P a g e | 1 Language Contact in Pomerania: The Case of German, Polish, and Kashubian Nick Znajkowski, New York University Purpose The effects of language contact and language shift are well documented. Lexical items and phonological features are very easily transferred from one language to another and once transferred, rather easily documented. Syntactic features can be less so in both respects, but shifts obviously do occur. The various qualities of these shifts, such as whether they are calques, extensions of a structure present in the modifying language, or the collapsing of some structure in favor the apparent simplicity found in analogous foreign structures, all are indicative of the intensity and the duration of the contact. Additionally, and perhaps this is the most interesting aspect of language shift, they show what is possible in the evolution of language over time, but also what individual speakers in a single generation are capable of concocting. This paper seeks to explore an extremely fascinating and long-standing language contact situation that persists to this day in Northern Poland—that of the Kashubian language with its dominating neighbors: Polish and German. The Kashubians are a Slavic minority group who have historically occupied the area in Northern Poland known today as Pomerania, bordering the Baltic Sea. Their language, Kashubian, is a member of the Slavic branch of Indo-European languages and further belongs to the Pomeranian branch of Lechitic languages, which includes Polish, Silesian, and the extinct Polabian and Slovincian. The situation to be found among the Kashubian people, a people at one point variably bi-, or as is sometimes the case among older folk, even trilingual in Kashubian, P a g e | 2 Polish, and German is a particularly exciting one because of the current vitality of the Kashubian minority culture. -

TRANSLATING THE CONSTITUTION ACT, 1867 A Legal-Historical Perspective by HUGO YVON DENIS CHOQUETTE A thesis submitted to the Faculty of Law in conformity with the requirements for the degree of Master of Laws Queen’s University Kingston, Ontario, Canada September 2009 Copyright © Hugo Yvon Denis Choquette, 2009 Abstract Twenty-seven years after the adoption of the Constitution Act, 1982, the Constitution of Canada is still not officially bilingual in its entirety. A new translation of the unilingual Eng- lish texts was presented to the federal government by the Minister of Justice nearly twenty years ago, in 1990. These new French versions are the fruits of the labour of the French Constitutional Drafting Committee, which had been entrusted by the Minister with the translation of the texts listed in the Schedule to the Constitution Act, 1982 which are official in English only. These versions were never formally adopted. Among these new translations is that of the founding text of the Canadian federation, the Constitution Act, 1867. A look at this translation shows that the Committee chose to de- part from the textual tradition represented by the previous French versions of this text. In- deed, the Committee largely privileged the drafting of a text with a modern, clear, and con- cise style over faithfulness to the previous translations or even to the source text. This translation choice has important consequences. The text produced by the Commit- tee is open to two criticisms which a greater respect for the prior versions could have avoided. First, the new French text cannot claim the historical legitimacy of the English text, given their all-too-dissimilar origins. -

The French Legal Studies Curriculum: Its History and Relevance as a Model for Reform Thomas E. Carbonneau* I. Introduction Much like a fine wine of precious vintage, the legal studies curriculum in France took centuries to reach its point of maturity. By and large, it is a product of careful molding and enlightened experimentation, although some disparity exists between its theo- retical promise and its actual implementation within the French university system. Moreover, its history is not without its share of ill-conceived hopes and retrogressive thinking. This article at- tempts to describe and analyze those events which fostered the historical metamorphosis of the French legal studies curriculum. The predominance of a broad academic -approach to law and the concomitant absence of a narrow "trade sohool" mentality in the French law schools might be attributed to the general organi- zation of higher education in France.1 The basic law degrees, the licence and the maitrise en droit, are undergraduate degrees; stu- dents enter the university law program at the age of eighteen or nineteen after having obtained the baccalaurdat (the French high school diploma). -

