Act 15 Act anent Sale of Properties and Release of Funds

1. Applecross The General Assembly receive the petition from the Deacons’ Court of Lochcarron and Applecross Free Church and grant its crave. They authorise the sale of the Free Church Manse at Applecross, the transaction to be carried out under the supervision of the Church’s Law Agent, and direct that the proceeds of sale be held by the General Trustees and that the congregation have access to these funds for the repair, maintenance and development of existing congregational properties and for specific congregational projects subject to the approval of the Board of Trustees.

2. Scalpay The General Assembly receive the petition from the Deacons’ Court of Scalpay Free Church and grant its crave. They direct that the congregation be given access, upon application to the Chief Administrative Officer, to the sum of £15,000 held by the Board of Trustees, for the purpose of replenishing the congregation’s savings.

3. Perth The General Assembly receive the petition from the Deacons’ Court of Knox Free Church, Perth, and grant its crave. They authorise the congregation to have access to the surplus funds from the sale of the manse at Pitlochry held by the Board of Trustees, upon application to the Chief Administrative Officer, to facilitate the taking on of a Ministry Apprentice/Assistant to support the furtherance of the gospel in Perth.

4. Tarbert The General Assembly receive the petition from the Finance Committee of Lochgilphead and Tarbert Free Church at Tarbert and grant its crave. They direct that the congregation have access to the sum of £4,710.37 held by the Board of Trustees, upon application to the Chief Administrative Officer, for repairs to the church building at Tarbert.

Kinloch Manse - The Commission of Assembly authorise the sale of the Manse of the Kinloch congregation under the supervision of the Church’s Compliance Officer, and direct that the proceeds of sale be held by the Board of Trustees to be made available to the congregation for the purchase of a suitable manse or the erection of a new one, with any surplus to be used towards the reduction of the existing loan debt.

1. Burghead The General Assembly receive the petition from the Finance Committee of Burghead Free Church and grant its crave. They renew authority to sell the main church building and hall at Burghead, under supervision of the Church’s Compliance Officer, and direct that the proceeds be used to develop and modernise the existing halls and vestry, with any remaining balance to be held by the Board of Trustees on behalf of the congregation to be made available upon application for the maintenance of congregational properties and for specific congregational projects subject to the approval of the Board of Trustees.

2. Cross The General Assembly receive the petition of the Deacons’ Court of Cross Free Church and grant its crave. They grant authority to sell the Free Church Mission House at Lionel, under supervision of the Church’s Compliance Officer, and direct that the proceeds of sale be applied to the reduction of the congregation’s capital borrowing.

3. Gairlochy The General Assembly receive the petition of the Deacons’ Court of Fort William and Kilmonivaig Free Church and grant its crave. They renew authority to dispose of the church building and site at Gairlochy, under supervision of the Church’s Compliance Officer. They direct that the proceeds be held on behalf of the congregation by the Board of Trustees, and made available upon application for the maintenance of congregational properties and for specific congregational projects subject to the approval of the Board of Trustees.

They amend Act XL, 2009, to the extent that the words “Gospel ordinances” be replaced by the words “the work of the Gospel.” 6. Scalpay The General Assembly receive the petition of the Deacons’ Court of Scalpay Free Church. They authorise the Commission of Assembly to take up and dispose of the Petition subsequent to a meeting of the Scalpay Deacons’ Court with representatives of the Board of Trustees.

Act 13 Act anent Sale of Property

1. Kilmaluag The Commission of Assembly receive the Petition of the Deacons’ Court of Trotternish Deacons’ Court, and grant its crave. They authorise the sale of the Kilmaluag Free Church building, the transaction to be carried out under the supervision of the Compliance Officer or the Church’s Solicitor. They direct that the proceeds of the sale be held by the Board of Trustees on behalf of the Congregation, to be made available to the Congregation for the maintenance of the other Church buildings, the interest to be added to the capital.

2. Duirinish The Commission of Assembly receive the Petition of the Deacons’ Court of Duirinish Free Church of Scotland and grant its crave. They authorise the sale of the manse building in Lonemore, the transaction to be carried out under the supervision of the Compliance Officer or the Church’s Solicitor. They direct that the proceeds of the sale be held by the Board of Trustees on behalf of the congregation, to be made available to the congregation in order to provide a replacement property and for the maintenance of the other Church buildings, the interest to be added to the capital.

Act 7 Act anent Sale of Properties and Release of Funds

1. St Columba’s, Edinburgh The General Assembly grant authority to sell the manse of St Columba’s Church, Edinburgh, at 10 Esslemont Road, Edinburgh, the transaction to be carried out under the supervision of the Compliance Officer or the Law Agent of the Free Church of Scotland, and further that up to one half of the proceeds be made available to the Deacon’s Court of Edinburgh Free Church Continuing for the purchase by them of an alternative manse, the remainder of the proceeds to be lodged with the Free Church of Scotland Board of Trustees on behoof of the congregation of St Columba’s Free Church, the interest in the meantime to be added to the capital. The General Assembly further direct that the St Columba’s Free Church Deacon’s Court have access to the whole funds lodged, upon due application to the Chief Administrative Officer, for the purchase or development of congregational properties.

2. Assynt The General Assembly authorise the sale of the church building at Stoer and the glebe at Stoer, as well as the church at Lochinver and the manse at Lochinver, all transactions to be carried out under the supervision of the Compliance Officer or the Law Agent of the Free Church of Scotland and the proceeds of any sale to be held by the Board of Trustees on behoof of the congregation with interest payable to the congregation and the funds to be made available to the congregation, upon due application to the Chief Administrative Officer, for congregational purposes.

3. North Uist, Grimsay and Berneray (A) The General Assembly grant authority to sell the manse building at Paible, North Uist, under supervision of the Compliance Officer or the Law Agent of the Free Church of Scotland, and direct that the proceeds of sale be applied to the reduction of their capital borrowing. 4. North Uist, Grimsay and Berneray (B) The General Assembly grant authority to transfer title to the church building at Paible, North Uist, to the North Uist Free Church Continuing, under the supervision of the Compliance Officer or the Law Agent of the Free Church of Scotland.

5. Scalpay The General Assembly grant authority to sell the manse at Kyles, Scalpay, the transaction to be carried out under the supervision of the Compliance Officer or the Law Agent of the Free Church of Scotland, the proceeds of the sale be lodged with the Board of Trustees on behoof of the congregation and the congregation to have access to the whole funds, upon due application to the Chief Administrative Officer, for the improvement of the new manse, or the purchase and improvement of the church hall currently leased from the Tarbert Church of Scotland, or for the building of a purpose built church adequate to meet the needs of the Free Church congregation in Scalpay.

6. Smithton-Culloden and Nairn The General Assembly grant permission to sell the Rosebank Hall at Academy Street, Nairn, the transaction to be carried out under the supervision of the Compliance Officer or the Law Agent of the Free Church of Scotland, and the proceeds to be held by the Board of Trustees on behoof of the congregation. The General Assembly further direct that the congregation have access to the interest and capital, upon due application to the Chief Administrative Officer, for the repair, maintenance and development of existing congregational properties and for such congregational purposes as may be approved by the Deacons’ Court from time to time.

7. Glenelg and Arnisdale, Lochalsh and Glenshiel The General Assembly grant authority to transfer title to the church building at Ardelve and associated land to the Ardelve Free Church Continuing, under the supervision of the Compliance Officer or the Law Agent of the Free Church of Scotland.

8. Coll The General Assembly amend Act IV, § 2, 1984, to the extent that they authorise the release of the sum held in trust on behalf of Coll Free Church for the purpose of funding the appointment of a Presbytery worker within the Presbytery of Glasgow and Argyll.

9. Mull The General Assembly amend Act XVIII, § 3, 2008 to the extent that they grant authority to: a) Release the sum of £75,000 to help fund the appointment of a Presbytery worker within the Presbytery of Glasgow and Argyll; b) Release the sum of £70,000 to the Deacons’ Court of Mull Free Church to carry out necessary repairs to the church at Tobermory.

10. Lochgilphead and Lochfyneside The General Assembly receive the petition from the Finance Committee of Lochgilphead Free Church and grant its crave. They authorise the release of cash funds held by the Board of Trustees on behalf of the congregation as may be required for purposes of church renovation.

