ABOUT THE AUTHOR Louis Fisher is Specialist in Constitutional Law with the Law Library of the Library of Congress. The views expressed here are personal, not institutional. Earlier in his career at the Library of Congress, Fisher worked for the Congressional Research Service from 1970 to March 3, 2006. Hill practiced law in Washington with Orville Hickman Browning after the latter had been unseated in the Senate in 1863 by a Democratic Illinois General Assembly. Confidential Washington Oct 3d, 1864 Mr President; 2 It gives me great pleasure to state, that Mr Browning has been misrepresented as to his speech 3 4 in Quincy— “He merely said, that if Genl. Fremont or Genl McClellan were elected he would not commit suicide; but would endeavor to support the govt faithfully, as he had done under your 5 administration”. He has spoken always in favor of yr administration & reelection. 2 Orville H. Browning 3 At the end of May 1864 a convention primarily composed of Radical Republicans and German-Americans met at Cleveland and nominated General John C. Fremont for the presidency. Fremont withdrew from the campaign in September. 4 General George B. McClellan was the 1864 presidential nominee of the Democratic Party. 5 Republicans were eager to obtain Browning's endorsement, but his support for Lincoln's reelection was lukewarm at best. In an October 3, 1864 letter to William D. Henderson, Browning stated his desire to see the rebellion crushed, however he refused to endorse either Lincoln or McClellan. While Browning admired McClellan's patriotism, he could not support the platform of the party that had nominated him. This refusal to support the so-called “peace plank” of the Democratic platform was the closest Browning came to an endorsement of Lincoln. Browning's letter to Henderson was published in the newspapers and Republican wags spun it as an endorsement. -

••••••••••••TENNESSEE CONSTITUTIONAL HISTORY Settlement and 1796 Constitution • The area that became Tennessee was part of the 1663 land grant of North Carolina from Charles II. • In violation of the British Proclamation of 1763 prohibiting settlements west of the Appalachian Mountains, the Watauga settlement was founded in 1771. (T. R's "Great Leap Westward" He wrote that Robertson and Sevier were two of the three greatest leaders in the development west of the mountains, the third being George Rogers Clark) The Watauga Association adopted articles to govern their settlement in 1772—this was the first government west of the mountains. The last British Governor of Virginia, the Earl of Dunmore, wrote in 1774 that Watauga was "a dangerous example to the people of America of forming governments distinct from and independent of his majesty's authority." In 1775, Richard Henderson purchased a large area of Kentucky and Middle Tennessee from the Cherokees--20 million acres for 6 wagon loads of goods. The governments of Virginia and North Carolina refused to recognize it. It was Henderson who was behind the settlement of Nashville in 1779-80. James Robertson led most of the men and the livestock over land to the settlement. John Donelson led a flotilla by water, down the Tennessee River to the Ohio, up the Ohio to the Cumberland, and up the Cumberland to the settlement. The Cumberland Compact was signed in 1780. It provided for the government of the settlement. · After being ignored by North Carolina for many years, the eastern settlements attempt to form the state of Franklin in 1784. -

Episode 113: A Place Worse Than Hell Week of December 2 – 8, 1862 http://civilwar150.longwood.edu “If there is a worse place than hell,” Lincoln told a visitor in December 1862, “I am in it.” The fall state and congressional elections had not gone well. Radical Republicans, angered that the President had remained loyal to McClellan so long, failed to campaign wholeheartedly, leaving the field to the Democrats, who accused the administration of incompetence on the battlefield and of unconstitutional abuse of its power, both in curbing dissent and in daring to speak of freeing slaves. Asked for his reaction to all this bad news, Lincoln said he felt like the boy who stubbed his toe – he was too big to cry, and it hurt too much to laugh. “The fact is that the country is done for unless something is done at once…..” said Senator Zachariah Chandler. “The President is a weak man, too weak for the occasion, and those fool or traitor generals are wasting time and yet more precious blood in indecisive battles and delays.” Rumors circulated that Lincoln would resign in favor of Vice President Hannibal Hamlin, and that McClellan would somehow be recalled to Washington to assume dictatorial power. This attack on his leadership by men of his own party at such a critical time deeply distressed Lincoln: “We are now on the brink of destruction,” he told an aide. “It appears to me that the Almighty is against us.” Generally the public press supported the President. The Washington Chronicle saw “a perfect balance of thoroughly sound faculties, great calmness of temper, firmness of purpose, supreme moral principle and intense patriotism”. -

