LEGITIMATION AND SANCTIFICATION OF THE CONCEPT OF "PEACEFUL COEXISTENCE" 1 The concept of "Peaceful Coexistence," the bate noire of some Western political leaders and their jurists in the early 1960's, figures prominently in the texts of the two recent great political accommodations that are now being widely heralded as marking the final ending of the Cold War, namely the Chinese-U.S. Joint Communiqu6 of February 27, 1972, and the Joint U.S.-Soviet Declaration of May 29, 1972. "Peaceful Coexistence" was ad- vanced by Soviet policy-makers and their jurists at the beginning of the 1960's as the leitmotiv of Soviet foreign policy in the then new,. Khrushchev era of political power in the Soviet Union that had emerged after the immediate, post-Stalin succession struggles. This particular Soviet campaign was, however, viewed by Western policy-makers, at first, with reserve and suspicion, perhaps in part because of the zealousness with which Soviet policy-makers, in their own politically understandable desire to demonstrate their own revolutionary continuity and faithful adherence to Marxist ortho- doxy, dropped retrospective historical footnotes and established that "Peaceful Coexistence" had been originally devised by Lenin himself and that it had always been the guiding principle of Soviet conduct towards the outside World. Sorensen, et al. eds. 1969). 19721 MOSCOW SUMMIT carrying out of traditional Cold War objectives under somewhat more sophisticated, or at least externally more reassuring, slogans than heretofore. On this view, which was generally held by Western leaders at the opening of the Khrushchev campaign in be- half of "Peaceful Coexistence," that concept itself was a Trojan Horse device for lulling the West into a false sense of security while the Soviet Union prepared, sub rosa, (to borrow one of Premier Khrushchev's colorful phrases) to "bury the West." With all the advantages of historical hindsight, these particular Western at- titudes seem, now, to have been too absolute or at least overstated, having resulted in part from bad Western fact-finding in relation to basic political changes within the Soviet Union. Such Western attitudes represented a continuance, therefore, into the early 1960's and into the then new, post-Stalin era of political flux and transi- tion, of old Western attitudes and policies born of the earlier Cold War rigidities. Western policy-makers failed clearly to grasp the emerging new imperatives of Soviet policy-making, in the post- Stalin era: the Soviet Union's need for at least partial relief from the crushing burden of competitive (Soviet versus United States) armament costs, so as to allow for some diversion of Soviet produc- tion and planning energies to the satisfaction of internal economic needs and also the demands of the Soviet Union's own rising new bourgeois class; and the Soviet Union's need for at least partial political accommodation or ddtente with the West, especially in Western Europe, so as to allow for some diversion of Soviet mili- tary strength and planning to meet potential Chinese "revisionist" claims along the Soviet Union's Asian frontiers, following on the, then still secret, Russian break with China in 1959 over the Chinese demand for nuclear armaments, and on the rapidly ensuing Soviet- Chinese ideological conflict. Like most new Soviet policies, "Peaceful Coexistence" had, at the outset and in the period of its first political testing, a Janus- like quality - looking forward and looking back at the same time: forward, if, on balance, the results yielded by it should seem to vali- date it in action; backward, in case of political rebuff, to enable a speedy retreat by its Soviet sponsors to the convenient safety of conventional Marxist political orthodoxy. This ambivalence in basic Soviet governmental attitudes as to "Peaceful Coexistence" was paralleled by the political fate of various Soviet foreign policy initiatives in the early Coexistence era. As an example, the initial Soviet nuclear missile investment in Cuba, an operation that was clandestine and hostile (in Soviet-U.S. bipolar terms) in the best of the old, Cold War traditions, was followed up immediately by INDIANA LAW REVIEW [Vol. 6: 202 the Kennedy-Khrushchev ddente of October 1962, when a Soviet- U.S. highly pragmatic accommodation was achieved on a basis of mutual give-and-take and reciprocal self-interest. Again, Premier Khrushchev's New Year's Eve message (of December 31, 1963) on the security of territorial frontiers was misconstrued by Western leaders, at the time, as being designed primarily to legitmate the Soviet Union and its allies' de facto territorial acquisitions, after World War II, in Central Europe; whereas in fact, as we now know (and as the particular orientation and direction of the then current Soviet literary-scientific campaigns should have informed us) it was designed, rather, as a preventive legal measure to buttress ex- isting Soviet territorial interests in Central Asia and the Far East against mounting Chinese "irridentist" pretensions. Whatever the various political origins of "Peaceful Coexis- tence" may have been in the Kremlin political leaders' own think- ing, there is no doubt that, as a theoretical juridical concept, it was attractively and persuasively developed by its original legal spokesmen, particularly Dr. Gregory Tunkin, who was, at the time, the Principal Legal Adviser to the Soviet Foreign Ministry. On this particular Soviet scientific legal thesis, Coexistence, far from being an abnormal, and hence purely artificial, legal con- struct, no more than reflected the basic societal facts of the na- tional and international political communities. Here we have, of course, a legal truism that has been developed in depth by the members of the North American Pragmatist-Realist legal school. All law, on this view, is a process of reconciliation and accommoda- tion of conflicting social forces, through the balancing and ultimate maximization of the competing interests presented by those par- ticular forces. Further, it is not necessary, for the existence of an organized political community - the starting point of any legal system - that a total societal consensus should exist as to the basic values and even as to the basic procedures of that community, or that any one group or combination of groups should possess a complete monopoly of power. The mediaeval political community, from which analogies are sometimes drawn for the present-day World Community, was characterized, after all, by widespread dissent and dissonance within its territorial frontiers, with the King's writ and the Common Law often running no further than the reach of the King's armies. Yet the mediaeval political com- munity was for all practical purposes, a viable political com- munity in a difficult and dangerous age. The conclusion, for pur- poses of present-day International Law, was clear. Identity of outlook as to a priori principles - that is, as to ultimate ideological 1972] MOSCOW SUMMIT premises or goal values, and identity even as to methods and instru- ments for achieving those principles - was neither a prerequisite, nor even necessarily a desideratum, for the achievement and main- tenance of a viable system of World public order in a post-World War II era characterized by Soviet and Western political-military bipolarity and ideological debate in general.