Act 24 Act anent Sale of Properties and Release of Funds

1. Arran The General Assembly grant authority to the Deacons’ Court of Arran to sell the manse at Shiskine, under the supervision of the Compliance Officer or the Church’s Law Agent, and direct that the proceeds of sale be held by the Board of Trustees on behoof of the congregation, to be released to the congregation upon application to the Chief Administrative Officer for the purchase of a replacement manse.

2. Kilwinning and Saltcoats The General Assembly authorise the release from the sums invested on behoof of the congregation a sum sufficient to repay the loan from the Board of Trustees and the interest due. The General Assembly also authorise the release of an additional sum, up to a maximum of £3,000, to meet additional expenses likely to be incurred in the event of a ministerial settlement.

3. Plockton and Kyle The General Assembly grant authority to the Deacons’ Court of Plockton and Kyle to sell the old manse garden ground, under supervision of the Compliance Officer or the Church’s Law Agent, the proceeds of the sale to be lodged with the Board of Trustees and made available to the congregation for the purchase of the Plockton Church of Scotland building, with the remainder to be held for the behoof of the Plockton and Kyle congregation, with interest paid to congregational funds.

4. Campbeltown The General Assembly amend Act XVIII, Class II, 1996, to the extent that they authorise the release of the sum of £24,000 for the repointing of the Campbeltown Free Church. They further authorise the release of such further sums as may be required for the repair and refurbishment of Campbeltown Free Church from the proceeds specified in Act XVIII, Class II, 1996, upon application to the Chief Administrative Officer.

5. Lochgilphead and Lochfyneside The General Assembly the sale of Lochgilphead and Lochfyneside Free Church and Hall, the transaction to be carried out under supervision of the Compliance Officer or the Church’s Law Agent, and direct that the proceeds be held by the Board of Trustees on behoof of the congregation, to be made available to the congregation, upon application to the Chief Administrative Officer, for the purchase or erection of a new church building and hall, any residue to be applied to the funds of the congregation. The General Assembly further authorise the release of such funds as are held by the Board of Trustees for the congregation of Lochgilphead and Lochfyneside, upon application to the Chief Administrative Officer, as may be required towards the purchase or erection of a new church building and hall.

6. Lochgilphead and Lochfyneside The General Assembly authorise the sale of the Lochgilphead and Lochfyneside Manse, the transaction to carried out under supervision of the Compliance Officer or the Church’s Law Agent, and direct that the proceeds be held by the Board of Trustees on behoof of the congregation, to be released to the congregation upon application to the Chief Administrative Officer for the purchase or erection of a replacement manse.

7. Gairloch and Kinlochewe The General Assembly authorise the sale of the area of ground of approximately 0.9 acres to the north side of the manse, the transaction to carried out under supervision of the Compliance Officer or the Church’s Law Agent, and direct that the proceeds be applied to the repayment of the loan from the Board of Trustees, the residue to be applied to the funds of the congregation.

Act 4 Act anent Sale of Properties

1. Duirinish The Commission of Assembly grant authority to sell the church building in Glendale under supervision of the Church’s Compliance Officer or the Church’s Law Agent, and direct that the proceeds of the sales be held by the Board of Trustees on behalf of the congregation, with interest added to the capital, to be made available to the congregation in order to provide replacement property. 2. Poolewe and Aultbea The Commission of Assembly authorise the sale of a portion of land between the manse and western property boundary of the land owned in Aultbea under supervision of the Church’s Compliance Officer or the Church’s Law Agent, and direct that the proceeds of the sales be held by the Board of Trustees on behalf of the congregation, with interest added to the capital, to be made available to the congregation in order to provide a more suitable property within the bounds of the congregation.

Act 30 Act anent Sale of Properties and Release of Funds

1. Strathpeffer The General Assembly grant authority to sell all or part of the congregational property held in Strathpeffer, the proceeds to be held by the Board of Trustees on behoof of the congregation, and the sum lodged and any interest thereon to be available upon due application for the purpose of purchasing land or property, or for repairing or improving congregational property, or for general congregational purposes including the funding of evangelistic or pastoral work carried out under the oversight of the Kirk Session, the transaction to be carried out under supervision of the Compliance Officer or the Church’s Law Agent.

2. Aird Mission House The General Assembly grant authority to sell the church building at Aird known as Aird Mission House, under supervision of the Compliance Officer or the Church’s Law Agent, and direct that the proceeds of sale be held by the Board of Trustees on behoof of the congregation, with interest on the proceeds being added to capital. The General Assembly further direct that the congregation have access to the proceeds for congregational purposes upon application to the Board of Trustees.

3. Bonar Bridge The General Assembly receive the petition from the Finance Committee of Bonar Bridge Free Church and grant its crave to the extent that they grant authority to sell the piece of land adjacent to the car park of the Old Manse, extending no further than the access gate, the transaction to be carried out under the supervision of the Church’s Law Agent, and direct that the proceeds of sale be held by the Board of Trustees on behoof of the congregation, with interest on the proceeds being added to the Capital. The General Assembly further direct that the congregation have access to the proceeds for congregational purposes.

4. Kilwinning The General Assembly receive the petition from the Deacons’ Court of Kilwinning and Saltcoats Free Church and grant its crave to the extent that they grant authority to sell the church building at Kilwinning and direct that the proceeds of sale be held by the Board of Trustees on behoof of the congregation, with interest on the proceeds being added to the Capital. The General Assembly further direct that the congregation have access to the proceeds for congregational purposes.

5. Dumfries The General Assembly grant permission for the sale of the manse at 2 Gillbrae Court, Georgetown, Dumfries, under supervision of the Compliance Officer or the Church’s Law Agent, and direct that the congregation be allowed access to the capital for the purchase of a new manse.

6. Arran The General Assembly receive the petition from the Deacons’ Court of Arran Free Church and grant its crave. They amend Act XVII, Class II, 1995, to the extent that they authorise the residue sum of £7691.08 or more to be released to the congregation from the funds realised by the sale of the Corrie church building, ground and cottage, the sum to be used for the purpose of repairing and refurbishing the Brodick Free Church and the Free Church manse in Shiskine.

7. Wick and Keiss The General Assembly amend Act XXVII, Class II, 2006 and Act XL, Class II, 2009, thereby granting the congregation of Wick and Keiss access to funds from the sale of the Keiss manse and church building, and the Wick manse and church, for congregational purposes, including the support of an evangelist in Wick, as proposed by Northern Presbytery, upon application to the Board of Trustees.

8. Callanish The General Assembly authorise access to the funds held by the Board of Trustees on behoof of the congregation of Callanish for renovation and repairs to the church and manse at Callanish up to a maximum of £30,000.

Act 34 Act anent Sale of Properties

Nairn The General Assembly grant authority to sell the former manse at Gordon Street, Nairn, the proceeds of the sale to be lodged with the Board of Trustees on behoof of the congregation and the capital to be made available upon application to the Board for the development of new buildings and maintenance of existing properties, the transaction to be carried out under supervision of the Church’s Law Agent.

Greyfriars-Stratherrick The General authorise the sale of the manse at Tomatin, and direct that of the proceeds remaining after the deduction of all marketing and legal costs, 80% be allocated to the Greyfriars-Stratherrick Free Church congregation and 20% to the Duthil-Dores congregation of the Free Church Continuing, the proceeds allocated to the Greyfriars-Stratherrick Free Church to be held by the Board of Trustees on behoof of the congregation and made available to the congregation for congregational purposes. The General Assembly authorise the transfer of title to the church building at Dores to the congregation of the Duthil-Dores congregation of the Free Church Continuing on condition that, should the Free Church Continuing, or the Duthil-Dores congregation of the Free Church Continuing cease to exist, or should the said congregation cease to use the church building at Dores for meetings of a strictly religious, charitable or social nature (as specified in The Practice, Supplement to Chapter I, paragraph 2,2), the title shall be transferred to the Greyfriars-Stratherrick congregation of the Free Church of Scotland. The General Assembly direct the Deacons’ Court of Greyfriars-Stratherrick Free Church to secure a legally binding agreement with the Dores congregation of the Free Church Continuing to secure the abovementioned condition.

