EASTERN BAY ROAD SAFETY COMMITTEE JOINT COMMITTEE AGREEMENT

PURPOSE

Clause 30A of Schedule 7 of the Local Government Act 2002 (LGA 2002) requires that an agreement be entered into by the Parties specifying the number of members each Party may appoint to the joint committee; how the chairperson and deputy chairperson are to be appointed; the terms of reference of the joint committee; what responsibilities (if any) are to be delegated to the joint committee by each Party; and how the agreement may be varied. This Agreement sets out each of these matters as required by the LGA 2002.

The Eastern Bay Road Safety Committee has been established to provide strategic direction, oversight and leadership to ensure Eastern Bay roads are increasingly free of death and serious injury.

INTERPRETATION Agreement means this agreement with its Appendix including any variations entered into from time to time.

Joint Committee means the Eastern Bay Road Safety Committee

Party means the Kawerau District Council, Ōpōtiki District Council, Whakatāne District Council and Bay of Plenty Regional Council being a joint committee of each of these Councils established under the Local Government Act 2002.

Terms of Reference means the terms of reference for the Eastern Bay Road Safety Committee Joint Committee set out in Appendix 1.

NUMBER OF MEMBERS The number of members that each Party may appoint to the Joint Committee is set out in the Terms of Reference.

CHAIRPERSON AND DEPUTY CHAIRPERSON The process for the appointment of the Chairperson and Deputy Chairperson is set out in the Terms of Reference.

TERMS OF REFERENCE The Terms of Reference for the Joint Committee are set out in Appendix 1.

DELEGATIONS The Eastern Bay Road Safety Committee’s role is essentially to provide an interagency response to local, regional and national road safety strategies, and in particular, will seek to achieve the Eastern Bay’s road safety objective. The Joint Committee’s delegations are set out in the Terms of Reference. The Joint Committee has all the powers necessary to enable it to carry out its functions.

VARIATIONS This Agreement (including the Terms of Reference) may be varied by mutual agreement of the Parties at any time.

Any agreement to vary the Agreement shall be recorded in writing, signed by the parties and attached to this document.

Appendix 1 Terms of Reference Eastern Bay Road Safety Committee

Objective To provide strategic direction, oversight and leadership to ensure Eastern Bay roads are increasingly free of death and serious injury.

Aims Safer Journeys, the New Zealand Road Safety Strategy, highlights the need to work across all elements of the road system (roads, speeds, vehicles and road use) and advocates that everyone has a responsibility for road safety.

The aim of the Eastern Bay Road Safety Committee (EBRSC) is to support, monitor and advocate for road safety in the Eastern Bay. It will do this through coordinating the work of all the Eastern Bay agencies that have a road safety function to ensure the Safer Journey’s ‘safe systems’ approach is achieved.

The Committee will support road safety in the Eastern Bay by:

. Ensuring that all funders and stakeholders maintain an agreed vision and purpose; . Providing leadership in planning and development of road safety programmes, plans and initiatives; . Supporting each of the key actions within the Road Safety Implementation and Action Plans; . Contributing to the preparation of local, regional or national strategies and plans as appropriate; . Overviewing the implementation of the Road Safety Action Plan by monitoring progress, evaluating and providing feedback and direction to member agencies; . Raising the profile of road safety initiatives within member organisations and within the wider community; . Providing networking and information sharing opportunities, with regular reporting by member organisations to the Committee on projects and priorities; . Supporting community led road safety initiatives if they can be demonstrated to contribute to Eastern Bay road safety objectives;

Principles The Committee will work to:

. enhance mutual benefit and create a common purpose; . commit appropriate resources including time, skill and expertise; . encourage participation of all members; . think strategically and innovatively; and . provide leadership and oversight.

While it is recognised that each member brings a particular perspective, members will be expected to act in the best interests of road safety and all people in the region in achieving the above aims.

All members must agree to support the terms of reference.

Chairperson The Chairperson and Deputy Chairperson of the Committee will be appointed by the EBRSC at the first meeting of the new three year planning term for a term of three years.

Membership The EBRSC will be composed of no more than 10 core members. Members of the EBRSC will be selected by the individual organisations. Members will be eligible for reappointment, which will coincide with the local government election cycle Each appointment will be for a term of approximately three years.

