7. Waterside Permit Application — Island Enterprises Applicant has resubmitted a Waterside Permit Application. At its December 18, 2018, meeting the City Council approved the renewal of Island Enterprises’ 2019 Waterside Permit contingent upon payment of the outstanding balance for various harbor related fees owed the City. The 2020 Waterside Permit Renewals were heard by Council at its December 17, 2019, City Council meeting. Island Enterprises’ Waterside Permit was not renewed because there is still an outstanding balance owed to the City of Avalon. Recommended Action: Deny Island Enterprises’ request for a Waterside Project Application pursuant to Section 10-2.416(a) (8) and (9) of the Avalon Municipal Code.
PUBLIC HEARING
8. Public Hearing for Approval of Fiscal Year 2020-2021 Community Development Block Grant (CDBG) Funds. A Public Hearing is required to receive comments on the proposed use of the FY 2020-2021 CDBG Funds. Staff is recommending the FY 2020-2021 funds be used for Phase IIof the City of Avalon’s ADA Curb and Ramp Project. Recommended Action: Open the Public Hearing, accept comments, close the Public Hearing and authorize the City Manager to approve the proposed allocation of Fiscal Year 2020-2021 CDBG funds for Phase II of the ADA Curb and Ramp Project.
GENERAL BUSINESS
9. Ordinance Amending Chapter 4 of Title 3 of the City of Avalon Municipal Code to Implement Uniform Public Construction Cost Accounting Act Procedures for Public Projects The Uniform Public Construction Cost Accounting Act (Act) is a program created in 1983 that provides for alternative bidding procedures for public projects ifthe agency elects to follow the cost accounting procedures set forth in the Cost Accounting Policies and Procedures Manual of the California Uniform Construction Cost Accounting Commission. The Act is enacted under Public Contracts Code Section 22000 through 22045. On December 4, 2018, the City Council adopted Resolution 18-39 electing to become subject to the Act. Recommended Action: Introduce and waive all readings of an Ordinance of the City of Avalon amending Chapter 4 (Purchasing System) of Title 3 (Finance) of the City of Avalon Municipal Code to implement the Uniform Public Construction Cost Accounting Act procedures for public projects. 10. Development of Cruise Ship Policy This item was discussed at two previous City Council meetings on October 1, 2019 and December 17, 2019. City Staff was directed to come back with certain findings. Staff developed guidelines for scheduling future cruise ship requests. Recommended Action: Consider adopting by resolution a policy that will provide guidelines for scheduling cruise ships to visit the City of Avalon.

SUBJECT: Fiscal Year 2019-2020 Second Quarter Treasurer’s Report
RECOMMENDED ACTION(S): Adopt the resolution accepting the FY19-20 Second Quarter Treasurer’s Report.
REPORT SUMMARY: State and Municipal Codes require the Treasurer to submit within 30 days following each fiscal quarter a report summarizing the City’s cash and investment balances. Attached is the Second Quarter Treasurer’s Report for FY19-20.
The purpose of the report is to inform you on a quarterly basis, the City’s cash and investment balances, the investment types, yields, and market values, and to ensure you that the City’s investments are in compliance with the City’s adopted Investment Policy.
The report shows that all of the City’s funds are in compliance with its investment policy. In general, operating cash is held in US Bank checking accounts and the excess cash is invested in California’s Local Agency Investment Fund (LAIF) and various certificates of deposit (CDs), both currently earning around 2% interest.
The total cash balance for the second quarter of 2019-2020 has increased by approximately $100 thousand compared to the first quarter of 2018-2019. The unrestricted cash balance for the second quarter of 2019-2020 has decreased by approximately $2.1 million due to funds transfer to trust accounts totaling approximately $400 thousand, outstanding grants receivables totaling approximately $600 thousand, and budgeted draws on fund balance in the FY2018-2019 and FY2019-2020 budgets. The grants receivable have been invoiced and are expected to be received in the third quarter of 2019-2020. The restricted cash balance for the second quarter of 2019-2020 has increased by approximately $1.2 million compared to the second quarter of 2018-2019. The increase was attributed to the SERAF loan repayment to the Housing Authority of approximately $600 thousand, the previously mentioned transfers to trust accounts, and investment income.
GOAL ALIGNMENT: Required disclosures.
1 Comparisons are to the same quarter in the prior fiscal year to avoid seasonal fluctuations in cash balances. The First Quarter Treasurer’s Report for FYi 8-19 did not include the landfill trust account with a balance of approximately $2.2 million, which has subsequently been included in cash totals for comparison purposes. SUBJECT: Authorize Bid Solicitation for Phase lB Community ADA Ramp Project
RECOMMENDED ACTION(S): Authorize the bid solicitation for Phase 1B Community ADA Ramp Project.
REPORT SUMMARY: The scope of the proposed work for the project is to construct Americans with Disabilities Act (ADA) compliant curb ramps at four locations.
In 2019, the City completed the construction of seven ramps and two cross gutters with the base bid of the Phase I Community ADA Ramp Project. Four additional ramps were included in the Phase 1 plans and specified on the bid sheet as add bid items - but due to lack of funds were not awarded. This year’s CDBG allocation along with the balance of previous years allocation appears to be sufficient to fund the construction of these four ramps. The four ramps are located at Third Street, with two at the Catalina Avenue intersection and two at the Clarissa Avenue intersection. To simplify the production of the construction documents, staff is reusing the construction drawings from the Phase 1 project which included the scope of the proposed four ramps. The updated project plans will be renamed with the project title as Phase 1B Community ADA Ramp Project’. City Council previously approved the plans for construction.
The project is funded through the Community Development Block Grant (CDBG) federal program, one of the longest-running programs of the U.S. Department of Housing and Urban Development and is included in the Fiscal Year 19/20 budget under CIP number 180006. Construction will be scheduled to be completed before May 1, 2020.
GOAL ALIGNMENT: City Infrastructure.
FISCAL IMPACTS: This item is included in the Fiscal Year 19/20 budget and funds will be reimbursed through CDBG funding.

SUBJECT: Waterside Permit Application — Catalina Scuba dba Scuba Instruction and Guides
RECOMMENDED ACTION(S): City Council make the affirmative finding that conditions set forth in the Avalon Municipal Code have been met and grant the Waterside Permit Application to Catalina Scuba ciba Scuba Instruction and Guides, with the following condition:
1. Applicant abides by the Standard List of Conditions for Waterside Permit Holders.
REPORT SUMMARY: The applicant has submitted a Waterside Permit Application to offer scuba instruction and guided dives.
The applicant will be operating 7 days per week, year round, between the hours of 8:00am and sundown.