Kosar Analyst in American National Government Government and Finance Division Summary The veto power vested in the President by Article I, Section 7 of the Constitution has proven to be an effective tool for the chief executive in his dealings with Congress. Since the founding of the federal government in 1789, 35 of 43 Presidents have exercised their veto authority a total of 2,550 times. Congress has overridden these vetoes on 106 occasions (4.2%). Presidents have vetoed 80 appropriations bills, and Congress has overridden 12 (15.0%) of these vetoes. This report will be updated at the beginning of each new Congress. Constitutional Basis and Importance To become law, the U.S. Constitution (Article I, Section 7) provides that all bills that have been approved by both houses of Congress must be presented to the President for his approval and signature.1 The President may sign a bill into law within the 10-day period (excluding Sundays) provided in the Constitution,2 let it become law without his signature, or veto it. The Constitution states that, when the President vetoes a bill, “he shall return it, with his Objections to that House in which it shall have originated.” This type of action is called a “regular” or “return” veto. If, on the other hand, Congress has adjourned within the 10-day period after presentation of the bill to the President (thereby preventing the return of the bill to Congress), the President may simply withhold his signature, and the bill does not become law — a practice that has been dubbed a “pocket” veto.3 The President’s veto authority is among his most significant tools in legislative 1 These bills include joint resolutions, but do not include proposed amendments to the Constitution, which require a two-thirds vote in each house, and are sent directly to the states for approval. -

Stanton • Congress passes a law making it illegal for a President to fire a cabinet member without Congressional approval. • The Tenure of Office Act. • Johnson fires Stanton Tenure of Office Act - Tenure of Office Act, in U.S. history, measure passed on Mar. 2, 1867, by Congress over the veto of President Andrew Johnson; it forbade the President to remove any federal officeholder appointed by and with the advice and consent of the Senate without the further approval of the Senate. With this measure the radical Republicans in Congress hoped to assure the continuance in office of Secretary of War Edwin M. Stanton and thus prevent any interference with the military occupation of the South in their Reconstruction plan. In order to bring about a court test of the constitutionality of the act, Johnson dismissed Stanton, but the Supreme Court, intimidated by the radicals, refused to pass on the case. Gen. Ulysses S. Grant, whom Johnson appointed Secretary ad interim, turned the office back to Stanton when the Senate refused to approve his dismissal. -

Chapter Thirty-four “The Wisest Radical of All”: Reelection (September-November, 1864) The political tide began turning on August 29 when the Democratic national convention met in Chicago, where Peace Democrats were unwilling to remain in the background. Lincoln had accurately predicted that the delegates “must nominate a Peace Democrat on a war platform, or a War Democrat on a peace platform; and I personally can’t say that I care much which they do.”1 The convention took the latter course, nominating George McClellan for president and adopting a platform which declared the war “four years of failure” and demanded that “immediate efforts be made for a cessation of hostilities, with a view to an ultimate convention of the states, or other peaceable means, to the end that, at the earliest practicable moment, peace may be restored on the basis of the Federal Union of the States.” This “peace plank,” the handiwork of Clement L. Vallandigham, implicitly rejected Lincoln’s Niagara Manifesto; the Democrats would require only union as a condition for peace, whereas the Republicans insisted on union and emancipation. The platform also called for the restoration of “the rights of the States 1 Noah Brooks, Washington, D.C., in Lincoln’s Time, ed. As the nation waited day after day to see how McClellan would react, Lincoln wittily opined that Little Mac “must be intrenching.” More seriously, he added that the general “doesn’t know yet whether he will accept or decline. -

