Can. Judge Augustino S. L. Ramadhani. 1 BIOGRAPHY OF THE LATE GENERAL BRIGADIER, RETIRED CHIEF JUSTICE, JUDGE, REV. CAN. JUDGE AUGUSTINO S. L. RAMADHANI, THE FORTH ACT REGISTRAR 1. BIRTH The late Rev. Can. Judge Augustino Ramadhani was born at Kisima Majongoo, Zanzibar on 28th Dec 1945 (Last days of the second world war). He was the second born in the family of eight children (4 Girls and 4 Boys) of the late Mwalimu Matthew Douglas Ramadhani and Mwalimu Bridget Ann Constance Masoud. 2. CHURCH’S LIFE Augustino was born and raised up in a Christian family despite the facts of the family names that are mixture of both Islam and Christian background. As a Christian he played several roles in the church from the local church to provincial (national) level. At the parish level he was a good chorister, as well as pianist. He is the author of several books and articles. Even after joining military service he continued to serve in the church as secretary for the parish of St Alban in Dar es Salaam. In 2000 he was appointed to be the 4th Provincial Registrar of the Anglican Church of Tanzania (ACT) since the inauguration of the Province in 1970 , the position that he held for seven years until 2007 when he resigned after being appointed as the Chief Justice of Tanzania 25th July 2007 at All Saints Cathedral in the Diocese of Mpwapwa he was honored to be a Lay Canon. -
Human Rights, the Rule of Law, and the East African Court of Justice: Lawyers and the Emergence of a Weak Regional Field
HUMAN RIGHTS, THE RULE OF LAW, AND THE EAST AFRICAN COURT OF JUSTICE: LAWYERS AND THE EMERGENCE OF A WEAK REGIONAL FIELD Mihreteab Tsighe Taye* This article represents a first systematic attempt to trace the trajectory that follows the professionalization of a group of East African lawyers committed to the cause of a regional International Court (IC) inspired by the rule of law and human rights. It demonstrates how a group of lawyers participated in the struggle to define law and to construct the East African Court of Justice (EACJ) and build the field of human rights. Lawyers who participated in the creation of the EACJ became “experts” in regional law. This expertise was legitimised not only by the political and social capital deriving from their participation in the drafting of the EAC Treaty, as representatives of states or civil society groups, but also by the capital of knowledge and technical skill accumulated in the course of bringing forth and litigating cases in both the national and transnational spaces. Upon entering the regional IC, as either judges or litigators, these agents became interpreters of the EAC Treaty inspired by the respect for the rule of law and human rights. The article reports on data from field research in East Africa. This article starts with a discussion of the role of lawyers and civil society groups in the formation of the EACJ before analysing efforts to extend the jurisdiction of the EACJ to include human rights. It then examines the EACJ judges’ off-the-bench efforts at judicial empowerment before looking at how lawyers introduced their litigation experience from the national level to the EACJ. -

Remembering the Dark Years (1964–1975) in Contemporary Zanzibar Marie-Aude Fouéré French Institute for Research in Africa (IFRA), Nairobi, Kenya In the islands of Zanzibar (Unguja and Pemba), the memories of violence and repression perpetrated by revolutionaries and the state from 1964 to 1975 have long been banished from the public space. The official narrative of the 1964 Revolution and the first phase of the post-revolutionary periodi developed and propagated by the Revolutionary Government of Zanzibar, through a control over the production, transmission, and circulation of ideas, combined with repressive measures against dissenting voices, led people to keep their memories private. The official injunction calling for silence did not bringabout a forgetting of the past, but rather contributed to the clandestine transmission and reconstruction of fragments of individual, familial, and community memories within private circles. -

Tanzanian Affairs Issued by the Britain-Tanzania Society No 118 Sept 2017 Mining Sector - The Mineral Sands Export Saga Challenge to Schooling Ban for Pregnant Girls Key “Escrow” Suspects Arrested Roger Nellist: THE MINERAL SANDS EXPORT SAGA Tanzania’s mining sector in difficulty - the background As reported in TA117, in March the government took the controversial step of banning the export of mineral concentrates and ores for metallic minerals such as gold, copper, nickel and silver. Later the same month, President Magufuli had intervened personally, ordering the seizure at Dar port of 277 containers of mineral sands destined for export mainly from two gold mines operated by Acacia Mining (Tanzania’s largest gold-producer), and asserted: “There is no country being robbed of its mineral wealth like Tanzania”. Samples were taken from the sands for analysis. Several foreign mining companies were immediately affected by the export ban but local miners and other entities also expressed concerns. In April, Magufuli established two expert teams to report to him quickly on different aspects of the mineral sand exports. Since then the saga has intensified, triggering an avalanche of robust follow-up actions by government – including more sackings and contentious new legislation. Tanzania is variably listed as Africa’s third or fourth largest gold- producing country so, unsurprisingly, the saga has generated much news coverage and comment, both in Tanzania and abroad. There have been headlines like: “Industrial-scale plunder of Tanzania’s mineral wealth by multinational companies”, “Probe team unearths massive thievery in mineral sand exports”, “Tanzania has been losing trillions of shillings in revenue” and “Tanzania’s Acacia spat shows deepening battle with business”. -

The union is headed by a president who is also the head of government; its unicameral legislative body is the National Assembly (parliament). Zanzibar, although part of the union government, has its own president, court system, and legislature, and exercises considerable autonomy. Tanzania held its fourth multiparty general elections on October 31, in which voters on both Tanzania mainland and Zanzibar elected a union president and their respective representatives in the union legislature. President Kikwete, the incumbent Chama cha Mapinduzi (CCM) candidate, was reelected union president with 61.7 percent of the vote. The national elections were generally peaceful, but there were several protests in urban areas associated with the slow pace of reporting election results. In Zanzibar the October elections proceeded peacefully after a power-sharing agreement was reached between the ruling CCM party and the opposition Civic United Front (CUF). In a July 31 referendum, Zanzibaris voted to amend the constitution to allow for a unity government. In October the Zanzibar electorate elected Ali Mohamed Shein, the immediate past union vice president, as president of Zanzibar with 50.1 percent of the vote and also elected members of its House of Representatives. -