Sec. 10-2.416 of the Municipal Code provides that a waterside permit may only be granted where the City Council is able to make the following affirmative findings: 1. The project will not result in a substantial alteration of the City’s present or planned waterside uses of the Avalon Harbor; 2. With regard to transportation and circulation, the project (i) will not generate substantial additional boat trips, including shoreboat trips, or other movement within Avalon Harbor; (ii) will not have a substantial negative impact upon existing mooring, docking, or other anchorage facilities; (iU)will not have a substantial impact on other modes and systems of transportation; (iv) will not result in substantial alterations to present patterns of circulation or movement of people and/or goods; (v) will not increase traffic hazards to swimmers, boaters, or other existing activities; and (vi) will not restrict or alter existing coastal access; 3. The project will not have a substantial effect upon and will not result in a need for new or altered governmental services, including but not limited to, fire, police, maintenance of facilities, and Harbor Department services; 4. The project willnot result in the use of substantial amounts of fuel or other forms of energy or substantially increase the demand upon existing sources of energy or require the development of new sources of energy; 5. The project will not result in a need for new utility systems or a substantial alteration of existing sources or systems for power, natural gas, communications, water, sewage disposal or solid waste disposal; 6. The project will not obstruct any scenic vista or view open to the public, and will not result in the creation of an aesthetically offensive site which is open to public view; 7. The project will not result in a substantial negative impact upon the quality and quantity of existing recreational opportunities or result in alterations or restrictions to coastal access; 8. The applicant is fit to be entrusted with the privileges of a permit, in that he has not engaged in prior violations of the City’s harbor regulations, including the provisions of this article, has timely paid any harbor-related fees and has not presented checks returned for insufficient funds. 9. The applicant has a license to do business in the City, in good standing and is current on all fees and charges due to the City; (2, Ord. 1122-13, eff. September 19, 2013) 10. The applicant can demonstrate compliance with all Federal, State, and local laws, including all applicable City zoning laws. (2, Ord. 1122-13, eff. September 19, 2013).
The City Council may deny the permit where the impacts listed in paragraphs (1) through (10) above are cumulatively significant, even though the individual impacts are limited. The City Council may approve a project where mitigation measures eliminating significant impacts are incorporated into the project, and the approval shall be conditioned upon the implementation of such mitigation measures. The failure to comply and maintain any mitigation measures shall be a basis for suspension or revocation of a waterside project permit pursuant to Section 10-2.415.
This Waterside Permittee willbe exclusively operating from within the dive park and will have no substantial adverse affect on harbor congestion, facilities, services, fuel, and traffic or congestion at the Cabrillo Mole or Pleasure Pier and willadd to recreational opportunities and will not result in the need of new utility systems. No prior violations of harbor regulations exist and the applicant is in good standing and compliant with relevant laws.
GOAL ALIGNMENT: Enhance recreational activities in Avalon City waters.
FISCAL IMPACTS: Unknown, potential Harbor Use Fees.

1. Section 1-6.01 Public Liability Insurance
Applicants for permits or franchises and parties to leases and contracts with the City ofAvalon may be required by the Avalon Municipal Code or the City Manager to maintain a policy of public liability insurancc. Such policy shall:
(a) Contain broad form commercial general liability insurance, or in the case of marine operations, the substantial equivalent, with respect to the Premises, as applicable and the permittee, franclusee, contractor or lessees’activities with a combined single limit of not less than $1,000,000 per occurrence and aggregate. Such insurance shall be produced by an insurer authorized to do business in California with a then current Best’s Insurance Guide Rating of not less than A-Vll. , shall name the City ofAvalon, its officers, agents and employees as additional insureds, and shall contain a provision that prohibits cancellation, modification or: and
(b) Name the City as additional insured and contain a waiver of subrogation against the named insured or respective officers, employees, agents: and
(c) Provide that it may not be canceled without at least thirty (30) days prior written notice to the City; and
(d) Provide primai’yand not excess coverage Insurance coverage shall be subject to the approval of the City.
The applicant shall provide evidence of such insurance coverage by providing the City with a copy of the policy and/or a copy of a fully explanatoiy certificate of insurance, as determined by the City.
2. Section 10-2.402 Use of Harbor Related Facilities: Use Fees
Wharfage, dockage, landing and use fees for the use of or impact upon any harbor or harbor-related facility owned or controlled by the City ofAvalon shall he as follows:
(a) Except as otherwise specifically provided in this article, for all boats, ships. vessels, airplanes or other transportation facilities carrying passengers for hire or charter, whether operating under the authority of the California Public Utilities Commission or not, which land, discharge, load, or embark passengers on. to, or from such City harbor facilities Two Dollars and Fifty Cents ($2.50) per passenger so landed, discharged, loaded or embarked.
(b) Except as otherwise provided in paragraph (I) below, for all crtuse ships, Two Dollars and Fifty Cents ($2.50) per passenger, which fee shall be levied upon eighty (80%) percent of the manifest passengers, excluding persons employed upon the vessel. As used in this section “cruise ship” means a vessel which lists Avalon as a port-of-call and which anchors so as to permit passengers to disembark and to return to the same vessel.
(c) For businesses engaged in the operation of excursion boats using such facilities for landing, discharging, loading or embarking passengers on, to, or from such facilities, seven (7%) percent of the gross receipts of such business derived from such use. For the purpose of this section, “excursion boats” shall mean vessels operating from points in the City and returning thereto for sightseeing scenic tours or as pleasure cruises, and carrying passengers for hire, but not providing facilities for overnight stays.
(d) For businesses engaged in the operation of”shore boats,” as defined herein, and using such facilities for landing, discharging, loading or embarking passengers on, to, or from such facilities, seven (7%) percent of the gross receipts of such business derived from such use, excepting therefrom receipts for transportation of passengers to and from ‘cruise ships,’ as defined in subsection (b) herein, or as otherwise provided in an applicable franchise agreement issued pursuant to Section 10-2410. For the purpose of this section. “shore boats’ shall mean vessels carrying passengers or freight for hire to and from boats moored within or without City xsaters to the shore in Avalon. between such boats in City saters or hetxeen points on the shore in Axalon.
(e) Operators of fishing tournaments whose participants use City harbor facilities during the course of such tournaments shall comply with the provisions of Title 3. Chapter 3 regarding admissions taxes as applied to entry fees charged for participation in such tournament.
(f) For all other businesses not otherwise expressly provided for in this Section 10-2.402 carrying passengeis for hire by vessel fiom points in the City and returning thereto, or from one point in the City to another point therein, or engaged in the renting. leasing. or chartering of boats, paddle boards, rafts, or other floating watercraft for hire and using City harbor facilities, or whose patrons regularly use such facilities for launching. landing, boarding. unloading, embarking or disembarking. docking. or other sintilat-uses, or whose business activities involve the use of such facilities, seven (7°/b)percent of the gross receipts derived from such use.
