Terms of Reference (TOR) 132 2 NATIONAL FOOD AUTHORITY Central Regional Office Luzon Office Cabanatuan City SECTION I - INVITATION TO BID PROCUREMENT OF 2016 SE CURITY SERVICES OF NFA REGION 3 COVERING THE PERIOD JUNE 30, 2016 TO JUNE 30 , 2017 Project Reference No. : 2016-RBAC -REGIII-003 The National Food Authority, Central Luzon Regional Office (NFA -CLRO ) through the Corporate Budget for 2016 , intends to apply the sum of Forty Nine Million Nine Hundred Eighty Thousand Three Hundred Eighty Four pesos (P49,980,384.00 ) being the Approved Budget for the Contract (ABC) to payments under the contract for the provision of 2016 Security Services requirement of NFA Region 3. Bids received in excess of the ABC shall be automatically rejected at bid opening. The NFA-CLRO now invites bids from registered Security Agencies for the provision of Security Services requirement of NFA Region 3 . Delivery of the Services is required from June 30, 2016 to June 30 , 2017 . Payment of contracted rate shall be based on the actual acco mplished services rendered. Bidders should have completed, within the last three (3) years from the date of submission and receipt of bids, a single contract that is similar to the contract to be bid and whose value must be at leas t fifty percent (50%) of the ABC; or at least two (2) similar contracts within the last three (3) years from the date of submission and receipt of bids and the aggregate contract amounts should be equivalent to at least fifty percent (50%) of the ABC, t he largest of these similar contracts must be equivalent to at least twenty five percent (25%) of the ABC. The description of an eligible bidder is contained in the Bidding Documents, particularly, in Section II. Instructions to Bidder. Bidding will be cond ucted through open competitive bidding procedures using a non - discretionary “pass/fail” criterion as specified in the Implementing Rules and Regulations (IRR) of Republic Act (RA) 9184, otherwise known as the “Government Procurement Reform Act.” Bidding i s restricted to Filipino citizens/sole proprietorships, partnerships, or organizations with at least sixty percent (60%) interest or outstanding capital stock belonging to citizens of the Philippines, and to citizens or organizations of a country, the laws or regulations of which grant similar rights or privileges to Filipino citizens, pursuant to RA 5183 and subject to Commonwealth Act 138. Interested bidders may obtain further information from the NFA Region 3 Bids and Awards Committee (BAC) Secretariat and inspect the Bidding Docu ments at the address given below during office hours from 8:00 AM to 5:00 PM. A complete set of Bidding Documents may be acquired by interested Bidders on May 21, 2016 up to June 13, 2016 from the address below and upon payment of a non-refundable fee for the Bidding Documents, pursuant to the latest Guidelines issued by the GPPB, in the amount of Twenty Five Thousand Pesos (P25,000.00). It may also be downloaded free of charge from the website of the Philippine Government Elec tronic Procurement System (PhilGEPS) and the NFA website (www.nfa.gov.ph), provided that Bidders shall pay the non -refundable fee for the Bidding Documents not later than the submission of their bids. 3 The bidding activities will be conducted at the NFA-CLRO Conference Room (2nd Floor), Maharlika Highway, Cabanatuan City according to the following schedule: ACTIVITY DATE/TIME Availability and issuance of Bidding Documents May 21, 2016 to June 13, 2016; 8 AM to 5 PM (working days only) Pre-bidding Conference May 30, 2016; 2:00 PM Deadline for the Submission and Opening of Bids June 13, 2016; 2:00 PM The Pre-Bid Conference shall be open only to all interested parties who have purchased the Bidding Documents. Bids must be delivered to the address below on or before June 13, 2016 at 2:00 PM. All bids must be accompanied by a bid security in any of the acceptable forms and in the amount stated in ITB Clause 18. Bids will be opened in the presence of the Bidders’ representatives who choose to attend the Bid Opening at the address below. Late bids shall not be accepted. The National Food Authority, Region III reserves the right to accept or reject any bid, to annul the bidding process, and to reject all bids at any time prior to contract award, without thereby incurring any liability to the affected bidder or bidders. The procuring entity named in the BDS (hereinafter referred to as the “Procuring Entity”) wishes to receive bids for supply and delivery of the goods as described in Section VII. Technical Specifications (hereinafter referred to as the “Goods”). 1.2. The name, identification, and number of lots specific to this bidding are provided in the BDS . The contracting strategy and basis of evaluation of lots is described in ITB Clause 28. 2. Source of Funds The Procuring Entity has a budget or has applied for or received funds from the Funding Source named in the BDS , and in the amount indicated in the BDS . It intends to apply part of the funds received for the Project, as defined in the BDS , to cover eligible payments under the contract. 3. Corrupt, Fraudulent, Collusive, and Coercive Practices 3.1. Unless otherwise specified in the BDS , the Procuring Entity as well as the bidders and suppliers shall observe the highest standard of ethics during the procurement and execution of the contract. In pursuance of this policy, the Procuring Entity: (a) defines, for purposes of this provision, the terms set forth below as follows: (i) “corrupt practice” means behavior on the part of officials in the public or private sectors by which they improperly and unlawfully enrich themselves, others, or induce others to do so, by misusing the position in which they are placed, and includes the offering, giving, receiving, or soliciting of anything of value to influence the action of any such official in the procurement process or in contract execution; entering, on behalf of the government, into any contract or transaction manifestly and grossly disadvantageous to the same, whether or not the public officer profited or will profit thereby, and similar acts as provided in RA 3019. (ii) “fraudulent practice” means a misrepresentation of facts in order to influence a procurement process or the execution of a contract to the detriment of the Procuring Entity, and includes collusive practices among Bidders (prior to or after bid submission) designed to establish bid prices at artificial, non-competitive levels and to deprive the Procuring Entity of the benefits of free and open competition. (iii) “collusive practices” means a scheme or arrangement between two or more Bidders, with or without the knowledge of the Procuring Entity, designed to establish bid prices at artificial, non-competitive levels. (iv) “coercive practices” means harming or threatening to harm, directly or indirectly, persons, or their property to influence
