'

He therefore prays that Brusle be ordered to make said payment of 1425 livres, part .' \( in wilie, part in brandy and 3rd part in merchandise and that th?se be deposited with whomsoever the Court may choose, and then soid, proceeds of which are to be paid the creditors in order to liquidate de Hombourg's debt.

Petitioner alleges that he has learned that Sr. Faure died in the month of April,. 1726; that he left a widow and ohildren and some property, and that,. as'a niece of said Dame La Solaye, widow of said Faure, petitioner's wife has an interest in said property under the provisions of the mutu­ al donation oontained in their marriage oontract passed before Raguet, Notary, on July 2nd, 1714.

The oontraoting parties, with the advioe and oounsel of their friends hereinafter named, promise to take each other in lawful marriage, to be solemnized in the Holy Catholio Churoh as soon as praotioable and advisable.

The parties agree to the oommunity of property aooording to the Custom of Paris. They make to eaoh other an irrevooable mutual donation inter vivos of all their movable property, im­ movable aoquets and gains, to be enjoyed by the ~ survivor and his or her heirs and assigns in \ naked ownership. Answer of defendant

Levesque alleges he bought :3 thousand-weights of piping of one Bouche, at 400 livres per thousand- ~ weight. He paid 400 livres and gave his note for 800 livres balance. Owing to slack retail trade only 800 were sold and Levesque thus finds himself unable to meet the outstanding debit.

He therefore praya for an extension of one year or else that Bouche be ordered to take back the unsold portion at same price it was sold Levesque. This to cancel the debt.

Councillor Paul Parry has viewed the pre­ mises in company with Attorney General Fleuriau and Recorder Roasard. and finds the new road very near the old one. At present the new road looks passable and fairly dry. Of necessity there should be a bridge to cross the Bayou. S ome danger for foot passengers at present; none for carts and horses.

Defendant Rivard La Vigne shall furnish a road and bridge passable by horses and carts; or he shall allow use of the old road until the completion of the new bridge which thereatter shall be main­ tained by the residents of Gentilly• Rivard is ordered to pay all costs "aince it was he who changed the old road."