I employ transcripts of diplomatic negotiations to investigate the ways that Soviet and American leaders used new personal relationships with their adversaries to achieve thei r foreign policy goals.     65 1 May 20,1988 CHECKLIST FOR THE MOSCOW SUMMIT,BRIEFING From May 29 to June 2,1988, Ronald Reagan will be in Moscow for his fourth meeting with Soviet General Secretary Mikhail Gorbachev. The first meeting, in Geneva in 1985, restored United States-Soviet summit dialogue after a six-year hiatus caused by the Soviet invasion of Afghanistan and the terminal illness of three Soviet leaders. Reagan and Gorbachev met again in Reykjavik in 1986. That meeting broke down over Soviet insistence that the U.S. abandon its Strategic Defense Initiative. The third summit; .atwhichathe Intermediate-Range Nuclear Forces (INF) Treaty was signed, was held in Washington last December. With this fourth Reagan-Gorbachev summit, Reagan will have met the Soviet leader more times than any American President has met any other Soviet leader. In an important sense, therefore, this summit is almost routine. Dramatic agreements should not be expected, nor are they desirable. In keeping with this the Moscow summit should be deliberately low-key. Reagan should downplay arms control issues, except to insist on full Soviet compliance with the INF Treaty and to insist that any strategic arms agreement must include provisions for strategic defense deployment. Items of U.S. Concern. Reagan should emphasize agenda items reflecting U.S. concern over Soviet expansionism abroad and human rights abuses at home. He forcefully should express U.S. opposition to Soviet support for wars that anti-democratic and anti-Western regimes wage against their own peoples. He should tell Gorbachev that the U.S. expects Moscow to end all involvement in Afghanistan; stop its military aid to Nicaragua and pull Soviet-bloc advisors out of that country; support internationally supervised elections in Mozambique and Angola, along with a withdrawal of Soviet and Cuban troops from the latter country; refrain from encouraging the Philippine communist rebels; and end genocide being committed in Ethiopia by the Soviet client regime of the dictator Mengistu Haile Maria.

    About the Results of the Moscow Summit and Their Impact on U.S. Foreign Policy and Soviet-American Relations. As experience shows, final results of such events as the Soviet-American summits become apparent over more or less extended period of time. So far, we can only talk about preliminary results. Among them, the following are the most significant. First of all, the summit brought substantial political and diplomatic results. It is important that we did not allow any breaks in the process of dialog, even though it was possible and even probably due to the U.S. political calendar (the electoral campaign, the situation in which the outgoing administration now finds itself—according to the American political terminology—the state of “lame duck”). Thanks to the summit, the year 1988 did not fall out of the process of normalization of Soviet-American relations; to the contrary, it already became an important marker in their development, which help ensure the continuity: both most likely presidential candidates are simply forced by the logic of events itself to speak positively about Soviet-American relations, about disarmament and other important issues, which were on the agenda. Thus it is as if they are “taking the baton” from Reagan. Furthermore, the preparation for the summit, the summit itself, and the subsequent realization of those agreements, which were achieved or outlined there, do not just cement the constructive changes in Soviet-American relations, but also give them a new impulse for further development in all the spheres— disarmament, resolution of regional problems, and improvement of bilateral relations.