Committee membership will be made up of representatives from the following organisations:

• Whakatāne District Council (1 elected member) • Kawerau District Council (1 elected member) • Ōpōtiki District Council (1 elected member) • Bay of Plenty Regional Council (1 elected member) • NZTA (1 representative) • New Zealand Police (1 representative) • Road Transport Association NZ (1 representative) • ACC (1 representative)

Other members can be co-opted to the group for specific periods to assist the work of the EBRSC as necessary but will not have voting rights

The members may nominate an alternate person from their organisation to attend Committee meetings, either on a permanent or temporary basis.

Parameters The EBRSC provides support, leadership and oversight for road safety in the Eastern Bay of Plenty.

The Committee must be aware of, and monitor the progress of the objectives of the road safety programmes, plans and initiatives.

Accountability The Committee and its members are accountable for the outcomes of the Eastern Bay Road Safety activity.

Relationships Whakatāne District Council is responsible for the day to day management and coordination of the Eastern Bay Road Safety activity.

Whakatāne District Council will service the working of the EBRSC, including the provision of administrative support, preparation of agendas, reports and minutes in conjunction with the Chairperson.

Scope The scope of the EBRSC covers all roads in the Whakatāne, Ōpōtiki and Kawerau Districts, including State Highways. It includes all road safety activities carried out in the Eastern Bay including education and promotion, enforcement activities and engineering programmes. It coordinates these programmes and activities with regional and national road safety programmes and initiatives.

EBRSC will seek to give effect to the New Zealand road safety strategy, Safer Journeys, and the Eastern Bay Road Safety Implementation Plan when determining its local focus and priorities.

EBRSC’s role is essentially to provide an interagency response to local, regional and national road safety strategies, and in particular, will seek to achieve the Eastern Bay’s road safety objective.

Meetings and The Committee will meet at least quarterly. Meetings will be held at times Process and in places set out in an agreed schedule.

The Committee may need to hold additional workshops, information sessions involving group members or other interested parties.

The Chief Executive, or the Chief Executive’s representative, of each partner council shall attend meetings and will act as advisors to the EBRSC. Meetings may be attended by further staff support as considered appropriate by their Chief Executive. The quorum at a meeting of EBRSC is half of the members if the number of members (including vacancies) is even, or a majority of members if the number of members (including vacancies) is odd

The Chairperson will have a deliberative vote. In the case of equality of votes, the Chairperson of EBRSC does not have a casting vote and the status quo is preserved. The EBRSC has the ability to set up sub-committees to carry out specific directions of the Committee.

Performance These terms of reference are in force until amended in writing by the partner Councils. Consultation with all Committee member organisations will precede any amendments to the Terms of Reference.

3. FOLLOW UP ACTIONS FROM THE MINUTES

3.1. Bridge, Ōpōtiki

Jim Finlay advised that he had not recently heard complaints about horses and riders using the vehicle lanes on the Waioeka Bridge, although he noted that when they did they caused the traffic to slow to a walking pace, which caused traffic to build up. He stated that he understood that a new reinforcing layer for the footpath lane of the Waioeka Bridge was planned to enable horses to cross the bridge using the footpath. Adam Francis, NZTA, advised that he would follow up and report back on this issue.

3.2. Safety Update on SH 35 Schools

The Chairperson advised that a driver working for Williams and Wilsheir Ltd, accompanied by a road safety officer and forestry person, visited schools along SH 35 with his loaded logging truck and trailer unit. The teachers and children were invited to sit inside the driver’s cab to witness what the driver would see when driving. They also inspected the truck and looked at the wheels and were advised that loaded truck and trailer units were unable to stop quickly. The idea was to ensure the children and the teachers understood why the truck drivers and the company were saying that the children needed to be careful when trucks were on the road. The Chairperson advised that the company, Williams and Wilsheir Ltd, was also building bus shelters for the students.

The Chairperson asked that a letter of thanks be sent to the people from Williams and Wilsheir Ltd on behalf of the Committee for this road safety initiative.

4. EASTERN BAY ROAD SAFETY ACTIVITY REPORT 1 JULY – 30 SEPTEMBER 2015

Refer to pages 13-20 of the agenda.

