RE: Landfill Environmental Screening Study

DESCRIPTION Landfill Environmental Screening Study

RECOMMENDATION the information be received.

SUMMARY The Town of Smooth Rock Falls (Town) has completed an Environmental Screening Study for the proposed expansion to increase the disposal capacity at their Municipal Landfill by approximately 83,000 m3. The Town has also proposed to amend the Municipal Landfill Service Area to accommodate waste received from other municipalities.

PURPOSE Presently, the Town operates a 2.95 ha waste disposal site on a 9.04 ha property. The Landfill has been operational, accepting Municipal solid waste since 1986, and is rapidly approaching its total approved capacity of 89,500 m3.

Currently the remaining life of the Site is estimated to range between 1 to 2 years. The expansion will increase the total landfill capacity to approximately 172,500 m3, allowing for the life of the landfill to be extended into the foreseeable future.

The Environmental Screening Process has been documented in the Environmental Screening Report, which is a requirement under Provincial legislation when expanding a landfill by more than 40,000 m3 but less than 100,000 m3

The Study was conducted in accordance with the planning and design process outlined in Ontario Ministry of the Environment, Conservation and Parks’ “Guide to Environmental Assessment Requirements for Waste Management Projects” dated March 2007.

Page 13 of 38 The Screening process involves identifying and applying screening criteria to determine and describe potential environmental effects, public/external agency consultation, and the development of measures to mitigate identified environmental effects. The results of the Study were documented in an Environmental Screening Report, which will be made available for a 60-calendar day review period starting in August 2020 and ending in October 2020.

A Notice of Completion will be sent out to residents, Indigenous communities and government agencies outlining the information above, as well as who they may contact at the Town (Shane) in terms of questions or comments.

The Notice will also let residents know where they may view a copy of the Environmental Screening Report. In light of the current situation regarding COVID-19; hard copies will not be placed on display at public locations, but an electronic version will be available for public review at http://www.smoothrockfalls.ca. If there are no comments from residents, Indigenous communities or government agencies after the end of the 60-calendar day review period, then the Town of Smooth Rock Falls may proceed with detailed design and implementation of the expansion, subject to an amendments to the existing Environmental Compliance Approval (ECA) for the site.

 Correspondence from The Federation of Municipalities (FONOM) regarding issues discussed at their May 13th, 2020 virtual meeting brought attention to the Association of Municipalities of Ontario's (AMO's) Discussion Paper "New Ontario Provincial Police Detachment Boards: Building a Framework for Better Policing Governance";  AMO's discussion paper proposes that Northern Ontario District Social Services Administration Boards (DSSAB) replace the current OPP Detachment Boards;  the FONOM Board has identified several issues with DSSAB Boards replacing the current Detachment Boards, and recognizes that Community Policing is distinctive to each Municipality;  The Chair of the Smooth Rock Falls Board is in agreement with the opinion of FONOM and does not support that the current DSSABs would not be the best solution for overseeing the Northern OPP Detachments;  That the Chair recommendations echo the many resolution from Northern Municipalities stating the same opposition;  That a resolution from the Town of Smooth Rock Falls will be presented top our next council meeting on August 4, 2020 supporting the Chair recommendations and that the resolution would then be to FONOM and its member municipalities within NEOMA

The Ministry of the Attorney General has held several sessions and discussions on a new Governance model for OPP Police, under Community Safety and Policing Act, 2019. When the government passes the legislation, all Municipalities will lose the option to move forward with or without the Contract and may change your Detachment Board structure.

FONOM is working on a recommendation to the Solicitor General, and we would like to ask for information from our membership. Would I ask you to reach out to your council representative on your OPP Detachment Board and ask for their preference for the board's structure? Can you ask if they are happy with the current model or district size?

