15. DECLARATIONS OF INTEREST

Councillor M Snowdon declared a Disclosable Pecuniary interest in agenda items 4, Neighbourhood Plan Presentation and 6, Neighbourhood Development Plan as he owns property that is rented to students

17. NEIGHBOURHOOD DEVELOPMENT PLAN PRESENTATION BY TERRY GROVE- WHITE

Having earlier in the meeting declared a disclosable pecuniary interest in the Neighbourhood Development Plan Presentation Councillor M Snowdon left the meeting.

Terry Grove-White gave Council an update on the draft neighbourhood development plan, the areas covered included: • Housing Growth – does the Council wish to allocate sites? • Settlement Boundary – explained infill and rounding off • Green Infrastructure – areas to remain ‘green’, sustainability, bees and renewables • Heritage – there are existing heritage documents that do not appear to be used. • Economy – support of Kernick Industrial Estate, protection of smaller industrial areas, mixed use, improve waterfront access and linkages to Town Centre

No requests had been received from members of the public wishing to speak at the meeting

19. NEIGHBOURHOOD DEVELOPMENT PLAN

Having earlier in the meeting declared a disclosable pecuniary interest in the Neighbourhood Development Plan Councillor M Snowdon remained outside of the

meeting for the duration of the item and did not take part in the discussion or the vote.

RESOLVED that the Neighbourhood Development plan includes an Article 4 to limit HMO’s to no more than 10% across the Parish

Proposed by Councillor Mrs R L McSorley and seconded by Councillor J Langan Councillor Dr J Garrett requested that it be recorded that she abstained from the vote.

It was further RESOLVED that Round Ring and Packsaddle are incorporated in to the Neighbourhood Development as areas allocated for development

22. CORRESPONDENCE

The Town Clerk reported; • Cornwallalc – are considering holding chairmanship training and were looking for an expression of interest, of how many members may wish to attend. • Cornwallalc are holding Code of Conduct training, which members are reminded they are supposed to complete within six months of taking office • Coast Medic – Defibrillator at Exchequer Quay, following a complaint to the Town Council from a resident requesting the code for the defibrillator is lodged with South Western Ambulance Service. Coast Medic responded to confirm the callsign for the box is CC0156 and the box has been registered with the Ambulance Service. The defibrillator was originally funded by the Lions Club and is maintained by Coast Medic. • Falmouth Town Council – Governance review, Falmouth Town Council have confirmed that their response to the review which affects Penryn is “a rationalisation of the current dog-leg boundary, pushing the northern town boundary (current Trescobeas Ward) north to encompass two fields at Hillhead and making the A39 road the town boundary between Falmouth and Penryn. The Town Clerk confirmed this would mean the loss of the land at the former ‘Dales’ site, and the bottom field of the diocese land. Also, if the boundary goes to the waterfront, the Marina will become part of Falmouth. The Governance Review will be added to the July Council agenda to enable a response to made to , by the deadline of 17 July 2019.

23. MAYOR’S ANNOUNCEMENTS AND ENGAGEMENTS

The list of Mayor’s engagements for the period 28 March 2019 to 2 June 2019 were noted.

24. REPRESENTATIONS BY CORNWALL COUNCIL MEMBERS AND REPORTS BY COUNCILLORS ATTENDING EXTERNAL MEETINGS

Councillor J Symons reported; • Governance review – is not just open to Council’s to respond, the views of the public are also welcomed. • Climate Change – currently 113 parishes have confirmed their intentions to try to reduce carbon admissions. Some funds are being made available to insulate Council homes correctly. Cormac are also investigating the possibility of changing their motor vehicles to ones that are powered by electric.

Councillor Mrs M K May reported; • That alcohol licences have been applied for from two companies based on Commercial Road • Traffic Regulation Orders – the consultation for additional waiting restrictions at Trevance, Trekeen Road, Trewarton Road and Brown’s Hill is open for comment. • Train Timetables – from the Autumn due to additional trains being timetabled, a journey to London should reduce by 10 minutes.

Councillor Mrs R L McSorley took part in the Twinning visit to Audierne in France, and had her recent wedding blessed in their Town Hall, by the Mayor of Audierne.

