PROPOSAL: Re-consultation on planning application accompanied by an environmental statement for a Northern extension to the existing limestone quarry to the East of Musterfield Farm and restoration details at Potgate Quarry.

APPLICANT: North Yorkshire County Council Subject to NO OBJECTIONS with OBSERVATIONS as follows:-

1 The Borough Council raises no objections on the proviso that the proposal will not cause unacceptable planning problems. It is considered that the proposal as now set out will contribute to broader landscape-scale restoration of valuable habitats in the Southern Magnesian Limestone Character Area on the fringe of the Nidderdale AONB.

2 Noise and dust mitigation to prevent any additional impact on sensitive receptors should be conditioned if NYCC are minded to approve the proposed development. HBC is concerned that the working area is closer to Musterfield Farm and notes that the unilateral undertaking is more concerned with New Zealand Farm unless that is a drafting error.

3 The recommendation of the County Councils Ecologist is agreed with that the production of a full Environmental Management Plan for the Potgate complex should be secured by condition and that it should be overseen by an appropriate advisory committee. A representative from Harrogate District Biodiversity Action Plan Partnership should be co-opted onto the advisory committee to assist in the implementation of the Environmental Management Plan.

4 The County Council should be satisfied that the proposed development will not result in increased flood risk outside the site., and that no contamination/pollution of aquifers or other water resources will result from the proposed development.

5 The routeing of vehicles as set out in the Section 106 is noted (largely avoiding North Stainley and the centre of Ripon) and no concerns are raised in this respect.

6 The County Council should be satisfied that the proposal will not cause unacceptable harm to any heritage asset in accordance with national guidance in the National Planning Policy Framework. The proposal brings the working area of the quarry closer to Sleningford Grange (to the northwest of the site) which is a Grade II listed building, and the County Council should give consideration to any impact on this heritage asset

18 Unless otherwise approved in writing by the Local Planning Authority, there shall be no excavation or other groundworks, except for investigative works, or the depositing of material on the site until the access(es) to the site have been set out and constructed in accordance with the published Specification of the Highway Authority and the following requirements:

(i) The access to Plot 1 shall be formed to give a minimum carriageway width of 3.2 metres, and that part of the access road extending 6 metres into the site shall be constructed in accordance with Standard Detail number E6.

(ii) Any gates or barriers shall be erected a minimum distance of 6 metres back from the carriageway of the existing highway and shall not be able to swing over the existing or proposed highway.

(iii) Provision shall be made to prevent surface water from the site/plot discharging onto the existing or proposed highway in accordance with the Specification of the Local Highway Authority.

19 No part of the development shall be brought into use until the approved vehicle access, parking, manoeuvring and turning areas have been constructed in accordance with the submitted drawing (Reference Plan 1152/03 approved under Consent 6.79.3382.C.FUL). Once created these areas shall be maintained clear of any obstruction and retained for their intended purpose at all times.

20 There shall be no access or egress by any vehicles between the highway and the application site until details of the precautions to be taken to prevent the deposit of mud, grit and dirt on public highways by vehicles travelling to and from the site approved under application 6.79.3382.C.DISCON to discharge the requirements of Condition 20 of Consent 6.79.3382.C.FUL have been implmented and these precautions shall be made available before any excavation or depositing of material in connection with the construction commences on the site and be kept available and in full working order and used until such time as the Local Planning Authority in consultation with the Highway Authority agrees in writing to their withdrawal.

21 The proposed details in respect of on-site parking and materials storage approved under application 6.79.3382.C.DISCON to discharge the requirements of Condition 21 of Consent 6.79.3382.C.FUL shall be implemented prior to commencement of development and the approved areas shall be kept available for their intended use at all times that construction works are in operation. No vehicles associated with on-site construction works shall be parked on the public highway or outside the application site.

22 Before any materials are brought onto the site or any development is commenced, the developer shall implement the tree protection details, including the details contained within the submitted Arboricultural Method Statement approved under application 6.79.3382.C.DISCON to discharge the requirements of Conditions 21 and 22 of Consent 6.79.3382.C.FUL. The developer shall maintain such fences until all development the subject of this permission is completed. No operations shall commence on site in connection with the development hereby approved (including any demolition work, soil moving, temporary access construction and/or widening or any operations involving the use of motorised vehicles or construction machinery) until the root protection area (RPA) works required by the approved tree protection scheme are in place. No excavations for services, storage of materials or machinery, parking of vehicles, deposit or excavation of soil or rubble, lighting of fires or disposal of liquids shall take place within any area designated as being fenced off or otherwise protected in the approved root protection area scheme. The level of the land within the fenced areas shall not be altered without the prior written consent of the Local Planning Authority.

23 Unless otherwise agreed in writing by the local planning authority no building or other obstruction shall be located over or within 3.5 metres either side of the centre line of the sewer, which crosses the site.