(g) The fees for the use of such facilities by those not falling within the classifications set forth in subsections (a) through Id) of this section shall be deternuned initially by a schedule adopted by the Council or shall be incorporated into the flat rental of any contract, permit, lease, franchise or other agreement entered into for use of the facilities.
3. Section 0-2.410 Permits: Franchises to Conduct Business
a. All businesses operating in the harbor, except those enumerated in paragraph (b) of this section. shall maintain a shore base of operations or an office in Santa Catalina Island. Such office shall have a business telephone, which is covered twenty four (24) hours a day. An answering service or mechanical means of answering may be used provided messages are checked no less than three (3) times per day.
4. In addition to the provisions of Section 10—2.402.all businesses operating within the harbor. except those operating pursuant to a franchise issued by the City shall:
i. In the case of vaterside permit holders other than cross-channel carriers, pay to the City a non— refundable use fee deposit of One Thousand (51000.00) Dollars. payable in two (2) installments of Five Hundred (5500.00) Dollars each. the first installment on the inception of operations within the Avalon Harbor and the second on August I. The use fee deposit may be applied against use fees due and owing under Section 0-2.402 at such time that the perinittee has made timely payment of use fees for thirteen (13) consecutive months.
ii. In all cases here the business operates seven (7) or more months during any twelve (12) month period, pay to the City use fees under Section 10-2.402 no fewer than seven (7) months of any twelve (12) month period, and in no event less than the sum oftwentv five (525.00) Dollars per month for each month the business is operating and reports sales receipts.
iii. In all cases where the business operates fewer than seven (7) nionths during any t’ eke (12) month period. pa to the City a use fee of Two Hundred ($200.00) Dollars for each month the btisiness is closed or does not report any sales receipts.
6. All vessels over sixteen (16) feet in length operated for hire or used to conduct work in the harbor shall be equipped with a marine radio which shall be monitored at all times that the vessel is in operation. 7. All businesses operating in the harbor shall maintain all equipment. materials, facilities, machinery and vessels utilized in the operation of the licensed business in a good working condition, and such businesses shall only employ workers who are qualified to conduct the duties appropriate to the licensed business.
4. Resolution 96-36 Mandatory Activation Dates for Waterside Permits
Section 4. All newly permitted businesses must have proof of insurance, other required permits and/or leases, and all required deposits in place prior to commencing business operations in Avalon Harbor. All new permits issued before January 31 will expire on April I of the year of issuance unless the business is operating as of that date. All new permits issued after January 31 will expire sixty (60) days after issuance unless the business is operating as of that time. The Harbor Master shall have the authority to grant one extension of thirty (30) days of the time within which a business must be operating, upon showing a good cause. V

SUBJECT: Waterside Permit Application — Catalina Dive & Repair
RECOMMENDED ACTION(S): Deny Catalina Dive & Repair request for a Waterside Permit Application as itdid not meet the requirements of the City ofAvalon Waterside Permit Application deadline of December 15th each year.
REPORT SUMMARY: Applicant requested a Waterside Permit for dive services and limited mechanic repairs. The application was submitted after the December 15th deadline. Unfortunately, according to the Waterside Permit application guidelines, it states all new applicants have a deadline of December15 of each year to submit in order to be considered. In addition, several attempts were made to contact the applicant, but the contact number was never answered and the Voice Mail box was not set up. As such, it is recommended that the permit application be denied.

1. Section 1-6.01 Public Liability Insurance
Applicants for permits or franchises and parties to leases and contracts with the City of Avalon may be required by the Avalon Municipal Code or the City Manager to maintain a policy of public liability insurance. Such policy shall:
(a) Contain broad form commercial general liability’insurance, or in the case of marine operations, the substantial equivalent, with respect to the Premises, as applicable and the permittee, franchisee, contractor or lessees’activities with a combined single limit of not less than $1.000,000 per occurrence and aggregate. Such insurance shall be produced by an insurer authorized to do business in California with a then current Best’s Insurance Guide Rating of not less than A—Vu., shall name the City of A’.alon. its officers, agents and employees as additional insureds. and shall contain a provision that prohibits cancellation, modification or: and
(b) Name the City as additional insured and contain a waiver of subrogation against the named insured or respective officers. employees, agents: and
(c) Provide that it ma’ not he canceled without at least thirty (30) days prior written notice to the City: and
(d) Provide primary and not excess coverage Insurance coverage shall be subject to the approval of the City.
The applicant shall provide evidence of such insurance coverage by providing the City with a copy of the policy and/or a copy of a fully explanatory certificate of insurance, as determined by the City.
2. Section 10-2.402 Use of Harbor Related Facilities: Use Fees
Wharfage. dockage. landing and use fees for the use of or impact upon any harbor or harbor-related facility owned or controlled by the City of Avalon shall be as follows:
(a) Except as otherwise specifically provided in this article, for all boats, ships. vessels, airplanes or other transportation facilities carrying passengers for hire or charter, whether operating under the authority of the California Public Utilities Commission or not, which land, discharge. load, or embark passengers on, to, or from such City harbor facilities Two Dollars and Fifty Cents ($2.50) per passenger so landed, discharged, loaded or embarked,
(b) Except as otherwise provided in paragraph (I) below, for all cruise ships, Two Dollars and Fifty Cents ($250) per passenger, which fee shall be levied upon eighty (80%) percent of the manifest passengers, excluding persons employed upon the vessel. As used in this section “cruise ship” means a vessel which lists Avahonas a port-of-call and which anchors so as to perniit passengers to disembark and to return to the same vessel.
(c) For businesses engaged in the operation of excursion boats using such facilities for landing. discharging, loading or embarking passengers on. to. or from such facilities, seven (7%) percent of the gross receipts of such business derived from such use. For the purpose of this section. “excursion boats” shall mean vessels operating from points in the City and returning thereto for sightseeing scenic tours or as pleasure cruises. and carrying passengers for hire. hut not providing facilities for overnight stays. (dl For businesses engaged in the operation of “shore boats.” as defined herein, and using such facilities for landing. discharging. loading or embarking passengers on. to, or from such facilities, seven (7%) percent of the gross receipts of such business derived from such use, excepting therefrom receipts for transportation of passengers to and from “cruise ships.” as defined in subsection (b) herein, or as otherwise provided in an applicable franchise agreement issued pursuant to Section 10—2.410.For the purpose of this section, “shore boats” shall mean vessels carrying passengers or freight for hire to and from boats moored within or without City waters to the shore in Avalon, between such boats in City waters or between points on the shore in Avalon.