Park The General Assembly grant authority to sell the church building at Cromore, the transaction to be carried out under supervision of the Church’s Law Agent. They direct that the proceeds of the sale be held by the Board of Trustees on behoof of the congregation and that they be applied to the funds of the congregation, upon application to the Board of Trustees.

Act 4 Act anent Release of Funds to Perth and Pitlochry Congregation

The Commission of Assembly receive the Petition from the Presbytery of Edinburgh and Perth and grant its crave. They authorise the release of funds held in the name of Aberfeldy, Glenlyon and Pitlochry, for the use of the united congregation of Perth and Pitlochry as required, the funds to be used for the maintenance of existing church and manse properties and to finance gospel outreach. The Commission of Assembly also authorise the Perth and Pitlochry Deacons’ Court to administer the use of the said funds.

Act 40 Act anent Sale of Properties and Release of Funds

1. The General Assembly receive the petition from the Deacons’ Court of Fort William and Kilmonivaig Free Church and grant its crave. They renew permission to dispose of the site and buildings at Gairlochy in accordance with the terms of Act XVII, 2004.

2. The General Assembly receive the petition from the Finance Committee of Wick and Keiss Free Church and grant its crave. They grant authority to sell the church building and manse at Wick, the proceeds of the sale to be lodged with the Board of Trustees in behoof of the congregation and made available for the procurement of a more suitable church building and manse, the transaction to be carried out under supervision of the Church’s Law Agent. They direct that any residual balance shall be held on behalf of the congregation and shall be made available for congregational purposes upon application to the Board of Trustees.

3. The General Assembly receive the petition from the Finance Committee of Tongue Free Church and grant its crave. Act 9 Act anent Sale of Properties at Skeabost and Kilmuir

The Commission of Assembly receive the Petition of the Deacons’ Court of Kilmuir, Stenscholl and Snizort Free Church and grant its crave. They authorise the sale of the Church and Manse at Skeabost and the sale of the Manse at Kilmuir, the Presbytery of the bounds being fully informed of all the details of the proposed sale and the related agreements, any transaction to be carried out through the Church’s Law Agent, and that proceeds be lodged with the General Trustees on behoof of the Congregation, to be released in order to fulfil the terms of the negotiated agreement, the repaying of part of the new Manse loan, and the remainder to be used to improve the Church buildings at Kilmuir and Uig.

Act 7 Act anent congregational properties of St Peter’s, Dundee and other purposes

The Commission of Assembly receive the Report of the Board of Trustees and thank the Board. The Commission of Assembly note the issues arising from the Model Trust Deed with respect to granting of security over congregational properties. They also note the advice of the Church’s Law Agent and based on this advice authorise the congregational trustees in the Dundee – St Peter’s congregation and in the Lochbroom congregation to grant a standard security over congregational properties in favour of the Board of Trustees.

The General Assembly authorise the sale of the Manse at Staffin Road and the sale of the Church and Hall at Fancy Hill, Portree, the transaction to be carried out through the Church’s Law Agent. They appoint the proceeds to be lodged with the General Trustees on behoof of the congregation, to be released in order to fulfil the terms of the negotiated agreement with the self-styled Free Church Continuing, the repayment of the new manse loan, the remainder to be used to establish a fund towards the cost of erecting or procuring another church building, the interest in the meantime to be added to the capital.

They consolidate the funds of the congregation held under these various Acts (including Act 1.1 of the Commission of Assembly, October 1998; Act 8.3 and 8.8 of the General Assembly, May 2002, and various Acts relating to small capital sums connected with the sale of property in Contin) into one capital fund to be held on behalf of the congregation, interest being added to the capital, and the interest and capital being available to the Deacons’ Court upon application, for repairs and improvements to congregational properties and for congregational purposes.

Act 36 Act anent Sale of Church Flats

The General Assembly homologate the decision of the General Trustees that, because of the complexity of the legislative requirements placed upon landlords, together with the associated administrative burden, up to 13 of the flats held in Edinburgh be disposed of as they may become vacant, the proceeds of the sale to be held in the General Fund of the Church.

9. The General Assembly receive the Petition from the Finance Committee of Kiltarlity and Kirkhill Free Church and grant its crave. They amend Act III, paragraph 1, Commission of Assembly, March 2002, to the extent that the proceeds from the sale be held by the General Trustees for behoof of the congregation and that they be made available for the procurement of a more suitable manse and that an amount not exceeding £60,000 be used for the upgrading and improvement of the church building at Kiltarlity.

10. The General Assembly receive the Petition of the Deacons’ Court of Kilwinning and Saltcoats and grant its crave. They amend Act VIII, 1997, paragraph 3.1, so as to give unrestricted access to the capital for repairs and improvements to the properties of the congregation.

Act 23 Act anent Disposal of Sale Proceeds of Maxwell House

1. The General Assembly approve the action of the Committee on Eventide Homes in clearing the operating deficit for 2003 from the remaining capital held on behalf of Maxwell House, from the funds held by the Board in Glasgow in the Royal Bank of Scotland account, and from part of the proceeds realised from the sale in November 2003.

2. The General Assembly, whilst acknowledging that the sale proceeds of Maxwell House are ordinary revenue receipts, recognise the Church’s continuing responsibility to demonstrate the truth of the Gospel by practical social care, and direct that three hundred and fifty-five thousand pounds be set aside from the receipts for specific social responsibility purposes.

3. The General Assembly allocate one hundred and fifty thousand pounds from the above sum to the Thomas Chalmers Housing Association Ltd. as follows: fifteen thousand pounds per annum for five years toward the work at Westland Court, Glasgow, beginning in 2004; and seventy-five thousand pounds to be invested for the use of the Milngavie project; or, if either project should fail or lose its Christian input, for other uses as determined by the Stewardship and Policy Committee at that time; the interest accruing being accumulated and used to reduce the cost to the Church of the honorarium for the Chaplain at Westland Court.

4. Furthermore, from the specified sum, the General Assembly also allocate two hundred thousand pounds to the Grant Aid Scheme administered by the Social Responsibility Sub-Committee Council of Reference, to be made available at the rate of twenty thousand pounds per annum beginning in 2004, with any accruing interest or unspent funds accumulating in the scheme. The General Assembly authorise the Public Questions Committee at their next meeting to adjust the remit of the Grant Aid Scheme so as properly to administer these increased funds, and instruct the Public Questions Committee to report fully on these adjustments and the overall operation of the scheme to the next Assembly.

5. Furthermore, from the specified sum, the General Assembly also authorise a gift of five thousand pounds without interest to the Scottish Churches Housing Agency, to be paid at the rate of one thousand pounds per annum beginning in 2004, this being in addition to the normal annual subscription.

6. The General Assembly direct that the remaining revenue from the sale of Maxwell House (namely ninety-three thousand, four hundred and sixteen pounds and fifty-eight pence) be used to strengthen the Church’s capital reserves.

Act 37 Act authorising the Sale of the Colegio San Andres and other Purposes

The General Assembly renew Act XXI, 1981, in the following terms: The General Assembly authorise the General Trustees, upon advice from the International Missions Board, to sell the buildings occupied by the Colegio San Andres together with the other properties, inclusive of the Edificio San Andres, situated on Avenida Du Petit Thouars 179, Lima 1, or alternatively arrange for the development and subsequent sale of the site. They direct that the proceeds of such sale should be applied to the acquisition and building of a new school. The foregoing authorisation is conditioned upon the Trustees and the Stewardship and Policy Committee being satisfied with the financial arrangement of the whole transaction and the General Assembly direct the Board to consult with the General Trustees and the Stewardship and Policy Committee on necessary measures of interim- financing of the project and for providing assistance to the Trustees’ Nominees. The Stewardship and Policy Committee and General Trustees are authorised to advance such ‘bridging loans’ as may be necessary and available.

They grant authority to sell the plot of land at the site of the previous manse, subject to a Minute of Waiver being received, the transaction to be carried out under the supervision of the Church’s Law Agent, and direct that the proceeds of the sale be applied to the funds of the congregation.

3 The General Assembly receive the Petition of the Finance Committee of Strathpeffer and Garve Free Church, and grant its crave. They authorise the sale of the church building at Garve, the transaction to be carried out through the Church’s Law Agent. Act 34 Act anent Sales of Property

1. The General Assembly authorise the sale of a strip of land amounting to 0.1411 acres at the rear of the Glen Urquhart manse, the transaction to be carried out under the supervision of the Church’s Law Agents. The proceeds of the sale are to be made available to the congregation for the maintenance and improvement of congregational properties.

