Water (Permit) (Amendment) Regulations, 2020 (No. 7)

IT is hereby notified that the Minister of Lands, Agriculture, Water and Rural Resettlement, after consultation with the Zimbabwe National Water Authority, has, in terms of section 119 of the Water Act [Chapter 20:24], made the following regulations: — 1. These regulations may be cited as the Water (Permit) (Amendment) Regulations, 2020 (No. 7). 2. The Water (Permit) Regulations, 2020, publishedin Statutory Instrument 52 of 2020, are amended by the insertion of the following fees before existing fees in the First Schedule — “Raw water use for - bulk monitoring USD/ m3 or Equivalent ZWL / m: (i) Water Fund 1,00 (ii) ZINWA charges 1,00 (iii) Sub-catchment council levy 1,00 Ground Water use—bulk monitoring—

USD/ m3or Equivalent ZWL / m: (iv) Water Fund 1,00 (v) ZINWA charges 1,00 (vi) Sub-catchment council levy 1,00”. 3. The equivalent ZWL from LTSD shall be calculated based on the foreign exchange weekly auction results as published by the Reserve Bank of Zimbabwe. 4. THE Minister of Lands, Water and Rural Resettlement has, in terms of section 41 of the Zimbabwe National Water Authority Act [Chapter 20:25}, and after consultation with the Board of the Zimbabwe National Water Authority and with the approval of the Minister responsible for finance, made the following regulations: — 1. These regulations maybe citedasthe Zimbabwe NationalWater Authority (Water Levy) (Amendment) Regulations, 2020 (No. 6). 2. The Zimbabwe National Water Authority (Water Levy) Notice, 2000, published in Statutory Instrument 95 of2000 (hereinafter called “the principal notice”), is amended in section 3 by the repeal of subsection (2) and the substitution of— “(2) The levy payable — (a) in respect of direct abstraction of water by a permit holder or an agreement holder, shall be LTSD1,00, per megalitre or equivalent ZWL/ML of water permitted to be abstracted under the permit or water allocation to the agreement holder per quarter; (b) in respect of storage of water in any works for the construction of which a permit is or would have been required in terms of section 32(4) of the Water Act [Chapter 20:24}, shall be the amount specified in the third row of the following Table, as obtained by applying a factor 1.06 to the yield—

(2) The increase by this notice of the amounts specified in sections 23(3), 38B(1) and 38C of the Act shall not have effect in relation to any statutory policy issued before the date of commencement of this notice, until the end of the current term of that policy. Policies may be payable inforeign currency 2. For the avoidance of doubt, the amounts in this notice are denominated in the United States of America dollars (USD) and may be payable in Zimbabwean currency using the prevailing official exchange rate. Requirements in respect of statutory policies of insurance 3. For the purpose of section 23 (“Requirements in respect of statutory policies of insurance”) of the Act, a statutory policy shall not be required to cover— (a) liability in respect of the death of or bodily injury to persons who were being carried in or on entering or getting on to or alighting from the vehicle or trailer concerned when the event out of which the claims arise occurred to an amount exceeding— (i) one thousand dollars (USD1 000) in respect of any one such person killed or injured; or (ii) five thousand dollars (USD5 000) in respect of any one accident or series of accidents due to or an omnibus; or (iii) ten thousand dollars (USD10000) inrespect of any accident or series of accidents due to or arising out