Madman 2 Abstract In a geopolitical context, the means of establishing deterrence is premised on the military capability of a country and the perceived willingness of a leader to use force as a means to achieve policy goals. A key function of rhetoric is to establish the personal ethos of a leader regarding their willingness to use force. During the Cold War the rhetorical context of geopolitical discourse was premised on a rational choice model of decision-making based on a strategic calculation of the relative strength of each country. This paper argues that rhetorical strategies need to change relative to the strategic situation facing each leader. Further, the rhetorical burden of building and maintaining strategic credibility inversely increases relative to a country's military power. This paper explores Richard Nixon's innovative rhetorical strategy of cultivating irrationality and uncertainty as a means to maintain and enhance "deterrent credibility" during a period of national decline. Madman 3 Introduction Aristotle identified "ethos" or speaker credibility as a key component of successful rhetoric. One particular context of ethos can be referred to as "geopolitical credibility." Geopolitical credibility concerns the reputation of countries and leaders in relation to one another. In this context, credibility can be defined as a form of power and deterrence.

Edelman President Ronald Reagan is known as the “Great Communicator,” a soubriquet that was awarded to him by New York Times columnist Russell Baker, and which stuck despite Reagan’s disclaimer in his farewell address that he “wasn’t a great communicator” but that he had “communicated great things.” The ideas which animated Reagan’s vision were given voice in a series of extraordinary speeches, many of them justly renowned. Among them are his “Time for Choosing” speech in 1964, his “Shining City on a Hill” speech to CPAC in 1974, his spontaneous remarks at the conclusion of the Republican National Convention in 1976 and, of course, his memorable speeches as President of the United States. These include his “Evil Empire” speech to the National Association of Evangelicals, his remarks at Westminster in 1982, his elegiac comments commemorating the 40th anniversary of the D-Day invasion and mourning the Challenger disaster, and his Berlin speech exhorting Mikhail Gorbachev to “Tear Down this Wall” in 1987, which Time Magazine suggested was one of the 10 greatest speeches of all time.2 Curiously, Reagan’s address to the students of Moscow State University during the 1988 Summit with Mikhail Gorbachev draws considerably less attention today despite the fact that even normally harsh Reagan critics hailed the speech at the time and have continued to cite it subsequently. The New York Times, for instance, described the speech as “Reagan’s finest oratorical hour” and Princeton’s liberal historian Sean Wilentz has called it “the symbolic high point of Reagan’s visit….

    1 THE CUBAN MISSILE CRISIS AND ITS EFFECT ON THE COURSE OF DÉTENTE 2 Abstract The Cold War between the United States and the Soviet Union began in 1945 with the end of World War II and the start of an international posturing for control of a war-torn Europe. However, the Cold War reached its peak during the events of the Cuban Missile Crisis, occurring on October 15-28, 1962, with the United States and the Soviet Union taking sides against each other in the interest of promoting their own national security. During this period, the Soviet Union attempted to address the issue of its own deficit of Intercontinental Ballistic Missiles compared to the United States by placing shorter-range nuclear missiles within Cuba, an allied Communist nation directly off the shores of the United States. This move allowed the Soviet Union to reach many of the United States’ largest population centers with nuclear weapons, placing both nations on a more equal footing in terms of security and status. The crisis was resolved through the imposition of a blockade by the United States, but the lasting threat of nuclear destruction remained. The daunting nature of this Crisis led to a period known as détente, which is a period of peace and increased negotiations between the United States and the Soviet Union in order to avoid future confrontations. Both nations prospered due to the increased cooperation that came about during this détente, though the United States’ and the Soviet Union’s rapidly changing leadership styles and the diverse personalities of both countries’ individual leaders led to fluctuations in the efficiency and extent of the adoption of détente.

    evelyn goh Nixon, Kissinger, and the “Soviet Card” in the U.S. Opening to China, 1971–1974* The dramatic reconciliation with the People’s Republic of China in 1972 stands as one of Richard Nixon’s greatest achievements as the thirty-seventh president of the United States. While previous administrations had attempted minor modifications of the policy of containment and isolation of China, Nixon managed to negotiate a top-level reconciliation that would lead to normaliza- tion of relations in 1979.1 This rapprochement ended more than twenty years of Sino-American hostility and represented the most significant strategic shift of the Cold War era. It was intimately connected to U.S. relations with its super- power rival and the Nixon administration’s general policy of détente. In the writings of Nixon and his national security adviser Henry Kissinger—the key primary accounts of the policy change until recently—the central logic of the U.S.-China rapprochement was “triangular relations.” Within the context of the Sino-Soviet split, this entailed the opening of relations between the United States and China, bringing China into the realm of great power relations as a third vital power separate from the Soviet Union.