24 The surface water drainage shall be designed in accordance with the on-site storage requirements and Greenfield rates by Coda Structures, as submitted under application 6.79.3382.C.DISCON to discharge the requirements of Condition 25 of Consent 6.79.3382.C.FUL.

25 The details approved under application 6.79.3382.C.DISCON to discharge the requirements of Condition 26 of Consent 7.79.3382.C.FUL of the proposed surface water drainage including onsite storage, rates of discharge and outfall location shall be implented and no occupation of buildings to take place prior to the completion of the approved surface water drainage works.

26 Works shall be undertaken strictly in accordance with the Mitigation Recommendations for bats drawn up by Econorth Ecological Consultants (31.05.2013).

The Code Level to be achieved will be a minimum of Code Level 4.

Thereafter the development shall be carried out in accordance with the approved details.

5 A Post Construction Stage Certificate for each dwelling/dwelling type assessed shall be provided to the Local Planning Authority in writing, confirming that Code Level 4 has been met, prior to the first occupation of the first dwelling comprised in the development to which the certificate relates.

6 Unless otherwise agreed by the Local Planning Authority, development other than that required to be carried out as part of an approved scheme of remediation must not commence until sections 1 to 4 have been complied with. If unexpected contamination is found after development has begun, development must be halted on that part of the site affected by the unexpected contamination to the extent specified by the Local Planning Authority in writing until section 4 has been complied with in relation to that contamination. 1. SITE CHARACTERISATION An investigation and risk assessment, in addition to any assessment provided with the planning application, must be completed in accordance with a scheme to assess the nature and extent of any contamination on the site, whether or not it originates on the site. The contents of the scheme are subject to the approval in writing of the Local Planning Authority. The investigation and risk assessment must be undertaken by competent persons and a written report of the findings must be produced. The written report is subject to the approval in writing of the Local Planning Authority. The report of the findings must include:

(i) a survey of the extent, scale and nature of contamination;

(ii) an assessment of the potential risks to: * human health, * property (existing or proposed) including buildings, crops, livestock, pets, woodland and service lines and pipes, * adjoining land, * groundwaters and surface waters * ecological systems * archaeological sites and ancient monuments;

(iii) an appraisal of remedial options, and proposal of the preferred option(s).

This must be conducted in accordance with DEFRA and the Environment Agency's 'Model Procedures for the Management of Land Contamination, CLR 11'.

2. SUBMISSION OF REMEDIATION SCHEME A detailed remediation scheme to bring the site to a condition suitable for the intended use by removing unacceptable risks to human health, buildings and other property and the natural and historical environment must be prepared, and is subject to the approval in writing of the Local Planning Authority. The scheme must include all works to be undertaken, proposed remediation objectives and remediation criteria, timetable of works and site management procedures. The scheme must ensure that the site will not qualify as contaminated land under Part2A of the Environmental Protection Act 1990 in relation to the intended use of the land after remediation.

3. IMPLEMENTATION OF APPROVED REMEDIATION SCHEME The approved remediation scheme must be carried out in accordance with its terms prior to the commencement of development other than that required to carry out remediation, unless otherwise approved in writing by the Local Planning Authority. The Local Planning Authority must be given two weeks written notification of commencement of the remediation scheme works.

Following completion of measures identified in the approved remediation scheme, a verification report that demonstrates the effectiveness of the remediation carried out must be produced, and is subject to the approval in writing of the Local Planning Authority.

4. REPORTING OF UNEXPECTED CONTAMINATION In the event that contamination is found at any time when carrying out the approved development that was not previously identified it must be reported in writing immediately to the Local Planning Authority. An investigation and risk assessment must be undertaken in accordance with the requirement of section 1, and where remediation is necessary a remediation scheme must be prepared in accordance with the requirements of section 2, which is subject to the approval in writing of the Local Planning Authority.

Following completion of measures identified in the approved remediation scheme a verification report must be prepared, which is subject to the approval in writing of the Local Planning Authority in accordance with section 3.

7 The guest and letting accommodation hereby approved shall not be occupied as a person's sole or main place of residence and the owner /operator shall maintain an up -to date register of the names and addresses of all visitors , and shall make this Information available at all reasonable times to the local planning authority.

4 Any damage caused as a result of building traffic shall be rectified with regard to the survey of access road received by the Council of the Borough of Harrogate on 24.01.2014 prior to occupation of the dwelling hereby approved.

5 Other than as may be approved in writing by the Local Planning Authority, there shall be no excavation or other groundworks, except for investigative works, or the depositing of material on the site unless the final surfacing of the private access within 7 metres of the public highway does not contain any loose material that is capable of being drawn on to the existing or proposed public highway and surface water is prevented from discharging onto the public highway. Any necessary works shall accord with the specification of the Local Highway Authority and maintained thereafter to prevent such discharges.

6 The existing Public Right of Way shall be protected and kept clear of any obstruction until such time as any alternative route has been provided and confirmed under an Order made under the Town and Country Planning Act 1990.