Councillor Dr J Garrett attended the University Forum meeting and was glad to report the student warden scheme that was trialled in Falmouth would be extended to include Penryn in the next academic year. Councillor Mrs M K May thanked Councillors, staff and their family members for taking part in the raft race, and was glad to report that the Town Council had achieved first place. Thanks, were also expressed to Penryn Community Bingo who donated the prize money.

25. TOWN CLERK’S REPORT

27. INTERNAL AUDIT REPORT

The Town Clerk reported, that one recommendation had been raised by the internal auditor during his visit on 1 May 2019, regarding allowances to members. The Mayoral Allowance is currently paid by the submission of invoices/receipts and charged against the budget. The allowance now needs to be paid through the payroll. A report on how to proceed will be submitted at the July Council meeting.

It was RESOLVED that; a) the internal audit report for year ended 31 March 2019 be noted b) the internal audit action plan be approved

RESOLVED that, in accordance with S137 of the Local Government Act 1972 Carnon Carers be awarded a grant of £200.

Penryn Methodist Church and Sandra Tregidgo The Town Clerk reported that the grant requests from Penryn Methodist Church and Sandra Tregidgo, were against the Council’s grant policy and legislation.

RESOLVED that the Council accepts the advice of the Town Clerk and regrettably declines any grant funding for Penryn Methodist Church and Sandra Tregidgo.

RESOLVED that the Town Council has no objections to the application subject to the concerns of the Historical Environmental Planning (Archaeology) issues be taken into account and that the Tree Protection Plan be conditioned.

RESOLVED that the Town Council has no objections to the application subject to the satisfaction of the Highways Department in regard to the footpath being provided along Annear Road and is tied in with Kernick Road and that the recommendations by the Tree Officer and ecology report are carried out.

RESOLVED that the Town Council fully supports the application.

PA19/04032 – Sterling Court, Truro Hill, Penryn

RESOLVED that the Town Council has no objections to the application subject to the planning department being satisfied that there is adequate amenity space to service the apartments.

Penryn Town Council would also like to know why there is no affordable housing contribution on the permitted development for the 14 units and CIL on the proposed five units.

In conjunction with the forthcoming adoption of our Neighbourhood Plan and the declaration of the climate emergency, Penryn Town Council’s aim is to encourage wherever possible the installation of renewable energy solutions to conserve our environment by providing an environmentally friendly, reliable, cost effective and sustainable source of power. Penryn Town Council would also encourage electric car charging points on site.

The Town Council requested that the above paragraph be added to all new planning applications.

WAITING RESTRICTIONS CONSULTATION (EDG1622) After a lengthy discussion regarding the proposed installation of waiting restrictions on Trekeen Road, Trevance, Trewarton Road and Brown’s Hill it was RESOLVED that the Town Council would abstain from commenting on the consultation as it was for the residents of the proposed sites to make their own representations.

8. PART-TIME CARETAKER

RESOLVED that delegated authority be given to the Town Clerk in conjunction with the Chairman and Vice-Chairman to; a) Liaise with Ellis Whittam regarding the correct procedure for long-term sickness b) Agency/short-term staff are considered to cover the annual leave of the full- time caretaker c) A discussion takes place with the part-time caretaker regarding his return to work after attending the appointment scheduled with the consultant in late August

9. PART-TIME SUPPORT OFFICER – MATERNITY LEAVE

The dates for the period of maternity leave for the part-time support officer were noted

10. STAFF CLOTHING

RESOLVED that the Town Clerk discusses with the staff their clothing requirements and purchases the additional uniform accordingly.

11. TRAINING

RESOLVED that; a) If spaces are still available, the Town Clerk, Administration Officer and Councillor J Langan are booked on the Planning training scheduled for Tuesday 16 July at a cost of £80 per delegate. b) The full-time support officer receives in-house training from the Finance Officer on the accounts package. c) Volunteers and staff receive training in areas highlighted by the recent Health and Safety visit from Jim Stowe of Ellis Whittam d) The Town Clerk enrols staff on any additional courses as required, subject to budgetary constraints

It was further RESOLVED that; a) the Town Clerk uses a day per week, when she will be unavailable to be contacted by the public or Councillors to enable the CiLCA coursework to be completed. b) The Town Clerk starts to clawback the T.O.I.L. hours accrued

12. OFFICE WORKING CONDITIONS

RESOLVED TO RECOMMEND TO COUNCIL that an additional air-conditioning unit is installed in the Town Clerk’s Office, by the contractor who installed the unit in the Finance Office at a cost of £1,525 +vat a further £100 (approximately) will be required for an electrician to install a spur.