2. The General Assembly authorise the sale of the church building in Kingussie, which includes the land currently leased to the Local Authority for use as an off-street parking place. The transaction is to be carried out under the supervision of the Church’s Law Agents and the proceeds of the sale are to be lodged with the General Trustees in behoof of the Congregation, with capital and interest being available to the congregation for the maintenance and improvement of the Newtonmore Church building and the Kingussie Manse.

3. The General Assembly authorise the sale of the manse in Strontian, subject to obtaining a Minute of Waiver. The transaction is to be carried out under the supervision of the Church’s Law Agents, and the proceeds of the sale are to be lodged with the General Trustees in behoof of the Congregation, with interest being available to the congregation for the maintenance and improvement of congregational properties.

4. The General Assembly authorise the sale of the Church building at Alligin, subject to obtaining a Minute of Waiver from the Superior for change of use. The transaction is to be carried out under the supervision of the Church’s Law Agents, and the proceeds of the sale are to be lodged with the General Trustees in behoof of the Congregation, with interest being available to the congregation.

5. The General Assembly authorise the sale of the Manse at Garrabost, the transaction to be carried out under the supervision of the Church’s Law Agents. The proceeds of the sale are to be lodged with the General Trustees in behoof of the Congregation, and are to be made available for the erection or procurement of a replacement manse, with interest meantime being added to capital.

Act 35 Act anent Release of Congregational Monies

1. The General Assembly amend Act XXI (Class 2), 1999, to permit Arran Free Church to have access to the capital of the proceeds of the sale of Corrie Cottage to allow provision of hall facilities at Shiskine.

2. The General Assembly amend Act III, Class II, 1985, so as to permit the congregation of Kirkcaldy, Kinglassie and Glenrothes to have access to the balance of capital realised from the sale of the church and hall at Kennoway. The General Assembly also vary the Finding of the General Assembly of 21st May 1964 [Acts and Proceedings, page 44, regarding the sale of the Kinglassie manse] so as to permit the congregation to have access to the capital realised from the sale of the Kinglassie manse to help finance the purchase of a new manse for the congregation.

3. The General Assembly release such capital from the sale of the Bower manse as is necessary to pay for improvements to the Olrig manse.

Act 36 Act anent Sale of Portree Church and Hall

In the light of the exceptional circumstances prevailing in the Portree congregation, the General Assembly authorise the sale of the present Church building in Portree for a nominal sum, the Presbytery of the bounds being fully informed of all details of the proposed sale and related agreements, and having formally agreed that the transaction should proceed. Any transaction shall be carried out under the supervision of the Church’s Law Agents. The proceeds of the sale are to be lodged with the General Trustees, and are to be used towards the cost of erecting or procuring another Church building, the interest in the meantime to be added to the capital.

The proceeds of the sale are to be lodged with the General Trustees, and the interest made available to the Arran Deacons’ Court for the purpose of maintaining the remaining property of the congregation, the interest in the meantime to be added to the capital. 2. Assynt The General Assembly, waiving irregularities in procedure, receive the Petition of the Free Church Congregation of Assynt and grant its crave to the extent that they authorise the sale of the Church building in Drumbeg, subject to obtaining a Minute of Waiver; the transaction to be carried out under the supervision of the Church’s Law Agent. The proceeds of the sale are to be made available to the Congregation for the maintenance and improvement of congregational properties.

3. Duirinish The General Assembly, waiving irregularities in procedure, receive the Petition of the Free Church Congregation of Duirinish and grant its crave. They authorise the sale of the Mission House and Old School in Duirinish, subject to obtaining a Minute of Waiver, if necessary; the transaction to be carried out under the supervision of the Church’s Law Agent. The proceeds of the sale are to be lodged with the General Trustees in behoof of the Congregation, with capital and interest being available to the Congregation for the maintenance and improvement of congregational properties.

4. Rothesay The General Assembly receive the Petition of the Rothesay Deacons’ Court and grant its crave. They authorise the sale of the Rothesay Manse at 34 Ardmory Road, Rothesay, the transaction to be carried out under the supervision of the Church’s Law Agents. Once all financial obligations of the Rothesay Congregation have been met, the balance of the proceeds of the sale together with interest thereon are to be lodged with the General Trustees for behoof of the Special Projects Fund set up by paragraph 3 of Act V, 1991.

The proceeds of the sale are to be lodged with the General Trustees in behoof of the Congregation, and interest on the proceeds is to be made available to the Congregation for the maintenance of the Ardersier Church building, and access to the capital sum in the event of the Ardersier Church building being replaced.

2. Rothesay The General Assembly receive the Petition of the Deacons’ Court of the Congregation of Rothesay and grant its crave. They authorise the sale of the Church in Rothesay, the transaction to be carried out under the supervision of the Church’s Law Agent. The proceeds of the sale are to be lodged with the General Trustees in behoof of the congregation, and interest on the proceeds to be made available to the Congregation for the hiring of premises for public worship and access to the capital sum being permitted in the event that replacement property is purchased.

3. Kilwinning and Saltcoats The General Assembly receive the Petition of the Deacons’ Court of the Congregation of Kilwinning and Saltcoats and grant its crave to the extent that:

1. Smithton-Culloden The General Assembly receive the Petition of the Congregation of Smithton- Culloden Free Church of Scotland and grant its crave. They authorise the sale of the present manse building, the transaction to be carried out under the supervision of theChurch’s Law Agent. The proceeds of the sale are to be lodged with the General Trustees andmade available to the Congregation for the erection of a more suitable manse. Although the title to the Manse is in the name of the General Trustees of the Free Church of Scotland, the General Assembly direct that the Church’s Law Agents may take instructions from the office bearers of the Smithton-Culloden Free Church of Scotland regarding the sale and conveyance, the titles to the new manse to conform wholly to the Model Trust Deed.

2. Leith The General Assembly receive the Petition of the Deacons’ Court of Free Memorial Church, Leith, and grant its crave. They authorise the sale of the present manse at 11 Rosslyn Terrace, Leith, the transaction to be carried out under the supervision of the Church’s Law Agents. The proceeds of the sale are to be lodged with the General Trustees and made available for the purchase of a more suitable manse.

3. Kirkcaldy and Kinglassie The General Assembly receive the Petition of the Deacons’ Court of the Congregation of Kirkcaldy and Kinglassie and grant its crave. They authorise the sale of the church building in Kinglassie, the transaction to be carried out under the supervision of the Church’s Law Agents. The proceeds of the sale are to be lodged with the General Trustees and may be drawn on by the Congregation in connection with expenditure on buildings elsewhere in the congregation, interest in the meantime to be added to capital.

4. Campbeltown The General Assembly receive the Petition of the Deacons’ Court of Campbeltown Free Church and grant its crave. They authorise the sale of the present manse in Campbeltown, the transaction to be carried out under the supervision of the Church’s Law Agents. The proceeds of the sale are to be lodged with the General Trustees, but the Deacons’ Court may draw on sufficient of these funds as to finance a 50% share in a replacement Manse in Tarbert for the proposed Consolidated Charge. The remainder of the proceeds are to be held for behoof of the Campbeltown Congregation, with the interest accruing to be paid to the Campbeltown Deacons’ Court.

5. Bracadale The General Assembly receive the petition of the Deacons’ Court of Bracadale Free Church and grant its crave. 1. Bower The General Assembly note and approve the permission given by the Commission of Assembly of October 1994 regarding the sale of the Bower Manse. The General Assembly reiterate the terms of Act II, 1968, namely: The General Assembly remind Congregations that, where the authority of the Assembly to the sale of a property is required, any negotiations prior to the granting of such authority is ultra vires. The General Assembly warn Congregations that property should not be advertised for sale, nor should Missives of Sale be entered into, before the authority of the General Assembly, where required, has been obtained.

2. St. Vincent Street/Milton The General Assembly receive the Petition from the congregation of St. Vincent Street/Milton Free Church and grant its crave. They authorise the sale of the vacant site of the former Milton Free Church at Rose Street/West Graham Street, Glasgow. The transaction is to be carried out under the supervision of the Church’s Law Agents. The proceeds of the sale are to be lodged with the General Trustees and may be made available for the purchase of an alternative site or the procurement of a church building, interest in the meantime to be added to capital.

