After reviewing broadcast footage of the Incident and consulting the DSA, the RD determined that there was no evidence of a breach of the Rules by the Driver of Car #18. With his third place finish in Malaysia mid-October, seconds behind Bautista at the chequered flag, it was Simoncelli who was crowned the 2008 250cc champion and the Italian celebrated by completing a helmet-less victory lap around the track.