of the occurrence of any one such event, where the motor vehicle concerned is an omnibus or commuter omnibus; or (b) liability in respect of the destruction of, or damage to, any property to an amount exceeding— (i) two thousand dollars (USD2 000) in respect of any one accident or series of accidents due or arising out of the occurrence of any one event, where the motor vehicle concerned is a vehicle other than a passenger public service vehicle; or (ii) two thousand dollars (USD2 000) in respect of any one accident or series of accidents due or arising out of the occurrence of any one event, where the motor vehicle concerned is a passenger public service vehicle; or (c) any liability in respect of any one accident or series of accidents due to or arising out of the occurrence of any one event, to an amount exceeding— (i) five thousand dollars (USD5 000) where the vehicle concerned is a vehicle other than an omnibus or a commuter omnibus; or (ii) twenty thousand dollars (USD20 000) where the vehicle concerned is an omnibus or a commuter omnibus. Passenger public service vehicles to carry no fault insurance cover 4. For the purpose of section 38B of the Act, no person shall drive a passenger public service vehicle carrying passengers on any road unless there is in force a policy of insurance which provides a benefit in accordance with a scale approved by the Minister, irrespective of fault on the part of the owner or any of his or her employees or agents, to every person who suffers loss or injury, up to an amount of— (a) two thousand dollars (USD2 000) in respect of the death of or permanent disability suffered by any such passenger; and

(b) three hundred and lilty dollars (USD350) in respect of medical or funeral expenses incurred by or in respect of any such passenger who suffers a bodily injury or dies; where such death, permanent disability or bodily injury is caused by or arises out of the use of the passenger public service vehicle on any road. Limits of liability in respect of children and small claims 5. A policy of insurance referred to in section 38B of the Act may provide that where the passenger is a child, the benelits payable in respect of his or her death or permanent disability shall be limited, notwithstanding anything contained in the Insurance Act [Chapter 24:07], to— (a) two hundred dollars only (USD200), where at the time of his or her death or permanent disablement, the child was six years of age or younger; (b) three hundred dollars (USD300), where at the time of his or her death or permanent disablement, the child was fourteen years of age or younger but over the age of six years. Repeal 6. The Road Traffic (Prescribed Amounts for Statutory Policies of Insurance) Notice, 2009, published in Statutory Instrument 124 of 2009, is here by repealed.

Schedule EXPLANATORY NOTE (This note does not form part of the notice, but merely explains its contents') Under Part IV of the Road Traffic Act, all motor vehicles used on the roads must be insured, at a minimum, with statutory third-party insurance. This third- party insurance covers death or injury to third parties involved in accidents and loss or damage to their property. The limits are presently specified in the Act but the Minister responsible for the Act has power to increase these monetary limits from time to time, in terms of section 23A of the Act. Likewise, under Part VA of the Road Traffic Act, operators of passenger public service vehicles (i.e omnibuses, commuter omnibuses and taxis) are required to carry no-fault insurance compensating their passengers and their

The no-fault insurance is carried in addition to the existing statutory third-party insurance that is required under Part IV of the Act. The limits of the no-fault insurance are presently specified in the Act but the Minister responsible for the Act has no power to increase these monetary limits from time to time, in terms of section 38E of the Act. The changes to the amounts made by this notice, and the sections of the Act and matters to which they relate, are represented in the following table:

IT is hereby notified that the Minister of Transport and Infrastructural Development has, in terms of section 81 of the Road Traffic Act [Chapter 13:11], made the following regulations: — 1. These regulations may be cited as the Road Traffle (Licensing of Drivers) (Amendment) Regulations, 2019 (No. 33). 2. Section 12 of the Road Traffic (Licensing of Drivers) Regulations, 1977, published in Rhodesia Government Notice No. 240 of 1997, is hereby repealed and substituted with the following— “Prescribed fees 12. (1) A person applying in terms of section 8(2)(b) or (3) of the Act to an issuing officer for a tractor driver’s permit or duplicate tractor driver’s permit shall transmit with his or her application a fee of four hundred Zimbabwean dollars (ZWL$400,00). (2) The fee to be remitted to the Registrar by a farmer or miner or his or her manager or a registering officer in terms of section 8(5) of the Act, shall be a fee of four hundred Zimbabwean dollars (ZWL$400,00). (3) A person applying in terms of section 9(1) of the Act to an examiner for a learner’s licence shall transmit with his or her application a fee of one thousand Zimbabwean dollars (ZWL$1 000,00) for testing the applicant.