Act 5 Act anent Disposal of Surplus Properties and Monies Arising Therefrom

1. The General Assembly direct that all properties which are maintained centrally by the Church and are rented out should be assessed as to the need to retain them and any found to be surplus to requirements should be sold and the resulting proceeds put to work for the benefit of the Church as a whole.

2. The General Assembly direct Presbyteries as follows: 2.1 To continue to examine the possibility of linking congregations where this is feasible. 2.2 To assess the need to retain all properties within their bounds and where any properties are found to be surplus to requirements to urge the congregations to dispose of them and also to seek their agreement to using at least part of the proceeds for the wider work of the Church especially in areas where new buildings are required.

2.3 To identify areas where at considerable cost gospel ordinances are being maintained: to assess the measure of response and whether it is likely to justify continued effort: to report within 12 months to the Sustentation Committee if it appears that the resources involved would be more profitably employed elsewhere.

3. The General Assembly direct the Finance, Law and Advisory Committee to establish a fund into which contributions from congregations, realised in terms of 2.2 above, shall be paid. Committees with special projects requiring finance may apply to this fund as need arises.

Act 19 Act anent Sales of Properties

1. Bracadale The General Assembly receive the Petition of Bracadale Deacons’ Court and grant its Crave. They authorise the sale of the manse, subject to a minute of waiver being received from the Superior. They instruct that the proceeds of sale be invested with the General Trustees until required for the acquisition of a new manse, any interest accruing to be added to capital. Any surplus not required for the purchase of the new manse to be retained for behoof of the congregation and the interest thereon to be paid to the congregation. The transaction is to be carried out under the supervision of the Church’s Law Agents and the title of the new manse to be taken in terms of the Model Trust Deed.

2. Kiltearn The General Assembly remit the Petition from the Deacons’ Court of Kiltearn to the Committee for further investigation and consideration in consultation with the Presbytery of Ross, the Committee to report to the Commission of General Assembly which shall dispose of the matter.

3. Duirinish The General Assembly receive the Petition from Duirinish Congregation regarding the sale of Lusta Mission Hall, Waternish. Insofar as it is within their power they grant its crave and authorise the sale of the said Mission Hall subject to such conditions as the titles impose. The proceeds of sale are to be invested with the General Trustees and interest accruing paid to congregational funds. The Deacons’ Court are authorised to withdraw from the capital such money as may be needed for specific needs. The transaction is to be carried out by the Church’s Law Agents.

4. Duirinish The General Assembly receive the Petition from Duirinish Congregation with reference to Burnside Cottage, Waternish and grant its crave. They authorise the sale of the cottage and direct that the proceeds of sale be invested with the General Trustees. The Deacons’ Court of Duirinish are authorised to draw on the capital realised for necessary repairs to the Waternish Church. Interest on capital is to be paid to the Deacons’ Court for the benefit of the Waternish section of the congregation. The transaction is to be carried out under the supervision of the Church’s Law Agents.

5. Burghead The General Assembly receive the Petition from the Deacons’ Court of Burghead Congregation and grant its crave. They authorise the sale of the present manse at Burghead with retention of the adjoining garden site to be used for the erection of a new manse. The proceeds of sale are to be lodged with the General Trustees and released as required for the erection of a new manse, any interest accruing meantime to be added to capital and any excess capital to be invested by the General Trustees for behoof of the Congregation and interest thereon paid to congregational funds. 6. Elgin The General Assembly receive the Petition from the Deacons’ Court of Elgin Congregation and grant its crave. Greenock Edinburgh, 21st May 1991 7.1 The General Assembly, notwithstanding Act II, Class II, 1991, are prepared to entertain a Petition requesting permission for the sale of the present manse in Greenock for the special reasons adduced, but hereby declare that this can not be regarded as a precedent, and further declare that in any future purchase of a manse, any shortfall in invested capital, cannot be met by grant.

Edinburgh, 23rd May 1991 7.2 The General Assembly receive the Petition from Greenock Congregation and in the special circumstances ascertained grant its crave. They authorise the sale of the manse at 255 Eldon Street, Greenock. The proceeds of sale are to be invested with the General Trustees partly for behoof of the Greenock section of the consolidated charge and the amount advanced by the Dunoon section to be held on their behalf. In each case interest accruing is to be added to capital pending the acquisition of a new manse. The transaction is to be carried out by the Church’s Law Agents and the titles of the new manse taken out in terms of the Model Trust Deed.

8. Resolis The General Assembly receive the Petition from the Resolis Finance Committee and grant its crave. They authorise the sale of the manse at Resolis and its adjoining land. Act 4 Act anent Release of Congregational Funds

1. Nairn The General Assembly receive the Petition from the congregation of Nairn, Croy and Ardersier and grant its crave. They amend paragraph 5 of Act I, 1977 to the extent that the sum of £10,000 is to be paid from the capital held in terms of that Act to defray the cost of the acquisition and renovation of a new Church Hall at Nairn.

2. Kirkcaldy The General Assembly receive the Petition from the Deacons’ Court of Kirkcaldy congregation and grant its crave. They modify the terms of paragraph 4 of Act III 1985 to the extent that one half of the capital sum presently held in terms of that Act is to be made available to the Deacons’ Court towards the cost of procuring a new Church building in Kirkcaldy.

3. Rosskeen The General Assembly receive the Petition from the Rosskeen Deacons’ Court and grant its crave. They authorise such release of capital from the Kilmuir Easter Fund as together with the monies already held by the congregation will enable a house to he acquired as manse for the assistant minister. They ordain that in the event of the proposed arrangements being departed from in the future and the said manse being sold, Rosskeen Deacons’ Court will repay to the General Trustees for behoof of the Kilmuir Easter Fund an amount which will bear the same proportion to the selling price as the sum granted them from the Kilmuir Easter Fund bears to the purchase price.

1. The General Assembly receive the Petition from the Congregation of Fearn and grant its crave. They renew the authority to sell the Church which is presently in disuse and direct that the proceeds of sale be invested with the General Trustees and the income applied to congregational purposes. 2. The General Assembly receive the Petition from the Congregation of Olrig, Watten and Bower and grant its crave. The General Assembly receive the Petition from the Congregation at Alligin and grant its crave. They authorise the General Trustees to release so much of the capital rendered by the sale of the Alligin Mission House as will be required to have electricity introduced to the Church at Alligin, the Church wired and storage heaters installed. Any capital remaining will continue to be held by the General Trustees for behoof of the congregation and the interest paid to congregational funds.

The General Assembly receive the Petition from the Free Church Congregation of Arran and grant its craves. They modify the terms of Act II of the Commission of Assembly, October 1975, Act XX of 1976, Act I of 1977; and Act I of 1978 and direct that: (1) the proceeds from the sale of the Lochranza and Whiting Bay Manses be held for the Arran Congregation, the interest being paid to the Arran Finance Committee to be used for the repair and improvement of the Corrie cottage and the Shiskine Manse, and for the payment of ministerial expenses and other expenses of the joint charge; (2) the Arran congregation be permitted to withdraw from this invested capital up to 5,505 Share Pool Units to meet expenses connected with the securing of feu dispositions for the church and Manse at Shiskine. (3) accumulated interest on the Lochranza Manse investment be made over to the Treasurers of the Kilbride and Lochranza sections of the consolidated congregation for the upkeep of their fabric to be apportioned as follows: 2/7ths to Pirnmill, 2/7ths to Brodick, 3/7ths to Corrie. The General Assembly receive the Petition from the Congregation of Lybster, Bruan, Latheron and Berriedale and grant its crave. They authorise the sale of the church and manse buildings at Lybster, subject to such procedure as may be necessary for a Minute of Waiver or the purchase of the Superiority, the net proceeds of sale to be invested with the General Trustees until required for the purchase or erection of more suitable properties, and the income in the meantime to be made available to the Congregation. The transaction is to be carried out by the Church’s Law Agents. The General Assembly receive the Petition from the Congregation of Olrig, Watten and Bower and grant its crave. They renew the authority to sell the manse at Bower on the terms stipulated in Act III (Class II) 1980.