(e) Operators of fishing tournaments whose participants use City harbor facilities during the course of such tournaments shall comply with the provisions of Title 3, Chapter 3 regarding admissions taxes as applied to entry fees charged for participation in such tournament.
(f) For all other businesses not otherwise expressly provided for in this Section 10-2.402 carrying passengers for hire by vessel from points in the City and returning thereto, or from one point in the City to another point therein, or engaged in the renting, leasing. or chartering of boats, paddle boards, rafts, or other floating watercraft for hire and using City harbor facilities, or shose patrons regularly use such facilities for launching, landing, boarding, unloading, embarking or disembarking. docking. or other similar uses. or hose busmess activities involve the use of such facilities, seven (7%) percent of the gross ‘eceiptsderived froni such usc.
(g) The fees for the use of such facilities by those not falling within the classifications sel forth in subsections (a) through (d) of this section shall be determined initially by a schedule adopted by the Cotmcil or shall be incorporated into the flat rental of any contract, permit, lease, franchise or other agreement entered into for use of the facilities.
3. Section 10-2.410 Permits; Franchises to Conduct Business
a. All businesses operating in the harbor, except those enumerated in paragraph (b) of this section. shall maintain a shore base of operations or an office in Santa Catalina Island. Such office shall have a business telephone, which is covered twenty four (24) hours a da) . An answering ser ice or mechanical means of answering may be used provided messages are checked no less than three (3) times per day.
4. [n addition to the provisions of Section 10—2.402.all businesses operating within the harbor, except thosc operating pursuant to a franchise issued by the City shall:
i. In the case ofwaterside permit holders other than cross-channel carriers, pay to the City a non- refundable use fee deposit of One Thousand ($1000.00) Dollars, payable in two (2) installments of Five Hundred ($500.00) Dollars each, the first installment on the inception of operations within the Avalon Harbor and the second on August 1. The use fee deposit may be applied against use fees due and owing under Section 10—2.402at such time that the permittee has made timely payment of use fees for thirteen (13) consecutive months.
ii. In all cases where the business operates seven (7) or more months during any twelve (12) month period, pay to the City use fees under Section 10-2.402 no fewer than seven (7) months of any twelve (12) month period, and in no event less than the sum of twenty five (S25.00) Dollars per month for each month the business is operating and reports sales receipts.
iii. In all cases where the business operates fewer than seven (7) months during an)’twelve (12) month period, pay to the City a use fee of Two I-Iuiidred(5200.00) Dollars for each month the business is closed or does not report any sales receipis. 6. All vessels over sixteen (16) feet in length operated for lure or used to conduct work in the harbor shall he equipped with a marine radio which shall be monitored at all times that the vessel is in operation.
7. All businesses operating in the harbor shall maintain all equipment. materials, facilities. machiner and vessels utilized in the operation of the licensed business in a good working condition, and such businesses shall only employ workers who are qualified to conduct the duties appropriate to the licensed business.

REPORT SUMMARY: Applicant has resubmitted a Waterside Permit Application to provide tours and charters, both scheduled and on-call. This applicant is a current business. Island Enterprises proposes to use one 26’ vessel, one 30’ vessel, one 48’ vessel and one 65’ vessel. The vessels will be moored on City moorings. At its December 18, 2018, meeting the City Council approved the renewal of Island Enterprises’ 2019 Waterside Permit contingent upon payment of the outstanding balance for various harbor related fees owed the City. The 2020 Waterside Permit Renewals were heard by Council at its December 17, 2019, City Council meeting. Island Enterprises’ Waterside Permit was not renewed because there is still an outstanding balance owed to the City of Avalon. Island Enterprise, without paying the outstanding balance, has resubmitted its application. Sec. 10-2.416 of the Municipal Code provides that a waterside permit may only be granted where the City Council is able to make the following affirmative findings: 1. The project will not result in a substantial alteration of the City’s present or planned waterside uses of the Avalon Harbor; 2. With regard to transportation and circulation, the project (i) will not generate substantial additional boat trips, including shoreboat trips, or other movement within Avalon Harbor; (U)will not have a substantial negative impact upon existing mooring, docking, or other anchorage facilities; (iU)will not have a substantial impact on other modes and systems of transportation; (iv) will not result in substantial alterations to present patterns of circulation or movement of people and/or goods; (v) will not increase traffic hazards to swimmers, boaters, or other existing activities; and (vi) will not restrict or alter existing coastal access; 3. The project will not have a substantial effect upon and will not result in a need for new or altered governmental services, including but not limited to, fire, police, maintenance of facilities, and Harbor Department services; 4. The project will not result in the use of substantial amounts of fuel or other forms of energy or substantially increase the demand upon existing sources of energy or require the development of new sources of energy; 5. The project will not result in a need for new utility systems or a substantial alteration of existing sources or systems for power, natural gas, communications, water, sewage disposal or solid waste disposal; 6. The project will not obstruct any scenic vista or view open to the public, and will not result in the creation of an aestheticafly offensive site which is open to public view; 7. The project will not result in a substantial negative impact upon the quality and quantity of existing recreational opportunities or result in alterations or restrictions to coastal access; 8. The applicant is fit to be entrusted with the privileges of a permit, in that he has not engaged in prior violations of Citys harbor regulations, including the provisions of this article, has timely paid any harbor-related fees and has not presented checks returned for insufficient funds. 9. The applicant has a license to do business in the City, in good standing and is current on all fees and charges due to the City; (2, Ord. 1122-13, eff. September 19, 2013) 10.The applicant can demonstrate compliance with all Federal, State, and local laws, including all applicable City zoning laws. (p2, Ord. 1122-13, eff. September 19, 20 13). The City Council may deny the permit where the impacts listed in paragraphs (1) through (10) above are cumulatively significant, even though the individual impacts are limited. The City Council may approve a project where mitigation measures eliminating significant impacts are incorporated into the project, and the approval shall be conditioned upon the implementation of such mitigation measures. The failure to comply and maintain any mitigation measures shall be a basis for suspension or revocation of a waterside project permit pursuant to Section 10-2.415. REPORT SUMMARY: The Uniform Public Construction Cost Accounting Act (Act) is a program created in 1983 that provides for alternative bidding procedures for public projects if the agency elects to follow the cost accounting procedures set forth in the Cost Accounting Policies and Procedures Manual of the California Uniform Construction Cost Accounting Commission. The Act is enacted under Public Contracts Code Section 22000 through 22045. On December 4, 2018, the City Council adopted a resolution (Resolution No. 18-39) electing to become subject to the Act. Pursuant to Public Contract Code