It was further RESOLVED that; a) Display Screen Workstation Assessments are carried out as soon as possible b) Town Clerk reminds staff who work on computer about having regular eye tests, and that the Council pays for the test c) Risk Assessments are drawn up as soon as possible, as per the discussions with Jim Stowe of Ellis Whittam d) Fire Alarm tests are carried out as soon as possible and recorded e) Asbestos – if asbestos surveys cannot be found for the Council’s buildings, quotations are sourced for the works

13. EMPLOYEE HANDBOOK – DRAFT CONTRACTS

RESOLVED that; a) As per the Green Book the Council will pay enhanced maternity pay and enhanced adoption pay b) The draft contracts of employment are amended to show the library address as the main place of work. c) The Town Clerk contacts Ellis Whittam with the proposed changes and the handbook is presented to Council for adoption

Julie is now unable to attend. • Amie to email Mark Killingback thanking him for his support in the Raft Race evening but also mentioning the disappointment of the moored yacht which restricted access for the racers and the view for the spectators. • Thanks, be recorded to Julie and the Penryn Community Bingo for sponsoring the Raft Race.

3. PENRYN WEEK 2019 • The Craft morning event on Facebook had an error in the time – Amie to rectify • There should be some small trophies in the library if Darren wants to use them for the Lego club • Chairs and PA system need to be arranged for the RNLI evening. Mark Snowdon to possibly transit chairs? • Tins and buckets need to be ready for RNLI evening and Carnival night • Hymn sheet the same as last year to be used – Amie to email the Hymn sheet to the band and ask how many chairs they require • Amie to email Chaz the Hymn sheet • Mary May will contact Father Froom regarding the evening • Rose Webber to be contacted to see if Chapel can be used in case of bad weather • Co-op Funeral Care kindly offered to do teas at Tea Dance – Mary to kindly decline the offers as we already have our own volunteers • Co-Act performance unlock at 6.30pm – chairs to be put out • Larry/Darren to be asked about prizes for FIFA night • Amie to email Shelley for the tug-of-war rope for Sports Evening • Committee decided on no bouncy castle this year for Sports Evening due to increased cost to hire • Megaphone to be checked its working prior to Sports evening

4. GIG@GLASNEY • Amie to chase the permission to use the field for Penryn Week • Dave will monitor the cars in and out of the field on Gig evening – no cars allowed to drive over the new tiles • Gordon’s Alive have now again confirmed attendance despite double booking • John Ormond will provide marquee with refreshments • Portable toilets and generator booked

5. Autumn Festival • WI all set for the Craft Show • Afternoon with the Mayor’s to go ahead on Sunday 29th September –

3.00pm start – hall open at 2.30pm.

6. CHRISTMAS LIGHTS WEEKEND This will be discussed at the next meeting.

3. Minutes The minutes of the meeting of the Neighbourhood Plan Steering Group held on the 7 May 2019 were approved as a true and accurate record.

4. Correspondence RH stated that she had received an email from Councillor M Cant in which he wanted the following items considered in regard to the NHP.

1. Narrow footpaths at the pinch point around the Town Hall

2. Frequent double decker buses thundering through a 1 19 historic town centre that is not built to cope with these vehicles.

3. The need to provide a direct route from Commercial Road Car park to the Town Centre.

4. Whether the Steering Group have had discussions of partial pedestrianisation for Penryn.

After a lengthy discussion in regard to these issues it was proposed that an ‘aspirational and/or creative solutions’ section be added to the draft plan which would include such issues as listed above.

5. For Discussion: Site assessment – (Councillor John Symons left the room)

TGW reported to the meeting that after presenting to the Town Council on the 3 June 2019 it was resolved that the two sites of Round Ring and Packsaddle be included in the plan. TGW added that he has now updated the draft plan in this regard and is not ready for possible Strategic Environmental Assessment (SEA) to be scoped out with possibly free technical support from Locality. This work could be run in parallel.

Various discussions then ensued on how to assess the sites and it was proposed to combine the process of:

a) obtaining the SEA assessment and free technical support but also;

b) to liaise with the land owners of the two sites for their individual knowledge and how they would address any issues with their site.