Ms Hartley spoke to her report and outlined the first quarter of the year’s activities which was designed to align with the national campaigns and the Police priorities. She advised that the “Can’t Rewind Time” youth targeted event would be held in Ōpōtiki at the A & P Show in March 2016 and in Kawerau in conjunction with the night markets.

Ms Hartley advised that William Stewart was undertaking a campaign in Quarter Two which would involve collaboration with local sports club targeting the issue of drinking and driving following sporting events.

Ms Chapman introduced the third video in the #Dontjimithat campaign which focused on a series of videos which used humour to show people being stopped from drinking and driving. These videos were available on both Jimi Jackson’s and the Eastern Bay Road Safety Facebook pages. She stated that the campaign aimed to connect with males aged 15-30 years, which was the demographic that more traditional media campaigns failed to connect with. Jimi Jackson, a kiwi comedian with a vast internet following, was the face of the campaign. He had over 500,000 Facebook fans and had received over 2.6 million views for these videos. The montage of the drink driving series was played at the meeting. She stated that this was the end of the campaign and she believed the amount of money spent on this campaign had resulted in a significant reach to the demographic they were aiming to influence.

5. NZTA ROAD SAFETY ACTION PLAN REPORT OCTOBER 2015

Refer to pages 21-26 of the agenda.

Adam Francis advised that the Regional Safety Alliance was targeting safety issues for SH30 from Te Teko to Awakeri and SH34 from the SH30 turnoff to Kawerau. He stated that a workshop had been held with key stakeholders and a number of options were being explored. Mr Francis stated that in terms of the minor safety improvements in this year, these were focused mainly around schools. The following works were programmed:

1. advanced warning signs for Nukuhou North School 2. footpaths for and Tōrere Schools 3. Waimana Road Right Hand Turn 4. Guardrails along Forsyth Street, Ōpōtiki 5. work around kerbs between Ōpape Beach and Mōtū

Rob Bullick advised that the signature project had transformed into a project in the Ōpōtiki District that would support the forthcoming harbour development. He stated that two investment logic mapping workshops had been held with the Mayor, Deputy Mayor and Chief Executive of the Ōpōtiki District Council, representatives from the Bay of Plenty Regional Council, the NZ Police, FLAG, NZTA and iwi. He noted that Stephen Davies-Howard, NZTA, Tauranga, would be writing a strategic business case and that further feedback to the Committee would be given as this project progressed.

6. POLICE REPORT

Refer to tabled document 27A-B.

Sergeant Wylie read his tabled report (refer to tabled document 27A-B) which set out the latest crash statistics. He stated that Police were involved in Rail Safe week in August 2015 which was an opportunity to work with KiwiRail and media staff to raise awareness of the dangers at rail crossings and to highlight some of the high risk crossings.

He stated that the Tactical Alcohol Group (TAG) was currently deployed on a regular basis in the Eastern Bay of Plenty and had undertaken a two night operation in August 2015.

Sergeant Wylie stated that during the changeable weather conditions drivers were losing control in the wet, however, the wet surface was not the cause of a crash. He stated that drivers needed to pay more attention to the risks and slow down when approaching bends.

Sergeant Wylie stated that the number of drivers driving in breach of their graduated licence conditions was a concern. He spoke about the annual fatigue stop in the Manganuku campsite area in the Waioeka Gorge on Labour Day, 26 October 2015. He stated that drivers were breath tested and one driver was processed for drunk driving.

Sergeant Wylie stated that planning was underway for the summer months, including a focus on high risk drivers, speed, road works, alcohol, fatigue, changeable weather conditions and motorcycling.

He stated that planning was also underway for the Rhythm and Vines festival in Gisborne, which meant a significant volume of traffic coming through the Eastern Bay, particularly with young fatigued people returning from the festival on 1 January 2016.

The event was attended by approximately 150 motorists dropping in at the rest area, with over 300 vehicles stopped by Police. Potentially, this initiative could be relocated with a more educative perspective.