Section 22034, the City must enact an informal bidding ordinance and the proposed changes to Chapter 4 (Purchasing System) are to enact said informal bidding ordinance and incorporate other bidding requirements of the Act, including limits on certain procurement procedures. For public projects of sixty thousand dollars ($60,000) or less, the City may use its own employees or negotiate a contract. For public projects valued at two hundred thousand dollars ($200,000) or less, the City may issue a contract using informal bid procedures, typically through a notice inviting informal bids issued to listed contractors for the category of work to be bid. As set forth in further detail in Section 3-4.110, the City Council has made findings and adopted a Local Vendor Preference Program (“Local Program”) applicable to certain purchases of materials, supplies, and equipment. as well as contracts for public works construction, maintenance and general services contracts described in this section. Accordingly, construction. maintenance and general services contracts that follow the City’s formal contract bid procedure or competitive process procedures shall be subject to the Local Program set forth in Section 3- 4.110. A properly certified Local Small Businesses (as defined in Section 3-4.110) shall be entitled to the specified reduction of five (5%) percent in the tabulation of its bid for purposes of determining the lowest responsible vendor or proposcd price for services or delivery of goods, unless otherwise prohibited by law. This five (5%) percent adjustment shall only apply to local small businesses when such local small businesses are at least equal in responsibility and quality to other businesses bidding on contracts. Such findings shall be made by the City Council when awarding the contract to a local small business. If the Program is applicable to a bid offering, it shall be noted in the applicable bid solicitation. The five (5%) percent preference shall only apply to the determination of the business that is awarded the City contract. Based upon the findings provided for in the recitals of the Ordinance adding this section, the City Council has determined that is in the best interests of the City to give a minimum preference to local small businesses when the City is making certain purchases of materials. supplies, and equipment, as well as when it is entering into contracts for public works construction, maintenance, and general services, as set forth in this Local Vendor Preference Program (“Program”). The Program shall consist of the following general requirements. which shall be implemented by the City Manager: (a) A local small business for the purposes of this Program shall mean the vendor: (i) has fixed facilities with employees located at a business address within City limits (a post office box or nonbusiness residence alone is insufficient): (ii) has an appropriate City business license/permit (iii) has at least filly (50%) percent of its fulltime employees residing within City limits; and (iv) has no more than twenty- five (25) employees employed fuiltime. A fulitime employee is one who works more than thirty-five (35) hours a week. A vendor seeking to qualify for this Program shall provide supporting information and certify in writing that it meets the above requirements as part of its bid. In the case of a city owned utility system, “public project” shall include only the construction, erection, improvement, or repair of dams, reservoirs, power plants, and electrical transmission lines of two hundred thirty thousand volts and higher; 4. “Public project” does not include maintenance work. “Maintenance work” includes all of the following: i. Routine, recurring and usual work for the preservation or protection of any city-owned or city-operated facility for its intended purposes, ii. Minor repainting, iU. Resurfacing of streets and highways at less than one inch, iv. Landscape maintenance, including mowing, watering, trimming, pruning, planting, replacement of plants, and servicing of irrigation and sprinkler systems, 4 v. Work performed to keep, operate, and maintain city-owned water, power or waste disposal systems, including, but not limited to, dams, reservoirs, power plants and electrical transmission lines of two hundred thirty thousand volts and higher. Sec. 3-4.202 City Subject to Uniform Public Construction Cost Accounting Act. The City elects to become subject to the Act and to the Commission’s policies and procedures. If the Act increases its thresholds for public projects, those new thresholds shall prevail. Sec. 3-4.203 Contractors list. The City Manager, or the City’s Manager’s designee, shall compile and maintain a list of qualified contractors identified according to categories of work eligible to submit bids on informal contracts awarded by the City. This list shall comply with the requirements of the Act and the criteria promulgated, from time to time, by the Commission. Sec 3-4.204 Purchasing Procedures — Public Projects of Sixty Thousand Dollars or Less. Public projects of sixty thousand dollars ($60,000.00) or less may be performed by the employees of the City by force account, by negotiated contract or by purchase order, The City Manager is authorized to award contracts for public projects of sixty thousand dollars ($60,000.00) or less. Sec. 3-4.205 Informal bidding Procedures - Public Projects Public projects between $60,001 and $200,000 may be let to contract by the informal bidding procedures set forth in this section. (a) Notice. When a public project is to be performed which qualifies for informal bidding, notice of such project shall be given as follows except where the product or service is proprietary: 1. Mailed notice shall be sent to all contractors on the contractors list for the category of work being bid; and 2. Mailed notice shall be given to all construction trade journals specified by the Commission for the receipt of such notice for Los Angeles County; 3. Additional notice to other contractors and/or trade journals may, in the discretion of the City, be given. 5 4. All mailing of notices to contractors and construction trade journals shall be completed not less than ten (10) calendar days before bids are due. 5. The notice shall describe the project in general terms, how to obtain more detailed information about the project and shall state the time and place for submission of bids. (b) Opening of Informal Bids and Award of Contract. 1. At the time provided in the notice inviting informal bids, the City shall open all bids timely received. If a contract is awarded, it shall be awarded by the Council to the lowest responsible and responsive bidder. If two (2) or more responsive bids are the same and lowest, the Council may accept the one it chooses. If no bids are received, the project may be performed by the employees of the City by force account, or negotiated contract without further complying with this article. 2. If all bids received are in excess of the informal bidding limit, the Council may, by adoption of a resolution by a four-fifths (4/5) vote, award the contract, at or below the provisional limit set forth in Public Contract Code section 22034(f), to the lowest responsible bidder, if it determines that the City’s cost estimate was reasonable. Sec. 3-4.206 Formal bidding Procedures - Public Projects Public projects in excess of two hundred thousand dollars ($200,000.00) must, except as otherwise provided in this chapter, be let to contract by the formal procedures set forth in this section. (a) Notice of such project shall be given as follows unless an exception to competitive bidding applies: 1. The notice shall state the time and place for the receiving and opening of sealed bids and distinctly describe the project. 