But recent developments suggest that this norm against the weaponization of space is now threatened. The Bush Administration withdrew from the Anti-Ballistic Missile (ABM) Treaty in June 2003 and has committed to deploying a multi- layered missile defence system, the first stage of which could be ready by 2004, with testing of a space-based element as early as 2008. As part of this pressure for missile defences, elements within the US Department of Defense (DoD) are pushing hard to expand the military uses of space to include war-fighting capabilities from, in, and into space. Internationally, there is broad consensus in opposition to the weaponization of space, reaffirmed annually by virtually unanimous support for a United Nations General Assembly resolution on Prevention of an Arms Race in Outer Space (PAROS).b Although there is clearly broad international support for the creation of a legal instrument prohibiting the placement of weapons in outer space, to date there is still no agreement on a Exchange between Dwight Eisenhower and Nikolai Bulganin, Chairman, Council of Ministers, USSR, 13 January 1958 [Online]. At the same time, talks on PAROS in the Conference on Disarmament (CD) have been blocked by US opposition since 1995. It was with a view to exploring these dilemmas and developing options for future actions that an international conference on outer space and global security was held in Geneva on 26-27 November 2002. Jointly convened by the Simons Centre for Peace and Disarmament Studies, at the Liu Institute for Global Issues, the United Nations Institute for Disarmament Research (UNIDIR), and Project Ploughshares, with support from the Simons Foundation and the Canadian Department of Foreign Affairs and International Trade, the Conference brought together experts from military, industry, government, and non-governmental organizations (NGOs), representing countries with interests across the range of civilian and military space activity. The speakers gave presentations on a variety of technical, political and legal issues regarding space use and space security, including current civilian and military uses of space, technical and political considerations regarding space weapons, the legal regime governing space use, and the prospects and problems of developing a space weapons ban. Introduction This chapter discusses some methods and institutions that will bridge the gap between today’s practical reality of space commerce as satellites and signals and future visions of commercial empires in an outer space populated by thousands of human beings and shared by space enthusiasts. It argues that the present and future of space commerce are not two isolated and foreign concepts, but merely two points on a continuous wave of human progress that already shares a common character and logic. By identifying the underlying structural similarity between the present and future of space commerce, we can envision a way to connect the two concepts in the mind of the public that will enhance the former and prepare the way to reach the latter. The ultimate purpose of establishing a continuum of space commerce in this paper is to argue for the logic and necessity of creating an institution that can act as the stewards of the space industry in any form – a military space service. 334 Space Commerce The service will be formed by merging some of today’s military and civil space agencies, and would be immediately relevant and useful in today’s space activities. At the same time, it will be inherently adaptable to any future direction of space commerce while maintaining a doctrine and culture that will be equally comfortable operating Global Positioning System satellites or rescuing stranded passengers on a punctured and decompressing space station.

On 13 December, President George W. Bush announced that the USA would withdraw from the ABM Treaty. Bush’s announcement was widely expected and did not undermine commitments made by Russia and the USA the previous month to further reduce their nuclear arsenals. Against the background of improving political relations, Bush and Russian President Vladimir Putin had pledged to make significant new cuts in US and Russian strategic nuclear forces. As the year ended, however, there was disagreement between Russia and the USA over whether these reductions would be made within the framework of an arms control treaty or as parallel, non-legally binding initiatives. This chapter reviews the principal developments in missile defence and nuclear arms control in 2001. Section II describes the US administration’s decision to withdraw from the ABM Treaty and assesses the reaction of Russia and other states. It also examines changes in the US programme to develop and deploy a missile defence system designed to protect the United States and its allies from a limited ballistic missile attack. Section III examines the Russian and US commitments to make further nuclear force reductions. It also notes the completion of the reductions in strategic nuclear delivery vehicles (SNDVs) and accountable warheads mandated by the 1991 Treaty on the Reduction and Limitation of Strategic Offensive Arms (START I Treaty).