Restraints A one week WDC October Programmes delivered in Whakatāne, programme 2015 Edgecumbe, Murupara, Kawerau, educating Plunket Tāneatua and Ōpōtiki. whānau on the appropriate REAP use of car restraints

2.2. Table Two: Speed Indicator Device Use and Recommendation: 1 October to 31 December 2015

The Speed Indicator Device (SID) tool is used by the Eastern Road Safety Programme as part of its speed management activity. Opus is engaged to analyse surveyed data and the setting out of SID over the past quarter, with assistance from Whakatāne, Kawerau and Ōpōtiki District Councils. The SID is an electronic speed warning sign that measures, displays and records a vehicle’s speed when

they approach the sign. The SID is mounted to a trailer and is used to target high risk speed areas. Speed is identified as a high concern for the Ōpōtiki District and a medium concern for both Whakatāne and Kawerau Districts.

There have been various technical issues with SID in the past quarter due to moisture in the lacquer PCB boards (computer). Once moisture gets within the unit it can cause intermittent failures and the recommendation from OPUS is that SID needs replacing which has been discussed with the transport team.

4. OTHER AREAS IN FOCUS

4.1. SOLGM Excellence Awards - #Dontjimithat

The success of the #Dontjimithat project has resulted in an entry being made in the Innovation in Council-Community Relations category of the SOLGM Excellence Awards. The entry is centred around the development of the R4 model – a framework used to identify suitable influencers/opinion leaders (e.g. Jimi Jackson) to front or feature in behaviour change and other community focussed good. This entry has been made by the name of the four local authorities. The campaign has also been entered in the Webby Awards (www.webbyawards.com) by Wellington based creative agency Cleminger BBDO, who worked collaboratively with New Zealand Transport Authority on the third and final set of videos.

4.2. Up and Over Event

The Eastern Bay of Plenty Road Safety Programme was the major sponsor of the Up and Over Fun Walk/Run/Bike event held on November 15, 2015. The event marked the official opening of the Whakatane-Ohope walk/cycle way and provided a valuable opportunity to grow awareness of the Eastern Bay Road Safety Programme brand, and drive key road safety messaging, particularly around speed and awareness of pedestrians/cyclists.

4.3. Animation Project

Building on Jimi Jackson’s success we are investigating a digital project that will focus on young male Māori drivers. The concept is currently being designed and will include local leaders that rangatahi can relate to in 3D animation, for social media.

4.4. ‘Buckle Up. Stay Focussed. Stay Alive.’ Campaign

The Buckle Up. Stay Focussed. Stay Alive campaign concluded at the end of October. The two month campaign was centred on restraints and distractions, with campaign advertising comprising local radio, print and online activity. Please see Appendix A for more detailed information on campaign tactical activity.

4.5. #KnowWhen Campaign

The #KnowWhen campaign was launched in November, and scheduled to conclude at the end of February. Centred on speed, alcohol/drugs and fatigue, a multimedia approach was again favoured with significant advertising placed with local print and radio media outlets. Please see Appendix A for more detailed information on campaign tactical activity.

4.6. Report to the Regional Transport Committee

The Eastern Bay Road Safety Programme team presented to the Regional Transport Committee on 27 November 2015, highlighting the road safety issues in the Eastern Bay and solutions which enable communities to engage.

4.7. #BikeWise

Collateral has been provided to the Sport Bay of Plenty Bike Wise programme being delivered in primary schools.

4.8. #OrangeDay

School Patrols celebrated their year’s achievements at the Aquatic Centre on 13 November 2015, in partnership with the Police and Blue Light.

5. COMMUNICATION ACTIVITY

There is consistent communication activity happening for road safety in the Eastern Bay. A list of activity is attached as Appendix B.

6. ROAD SAFETY OPERATIONS GROUP

The Operations Group meeting is to be held on Monday 22 October, 2016. A verbal update will be provided at the meeting.

Our advertising team are in the process of producing new creative material that regional road safety partners can pick up and use locally to encourage safety belt wearing. This is likely to include creative material that can be used outdoors, in print media, radio ads, and online / social media material. This is expected to be ready in April.

The lack of restraint use has been identified as an emerging strategic priority in the Safer Journeys Road Safety Strategy. In the last five years 300 people have died because they didn’t buckle up. On average that’s 60 lives per year that could have been saved if they had made the decision to wear their safety belt.