Act 6 Act anent Release of Congregational Money (Kilmallie)

The General Assembly receive the Petition and grant its crave. They amend Act VIII 1975 and allow access to the balance of the capital realised from the sale of the Corpach Church and site, viz. £2,900.

Act 31 Act anent Maintenance of Buildings

The General Assembly, desiring that the fabric of churches, halls and manses be preserved from decay, that the cost of repairs be lessened by constant attention to the condition of buildings, and that the church be not burdened by the upkeep of buildings no longer fully utilised, enact that; (1) the Deacons’ Court of each congregation shall give regular attention to, and promptly see to the making good of, defects in all congregational property; (2) the Committee on Buildings Maintenance shall prepare, and revise as necessary, an appropriate Buildings Return to be filled in by the Deacons’ Court at the time of each quinquennial visitation; this Return shall give details of the properties held by the congregation, of the Buildings Certificate required in (4) below, and of major repairs carried out since the last such return; (3) at least three months before the date on which the Presbytery shall resolve to conduct a quinquennial visitation, the Presbytery Clerk shall send to the Clerk of the Deacons’ Court a copy of the Buildings Return specified in (2) above so that it may be timeously filled in and returned before the visitation takes place; (4) the Deacons’ Court shall prior to each quinquennial visitation of the congregation by the Presbytery provide the Presbytery with a Buildings Certificate dated in the previous three months and under the hand of a qualified person, such a Certificate attesting that the fabric of all congregational property is in a good state of repair, subject to such defects (if any) as exist and are specified; the Deacons’ Court shall also complete the Buildings Return; (5) the Presbytery shall consider the particulars of the above-mentioned Buildings Certificate and Return, and shall transmit a copy of the Buildings Return to the Clerk to the Buildings Committee, with their comments thereon. In particular the Presbytery shall formulate a view, conjointly with the congregation, as to whether sufficient use is being made of each property as to warrant its continued upkeep; (6) the Committee on Buildings Maintenance shall not approve of applications for buildings grants and loans on property for which a duly completed Buildings Return has not been provided during the previous five years; (7) if a congregation does not have a Deacons’ Court, the Finance Committee shall assume the functions and responsibilities allocated above to the Deacons’ Court: (8) Acts V, 1939 and VIII, 1948 are hereby repealed.

Act 32 Act anent Church and Manse Building Fund

The General Assembly authorise the Committee on Buildings Maintenance to give at its discretion grants and/or loans from the Church and Manse Building Fund in the following circumstances: (1) where assistance is needed with the cost of a survey required in connection with a quinquennial visitation Buildings Certificate; (2) where assistance is needed with the cost of changing the title deeds of a congregation’s property to conform to the Model Trust Deed. (3) where assistance is needed with the cost of obtaining valid titles to existing buildings, provided that such titles conform to the Model Trust Deed.

The General Assembly renew the authorisation of the sale of the ground at Strathtongue on the same terms as granted by the Assembly of 1979 (Act XXVII 1979). The General Assembly receive the Petition from Farr Congregation and grant its crave. The General Assembly modify the terms of their findings recorded in Act XXVII 1979 and Act IV 1980 relative to the sale of the manse at Farr so as to permit the use of the proceeds for the improvement of general facilities and accommodation in the Church at Bettyhill.

The General Assembly receive the Petition from the Congregation of Thurso and Reay, and grant its crave. They authorise the sale of the Reay Manse at Shebster, subject to such consent as may be necessary from the Superior. They direct that the proceeds of sale be invested with the General Trustees and the income applied to congregational funds, and that the transaction be carried through by the Church’s Law Agents. The General Assembly receive the Petition from the Congregation of Greenock and grant its crave. They approve the sale of the Manse at 165 Newark Street and direct that the proceeds of sale be invested by the General Trustees until required for the purchase of a more suitable Manse, the income meantime being added to the capital. They direct that the titles of the new Manse be drawn in terms of the Model Trust Deed and that the transaction be carried through under the supervision of the Church’s Law Agents. Further, with regard to the residue of the sale of the former Church presently held by the General Trustees the Assembly authorise that up to £4,000 be made available, if required, for the purchase of a new manse, and the remainder of these funds continue to be set aside for use in connection with the Church building on its replacement. The General Assembly receive the Petition from the Congregation of Berneray, Harris, and recognising that the contract already entered into was due to misapprehension and that the parties concerned acted in good faith simply remind them of the need to secure well- founded information before entering upon such procedures. They grant the crave of the Petition and authorise the sale of the Mission House at Berneray, Harris, the capital realised to be applied in the first instance to the repair of the Church and any surplus to be lodged with the General Trustees and the income applied to congregational purposes. The General Assembly receive the Petition from the congregation of North Knapdale and grant its crave. They authorise the sale of the Church and grounds at Tayvallich subject to such consent as may be required from the Superior for any change of use contemplated by the Congregation or a prospective customer. They direct that the proceeds of sale be invested with the General Trustees and the income applied to congregational funds. The transaction is to be carried out by the Church’s Law Agents.

Act 3 Act anent Re-application of Congregational Money

The General Assembly receive the Petition of the Congregation of Glenurquhart and Fort Augustus and grant its crave. They grant access to the capital already held by the General Trustees for behoof of the Congregation, and they amend the terms of Act III 1985 to allow access to the capital to be realised from the sale of the Glenmoriston Manse in order to repair and maintain the properties of the consolidated charge; the remainder of the proceeds to be invested for behoof of the Congregation, and interest paid to the Congregation.

Act 1 Act anent Sale of Property 1. The Commission of Assembly receive the Petition from the Congregation of Raasay and grant its crave. They authorise the sale of the manse at Raasay, the Proceeds to be invested by the General Trustees until required for the acquisition of more suitable premises, the interest meantime being added to capital: any surplus to remain invested and the interest applied to Congregational Funds.

2. The Commission of Assembly receive the Petition from the Finance Committee of the North Knapdale Congregation and approve of its crave. They approve of the sale of the manse at Carsaig and of the investment of the proceeds with the General Trustees. They commend the congregation’s desire to aid the congregation of Islay in the renovation of the Church and manse at Islay and approve of the proposal to meet half of this cost up to a maximum of £5,000 from the proceeds of sale should the work of renovation be undertaken. They authorise the General Trustees to hold the remaining funds for behoof of the congregation of North Knapdale paying the interest to the congregation. Should the congregation cease to exist the General Trustees are to allocate the capital equally between the Sustentation Fund and the Eventide Homes Committee of the Free Church of Scotland. The Commission advise that the transaction be carried out by the Church’s Law Agents.

3. The Commission of Assembly receive the Petition from the Elgin Finance Committee of Elgin Congregation and grant its crave. They authorise the sale of the present Church and site the proceeds of sale to be invested by the General Trustees pending the purchase or erection of a more suitable place of worship, interest accruing in the meantime to be added to capital until the replacement building has been acquired and satisfactorily furnished: thereafter any surplus to be held for behoof of the congregational funds. The transaction is to be carried out by the Church’s Law Agents.

1. The General Assembly receive the Petition from the Deacons’ Court of Alligin and Diabaig and grant its crave. They authorise the sale of the Mission House at Alligin, the proceeds to be invested by the General Trustees and the income to be made available to the congregation. 2. The General Assembly receive the Petition from the congregation of Glenurquhart and Fort Augustus and grant its crave. They authorise the sale of the Church and Manse at Glenmoriston subject to obtaining such consent as may be required from the Superior. Proceeds of the sales shall be dealt with as follows: (a) the proceeds of the sale of the manse will be invested by the General Trustees for behoof of the congregation and the income paid to the congregation; (b) the proceeds of the sale of the church will be made available as necessary to the congregation for the upkeep of their other properties; insofar as not required the proceeds will be invested for behoof of the congregation and the income paid to the congregation. The transactions will be carried out by the Church’s Law Agents.

3. The General Assembly receive the Petition from the congregation of Fort William and grant its crave. They authorise sale of the present manse and of the grounds in whole or in part as may be deemed most expedient for the acquisition by building or purchase of a more suitable residence. The proceeds of sale will be lodged with the General Trustees and made available for the erection or purchase of a new manse and any surplus capital will be invested and the interest paid to the congregation. The transaction will be carried out by the Church’s Law Agents.