2. The notice shall be published at least fourteen (14) calendar days before the date of opening the bids in a newspaper of general circulation, printed and published in the City; or, if there is no newspaper printed and published within the jurisdiction of the City, in a newspaper of general circulation which is circulated within the City. 3. The notice inviting formal bids shall also be mailed to all construction trade journals specified by the Commission for the receipt of such notice for Los Angeles County. The notice shall be 6 mailed at least fifteen (15) calendar days before the date of opening the bids. (b) Bidders Security All bids shall be presented under sealed cover accompanied by a form of bidders’ security as prescribed in the public notices inviting bids in an amount at least equal to ten percent (10%) of the amount bid. Bidders shall be entitled to the return of bid security; provided, however, the successful bidder shall forfeit its bid security upon its refusal or failure to execute the contract within ten (10) days after the notice of the award of contract has been mailed, unless the City is responsible for the delay. The Council, on the refusal or failure of the successful bidder to execute the contract, may award it to the next lowest responsible bidder. Ifthe Council awards the contract to the next lowest bidder, the amount of the lowest bidders security shall be applied by the City to the difference between the lowest responsible bid and the second lowest responsible bid, and the surplus, ifany, shall be returned to the lowest responsible bidder. (c) Bid Opening Procedure. Sealed bids shall be submitted to the City Manager or the City Manager’s designee, and shall be identified as bids on the envelope. Bids shall be opened in public at the time, date and place stated in the public notices. A tabulation of all bids received shall be open for public inspection during regular business hours for a period of not less than thirty (30) calendar days after the bid opening. (d) Rejection of Bids. In its discretion, the Council may reject any and all bids presented and purchase without further bidding or may re-advertise for bids in the manner prescribed under this section. (e)Award of Contracts. Contracts shall be awarded by the Council to the lowest responsible bidder, except as otherwise provided in this section. Ifno bids are received, the project may be performed by employees of the City by force account or by negotiated contract without further complying with this section. The Council shall have the right to waive any defect or informality in the bidding or in the procedures set forth in this section. No defect or informality shall void any contract entered into. (f) Tie Bids. Iftwo (2) or more bids received are for the same total amount or unit price, quality and service being equal, the Council may accept the bid it chooses. (g) Performance Bonds. The Council shall have the authority to require a performance bond before entering into a contract in such amount as the Council shall find reasonably necessary to protect the best interests of the City. Ifthe Council requires a performance bond, the form and amount of the bond shall be described in the notice inviting bids. 7 Sec. 3-4.207 Approval of plans and designs. The City engineer, or designee, is authorized to approve plans and designs, and all amendments and addenda thereto, for performance of a public project of the City. This shall include the working details, drawings, plans and specifications prepared for every public project, including emergency and change order work, which may affect the design or operation of public improvements and which may bring into question the City’s liability for dangerous conditions of public property. Sec. 3-4.208 Emergencies. The Council hereby delegates to the City Manager the power to take any directly related and immediate action required by an emergency, as defined in this chapter. In situations determined by the City Manager to constitute an emergency, the City Manager may take action pursuant to Section 22035 of the Act and Public Contract Code Section 22050. Work shall be performed without the benefit of competitive bidding, either formal or informal, only so long as necessary under those sections. A report on the emergency and work performed shall be provided at the next regular meeting of the Council, and then at every meeting thereafter as required by Section 22050. At such meetings, the Council shall determine, by a four-fifths vote, that there is a need to continue the action without the benefit of informal or formal competitive bidding in accordance with Section 22035 of the Act and Public Contract Code Section 22050. The Council shall terminate the emergency action at the earliest possible date that conditions warrant, so that the remainder of the emergency action may be completed pursuant to a formal bidding procedure. SECTION 7: CEQA. This Ordinance is not a project within the meaning of Section 15378 of the State of California Environmental Quality Act (“CEQA”) Guidelines, because it has no potential for resulting in physical change in the environment, directly or indirectly. 14 Cal. Code Regs. § 15378(a). Further, this Ordinance is exempt from CEQA as there is no possibility that this Ordinance or its implementation would have a significant negative effect on the environment, 14 Cal. Code Regs. § 15061(b)(3). SECTION 8: Severability. If any section, subsection, provision, sentence, clause, phrase or word of this Ordinance is for any reason held to be illegal or otherwise invalid by any court of competent jurisdiction, such invalidity shall be severable, and shall not affect or impair any remaining section, subsection, provision, sentence, clause, phrase or word included within this Ordinance, it being the intent of the City that the remainder of the Ordinance shall be and shall remain in full force and effect, valid, and enforceable. REPORT SUMMARY: Background During the October 1,2019 City Council meeting, Item 12 on the agenda included a discussion regarding the economic impact of cruise ships, clarification on the marketing incentive provided to cruise ships, and the established process that is established for ships interested in adding Avalon as a port-of-call. After much discussion and public input, City Council directed the community to submit their input to the City Manager regarding the following questions: 1. How many days of the week should cruise ships be allowed to call on Avalon as a port- of-call? 2. Which days of the week should cruise ships be allowed to call on Avalon as a port-of- call? 3. What is the maximum number/size of cruise ships that should be allowed to call on Avalon as a port-of-call? During the December 17, 2019 City Council meeting, Item 13 on the agenda included an overview of written public input submitted to the City Manager’s Office as well as public feedback from a series of meetings held regarding cruise ships. During the meeting, a report was provided by the City Manager asking City Council: 1. Do you want to establish further guidelines, or allow the Harbor Master to continue to exercise sound judgement on granting vessel access? 2. Do you wish to further limit the number of cruise ship vessels allowed in Avalon Harbor at one time? 3. Do you wish to prohibit cruise ships on any specific dates or days of the week? 4. Do you wish to limit the number of visitors allowed to disembark from cruise ships daily or weekly? After much discussion, and no clear consensus, City Council requested Staff: - Provide daily sewer, wastewater, and trash collection counts for visitors. - Consider possible removal of the marketing incentive for cruise ships. - Consider a possible increase on wharfage once the rate reaches $5.00 in 2021. - Determine how to include Spanish-speaking community members in the discussion regarding the economic impact of cruise ships. In response to City Council direction, City Staff gathered data and reports regarding the operations of the sewer, wastewater and landfill facilities. Staff was able to analyze impacts on the existing infrastructure; however, limitations in the data prevented Staff from determining what impacts were attributable to residents and which were attributable to visitors (including cruise ship, cross-channel, etc.). Impacts to the Wastewater Treatment System The City’s Wastewater Treatment Plant (WIP) designed influent flow capacity is rated at 1.2 million gallons per day (MGD). Influent flows are the raw, untreated wastewater (sewage) that enters into the WWTP. At the peak, the average influent flows for years 2018 and 2019 were at approximately 