Thaddeus Stevens of Pennsylvania, President Andrew Johnson, and President Rutherford B. Hayes, elected in 1876. Reconstruction The Reconstruction era after the Civil War has been called "the bloody battleground of American historians1'-so fierce have been the scholarly arguments over the missed opportunities fol- lowing black emancipation, the readmission of Southern states to the Union, and other critical developments of the 1865-1877 period. The successes and failures of Reconstruction retain a special relevance to the civil rights issues of the present day. Here, three noted historians offer their interpretations: Armstead L. Robinson reviews the politics of Reconstruction; James L. Roark analyzes the postwar Southern plantation econ- omy; and James M. McPherson compares the first and second Reconstructions. THE POLITICS OF RECONSTRUCTION by Armstead L. Robinson The first Reconstruction was one of the most critical and turbulent episodes in the American experience. Few periods in the nation's history have produced greater controversy or left a greater legacy of unresolved social issues to afflict future gener- ations. The postwar period-from General Robert E. Lee's surren- der at Appomattox in April 1865 through President Rutherford B. Hayes's inauguration in March 1877-was marked by bitter partisan politics. Reconstruction (1865-1877) Robert E. Lee’s surrender to Ulysses S. Grant at Appomattox Courthouse in Virginia in 1865 brought an end to the Civil War, and the Reconstruction Era immediately followed. Reconstruction was the federal government’s plan to rebuild and re-establish the states of the former Confederacy. In short, Reconstruction was the period when the federal government tried to rebuild the South and restore the Union after the Civil War. The Civil War and Reconstruction resulted in Southern white resentment (irritation) toward both Northerners and Southern African-Americans. Reconstruction ultimately led to the political, economic, and social control of the South by whites. Unfortunately, the economic and political gains of former slaves were temporary. As a result of the North’s military victory, President Abraham Lincoln’s view that the United States was one nation indivisible had prevailed (won). Lincoln believed that since secession was illegal, Confederate governments in the Southern states were illegitimate (not legal governments) and the states had never really left the Union. As a result, Lincoln believed that Reconstruction in the Southern states was a matter of quickly restoring legitimate state governments that were loyal to the Union. Lincoln also believed that once the war was over, the federal government should not punish the South. Instead, it should reunify the nation as quickly as possible. Unit 7-Civil War and Reconstruction 1861-1876 Unit 7 Vocabulary • Sectionalism – Concern for regional needs and interests. • Secede – To withdraw, including the withdrawal of states from the Union. • Blockade – Blocking off an area to keep supplies from getting in or out. • Emancipation – The act of giving someone freedom • Reconstruction – The act of rebuilding; Generally refers to the rebuilding of the Union following the Civil War. • Martial Law – The imposition of laws by a military authority, general in defeated territories. • Sharecropper – A tenant farmer who receives a portion of the crop. • Popular Sovereignty – Independent power given to the people. • The Democrats were the dominant political party, and had Political very little competition from the Parties Whig party. -Texans would vote for southern democrats until the 1980’s! • Sam Houston, though he never joined the party, supported the Know-Nothing party which opposed immigration to the United States. Southerners saw the Republican party as a threat and talk of secession increased. (The act of a state withdrawing from the Union) Abolitionist movement • Beginning in the 1750s, there was a widespread movement after the American Revolution that believed slavery was a social evil and should eventually be abolished. • After 1830, a religious movement led by William Lloyd Garrison declared slavery to be a personal sin and demanded the owners repent immediately and start the process of emancipation. (Granting Freedom to slaves) An Abolitionist is someone who wanted to abolish slavery William Lloyd Garrison Slavery in the South • In 1793 with the invention of the cotton gin by Eli Whitney, the south saw an explosive growth in the cotton industry and this greatly increased demand for slave labor in the South.