The Federation of Municipalities met on Wednesday, May 13th, 2020, by ZOOM, to discuss the issues and challenges facing their 110 members. Since the COVID19 Pandemic contributed to the cancellation of FONOM’s Annual Conference, the Executive and Board have been meeting monthly to understand the changing landscape better. President Danny Whalen said “with several members of the Board sitting at other political tables, it’s important that we hear from our members about the impacts the COVID19 Pandemic is having in the North”. The Board reviewed and discussed AMO’s Policy Paper on the “OPP Detachment Boards, Building a Framework for Better Policing Governance.” The Paper notes that Northern Ontario is unique, but the FONOM Board identified several issues with the DSSAB Boards replacing the current Detachments Boards. Community Policing is distinctive to each Municipality, and the current DSSAB’s would not be the best solution for overseeing the Northern OPP Detachments. Several of those issues were; • The discrepancy between the number of DSSAB Boards to the number of Detachments. • Representation on some boards, with members of the municipalities with no OPP contracts. • The concern that this will start a conversation about the creation of Upper Tier or Regional Governments in the North. During the meeting the Board appointed Sandra Hollingsworth to the Northern Ontario School of Medicine, Nominations and Community Relations Committee and as our representative to the AMO’s Health Task Force. Sandra’s experience working in the Health field will be a benefit for our members. FONOM is an association of some 110 districts/municipalities/cities/towns in Northeastern Ontario mandated to work for the betterment of municipal government in Northern Ontario and to strive for improved legislation respecting local government in the north. It is a membership-based association that draws its members from northeastern Ontario and is governed by an 11-member board.

The Ministry of the Attorney General has held several sessions and discussions on a new Governance model for OPP Police, under Community Safety and Policing Act, 2019. When the government passes the legislation, all Municipalities will lose the option to move forward with or without the Contract and may change your Detachment Board structure.

FONOM is working on a recommendation to the Solicitor General, and we would like to ask for information from our membership. Would I ask you to reach out to your council representative on your OPP Detachment Board and ask for their preference for the board's structure? Can you ask if they are happy with the current model or district size? If I would be able to get the information back by July 20th, as the Policy Paper has to be written ahead of the AMO Conference.

Whereas, the Association of Municipalities of Ontario (AMO) has issued the Discussion Paper New Ontario Provincial Police (OPP) Detachment Boards: Building a Framework for Better Policing Governance, identifying that the Boards are a vital link between the police and democratic governance and that open and transparent discussions are essential; and, Whereas, the government is planning to move from OPP Detachment boards aligning with municipal boundaries to regional or detachment-based boundaries; and, Whereas, one of the goals of this initiative is to improve the quality of the existing governance and civilian oversight system including ensuring that community expectations are reflected in the way a community is policed and that good governance of policing matters will apply to municipalities of all sizes; and,

Whereas, the Township of Hornepayne does not currently have an OPP Detachment Board and deems it necessary to have representation on such a Board in order to help align policing objectives, priorities and policies with community expectations and to align municipal public safety expectations with those of neighbouring communities; Therefore Be It Resolved That, the Council of the Corporation of the Township of Hornepayne does hereby support for following: • that the government recognize that policing is fundamentally local; • that, at a minimum, each OPP cluster, at least in northern, rural areas, be permitted to establish an OPP Detachment Board including representation for each community serviced by the OPP; and, • that all municipalities should have the opportunity to select at least one representative to sit on an OPP Detachment Board; • that the members should be municipally selected, non-elected officials (community and/or municipal staff members); • that individual Detachments be permitted to control the appointment of provincial members; • that each Board will determine local objectives, priorities and policies in consultation with the Detachment Commander, consistent with the Solicitor General's strategic plan for the OPP out of which the Detachment Commander that prepare and adopt a local plan; and, • that the cost for the boards, mandatory member training, and any other related costs must be provincially funded in order to make access to the boards fair for all; Be It Further Resolved that the Council of the Corporation of the Township of Hornepayne is in full support of the Federation of Northern Ontario Municipalities' (FONOM's) statement that replacement of OPP Detachment Boards by District Social Services Administration Boards (DSSAB's) in Northern Ontario, a suggested option in the AMO Discussion Paper, would not be the best solution for overseeing Northern OPP Detachments and would lessen the voices of small, northern communities; and, Be It Finally Resolved that a copy of this resolution be sent to the Association of Ontario Municipalities (AMO), the Federation of Northern Ontario Municipalities (FONOM), the Honourable Sylvia Jones, Solicitor General, Michael Mantha, MPP Algoma-Manitoulin, all ~J:io municipalities with a copy being submitted to the c ltation process when it reopens. _Carried _Defeated _Deferred

RECOMMENDATION THAT the council of the Town of Smooth Rock Falls accepts the report and reviews the procedural bylaw and recommended resolution as recommended from Wishart Law Firm LLP.

SUMMARY Bill 197 received royal assent on July 21, 2020. Among other changes, Bill 197 repealed those subsections of the Municipal Act, 2001 that permitted electronic meetings during the declared emergency.