TGW and LB will meet as soon as possible to begin the TGW/LB application process for the free technical support

Councillor John Symons returned to the room.

Approach to Consultation – TGW explained that he will TGW investigate how other plans have approached this in the past and report back to the next meeting.

The meeting agreed to:

• Add to agenda of next meeting how to consult with

neighbours of the two sites and land owners

• Raise awareness of where we are now with the

plan during Penryn Week 2 20 • Consider producing an initial easy document that can include various links and also be colour coded to the draft plan, showing the themes throughout the plan • RMcS and JG to discuss with Michael Hewitt what to produce for any flyers/leaflets for Penryn Week • TW suggested a ‘consultation bus’ and will investigate • All to think about the process and how we consult with the town and bring back to the next meeting

Drafting and Design of the document – TGW explained to the meeting that Mike Hewitt has been appointed to proof read and style the plan and that any celebratory or aspirational work is best completed by other members of the group.

After various discussions around the table RMcS proposed:

• that a frontice piece be included in the plan in relation to the vision and how we celebrate Penryn and also include our ongoing aspirations • an evidence base of local documents relative to the plan also be included and added to the website • a working group will be set up consisting of TW, JG and MM to ascertain the vision and report back to the meeting • local services to be added as an appendix

6. Finance Update LB reported that following a recent payment the budget currently stands at £9,099.24

7. Next steps • working group of the celebratory sections of the plan to meet • meet after the planning committee meeting on the 17 June to discuss the way forward with regard to the consultation, especially in regard to Penryn Week • TGW and LB to commence the bid to AECOM for technical support

1. Background

The Town Clerk’s report is a regular update on progress with Council decisions and projects and the work of the Council staff.

2. Discussion

Ellis Whittam – Health & Safety Jim Stowe of Ellis Whittam visited the Council on Monday 17 June to carry out the annual health & safety review, as part of the contract a Health and Safety Handbook and a Policy book will be produced.

Various items requiring action were discussed during the visit and will be available on Penryn Town Council’s section of the Ellis Whittam Portal.

Staffing Levels The part-time Support Officer will be commencing her maternity leave on Monday 29 July, with an expected return to work date in late April 2020

Training A planning course is scheduled for Tuesday 16 July, the course is currently oversubscribed and I am awaiting confirmation if we have been allocated any spaces.

Mayor’s Expenses

1. Background

The town council currently has a budget of £2750 for Mayor’s Expenses and £500 for Deputy Mayor’s Expenses.

2. Discussion

Following the last Internal Audit report on 1 May 2019 for the year ending 31 March 2019 it was a recommendation/action that allowances to members be paid through the payroll rather than expenses that are reimbursed.

3. Recommendation

As per the auditors recommendation the Mayor’s allowance should be paid through the payroll. This could be paid on a monthly basis in line with current council staff.

The Mayor will then be subject to the standard income tax rates and could be taxed up to 20% on the member’s allowance. It would therefore be a recommendation that the Mayor’s Allowance budget be increased by 20% in line with tax rates to ensure the Mayor isn’t out of pocket.

It should be noted that the Mayor Making ceremony and a Mayor’s ball or similar event are paid through the Mayor’s allowance currently. It could be a consideration that the Mayor making ceremony be set-up as a new budget line and the Mayor’s Allowance decreased by the same amount. The cost of the Mayor making ceremony last year was £350 and stands at £450 year to date. As the ceremony takes place early in the year financial year by creating a budget and decreasing the Mayor’s allowance the costs do not have to be paid out of the Mayor’s ‘salary’.

Possible options could be:

Mayor Making Budget - £500 Mayor’s Allowance reduced to £2250 (+ 20% uplift = £2700) Mayor Making Budget - £450 Mayor’s Allowance reduced to £2300 (+ 20% uplift = £2760) Mayor Making Budget - £0 Mayor’s Allowance increased by 20% to £3300

The Mayor will no longer be required to provide receipts, the allowance is paid as a ‘salary’ and can be spent as he/she sees fit.

Community Governance Review 2019

1. Background

Cornwall Council is currently undertaking a Community Governance Review for Cornwall, the review enables the following changes to be made, however requests for changes should be supported by clear evidence of an improvement or benefit.