4. The General Assembly receive the Petition from Kennoway and grant its crave. They authorise the sale of the Church and Hall at Kennoway, the proceeds to be lodged with the General Trustees for behoof of the congregation of Kirkcaldy, Kinglassie and Glenrothes and the interest along with that of money presently held by the Custodiers of Titles for behoof of the Kennoway congregation to be made available in equal amounts to the congregation of Kirkcaldy and Kinglassie and Glenrothes for congregational purposes.

5. The General Assembly receive the Petition from the Deacons’ Court of Creich, Kincardine and Croick and grant its crave to the following extent. They authorise the sale of the Church at Kincardine and of the Hall at Spinningdale; subject to the Congregation obtaining the necessary waiver from the Superiors of both properties of the relevant prohibitions in the respective titles; the proceeds of the sales to be lodged with the General Trustees and drawn upon as required by the congregation for maintenance and improvements of the congregation’s other buildings. Such capital sums as are not so required will be invested and the proceeds paid to the congregational funds. The transactions are to be carried out by the Church’s Law Agents.

6. The General Assembly receive the Petition from the Deacons’ Court of Assynt and grant its crave. They authorise the sale of the manses in Lochinver and in Stoer and direct that the proceeds of sale or sales be lodged with the General Trustees and invested for behoof of the congregation with interest accruing being added to capital: the capital with accrued interest shall be used for the acquisition of a suitable manse or, should one of the present manses be retained, for its renovation and upgrading to acceptable standards: such capital as is not so required will be retained and the interest paid to congregational funds. The transaction will be carried out by the Church’s Law Agents.

7. The General Assembly receive the Petition from the Congregation of Keiss and grant its crave. They authorise the sale of the manse at Keiss and direct that the proceeds of sale be lodged with the General Trustees to be invested for behoof of the congregation: the congregation may draw upon one quarter of the capital realised for the maintenance and/or improvement of their Church building: the interest accruing shall be paid to congregational Funds: and the transaction will be carried through by the Church’s Law Agents.

Act 18 Act anent Proceeds of Sale of Properties in Thunder Bay - amending Act 3 1978

The General Assembly noting the changed situation in regard to Thunder Bay and the decision of the Synod of North America that the proceeds of the sale of properties should be transferred to the care of the General Trustees of the Church amend Act 3 Class II 1979 so as to read as follows from the second sentence: “The proceeds of sale shall be invested by the General Trustees for behoof of the Overseas Board and the Synod of North America. There shall be added to Capital annually from interest accruing such sums as shall prevent depreciation by inflation. The remaining interest shall be made available to the Overseas Board only for the benefit of their work in North America and Capital shall be drawn upon only by authority of the Board in consultation with the Synod of North America.” These arrangements are subject to Canadian Law.

They authorise the sale of the Church building and direct that the proceeds of the sale, or any compensation payable, be lodged with the General Trustees until required for the provision or erection of an alternative building, and the income meantime to be accumulated with the capital; any surplus remaining after the acquisition of the new building to be held for behoof of, and the interest thereon to be paid to, the Congregation. The transaction is to be carried through by the Church’s Law Agents. The Commission of Assembly receive the Petition from the Kilmuir and Stenscholl Congregation and grant its crave. They authorise the sale of the present Manse at Kilmuir and direct that the proceeds of the sale be lodged with the General Trustees until required for the purchase or erection of an alternative building, the income meantime to be accumulated with the capital. Further, with regard to the Mission House at Staffin, as this property is held on a Lease and negotiations are currently in progress with the Department of Agriculture and Fisheries for Scotland whereby a title may be granted, the Commission of Assembly direct that, if and when such a title is granted, the Congregation may sell the building, the proceeds of sale to be lodged with the General Trustees on the same basis as the proceeds of the sale of the Manse at Kilmuir.

Act 4 Act anent Sale of Property

1. The General Assembly receive the Petition from the Finance Committee of Fortrose. The General Assembly receive the petition from the Fortrose Congregation and grant its crave. They authorise the Congregation to sell the ground, surplus to their requirements, at a suitable distance to the west of the Church Hall, the proceeds of sale to be applied to the general funds of the Congregation, but the Assembly recommend that the Congregation consider the wisdom of selling the ground in such a way that they can maintain future control of its use.

2. The General Assembly receive the Petition from the Congregation of Coll and grant its crave. They authorise sale of the present Manse subject to (a) the retention by the Congregation, if they are so minded, of sufficient ground for the erection of a replacement Manse when the time is ripe and (b) such consent as may be necessary from the Superior. They direct that the proceeds of sale be invested with the General Trustees (subject to the retention from the proceeds by the Congregation of £l,000 to be expended by the Congregation on repairs to the Church building), one-half of the income from the balance to be applied to Congregational funds and the remaining one-half to be accumulated with the capital. The transaction is to be carried through by the Church’s Law Agents.

3. The General Assembly receive the Petition from the Congregation of North Knapdale and grant its crave. They authorise the sale of such portion of the Church ground at Tayvallich as is required, provided that the ground sold does not adversely affect the amenity or the security of the remainder, and provided that such consent as may be necessary is obtained from the Superior. The General Assembly further direct that the proceeds of sale be invested with the General Trustees and the income applied to Congregational purposes, the transaction to be carried through by the Church’s Law Agents.

The Commission of the General Assembly receive the Petition from the Congregation of Poolewe and Aultbea and grant its crave. They authorise the sale of the Mission House at Poolewe and its ground (formerly the Poolewe School) the proceeds to be held by the General Trustees until such time as they are required for the purchase or erection of a new Mission House. The Commission receive the further Petition from the Congregation and authorise the proposal of the Congregation to demolish the existing Manse and replace it with a new Manse within the same grounds. 2. The General Assembly receive the Petition from the Congregation of Strathy and grant its crave. They authorise the sale of the church and the manse at Strathy either together or separately, subject to such consent as may be necessary from the Superior. They direct that the proceeds of sale be invested with the General Trustees and the income applied to Congregational funds and that the transaction be carried through by the Church’s Law Agents.

3. The General Assembly receive the Petition from the Fearn Congregation and grant its crave. They authorise the sale of the Church in Fearn which is presently in disuse and direct that the proceeds of sale be invested with the General Trustees and the income applied to congregational purposes, the transaction to be earned through by the Church’s Law Agent. The General Assembly receive the Petition from Greenock Congregation and grant its crave. They authorise the withdrawal of a sum not exceeding £4,500 from funds held for behoof of the congregation, to be applied to the renovation of congregational property. They further direct that interest accruing on the remaining capital be made available, upon request by the Deacons’ Court, for congregational purposes.

The General Assembly direct that when Petitions for sale with proposed findings are included in the Committee’s submissions to the Assembly or its Commission, the Presbytery concerned shall appoint one of their number to answer such questions bearing on the local situation as members of Assembly or Commission may propose.

The General Assembly receive the Petition from the Congregation of Creich, Kincardine and Croick and grant its crave. They authorise the sale of the Church at Croick subject to such consent as may be necessary from the superior. Act 4 Act anent Release of Congregational Monies

The General Assembly receive the Petition from the Congregation of Greenock and grant its crave. They authorise the General Trustees to release a sum not exceeding £12,000 from the funds realised by the sale of the Church at Greenock: such sum to be applied to the purchase and renovation of the halls and ancillary rooms presently used by the congregation. The General Assembly receive the Petition from Lochalsh and Glenshiel Congregation and grant its crave. They authorise the General Trustees to release such sums from the funds realised by the sale of the Glenshiel manse as when added to the sum realised by the sale of the manse at Ardelve, shall meet the cost of the new manse being built at Ardelve. The General Assembly receive the Petition from Vancouver Deacons’ Court and grant its crave in the following terms. They delete the words of the General Assembly of the Free Church of Scotland from the last line of paragraph (2) of the Finding of 22nd May 1958 and substitute the following “of the Overseas Missions Board, who are hereby authorised to dispose of requests from the Deacons’ Court to apply specified amounts of the interest or capital of the Manse Fund to the maintenance of Gospel ordinances. They authorise the sale of half an acre of the manse garden, subject to the consent of the Superior or otherwise disposing of any objection to the variations of the feuing conditions. The proceeds of sale are to be lodged with the General Trustees for behoof of the congregation and the income to be available for congregational purposes. The whole transaction is to be carried out by the Church’s Law Agents.

