APPENDIX E.3 IDNR Roster of Navigable Waterways in Indiana Nonrule Policy Documents NATURAL RESOURCES COMMISSION Information Bulletin #3 July 1, 1992 SUBJECT: Roster of Indiana Waterways Declared Navigable I. NAVIGABILITY Property rights relative to Indiana waterways often are determined by whether the waterway is "navigable". Both common law and statutory law make distinctions founded upon whether a river, stream, embayment, or lake is navigable. A landmark decision in Indiana with respect to determining and applying navigability is State v. Kivett, 228 Ind. 629, 95 N.E.2d 148 (1950). The Indiana Supreme Court stated that the test for determining navigability is whether a waterway: was available and susceptible for navigation according to the general rules of river transportation at the time [1816] Indiana was admitted to the Union. It does not depend on whether it is now navigable. .The true test seems to be the capacity of the stream, rather than the manner or extent of use. And the mere fact that the presence of sandbars or driftwood or stone, or other objects, which at times render the stream unfit for transportation, does not destroy its actual capacity and susceptibility for that use. A modified standard for determining navigability applies to a body of water which is artificial. The test for a man-made reservoir, or a similar waterway which did not exist in 1816, is whether it is navigable in fact. Reed v. United States, 604 F. Supp. 1253 (1984). The court observed in Kivett that "whether the waters within the State under which the lands lie are navigable or non-navigable, is a federal" question and is "determined according to the law and usage recognized and applied in the federal courts, even though" the waterway may not be "capable of use for navigation in interstate or foreign commerce." Federal decisions applied to particular issues of navigability are useful precedents, regardless of whether the decisions originated in Indiana or another state. -

Within the famous fountain is the wistful figure of Lake Ontario. She sits apart from her sister lakes, gazing into the distance with arms outstretched. But what does she have to say for herself? Write a Monologue! Monologos means “speaking alone” in Greek, but we all know that people who speak without thinking about their listener can be very dull indeed. Your challenge is to find a ‘voice’ for your statue and to write an engaging monologue in 350 words. Get under your statue’s skin! Look closely and develop a sense of empathy with the sculpture and imagine how it would feel. How does Lake Ontario feel about her sister lakes? Invite your listener to feel with you: create shifts in tempo and emotion, use different tenses, figures of speech and anecdotes, sensory details and even sound effects. Finding your sculpture’s voice? Write in the first person and adopt the persona of your character: What kind of vocabulary will you use - your own or that of another era/dialect? Your words will be spoken so read them aloud: use their rhythm and your sentence structure to convey emotion and urgency. Read great monologues for inspiration, for example Hamlet’s Alas Poor Yorick, or watch film monologues, like Morgan Freeman’s in The Shawshank Redemption. How will you keep people listening? Structure your monologue! How will you introduce yourself? With a greeting, a warning, a question, an order, a riddle? Grab and hold your listener’s attention from your very first line. -

Ten other ice variants steadily exist only under a certain combinations of pressure, specific volume and temperature of medium, and those are not typical for our planet. The ice density is less than that of water by 9%, and owing to this water reservoirs are never totally frozen., Thus life is sustained in them during the winter time. As a rule, ice is much cleaner than water, and specific gas-ice compounds called as crystalline hydrates are found in ice. Among the different spheres surrounding our globe there are cryosphere (sphere of the cold), glaciosphere (sphere of snow and ice) and chionosphere (that part of the troposphere where the annual amount of solid precipitation exceeds their losses). The chionosphere envelopes the Earth with a shell 3 to 5 km in thickness. In the present epoch, snow and ice cover 14.2% of the planet’s surface and more than half of the land surface. -