Items that can be changed within a Community Governance Review are: • Parish areas – i.e. change of parish boundary, amalgamation of parishes, creation of new parishes out of existing parish or parishes • Number of Councillors – the number of Councillors representing the parish can be changed, along with warding arrangements • Parish name – the name of the Parish can be changed to reflect the area the parish may cover

2. Discussion

At the Council meeting held on 7 January 2019, the Town Council RESOLVED • YES – a governance review is required for the Parish • Issues requesting review – Parish boundary, Councillor numbers and Parish warding arrangements • Other issues – The Campus is called ‘Penryn Campus’ but is located within Mabe – should the campus not be in Penryn Parish?

Parish Boundary As reported at the Council meeting held on 3 June 2019, Falmouth Town Council confirmed that their response to the review that affects Penry Parish is “a rationalisation of the current dog-leg boundary, pushing the northern town boundary (current Trescobeas Ward) north to encompass two fields at Hillhead and making the A39 road the town boundary between Falmouth and Penryn”

A meeting is scheduled with Budock Parish Council on 27 June to discuss their response to the Governance Review.

A convenient date to meet with Mabe Parish Council is being discussed.

Councillor Numbers and Warding Penryn Town Council has sixteen Councillors, there is no set number for the maximum number of Councillors a Parish can have, but it cannot have less than five (Local Government Act 1972, Section 16, Paragraph 1). When deciding on the number of Councillors required, it would be prudent to consider: • Councillor Attendance • Contested (normal) Elections • Vacancies filled by co-option

• Number of electors – per Councillor • Projected number of electors • Precept • Number of Committees/Working Groups

Permarin Car Park – Temporary Access

1. Background

A request has been made by the developers of the property formerly known as Brigantine, to have access over Permarin Car Park for the duration of the build

2. Discussion

As the lessee of Permarin Car Park from Cornwall Council, we have been approached by Cornwall Council regarding a request for temporary access over the car park.

To enable the works to be completed at Brigantine we have been in discussions with Dan Thairs, to try to arrange a formal agreement with the proposed developer.

In conjunction with Cornwall Council, we requested the supply of the following information by the 14 June 2019.

1. Construction management plan for the build with predicted time scales. 2. Details of the insurance that will be put in place to indemnify Cornwall Council and Penryn Town Council against any claims for damage caused to their property or other users to the property. 3. Confirmation that no access by construction vehicles will be allowed during school dropping off periods this would mean no access till after 9:15am in the morning and no construction traffic from 2:30pm to 4:30pm. 4. Confirmation that any damage caused to the car park including any boundary walls, or any other council fixture will be repaired by yourselves at your cost. 5. Details on how you propose to restrict the size of construction vehicles to be suitable for accessing exiting the car park. 6. Confirmation that independent toilets and a water supply will be set up on site and that no construction workers will use the public toilets and details as to how you propose to manage this issue. 7. Confirmation that permanent bollards will be put in place to prevent vehicular access to the site at any time after the completion of construction. 8. Confirmation and details of the proposals that will be put in place to stop students using Permarin Car Park for Parking. 9. Confirmation as what measures will be put in place to inform students that the access is only via Lower Market Street.

No information was supplied by the proposed developer by the closing date.

Polling District & Polling Places Review – Stage 2

1. Background

Cornwall Council must conduct a polling district and polling places review every five-years the current review must be completed by the end of January 2020.

The first stage of the consultation has been completed comments are now requested for stage 2.

2. Discussion

Stage 2: 17 June to 29 July 2019 – consultation based on the current 122 electoral divisions and the new 87 electoral divisions which will take effect in May 2021

Penryn will fall into two electoral divisions (Cornwall Councillors): • Penryn • Mylor, Perranarworthal and Ponsanooth

Penryn Town Councillors will be split between two wards: • Penryn (15 Councillors) • Bissom (1 Councillors)

The new proposals state that the three polling stations within Penryn will remain and the electorate split as follows:

Council Projects

1. Background

The Town Council has a number of ongoing projects which have agreed budgets.

2. Discussion

Below is a update on the current position of the projects:-

Library Heating Project – The air conditioning unit has been fitted and is operational in the finance office. Quote received for an identical unit to be installed in the Town Clerk’s office. Some further investigative work is required to see if planning permission is required for the installation of skylight windows.

