Fohrman^ Senior Dairy Hushandman^^ Division of Dairy Cattle Breeding, Feedingj and Management^ Bureau of Dairy Industry WITH more than 26 million dairy cows spread over the entire United States, a survey of herds for superior germ plasm is a tremendous undertaking. How the survey which is the subject of this article was conducted among agricultural experiment stations and the owners of more than a thousand commercial herds is described in later pages. It is sufficient at this point to say that no similar project on so large a scale had previously been attempted in this country. Hitherto the genetic study of dairy cattle has been restricted for the most part to analysis of the hereditary make-up of the individual sire or dam. Some attempts have been made in studies in the Bureau of Dairy Industry, and more recently by the Holstein-Friesian Association, to show the inheritance for production being built in some herds through the use of a number of sires. To analyze all the sires used in herds during the entire period of record keeping, however, and to show the female lines of descent and their relationship to the various sires in a large number of herds, is pioneer work in the field of animal breeding. In the present state of genetic knowledge relating to livestock, many might call it premature to attempt a survey of progress in breeding superior germ plasm in dairy-cattle herds in which records of production have been kept over a period of years. -

VIETNAM VETERANS OF AMERICA Office of the National Chaplain FOUAD KHALIL AIDE -- Funeral service for Major Fouad Khalil Aide, United States Army (Retired), 78, will be Friday, November 13, 2009, at 7 p.m. at the K.L. Brown Funeral Home and Cremation Center Chapel with Larry Amerson, Ken Rollins, and Lt. Col. Don Hull officiating, with full military honors. The family will receive friends Friday evening from 6-7 p.m. at the funeral home. Major Aide died Friday, November 6, 2009, in Jacksonville Alabama. The cause of death was a heart attack. He is survived by his wife, Kathryn Aide, of Jacksonville; two daughters, Barbara Sifuentes, of Carrollton, Texas, and Linda D'Anzi, of Brighton, England; two sons, Lewis Aide, of Columbia, Maryland, and Daniel Aide, of Springfield, Virginia, and six grandchildren. Pallbearers will be military. Honorary pallbearers will be Ken Rollins, Matt Pepe, Lt. Col. Don Hull, Jim Hibbitts, Jim Allen, Dan Aide, Lewis Aide, VVA Chapter 502, and The Fraternal Order of Police Lodge. Fouad was commissioned from the University of Texas ROTC Program in 1953. He served as a Military Police Officer for his 20 years in the Army. He served three tours of duty in Vietnam, with one year as an Infantry Officer. He was recalled to active duty for service in Desert Shield/Desert Storm. He was attached to the FBI on their Terrorism Task Force because of his expertise in the various Arabic dialects and cultures. He was fluent in Arabic, Spanish and Vietnamese and had a good working knowledge of Italian, Portuguese and French. -

211 The America's Cup and the Law of Trusts: Mercury Bay Boating Club's 1988 K-Boat Challenge Peter Grainger German* The author examines the litigation surrounding the 27th America's Cup regatta. The author argues that the deed of gift did not permit a defence of the Cup with a catamaran, and that even if it did, the San Diego Yacht Club failed to satisfy its fiduciary obligation of acting in the utmost good faith towards the Mercury Bay Boating Club. Finally, the author argues that the deed of gift is more accurately described as a non- charitable purpose trust for factual beneficiaries. I INTRODUCTION On July 17 1987, Sir Michael Fay issued a letter of challenge for the America’s Cup to San Diego Yacht Club ("SDYC"; ”San Diego”). He could not then have foreseen that an air of ill-will and acrimony would so pervade the 27th America's Cup regatta as to demonstrate its fragility "...in the face of die amoral quest for betterment, the hunger to win at any cost, even at the cost of destroying the game."*1 The waters of San Diego Bay played host to two races for yachting's not-so-holy grail on September 7 and September 9 1988. SDYC's 60 foot catamaran Stars & Stripes defeated Mercury Bay Boating Club's 132.8 foot keeled monohull New Zealand2 in both races, making the scheduled third contest unnecessary.3 On the water at least, therefore, San Diego successfully defended the 27th America's Cup (the "Cup"). * This article was written as part of the LLB(Hons) programme. -

James Ashbury, a History
RACING SCHOONERS AND AMERICA’S CUP DREAMS. In 1851 this schooner sailed from New York to partake in yacht racing at Cowes. She was aptly named the “America”. She was not made to feel particularly welcome in the Solent, partly because she was syndicate owned, unheard of in Britain where racing yachts were owned by one person, preferably Royal, titled or definitely a “gentleman”, and partly because Americans were viewed with some suspicion at the time, and not considered as gentlemen. Subsequently the “America” was barred from entering most of the races. She was, however allowed to race around the Island for the 100 guinea Queen’s Cup which she won, beating the entire fleet of the cream of British racing yachts into the bargain. Yacht racing 1 rules were of a more casual nature in those days, and subsequently a tad ambiguous, so that the win did not go without a few comments about sportsmanship and a certain ill-feeling which set the tone for all subsequent races for this cup. Here is the cup she won, a rather brash, but valuable silver trophy by Garrards of London. This the syndicate took back to the New York Yacht Club, renamed it the “America’s Cup”, and by deed of gift offered it for international competition. Then nothing happened for the next nineteen years, partly due to civil war in the USA, and partly due to international indifference. Meanwhile in England a new face had burst upon the yachting scene in the late 1860s. This was James Lloyd Ashbury, the son of John Ashbury, a self- made man who had built up from a two man wheelwright shop the largest railway manufacturing business in the UK, producing rolling stock, iron bridges, turn-tables and other railway equipment in his factory at Openshaw in Manchester employing 2 over two thousand men. -