Stats show the high risk group is more likely to be travelling at night, be passengers and male with an alcohol- affected driver. Maori were also disproportionately represented in fatalities and serious injuries as a result of not wearing their safety belt.

The drop in deaths and serious injuries due to crashes involving alcohol-affected drivers has been one of the significant successes of the past decade. The number of young alcohol-affected drivers involved in fatal or serious injury crashes fell by 30% in the year prior to the new zero youth alcohol limit. Overall alcohol-related road deaths and serious injuries fell by 22%.

 Huntly section: Construction is well under way by the Fulton Hogan-HEB joint venture, with the northern interchange works seeing traffic managed off SH1, a haul road established along the route, including to the Taupiri pass, and bridging at southern end at Mangawara Stream. Completion date is 2020.  Longswamp section: Hearing in March over application for final designation. Construction on track to start 2016, with completion in 2018.  Rangiriri section: Construction continues, with traffic expected to be on the main line later this year, with the entire project finishing in 2017.  Cambridge section: Completed in December last year, six months ahead of schedule.  Hamilton section: On track to start construction this spring via an alliance contract.  A 3.2km shared path for pedestrians and cyclists along the eastern side of Ohaupo Road from Lorne Street to Dixon Road in Hamilton, including Normandy Avenue to Bader Street. Construction under way and due to finish in late April. More information

SH1 Kahikatea Drive-Gallagher Drive-Quentin Drive traffic lights:

 Traffic signals and minor road layout changes now under way to improve access to these busy side roads off SH1. Lights also provide a safe crossing for cyclists and pedestrians linking cycling networks, including the Western Rail Trail. More information SH3/21 roundabout

 Now under construction with completion late May. SH1-Cobham Drive

 Wairere Dr-ring road connection to SH1-Cobham Dr under way, with Dey St works ahead of roundabout connection to SH1 in autumn. Includes a ramped overbridge for pedestrians and cyclists. The Sillary St underpass is also likely to be built this year, providing another crossing point to Hamilton Gardens. SH1/26 Hillcrest roundabout completed late last year. 3. During the year

• Road codes have been issued to Road Safety Committees for distribution to young drivers and the community. • CAN Cycle workshop held in Tauranga and Rotorua • The Trafinz conference was attended by road safety co-ordinators and travel planners in the region. The theme was the changing face of transport. It was an excellent opportunity to be informed about the latest developments in transport including road safety, enforcement, travel demand management, different travel modes and engineering. • The next Trafinz conference will be in Tauranga November 2016. All road safety partners are encouraged to attend. It will be a chance for the region to showcase itself. Thought should be given submitting on road safety or other transport projects that showcase our region. • The SASTA Executive facilitated professional development training for all Road Safety Co-ordinators. The training was provided by NZTA free of charge and covered best practice around youth and road safety. It was held 2 December at the Rotorua Lakes Council, thanks to Jodie Lawson and her team for providing the venue. All the Region’s Road Safety Co-ordinators attended, as well as School Community Officers and other interested parties. • Presentation from Waikato and Commercial Vehicle Investigation crash unit on 10 below on bends campaign collaboration between the two regions. • Support provided to Rotorua Probation office for interactive Youth Expo on the 27th November 2015, by assisting 50 youth to attend the expo. 4. News from the Regional Transport Committee (RTC)

The last RTC Committee Meeting was 27 November 2015. • As the Eastern Bay Signature project has ceased, (due to changes in ACC), Regional Director Harry Wilson advised NZTA are focused on developing a strategic case to progress issues and it will be centred on Opotiki, • Bay of Plenty Child and Youth Mortality Review Group (CYMRG) Chair Dr Chris Moyes and Coordinator Raewyn Lucas presented their review findings on fatal road-related deaths occurring amongst children and youth in the Bay of Plenty. • Whakatane District Council’s Community Services Manager, Paula Chapman and Community Development Advisor Lorreen Hartley gave an update on road safety initiatives in the Eastern Bay of Plenty. New and improved initiatives targeting key at-risk groups aim to provide a more holistic approach that promotes a culture of making good life choices. Close collaboration at community level occurs. The programme is working well. • Senior Transport Planner Bron Healey provided the Committee with the Regional Land Transport Plan Annual Report Card 2014/15. Mr Healey advised of the gains made in road safety, despite the number of fatalities. (Report card attached). • Senior Transport Planner Bron Healey reported on progress made implementing cycling projects in the Regional Land Transport Plan. The Regional Transport Plan sets the strategic direction for cycling in consultation with local authority key staff representatives. (Presentation attached) • The Transport Committee is keen to hear about road safety from the joint Road Safety Committees. Since the meeting Rotorua Road Safety Committee have indicated they can do a presentation at the meeting being held 16 September 2016.

