meet the purposes and intent of this Act, to carry out the agreement of transfer or to meet cases that may arise and for which no provision is made in this Act; (2) Subject to the other provisions in this Act, an order made pursuant to this section comes into force: (a) only after it has been published in the Gazette; or (b) after a date named in the order; whichever is later. 3 Section 8 of The Resource Lands Regulations, 1989 provides, in part, as follows: (5) Notwithstanding any other provision in these regulations, for the purposes of satisfying or discharging any obligation or undertaking of the Government of Saskatchewan pursuant to a Framework Agreement as defined in The Treaty Land Entitlement Implementation Act, the Minister may sell provincial forest lands or resource lands on those terms and conditions that the Minister considers necessary. 4 The Saskatchewan Treaty Land Entitlement Framework Agreement, dated September 22, 1992, requires Her Majesty the Queen in Right of Saskatchewan to transfer certain lands that it administers and controls to Her Majesty the Queen in Right of Canada for the benefit of Bands that are Entitlement Bands within the meaning of the agreement. 5 The One Arrow Band is an Entitlement Band within the meaning of the agreement. 6 In order to satisfy Saskatchewan’s obligations under the agreement it is desirable and in the public interest to set aside and transfer the administration and control of the Crown lands described in the attached Schedule A to Her Majesty the Queen in Right of Canada for the purpose of assisting Her Majesty the Queen in Right of Canada to satisfy or discharge its obligations or undertakings to the One Arrow Band. 7 All requirements of The Forest Resources Management Regulations, The Provincial Lands Act and any other relevant regulations, all laws in force and any relevant agreements have been fulfilled. 8 By your Honour’s Order 908/2002 dated December 18, 2002, the Minister of Environment was authorized to withdraw provincial land from the “Nisbet Provincial Forest” and subsequently set aside and transfer the administration and control of Crown land described in Schedule A to Her Majesty the Queen in Right of Canada for the purpose of assisting Her Majesty the Queen in Right of Canada to satisfy or discharge its obligations or undertakings to the One Arrow Band effective on the day that all those lands are set apart as an Entitlement Reserve for the use and benefit of One Arrow Band. 9 It is desirable and in the public interest to amend the legal land description in the Schedule A attached to your Honour’s Order 908/2002 dated December 18, 2002 to include the lake bed and shore of Adamson Lake (Lake No. 5) which will be transferred to reserve status. The undersigned has the honour, therefore, to recommend that Your Honour’s Order do issue, pursuant to Section 3 of The Forest Resources Management Regulations and sections 20 and 22 of The Provincial Lands Act, effective on the day that all those lands are set apart as a Reserve for the use and benefit of One Arrow Band, amending the legal land description contained in Your Honour’s Order 908/2002 dated December 18, 2002 by repealing Schedule A to that Order and replacing it with the attached Schedule A. 4 Bylaw II, subsection 2(2) is repealed and replaced by the following: (2) A person who has satisfactorily completed a recognized educational program mentioned in subclause (1)(a)(ii) that is given outside the province shall, in addition to meeting the requirements of subsection (1), produce evidence establishing to the satisfaction of the Council, registration, certification or licensing as a medical laboratory technologist outside the province, that meets standards equivalent to those in Saskatchewan. 5 Bylaw II, subsection 2(7) is repealed and replaced by the following: (7) The Council may, in cases where it determines that a member has demonstrated CSMLS certification in one discipline only, licence the person as a practicing member with eligibility to practice restricted to that discipline only. Where such restriction exists, the same shall be noted upon the licence of the practicing member. 6 Bylaw II, Section 2 is amended by renumbering subsections (8)and (9) to subsections (9) and (10) respectively and inserting new subsection (8) as follows: (8) The Council may, in cases where it determines that a person has demonstrated through a process approved by Council, equivalent qualification in one or more discipline(s) expected of an entry level MLT, licence the person as a provisional restricted member with eligibility to practice restricted to the discipline(s) found to be equivalent. Where such restriction exists, the same shall be noted upon the licence. Members issued a provisional restricted licence will be required to; (a) complete the prescribed form and pay the prescribed registration and licensing fees to the Executive Director, (b) provide satisfactory references from the current employer, (c) practice in accordance with the restrictions indicated on their licence, (d) complete training prescribed by Council to obtain eligibility to write the CSMLS certification examination or equivalent examination recognized by Council, (e) provide documentation of acceptance to write the required examinations, (f) Persons practicing on a provisional restricted licence must meet the requirements of Bylaw II, clause 2(1)(c) within the time prescribed by Council. (8.1) In the event the member does not meet the requirements within the prescribed time, the member’s licence will be revoked and their employer informed. Council may choose to grant an extension of the time prescribed to fulfill the requirements of a provisional restricted licence where it determines that circumstances warrant such an extension. (8.2) When the member provides documentation of acceptance to write the required examinations, a temporary licence for the discipline(s) not identified on the Provisional Restricted License will be issued.
