First question. Franchised Buses and MTR Fare Adjustment Mechanisms 1. MR TANG KA-PIU (in Cantonese): President, the Government introduced in 2006 and 2007 for franchised buses and MTR respectively the Fare Adjustment Mechanisms (collectively referred to as "FAMs"), which provided for both upward and downward adjustments of fares, and it emphasized the objectivity and transparency of such mechanisms. However, in nearly a decade's time since the implementation of FAMs, fares of both the franchised buses and MTR have only gone up but never gone down, regardless of the economic environment of Hong Kong and the movements in energy prices. Some members of the public have queried that such mechanisms have failed to fully reflect the actual economic conditions, resulting in a continuous increase in their travelling expenses. In this connection, will the Government inform this Council: LEGISLATIVE COUNCIL ─ 1 June 2016 10809 (1) of the aspects of FAMs on which reviews or studies have been conducted by the authorities since the implementation of FAMs; whether such aspects included the objectivity and fairness of the mechanisms, the extent to which the data used were time-lagged, and the impacts of the fare adjustments made under FAMs on inflation rates and the burden on the public; if so, of the specific outcome of such reviews and studies; (2) of the respective numbers of times, since the implementation of FAMs, in which franchised bus companies and the MTR Corporation Limited offered fare concessions under the mechanisms, the projected amount of money to be given back to the passengers each time, and the details of the concessions concerned (including the concessionary periods, the number of trips made by the passengers benefited from the concessions, and whether there were monies left in the projected amounts to be given back to the passengers); and (3) as some members of the public have pointed out that the fare adjustment formulae under the existing FAMs are incomprehensive (e.g. they fail to reflect accurately the movements in energy prices and the data used are time-lagged, resulting in the fare adjustments pushing up inflation rates and creating a vicious cycle, etc.), whether the authorities will comprehensively revise the fare adjustment formulae and invite academics and stakeholders to join hands to take part in the reviews, with a view to making FAMs fairer and more objective; if so, of the details; if not, the reasons for that? SECRETARY FOR TRANSPORT AND HOUSING (in Cantonese): President, it is the Government's policy that public transport services should be run by the private sector in accordance with commercial principles for greater cost-effectiveness while its fares should be fair to both passengers and operators (Fair Fare). At the same time, we encourage operators to offer fare concessions as far as possible having regard to their operating and financial conditions, the nature of service of individual routes, and the needs of passengers. At the time of the Rail Merger in 2007, upon deliberations at the Legislative Council and approval at the shareholders' meeting of the MTR Corporation Limited (MTRCL), the MTRCL lost the fare autonomy it hitherto enjoyed, and fares are to be adjusted by adjusting fares by a direct-drive formula. The arrangement has become more objective and transparent. 10810 LEGISLATIVE COUNCIL ─ 1 June 2016 As for franchised buses, the current Fare Adjustment Arrangement (FAA) has been in place since 2006. Under this arrangement, a fare adjustment application would be determined by the Executive Council after considering an assessment based on a basket of six factors. One of the six factors is a formula with components similar to those included in the formula for fare adjustment of the MTRCL. Both formulae take into account changes in Nominal Wage Index (Transportation Section) and the Composite Consumer Price Index (CCPI), as well as increase in productivity. For details of the two adjustment mechanisms, please see Annex 1. My reply to the various parts of Mr TANG Ka-piu's question is as follows: Review of the MTR Fare Adjustment Mechanism (FAM) takes place once every five years. The first review in 2013 introduced multiple measures to expand the scope of consideration of the mechanism to include the Corporation's profitability level and service performance, as well as public affordability; and comprehensively enhanced monthly passes and related concessions to reduce passengers' burden.

