The collapse of Roman government in the western Roman empire in the late fifth century inspired a crisis of identity and political messaging in the eastern Roman empire of the same period. I argue that the Romans of the eastern empire, in particular those who lived in Constantinople and worked in or around the imperial administration, responded to the challenge posed by the loss of Rome by rewriting the history of the Roman empire. The new historical narratives that arose during this period were initially concerned with Roman identity and fixated on urban space (in particular the cities of Rome and Constantinople) and Roman mythistory. By the sixth century, however, the debate over Roman history had begun to infuse all levels of Roman political discourse and became a major component of the emperor Justinian’s imperial messaging and propaganda, especially in his Novels. The imperial history proposed by the Novels was aggressivley challenged by other writers of the period, creating a clear historical and political conflict over the role and import of Roman history as a model or justification for Roman politics in the sixth century. -

To repress the war torts, as well as to overcome the soldiers’ resistance, which at moments was violent, the king (rex) himself at first and the highest new established magistrates i.e. consuls (consules) afterwards, have been using various constrained acts. The authority of such enforcement against Roman soldiers sprang from their “military imperium” (imperium militiae). As most important criminal and judicial organs in conditions of war, responsible for maintenance of the military courtesy, were introduced the military commander (dux) and the array and their subsidiary organs were the cavalry commander, military legates, military tribunals, centurions and regents. In this paper, due to limited available space, we will only stick to the main military courts in ancient Rome. Keywords: military camp; tribunal; dux; recruiting; praetor. 1. These investigations have, however, largely privileged the importance of these activities to the upper levels of society. Attempts to examine the responses of the lower classes to death, and its consequent demands for disposal and commemoration, have focused on the activities of freedmen and slaves anxious to establish or maintain their social position. The free poor, living on the edge of subsistence, are often disregarded and believed to have been unceremoniously discarded within anonymous mass graves (puticuli) such as those discovered at Rome by Lanciani in the late nineteenth century. This thesis re-examines the archaeological and historical evidence for the funerary practices of the urban poor in Italy within their appropriate social, legal and religious context. The thesis attempts to demonstrate that the desire for commemoration and the need to provide legitimate burial were strong at all social levels and linked to several factors common to all social strata. -

Catullus, Memmius, and Bithynia
Catullus, Memmius, and Bithynia Gaius Memmius was the son-in-law of Sulla, an orator who won backhanded praise from Cicero (Brut. 247), seducer of the wife of Marcus Lucullus (Cic. Att. 1. 18. 3) and a fierce adversary of his brother (Plut. Cat. Mi. 29. 5-8), a poet whose immodesty impressed Ovid (Tr. 2. 433), a praetor (Cic. Q. fr. 1. 2. 16), a candidate for the consulship, a disgraced exile, the probable but imperfect patron of Lucretius, and a perfect villain for Catullus, and a successful military commander, hailed by his troops as “Imperator.” The last is evidenced by a denarius (427 Crawford). The obverse presents the head of Ceres, facing right, with C∙ MEMMI C ∙ F ∙ reading downwards. On the reverse is a trophy and a kneeling captive with hands tied behind his back; reading downwards on the left is the title IMPERATOR and on the right C ∙ MEMMIUS. To my knowledge this remarkable coin is never brought up in discussions of Catullus, despite the fact that Catullus would have been serving in the cohors of Memmius at the time he was acclaimed imperator. Crawford and others date the coin to 56, following the consensus that Memmius was governor of Bithynia in 57. This presents a problem, for it seems unlikely that Memmius could have engaged in any significant military campaign nine years after the province had been pacified (Cic. Agr. 2. 47) and a full five years after Pompey’s settlement of the East. It is much more likely that Memmius’ victory was earlier, at a time when there was still potential unrest in the area of Bithynia following Mithradates’ resurgence in 67. -

Brian Rose, Supervisor of Dissertation This dissertation investigates how Rome organized and paid for the considerable amount of labor that went into the physical transformation of the Middle Republican city. In particular, it considers the role played by the cost of public construction in the socioeconomic history of the period, here defined as 390 to 168 B.C. During the Middle Republic period, Rome expanded its dominion first over Italy and then over the Mediterranean. As it developed into the political and economic capital of its world, the city itself went through transformative change, recognizable in a great deal of new public infrastructure. -

This is clearly visible today, and it was also clearly visible to the Romans. The praetor’s work represented par excellance the actualization of the common good under specific conditions and for particular persons. The praetor was endowed with powers which ensured autonomy of action in Rome, limited only by the one-year-long term of office, or an objection by members of the magistracy. He was to act for the benefit of his fellow citizens as a group, and enhance their relationship with the civitas as well as among the citizens themselves. It was only in the latter sphere that he began to play an important role in the protection of private rights. The urban praetor combined all three spheres, which led to the emergence of ways for resolving and settling conflicts, thus improving conditions for the development of individuals within the State, understood as a community of citizens. The claim that the praetor promoted the common good that way – being both predestined and empowered to do so – results from an attempt at identifying the values behind legal solutions. It is not enough to establish what functions were performed by the magistrate and what tools he had at his disposal. It appears 217 that the quintessence of the mission the praetor was entrusted with was promotion of the common good – the way, naturally, it was understood by him and his fellow citizens understood it. -