65% capacity of the total 1.2 MGD. The chart below shows the influent flows for 2018 and 2019, including the percentage of capacity (out of the total 1.2 MGD capacity) by month and the monthly average daily influent flows1. Further analysis shows that during the tourist season, Fridays, Saturdays, and Sundays (when cruise ships are not present in the Avalon Harbor), are at relatively the same capacity as Mondays and Tuesdays. Impacts to the Pebbly Beach Landfill In analyzing commercial and residential data (including Crescent Street) received from Avalon Environmental (the City’s landfill contractor), indications of the impacts as a result of cruise ship tourists was negligible. However, data available was inconclusive as currently there is no way to identify trash by cruise ship visitors from cross-channel visitors or residents particularly during the peak summer months. Daily landfill tonnage does not serve as a reliable indicator of garbage generated as certain commercial locations are not picked up seven days a week and the timing and days of pickups might not accurately reflect when trash was accumulated. For example, garbage pickup on a Monday at 10:00 am. may be more representative of trash accumulated on Sunday or may even reflect accumulation on multiple days. Impacts on Potable Water Facilities Data from Southern California Edison on impacts on water infrastructure were inconclusive. While data does show demand rates, no additional data was available to show how demand is met! what the strain demand has on the existing infrastructure, or what users or other factors contribute to demand. In some instances, demand rates increase slightly on Monday and Tuesday: however, this is not consistent throughout each month nor is it consistent for any other day. Though historically, the City’s aging infrastructure has been a concern for the community, major strides have been made in the last 10 years. Additional strategic improvements (such as trash to energy facilities, pipe and valve replacements, desalination enhancements, bidirectional enhancements to reservoir water lines, etc.) are scheduled that will further enhance and improve the City’s overall sustainability and efficiency for water, trash, and sewer. 3 Environmental and Conservation Efforts Increasingly, the cruise ship industry is working to develop and implement a number of initiatives, policies, procedures, and protocols to mitigate their impact on the environment and promote conservation efforts. City Staff recommends actively working with the cruise ship industry to co-develop strategies to ensure Avalon’s fragile natural resources are protected now and in the future. Once developed, these strategies can be incorporated into new agreements with cruise lines seeking to call on Avalon as a port-of-call. Royal Caribbean Cruise Line In August 2019, City Staff received a request from Royal Caribbean Cruise Lines (RCCL) to visit the City a total of 53 times on Wednesdays between July 3 to October 2, 2021, May 28 to October 4, 2022, and May 30 to October 7, 2023. On January 8, 2020, RCCL revised their request to make Avalon a year-round port-of-call, expanding the approved 53 Summer-only visits to a total of 165 visits to Avalon (from July 2021 through August 2024). In consideration of approving the request, City Staff considered the balance of economic development and growth with quality of life to residents and existing visitors. This included an analysis of the day requested (Wednesday), holidays, event(s), harbor activity(ies), impacts to public safety, and the existing number of cruise ships already calling on Avalon as a year- round port-of-call, and impacts to the City’s water, sewer, and landfill infrastructure. Additionally, Staff considered the estimated fiscal impact of a third year-round cruise line. The economic impact is estimated to result in approximately $19 million into the local economy and an additional $2.8 million paid directly to the City through taxes. Further, wharfage projections are based on the 2021 rate of $5.00 as currently outlined in the AMC, not a potential increase as City Council has directed Staff to begin to negotiate. If this is increased, the estimated revenue figures would increase accordingly. 4 Given these considerations, City Staff will approve the above stated request from RCCL. Further, as outlined in the policy recommendations below for any additional requests, Staff, based on community and City Council input, considers the Avalon Harbor at capacity, unless City Council elects to revise the conditions of the resolution and set alternative guidelines for determining saturation. Recommended Policy Guidelines In consideration of the impacts outlined in the Staff Report, and based on the public and City Council input and direction, Staff recommends establishing the following guidelines by resolution to provide an equitable community strategy in managing cruise line requests for calling on Avalon as a port-of-call - Number of regularly scheduled cruise ship vessels shall not exceed 3 per week during the Summer Season (Memorial Day to Labor Day) without final written approval of the City Manager. - No cruise ship vessels shall be allowed on the weekends during the Summer Season (Memorial Day to Labor Day) or during special event weekends — such as Jazz Traxx — without final written approval of the City Manager. - Number of regularly scheduled cruise ship vessels shall not exceed 3 per week during the “Off Season” (Labor Day to Memorial Day) without final written approval of the City Manager. - Repositioning, infrequent, or small cruise ship vessels (1,000 passengers or less) may be considered for visitation by the Harbor Master, taking into account the day requested, holidays, event(s), harbor activity(ies), impacts to public safety, etc. - The Harbor Master and Finance Director will provide an annual report on cruise ship vessels that includes the number of vessels that visit Avalon, number of passengers, amount of wharfage collected, any safety or security incidents that may have occurred while the ship was in port, as well as projections and scheduling information for the next year. - Guidelines shall be reviewed and re-established by a City Council adopted resolution based on the findings of the annual reports. Conclusions Staff recommends City Council approve the attached resolution with guidelines and declare the Avalon Harbor at capacity with RCCL as the last accepted year-round cruise line using Avalon as a port-of-call. Additionally, staff will review of the City’s current marketing incentive and wharfage rates ordinance and develop a negotiations strategy regarding an increase in cruise ship wharfage. Last, the final directive to Staff by City Council was to engage the Spanish-speaking community in discussions regarding the economic impact of cruise ships. Staff is developing strategies to meaningfully engage Spanish speaking residents in dialog about the economic impact of cruise ships and will incorporate their concerns, ideas, and strategies into all future policies, procedures, and considerations. 