This paper intends to evaluate how political parties’ politics happened in Hong Kong’s recent history. The research was conducted through historical comparative analysis, with the context of Hong Kong during the sovereignty transition and the interim period of democratization being crucial. For the implementation of “one country, two systems”, political democratization was hindered and distinct political scenarios of Hong Kong’s transformation were made. The democratic forces had no alternative but to seek more radicalized politics, which caused a decisive fragmentation of the local political parties where the establishment camp was inevitable and the democratic blocs were split into many more small groups individually. It is harmful. It is not conducive to unity and for the common interests of the publics. This paper explores and evaluates the political history of Hong Kong and the ways in which the limited democratization hinders the progress of Hong Kong’s transformation. Keywords: election politics, historical comparative, ruling, democratization The democratizing element of the Hong Kong political system was bounded within the Legislative Council under the principle of the separation of powers of the three governing branches, Executive, Legislative, and Judicial. Popular elections for the Hong Kong legislature were introduced and implemented for 25 years (1991-2016) and there were eight terms of general elections for the Legislative Council.

This report covers the 2010-11 financial year. Commercial broadcaster, as a proprietary organization, is believed to emphasize on maximizing the profit while the public broadcaster, without commercial considerations, is usually expected to achieve some objectives or goals instead of making profits. Therefore, the contribution by public broadcaster to the society is usually expected to be different from those by commercial broadcaster. However, the public broadcasters are in crisis around the world because of their unclear role in actual practice. Many politicians claim that they cannot find any difference between the public broadcasters and the commercial broadcasters and thus they asserted to cut the budget of public broadcasters or even privatize all public broadcasters. Having this unstable situation of the public broadcasting, the role or performance of the public broadcasters in actual practice has drawn much attention from both policy-makers and scholars. Empirical studies are divergent on whether there is difference between public and commercial broadcaster in actual practice.

INTRODUCTION Transitional Hong Kong's endgame formally came to a close with the territory's reversion to Chinese rule on July 1, 1997. How- ever, a legal and institutional order and a "rule of law" for Chi- nese-ruled Hong Kong remain works in progress. They will surely bear the mark of the conflicts that dominated the final years pre- ceding Hong Kong's legal transition from British colony to Chinese Special Administrative Region ("S.A.R."). Those endgame conflicts reflected a struggle among adherents to rival conceptions of a rule of law and a set of laws and institutions that would be adequate and acceptable for Hong Kong. They unfolded in large part through battles over the attitudes and allegiance of "the Hong Kong people" and Hong Kong's business community. During the meeting with the Kwai Tsing DC, LegCo Members discussed and exchanged views with DC members on the requests for constructing lift and footbridge facilities in Kwai Tsing District; the proposal for the Housing Department to install dog latrines in all housing estates in Hong Kong; the concerns about the use of Besser blocks for surfacing pavements; tackling the problem of shortage of parking spaces; and the enhancement of the follow-up work by the Department of Health with regard to the Colorectal Cancer Screening Programme. We are making a stakeholder’s submission in our capacity as a political party of the pro-democracy camp in Hong Kong for the 2018 Universal Periodic Review on the People's Republic of China (PRC), and in particular, the Hong Kong Special Administrative Region (HKSAR). Currently, our party has five members elected to the Hong Kong Legislative Council, the unicameral legislature of HKSAR. 2. In the Universal Periodic Reviews of PRC in 2009 and 2013, not much attention was paid to the human rights, political, and social developments in the HKSAR, whilst some positive comments were reported on the HKSAR situation. i We wish to highlight that there have been substantial changes to the actual implementation of human rights in Hong Kong since the last reviews, which should be pinpointed for assessment in this Universal Periodic Review. In particular, as a pro-democracy political party with members in public office at the Legislative Council (LegCo), we wish to draw the Council’s attention to issues related to the political structure, election methods and operations, and the exercise of freedom and rights within and outside the Legislative Council in HKSAR. Most notably, recent incidents demonstrate that the PRC and HKSAR authorities have not addressed recommendations made by the Human Rights Committee in previous concluding observations in assessing the implementation of International Convention on Civil and Political Rights (ICCPR).