THE NATURE OF LEGAL LANGUAGE [This material may be used for educational or academic purposes if cited or referred to as: Peter Tiersma, The Nature of Legal Language, http://www.languageandlaw.org/NATURE.HTM] One of the great paradoxes about the legal profession is that lawyers are, on the one hand, among the most eloquent users of the English language while, on the other, they are perhaps its most notorious abusers. Why is it that lawyers, who may excel in communicating with a jury, seem incapable of writing an ordinary, comprehensible English sentence in a contract, deed, or will? And what can we do about it? Consider, first, the eloquence of the legal profession. Daniel Webster was famed for his oratory skills. Called upon to assist the prosecution in a murder case, Webster addressed any hesitations the jurors might have harbored about their power to punish the guilty. In doing so, he provided a memorable defense of the theory of deterrence: The criminal law is not founded in a principle of vengeance. It does not punish that it may inflict suffering. The humanity of the law feels and regrets every pain that it causes, every hour of restraint it imposes, and more deeply still, every life it forfeits. But it uses evil, as the means of preventing greater evil. It seeks to deter from crime, by the example of punishment. This is its true, and only true main object. It restrains the liberty of the few offenders, that the many who do not offend, may enjoy their own liberty. It forfeits the life of the murderer, that other murders may not be committed. -

COMMENT The French Language in Louisiana Law and Legal Education: A Requiem* I. INTRODUCTION Anyone familiar with the celebrated works of the sixteenth century French satirist Frangois Rabelais is sure to remember the protagonist Pantagruel's encounter with the Limousin scholar outside the gates of Orldans.1 During his peregrinations, the errant Pantagruel happens upon the Limousin student who, in response to a simple inquiry, employs a gallicized form of Latin in order to show off how much he has learned at the university.? The melange of French and Latin is virtually incomprehensible to Pantagruel, prompting him to exclaim, "What the devil kind of language is this?"' 3 Determined to understand the student, Pantagruel launches into a series of straightforward and easily answerable questions. The Limousin scholar, however, responds to each question using the same unintelligi- ble, bastardized form of Latin." The pretentious use of pseudo-Latin in lieu of the French vernacular infuriates Pantagruel and causes him to physically assault the student. -

English Alliterative Verse: Poetic Tradition and Literary History
ENGLISH ALLITERATIVE VERSE English Alliterative Verse tells the story of the medieval poetic tradition that includes Beowulf, Piers Plowman, and Sir Gawain and the Green Knight, stretching from the eighth century, when English poetry first appeared in manuscripts, to the sixteenth century, when alliterative poetry ceased to be composed. Eric Weiskott draws on the study of meter to challenge the traditional division of medieval English literary history into ‘Old English’ and ‘Middle English’ periods. The two halves of the alliterative tradition, divided by the Norman Conquest of 1066, have been studied separately since the nineteenth century; this book uses the history of metrical form and its cultural meanings to bring the two halves back together. In combining literary history and metrical description into a new kind of history he calls ‘verse history,’ Weiskott reimagines the historical study of poetics. eric weiskott is Assistant Professor of English at Boston College. In addition to publishing widely on alliterative verse and early English literary history in journals such as Anglo-Saxon England, ELH, Modern Language Quarterly, Modern Philology, Review of English Studies, and Yearbook of Langland Studies, Weiskott is also a practicing poet. Most recently, his poems have appeared in burnt- district, Cricket Online Review, and paper nautilus. His first poetry chapbook was Sharp Fish (2008). 'In Me Porto Crucem': a New Light on the Lost St Margaret's Crux Nigra

Both Turgot, Margaret’s biographer, and Aelred of Rievaulx, who spent some years at the court of Margaret’s son, King David, mention the reliquary without offering sufficient information on its origin. The Black Rood was probably lost or destroyed in the sixteenth century. Some lines written on the margins of a twelfth- century manuscript containing Aelred’s Genealogia regum Anglorum can now shed a new light on this sacred object. The mysterious lines, originally written on the Black Rood or more probably on the casket in which it was contained, claim that the relic once belonged to an Anglo-Saxon king, and at the same time they seem to convey a signifi- cant political message. In his biography of St Margaret of Scotland,1 Turgot († 1115),2 at the time prior of Durham, mentioned an object that was particularly dear to the queen. It was a cross known as crux nigra. In chapter XIII of his Vita sanctae Margaretae, Turgot tells how the queen wanted to see it for the last time when she felt death was imminent: 3 Ipsa quoque illam, quam Nigram Crucem nominare, quamque in maxima semper ven- eratione habere consuevit, sibi afferri præcepit.