The territorial expansion of Rome, the wars waged, and, in particular, the need to raise funds for their financing affected not only the norms of public law but also individual regulations of Roman private law, including those considering both tax and inheritance law. Keywords: vicesima UMCShereditatis; caducum; Roman law I. Wars have accompanied the Romans since the beginning of statehood. Dur- ing the Roman Kingdom period, fighting was rather rare and local. This situation changed after the introduction of the republic. This was the beginning of the ex- pansive policy of the Romans, which lasted throughout the times of the Empire. At that time, a great number of wars were being waged, at the same time internal riots took place, causing confusion in the structure of the Roman state. At the same time, factors facilitating control over the whole country and leading fights started to appear. The road system was extended, military bases were built for future military expeditions and they became fortresses, colonies, beginnings of the Italian cities and provinces. -
Calendar of Roman Events
Introduction Steve Worboys and I began this calendar in 1980 or 1981 when we discovered that the exact dates of many events survive from Roman antiquity, the most famous being the ides of March murder of Caesar. Flipping through a few books on Roman history revealed a handful of dates, and we believed that to fill every day of the year would certainly be impossible. From 1981 until 1989 I kept the calendar, adding dates as I ran across them. In 1989 I typed the list into the computer and we began again to plunder books and journals for dates, this time recording sources. Since then I have worked and reworked the Calendar, revising old entries and adding many, many more. The Roman Calendar The calendar was reformed twice, once by Caesar in 46 BC and later by Augustus in 8 BC. Each of these reforms is described in A. K. Michels’ book The Calendar of the Roman Republic. In an ordinary pre-Julian year, the number of days in each month was as follows: 29 January 31 May 29 September 28 February 29 June 31 October 31 March 31 Quintilis (July) 29 November 29 April 29 Sextilis (August) 29 December. The Romans did not number the days of the months consecutively. They reckoned backwards from three fixed points: The kalends, the nones, and the ides. The kalends is the first day of the month. For months with 31 days the nones fall on the 7th and the ides the 15th. For other months the nones fall on the 5th and the ides on the 13th. -

Where information has been derived from other sources, I confirm that this has been indicated in the thesis. 2 Thesis abstract One of the major duties performed by the censors of the Roman Republic was that of the lectio senatus, the enrolment of the Senate. As part of this process they were able to expel from that body anyone whom they deemed unequal to the honour of continued membership. Those expelled were termed ‘praeteriti’. While various aspects of this important and at-times controversial process have attracted scholarly attention, a detailed survey has never been attempted. The work is divided into two major parts. Part I comprises four chapters relating to various aspects of the lectio. Chapter 1 sees a close analysis of the term ‘praeteritus’, shedding fresh light on senatorial demographics and turnover – primarily a demonstration of the correctness of the (minority) view that as early as the third century the quaestorship conveyed automatic membership of the Senate to those who held it. It was not a Sullan innovation. In Ch.2 we calculate that during the period under investigation, c.350 members were expelled. When factoring for life expectancy, this translates to a significant mean lifetime risk of expulsion: c.10%. Also, that mean risk was front-loaded, with praetorians and consulars significantly less likely to be expelled than subpraetorian members. -
The Fifth Century, the Decemvirate, and the Quaestorship
THE FIFTH CENTURY, THE DECEMVIRATE, AND THE QUAESTORSHIP Ralph Covino (University of Tennessee at Chattanooga). There has always been some question as to the beginnings of the regularized quaestorship. As long ago as 1936, Latte pointed out that there seems to be no Roman tradition as to the quaestors’ origins.1 As officials, they barely appear at all in the early Livian narrative. The other accounts which we possess, such as those of Tacitus and Ioannes Lydus, are unhelpful at best. While scholars such as Lintott and others have sought to weave together the disparate fragments of information that exist so as to construct a plausible timeline of events surrounding the first appearance of regular, elected quaestors in the middle of the fifth-century, it becomes apparent that there is a dimension that has been omitted. Magisterial offices, even ones without the power to command and to compel, imperium, do not appear fully-formed overnight. This paper seeks to uncover more of the process by which the regular quaestors emerged so as to determine how they actually came to be instituted and regularized rather than purely rely on that which we are told happened from the sources.2 Tacitus records that quaestors were instituted under the monarchs in a notoriously problematic passage: The quaestorship itself was instituted while the kings still reigned, as shown by the renewal of the curiate law by L. Brutus; and the power of selection remained with the consuls, until this office, with the rest, passed into the bestowal of the people. The first election, sixty-three years after the expulsion of the Tarquins, was that of Valerius Potitus and Aemilius Mamercus, as finance officials attached to the army in the field.
