That event, and the President’s reaction to it, raised the disturbing possibility that for the first time in more than fifty years, white supremacy could be a matter of debate at the highest levels of American politics. This Foreword asks what legal scholarship has to contribute in times like these. It also introduces a partial answer: a group of student and faculty pieces analyzing some of the many difficult legal questions the rally raised. * * * T’S hard to know where to begin the story that culminated in the Imurder of Heather Heyer and the injury to our body politic. It could start in the early twentieth century, when black service in WWI and the rhetoric of that war gave black Americans new hope and inspired them to new militancy in demanding eQual citizenship.1 These hopes, short-lived, were “smashed” by a “reaction of violence that was probably unprecedented.”2 The last six months of 1919 saw twenty-five race riots in American cities, north and south, in which “mobs took over cities for days at a time, flogging, burning, shooting, and torturing at will.”3 It was also in 1919, that Paul Goodloe McIntire, a one-time UVA attendee and a great university benefactor, dedicated the first of the four bronze statues he had * Associate Professor of Law, University of Virginia School of Law.

It was another year of progress and noteworthy achievement, and we are delighted to share some of the highlights with you. In April, we celebrated the accomplishments of our 35th graduating class of Jefferson Scholars. In the class were a Schwarzman Scholar, a Fulbright Scholar, the Edgar Shannon Outstanding Engineering Student, the Ernest H. Ern Outstanding TIMOTHY J. INGRASSIA Chairman Student, and the Algernon Sydney Sullivan Award winner. The class also included the managing editor of The Cavalier Daily, a Gray-Carrington Scholarship recipient, two vice-chairs of the Judiciary Committee, and the chair of the University Guide Service, along with the president of the Raven Society and a quadruple All-American national champion in Mock Trial. Eight members of the class lived on the Lawn, and the group graduated with a cumulative GPA of 3.77. We also celebrated a very impressive accomplishment of a Scholar alumnus, who graduated in 2018 and became the eighth member of the Jefferson Scholars community to win a Marshall Scholarship. The Scholars returning to Grounds in the fall of 2019 are well positioned to continue the legacy of excellence established by the more than 900 alumni of the Foundation.

  • On Firsts, Feminism, and the Future of the Legal Profession
    ON FIRSTS, FEMINISM, AND THE FUTURE OF THE LEGAL PROFESSION RISA L. GOLUBOFF† This is my inaugural attempt to write about women in the legal profession and my own experiences as a woman in that profession. I must confess that I find the endeavor somewhat uncomfortable. I have spent most of my scholarly career researching and writing about a thirty-year period in American constitutional and civil rights history. I like to know a lot before I write a little. Moreover, I have spent my career writing histories not my own. My goal has always been to amplify the voices of those whose stories and claims have been hard to hear. Now, lately, and I imagine into the future, I find myself asked to share my own story and that of others like me—women with status, resources, and education that give them ample opportunity to speak for themselves. As I thought about how to write on this new and uncomfortable topic, I realized that two guiding principles that have defined my scholarship in constitutional history apply here too. Both flow from the foundational premise that the most visible markers of constitutional change—Supreme Court cases, constitutional amendments—are better understood as moments of punctuation in longer stories than as changes themselves. The first lesson that flows from that premise is that change is a process, not a point in time. The shift from past to present is rarely instant or binary. The second and related lesson is that change is not made by a single person, institution, or set of elite actors.
