The Provincial Lands Act ______

[O.C. 286/2008] 22 April 2009 TO THE HONOURABLE THE LIEUTENANT GOVERNOR IN COUNCIL The undersigned has the honour to report that: 1 Section 3 of The Forest Resources Management Regulations provides, in part, as follows: 3(2) The minister may withdraw land from a provincial forest with the written approval of the Lieutenant Governor in Council. (3) Where land is withdrawn from a provincial forest by the minister: (a) the written approval of the Lieutenant Governor in Council and the reasons for withdrawing the land are to be published in the Gazette; and (b) the areas described in Part III are deemed to be amended accordingly. 2 Section 7 of The Provincial Lands Act provides, as follows: 7(1) Notwithstanding anything in this Act, the Lieutenant Governor in Council may transfer to any department, other than the Department of Agriculture and Food or the Department of Environment and Resource Management, any provincial lands required by it for any purpose. (2) All lands so transferred shall thereafter be administered by such department in accordance with this Act and the regulations thereunder or regulations made pursuant to subsection (5) unless such department is authorized to administer the land under another Act. (3) When any land is transferred under subsection (1) the powers and duties of the Minister of Agriculture and Food and the Department of Agriculture and Food respectively, or the Minister of Environment and Resource Management and the Department of Environment and Resource Management respectively, with respect thereto shall be deemed to have been also transferred to the appropriate minister and department respectively, and all the provisions of this Act, and the regulations thereunder or regulations made pursuant to subsection (5), shall apply to such land unless such department is authorized to administer the land under another Act. (4) The Lieutenant Governor in Council may re-transfer to the Department of Agriculture and Food or the Department of Environment and Resource Management any lands which are transferred under subsection (1) when no longer required for the purpose for which they were transferred. (5) The Lieutenant Governor in Council may make regulations governing the administration of lands transferred under subsection (1). (6) Subsections (2) to (5) apply with respect to lands heretofore transferred to any department other than the Department of Agriculture and Food. THE SASKATCHEWAN GAZETTE, May 15, 2009 991

3 Section 4 of The Crown Resource Land Regulations provides, in part, as follows: 4(1) Subject to the approval of the Lieutenant Governor in Council, the minister may sell Crown resource land in accordance with this section if the Crown resource land is not part of a provincial forest. 4 On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that: (a) the Minister of Environment is authorized to withdraw the provincial land identified below from the “Northern Provincial Forest”; and (b) the Minister of Environment is authorized to transfer title of the provincial land identified below, for municipal purposes, to Saskatchewan Housing Corporation, an agency of the Ministy of Social Services, and to complete the necessary documents for title transfer.
