Caramello Alvarez, Philip Torbøl, Alessandro Di Mario, Inês Mendes ANTITRUST AND COMPETITION German Court asks ECJ About Review of Rail Station Fees The Berlin Higher Regional Court has lodged a request for a preliminary ruling with the European Court of Justice (ECJ) concerning railway station fees charged by Deutsche Bahn's DB Station & Service. DB Station & Service was sued by a rail transport company for reimbursement of excessive fees between November 2006 and December 2010. The regional court backed the claim, concluding that the DB subsidiary is obliged to reimburse these amounts. On 30 December, the Berlin Higher Regional Court referred two questions to the ECJ, asking whether it is compatible with Directive 2001/14/EC concerning railway infrastructure charges for national courts to review fees based on antitrust rules independently of the monitoring carried out by the regulatory body and, if so, whether civil courts are allowed to conduct an antitrust review even when railway undertakings can ask the regulatory body to review the fairness of the price. Lastly, the court asked whether civil courts must wait for the decision of the regulatory body, or if it is contested before court, for that decision to become final. Czech Agency Fines Firm for High-speed Railway Tender Manipulation The Czech Office for Protection of Competition has fined Sudop Praha €360,000 for entering into an illegal bid- rigging agreement. It was found that between November 2014 and May 2015, Sudop and Výzkumný Ústav Železniční (VUZ) coordinated their bids for a tender for a technical operational study for high speed railway lines.

    Media release HOLD-BACK PERIOD none DOCUMENT 2 pages ENCLOSURES General rendering of a Stadler FLIRT Bussnang, 21 October 2020 Stadler to deliver the bestseller FLIRT to the Iberian Peninsula for the first time The state-owned railway company Comboios de Portugal (CP) and Stadler have signed a contract for the manufacture and delivery of 22 regional trains of the type FLIRT. The order value amounts to around 158 million euros. This is the first time that Stadler´s FLIRT train will be used for passenger service on the Iberian Peninsula. The Portuguese state-owned railway company Comboios de Portucal (CP) and Stadler have signed today the contract for the delivery of a total of 22 trains for the renewal of CP’s regional train fleet. The contract includes the manufacture and delivery of ten electric multiple untis (EMU) and twelve bimodal multiple units (BMU) of the FLIRT type. The total order value of 158 million euros includes not only the delivery of the vehicles, but also maintenance services for at least four years and training services. Stadler manufactures for the first time FLIRT for passenger service on the Iberian-gauge of 1668 millimetres. The twelve bimodal FLIRT (BMU) are equipped with an additional drive module, which includes the diesel- electric drive. This enables driving on non-electrified lines. Thanks to their modular design, a possible future refitting from bimodal to purely electric drive or the replacement of the diesel generators with batteries are simplified, depending on the railway operator’s needs. Furthermore, 95 per cent of the material used is recyclable.

EPF has engaged with CER and CIT on the subject of passengers’ rights for a number of years now. Although we don’t always agree, discussions have always been constructive. We do agree, for example, that there should be greater consistency in the way in which the national enforcement bodies throughout the EU exercise their responsibilities. We also both advocate greater use of alternative dispute resolution. We have just started It’s good to see in this report that operators have taken action to comply with the regulation and to see examples of what they are doing. However, much more needs to be done. Passengers rights’ provisions are only just starting to be implemented in many places and continuing efforts are needed. For example there should be greater effort to inform passengers of their rights, especially at stations.