3. The General Assembly receive the Petition from Watten and Bower Congregation and grant its crave. They authorise the sale of the manse at Watten and of the grounds adjacent which are surplus to the congregation’s requirements. The proceeds of the sale are to be invested by the General Trustees for behoof of the Congregation and the income to be paid to the congregation’s Fabric Fund. The whole transaction is to be carried out by the Church’s Law Agents.

4. The General Assembly receive the Petition from the Deacons’ Court of Aberfeldy, Glen Lyon and Pitlochry and grant its crave. They authorise the sale of a part of the manse garden approximately 430 sq. yards in area located on Old Crieff Road, Aberfeldy. The proceeds of sale are to be lodged with the General Trustees and to be made available to the congregation for the maintenance and repair of their properties. The whole transaction is to be carried out by the Church’s Law Agents.

5. The General Assembly receive the Petition from Saltcoats and Stevenston and grant its crave. They authorise the sale of the Church at Stevenston and direct that the proceeds of sale should be held by the General Trustees for behoof of the Congregation to be used for the improving of the Saltcoats Manse and Church. Act 22 Act anent Sale of Keiskammahoek Manse

The General Assembly authorise the sale of the Keiskammahoek Manse and empower the Foreign Missions’ Board to apply the proceeds, or part thereof, to the erection of a Church at Ibika, Butterworth, Southern Africa, on such terms as the Board deem most appropriate.

Act 21 Act authorising Sale of Colegio San Andres and Associated Properties

The General Assembly amend Act XXI 1980 to read as follows:- The General Assembly authorise the General Trustees, upon advice from the Foreign Missions’ Board, to sell the buildings occupied by the Colegio San Andres together with the other properties, inclusive of the residential flats which comprise the Edificio San Andres, situated on Avenida Du Petit Thouars 179, Lima 1, or alternatively arrange for the development and subsequent sale of the site. They direct that the proceeds of such sale should be applied to the acquisition and building of a new school and ancillary buildings inclusive of necessary staff accommodation in a more suitable location. The foregoing authorisation is conditioned upon the Trustees and the Finance, Law and Advisory Committee being satisfied with the financial arrangement of the whole transaction and the General Assembly direct the Board to consult with the General Trustees and the Finance Committee on necessary measures of interim financing of the project and for providing assistance to the Trustees’ Nominees. The Finance Committee and Trustees are authorised to advance such bridging loans as may be necessary and available.

They authorise the sale of the church and Manse at Dunbeath, either together or separately, subject to the appropriate consent from the Superior to the change of use, the proceeds of the sale to be lodged with the General Trustees and the income to be utilised for Congregational purposes and the transaction to be carried out by the Church’s Law Agents. The General Assembly receive the Petition from the Congregation of Watten and Bower and grant its crave. They authorise the sale of the manse at Bower subject to the appropriate consent from the Superior to the change of use, the proceeds of the sale to be lodged with the General Trustees and the income to be utilised for Congregational purposes and the transaction to be carried out by the Church’s Law Agents. The General Assembly receive the Petition from Kilmuir-Easter and Logie-Easter Congregation and grant its crave. They authorise the sale of the Church and manse at Kilmuir-Easter subject to such consent by the Superior as may be necessary for change of use. They direct that the proceeds of sale should be lodged with the General Trustees for behoof of the Congregation, the Presbytery of Tain and the Church Extension Committee. The income from the proceeds shall be apportioned as follows: One quarter to the consolidated charge of Rosskeen and Kilmuir-Easter; and three quarters to the Church Extension Committee and to be in the first instance available to the Presbytery of Tain for extension work within their bounds. It is further directed that, should extension work initiated by the Presbytery in Milton of Kildary in the parish of Kilmuir-Easter so prosper as to justify the erection or acquisition of buildings, the capital invested may, on application to the General Assembly, be made available for this purpose. The transactions are to be carried out by the Church’s law agents.

Act 4 Act anent Release of Congregational Monies

The General Assembly receive the Petition from the Presbytery of Lochaber and Lorn regarding monies held under the name of Glenorchy. They grant the crave of the Petition to the extent that the income from the total now held in capital be paid to the Presbytery to assist congregations within the bounds. Should the bounds of the Presbytery be altered this finding shall apply to the Presbytery within whose bounds Glenorchy shall be included. The General Assembly receive the Petition from the Deacons’ Court of Buccleuch and Greyfriars and grant its crave. They authorise the release to the congregational treasurer of monies held in the name of the congregation in the Custodiers of Titles account. The General Assembly receive the Petition from the Congregation of Farr and grant its crave. They modify the appropriate finding of the General Assembly included in Act 27, 1979 to the extent that the congregation shall have the use of the interest on the proceeds of the sale of the manse at Bettyhill for the purpose of securing the Church there in a wind and watertight condition. Thereafter interest accruing shall be used as directed in 1979.

Act 21 Act anent Sale of Colegio San Andres and Related Properties

The General Assembly authorise the General Trustees, upon advice from the Foreign Missions Board, to sell the buildings occupied by the Colegio San Andres together with the other properties, inclusive of the residential flats which comprise the Edificio San Andres, situated on Avenida Du Petit Thouars 179, Lima 1. They direct that the proceeds of such sale should be applied to the acquisition and building of a new school and ancillary buildings in a more suitable location. The foregoing authorisation is conditioned upon the Trustees and the Finance, Law and Advisory Committee being satisfied with the financial arrangement of the whole transaction and the General Assembly direct the Board to consult with the Finance Committee on necessary measures of interim financing of the project and for providing assistance to the Trustees’ Nominees. The Finance Committee and Trustees are authorised to advance such “bridging loans” as may be necessary and available.

Act 2 Act anent Sale of Property

The Commission of Assembly receive the Petition from the Free Elder Memorial Church and grant its crave. They authorise the Congregation to sell the Manse, 48 Netherby Road, Edinburgh and, as the title stands in the name of the General Trustees of the Church, they further authorise the General Trustees, with consent of the Congregational Trustees, to grant the appropriate Conveyance to the Purchaser, the proceeds of sale to be retained meantime by the General Trustees and thereafter applied to the purchase or erection of a more suitable Manse, the title being taken in the name of the Congregational Trustees in terms of the Model Trust Deed; any income accruing to be added to capital and any surplus after acquisition of a new manse to be utilised for congregational purposes. The transaction is to be carried out by the Church’s Law Agents. The Commission of Assembly receive the Petition from the Congregation of Kiltarlity and Kirkhill and grant its crave. They authorise the sale of the Manse building at Kiltarlity, subject to such consent as may be necessary from the Superior, the proceeds to be lodged with the General Trustees and applied to the erection of a more suitable residence on adjoining ground belonging to the Congregation; any income accruing to be added to the capital. The transaction is to be carried out by the Church’s Law Agents. This approval is given on the understanding that the proceeds of sale will approximate to the likely cost of a new manse. The Commission of Assembly, waiving irregularities, receive the Petition from the London Congregation and grant its crave. They authorise the sale of the present manse at 306 Brownhill Road, London, in order to acquire a more suitable residence. This authority is given subject to the following provisos: (1) The Church’s Law Agent shall be satisfied that there is no legal barrier to sale. (2) The new manse shall be held in terms of the Model Trust Deed or as nearly as English Law allows. (3) The income of sale shall be applied to the purchase of the new manse any surplus in the transaction being utilised for the Congregation’s Building Fund. (4) The transaction shall be carried out under the supervision of the Church’s Law Agent.

Act 4 Act anent Sale of Property at Kilwinning

The Commission of Assembly note the intention of the Kilwinning Congregation to sell the property known as Deanfield, Almswall Road, Killwinning. They note also that the Kilwinning Congregation was duly admitted as a Congregation of the Free Church of Scotland on 2nd October 1956 by the Presbytery of Glasgow pursuant to a decision of the Commission of General Assembly of date 8th August 1956 and that title to the property referred to deduces from the Trustees for the Associated Anti-burghers Congregation of Original Seceders through the proceedings of the Commission of Assembly of the Free Church of Scotland in August 1956. The Commission of Assembly advise that the proceeds of sale insofar as capital is not required for improvements to congregational property be lodged with the General Trustees and the income applied to Congregational Funds and that the transaction be under the general supervision of the Church’s Law Agents.