RLTP implementation approach for road safety (from Draft Plan) National and regional priorities will be implemented through road safety action plans. The RTC is responsible for approving the regional road safety action plan. The three sub-regional road safety committees are responsible for developing and implementing the sub-regional plans. This ensures priority local issues and identified risks are taken into account alongside national and regional priorities. The proposed approach includes a feedback loop which allows for sub-regional road safety activities to be reported back to the RTC. The RTC also has a role in advocating on priority regional issues.

EASTERN BAY OF PLENTY OPERATIONS MEETING 18th February 2016

The 2015 road toll ended with 7 deaths from 7 fatal road crashes.

Of the 7 fatal crashes in 2015 only 1 was attributed to the driver being under the influence of alcohol as a major contributory factor. Two further crashes involved intoxicated pedestrians. One of the crashes involving a pedestrian still remains unresolved.

Careless/dangerous driving, speed and alcohol were all factors in contributing to the fatal crashes in 2015.

The number of alcohol related deaths on our roads has significantly reduced since 2013. 1 fatal crash last year involved alcohol, 1 fatal crash in 2014 and 2 fatal crashes in 2013 involved alcohol. This is a positive reduction for the Eastern Bay of plenty considering the high numbers of alcohol related deaths involving alcohol prior to 2013.

Initial analysis shows the overall number of crashes has increased in 2015 compared with 2014. This is unconfirmed until all data is entered into CAS.

The current road toll for 2016 sits at zero deaths. Serious injury crash on Toones Road, Kutarere early hours Sunday 14th Feb – alcohol suspected.

Rhythm and vines: Eastern Bay of Plenty Police were support by both Rotorua and Western Bay of Plenty TAG (booze bus) staff for the significant increase in traffic volume on the 1st of January. The TAG groups were deployed to SH 30 in Te Teko and SH 2 in the Matata Township. With the assistance from Loreen both groups provided bottles of water to drivers. This was timely and well received. No crashes were directly reported as a result of traffic returning from rhythm and vines.

Unfortunately Police attended 2 serious injury crashes on the 1st of January.

One of these was an off road crash involving a quad bike, the rider of this bike failed to recover from his injuries and has subsequently died in Waikato hospital.

A serious injury crash occurred on the 1st of January on SH 2 near Baird Rd, Öpötiki. A vehicle crossed the centre line into the path of 2 oncoming vehicles. A driver in one of the vehicles was seriously injured and is currently recovering from his injuries.

The annual fatigue stop was held in the Waioeka gorge on 26/10/2015. 368 vehicles stopped. 1x driver was processed for drink driving and issued with an infringement notice.

A Cellphone and restraint operation was held in Whakatäne on 18th of November. Within a two hour period 12 restraint and 9 cellphone Ion’s were issued.

Police have been focusing on Motorcycling during December. The results of this indicate too many riders are in breach of their motorcycle licence or do not have a motorcycle licence.

The summer Policing period ended with Zero fatal crashes-(December and January).

Between 2nd and 12th of February 2016 a Back to school operation was held targeting speed in and around school zones and a number of crash reduction measures outside of high risk school times. During this period Police issued 29 speeding offences with 5 notices issued for speeds around schools. Police also issued a number of notices for graduated licences breaches for students and unrestrained occupants including children.

The tactical alcohol group and static speed camera vehicles continue to deploy to the EBOP on regular occasions.

The high risk roads are SH 30 in the Rotoma area, Thornton rd near Smith rd, the Waioeka gorge, Wainui rd near Te Kooti and SH 2 between Kutarere and Öpötiki.

I currently have no road Policing vacancies.

Speed, Road works, alcohol, fatigue, changeable weather conditions and motorcycling will be significant risks on EBOP over the coming months.