Display Cabinet – The bespoke cabinet has been installed in the library; some interior extras are needed to ensure all silver can be displayed correctly.

Painting Shute Meadow – Painting of the fence at Shute Meadow Car Park was scheduled to be completed by the part-time caretaker, however this has been delayed due to sick leave.

Town Hall Railings – Painting of the railings by the Town Hall was to be completed by the part-time caretaker however has been delayed due to sick leave.

Phone Box Painting – Painting of the phone box was to be completed by the part-time caretaker however this has been delayed due to sick leave.

Glasney field, BMX Track – Currently awaiting an update from Ian Richardson, who met with Councillor Mrs M K May and the Town Clerk, regarding linkage of green spaces before progressing.

Temperance Hall Exterior Decoration – Awaiting quotes.

Temperance Hall Interior Decoration – Full specification required for the necessary works, will then obtain quotes.

Broad Street Pavement Fund - £30,000 currently available in Ear-Marked Reserves.

Library Toilet Installation – Awaiting a visit from a surveyor/architect before deciding how to proceed.

Library Wall & Guttering – The freeholders & leaseholder of the building next to the library have informed us that they do not intend to contribute to the repair of the wall, although the wall meant to be jointly owned. We are currently investigating the access they have over our land via the gate which has been created in the wall and whether this makes them partly responsible. The guttering company will be visiting week commencing

24 June 2019 to advise on the repairs and if they can proceed given the current condition of the wall.

Commercial Road Enhancement – Budget of £2,000 available.

Penryn Commemorates Project – Booklets now completed, printed and in the process of being distributed. This project is now complete

Terms of Reference – Climate Emergency Working Group

1. Background

At the Annual meeting of the Council, the membership for the Climate Emergency Working Group was agreed, the nine elected members are Councillors Edwards, Garrett, H May, M K May, Mullins, Peters, Ruby, Wenmoth and Widdon. It was also resolved that the draft terms of reference would be presented to the Council at the July meeting.

2. Discussion

That the draft terms of reference for the climate emergency group be discussed, and the number of co-optative members agreed.

3. Recommendation

That the terms of reference be amended as required, and approved

Climate Emergency Working Group DRAFT Terms of Reference

Composition: Nine elected members (voting) Maximum of xx Co-optees from the Penryn Community appointed by the Working Party as deemed appropriate The nine elected members of the working group will be established at the annual meeting of the Council

Chairmanship: Chair and Vice Chair to be appointed at the first meeting following the annual meeting of the Council for the ensuing civic year. The Chairman and Vice Chairman must be members of the Council.

Public Participation: Meetings of the Working Group shall not be open to members of the press and public except by invitation

Meetings: The working group will meet at least four times per year, additional meetings can be scheduled by the Group as required. The meetings will be held at a time of day to be decided by the group. Meetings can be held in the Council Chamber subject to availability.

Quorum: Four members

Administration: The working party will be administered by the Finance Officer the Town Clerk will attend as and when required.

Scope of the Group: To research and make recommendations to Council to enable the Council to become more energy efficient and reduce its carbon footprint.

Reporting: The minutes of the meetings shall be presented to full council for noting, and approval of recommendations.

Co-opted Members: Appointment Co-opted members may be proposed by any member of the Committee, and will be appointed by a majority vote, with the Chairman having an additional casting vote in the event of a tie.

Removal A Co-opted Member may be removed from the group if a majority of Committee members are satisfied the member: • Fails to comply with the terms of reference • Conducts in a manner considered to be injurious of prejudicial to the character or interests of the committee.

67 The resolution to remove a committee member shall be determined by a majority vote of members present. In the event of a tie the Chairman shall have an additional casting vote. If a member removed from office by the committee believes their removal to be unfair, the removed Member may appeal to the full council. If an appeal is held, the Council’s decision will be final

Budgetary: The Group has no authority to approve any expenditure, all expenditure must be approved by full council.

How Councillors are Addressed

1. Background

The Town Council currently addresses female Councillors using their marital status, e.g. Councillor Mrs A N Other.

2. Discussion

Addressing female councillors using their marital status is becoming more outdated, with the majority of Council’s now opting to use Councillor and the surname.

Where two councillors have the same surname the initial(s) of their first name are used.

3. Recommendation

That the Council ceases using the marital status of female councillors and addresses all councillors, by the title Councillor followed by the surname.