5 FISCAL IMPACTS: Unknown. In addition to the correspondences received by the City Manager’s Office, on October 3, 2019, resident Ernie Rodriguez posted a question on Facebook soliciting feedback. The original post asked: “Curious, how many cruise ships per week would you like to see June-Sept October- May?” The post received 123 comments posted by 43 individuals. Those comments were also reviewed by Staff and included in the public input analysis. In order to receive more specific feedback that addressed the questions posed by the City Council, on November 21, and December 9, 2019, the City hosted a meeting with specific, individuals who expressed interest in the future of the cruise ship industry in Avalon. On November 21, 2019 the group presented City Staff with a list of approximately 25 questions that included fiscal, quality of life, public input, environmental, policy and procedure concerns and recommendations. On December 9, 2019 City Staff returned the list of questions provided with some answers. In addition, during the course of the meetings, the following ideas were proposed as a part of a potential, comprehensive guideline to direct the Harbor Master and City Manager when approving additional cruise ship visits to Avalon: - Limit Cruise Ships by the number of passengers rather than the number of vessels. o 6,000 passengers per week in the Summer o 9,000 passengers per week in the Winter and Shoulder Seasons - Prohibit vessels that carry 4,000+ passengers - Prohibit more vessels being added to the Summer Season schedule Also, during the course of the meetings, the group requested greater clarification regarding the City’s Cruise Ship Policies as well as how those policies stand compared to other cities. City Staff reached out to two ports most similar to Avalon in that there is no berthing facilities and the cities are not ports of origin — the City of Santa Barbara and City of Monterey. Though the wharfage rates vary from Avalon compared to Santa Barbara and Monterey, so too do the level of services provided between each city. A portion of Santa Barbara’s wharfage is used to offset amenities provided to the cruise ship passengers including complimentary electric fare on their electric shuttle system and subsidized fare on water taxis. However, in addition to wharfage, the City of Santa Barbara requires a separate fee to supplement added police needed — approximately $1,500 per day — and recommends (not requires) that vessels rent portable restrooms for use while in port — approximately $1,235 per day. In Monterey, wharfage offsets the cost of establishing a “TSA like” security station for passengers as they disembark and re-board the vessel. In addition, all City of Monterey personnel are Facility Security Officer (FSO) certified. In Avalon, no amenities or extra security is provided to the vessel or its passengers. At this time the City Council may consider a number of actions: Option 1. Develop guidelines to be adopted by a resolution. - Discuss potential guidelines and direct City Staff to bring back a resolution establishing basic guidelines for the Harbor Master and City Manager to consider when receiving a request for a cruise ship vessel to visit Avalon Harbor. o Guidelines may limit number of vessels or passengers, limit the time of year or specific holidays for visitors, limit the size of vessels, etc. - Guidelines can be reviewed every two years and re-established by resolution. - Guidelines may include requiring the Harbor Master to provide an annual report on cruise ship vessels that visit Avalon. Option 2. Modify the City of Avalon Municipal Code to implement/address any of the following: - Modification to the cruise ship approval process — including incorporation of the process by which guidelines are adopted by resolution every two years. - Increase in wharfage or elimination of the current marketing incentive. - Require extra fees for services, such as extra security (LASD). Option 3. Develop an advisory measure. - Begin the process to develop an advisory measure to appear on the November 3, 2020 ballot. - Begin developing what specific question(s) may be asked of the public. At this time, City Staff recommends the City Council discuss formally adopting guidelines for City Staff to consider when a cruise ship request is received. The City of Avalon’s guidelines to allow cruise ships to visit Avalon Harbor closely align with the processes employed by the Cities of Santa Barbara and Monterrey. REPORT SUMMARY: This item appears on the agenda at the request of a member of the City Council. PROCESS TO ADD AVALON AS A PORT-OF-CALL The process by which approval is granted for a cruise ship wishing to add Avalon as a port-of- call begins and ends with the Harbor Master, The Avalon Municipal Code (AMC) (Section 10- 2.401) grants the Harbor Master the authority to control the use of harbor facilities, floats, docks, etc. as well as the authority to regulate the time and manner those facilities are used. An interested cruise line contacts the Harbor Department and the Harbor Master determines if Avalon Harbor can safely and appropriately accommodate the vessel’s presence. The Harbor Master, after making public safety and logistical considerations, may reach out to the City Manager, or any other entity deemed appropriate for input. After careful determination, the Harbor Master then informs the City Manager of his decision, then informs the vessel in question. The Catalina Island Chamber of Commerce and Visitor’s Bureau (Chamber) and City of Avalon City Council are not involved in the decision making process. MARKETING INCENTIVE As a part of an ordinance adopted in March 2017(Section 10-2.402 (b)(6)), to incentivize a cruise line deploying a second ship to Catalina for a total of fifty (50) or more calls per year, the City agreed to pay a cruise line an annual marketing incentive equal to half of the wharfage fees collected on a second ship. Currently, on a weekly basis Carnival Cruise Lines (Carnival) deploys two ships to Avalon — the Inspiration and the Imagination. Per the ordinance described above, the City collects the full wharfage rate on all passengers aboard the vessels and reimburses half the wharfage rate on the passengers aboard the second ship. If the second Carnival vessel does not call on Avalon at least fifty (50) times in a year there is no reduction or reimbursement of wharfage. This incentive is formally memorialized in the AMC. ECONOMIC IMPACT Cruise ships that utilize Avalon as a port-of-call contribute significantly to the Islands economy. In the State of California, only 7 ports-of-calls exist — San Diego, San Francisco, Santa Barbara, Monterey Bay, Los Angeles, Long Beach, and Avalon. Of those port cities, Avalon is unique in that it is the only port visited by cruise ships consistently that is a destination, not a port of origin. Santa Barbara and Monterey Bay are not ports of origin; however, neither city is considered a destination. Rather they each are used to seasonally reposition cruise ship fleets. The most substantial, direct economic impact of cruise ships on the City’s annual budget is the revenue generated by cruise ship wharfage. In March 2017, City Council adopted an ordinance (Section 10-2.402 (b)) establishing revised wharfage rates for cruise ship passengers. Beginning July 2017, cruise ship wharfage, initially established at $3.00 per passenger, began increasing annually by $0.50 until 2021. In July 2019, cruise ship passenger wharfage was $4.00 per person. Cruise ship wharfage is scheduled to increase in 2020 to $4.50 per passenger and in 2021 to $5.00 per passenger. Cruise ship wharfage accounts for 10 percent of the Harbor Fund’s operating revenue. The Harbor Fund is used to pay for Harbor Capital Improvement projects such as the Cabrillo Mole Rehabilitation Project, South Beach Sand Replenishment, South Beach Seawall Repairs, Cabrillo Mole Float Renovations, and Casino Way improvements. In addition, the fund is used for contract services for Harbor Public Works including, the LA County Lifeguards and Fire Department, waterfront trash collection, public restroom maintenance, and bird abatement as well as the Harbor Department’s employee wages and salaries. In Fiscal Year 2018-2019, the City collected approximately $914,102 in wharfage from Carnival and other cruise lines. As a second ship from Carnival visited Avalon at least 50 times in the year, $215,479 was reimbursed back to Carnival as a marketing incentive. The net contribution of cruise ship wharfage in Fiscal Year 2018-2019 was $698,623. Net cruise ship wharfage revenue is estimated to total $790,000 in Fiscal Year 2019-2020. The projected increase in revenue is due to the scheduled wharlage increase. Though on average cruise ship passengers are on the island for only 4.58 hours, in addition to City wharfage, they inject approximately $17.4 million into the Island’s economy1. This additional revenue extends business operating hours and provides additional year-round employment opportunities for Avalon residents during off-peak days of the week. In terms of the City’s budget, these additional sales account for approximately $188,000 in Admission Tax revenues and $107000 in Sales Tax revenues. In addition, the local hospital receives approximately $53,500 in Sales Tax revenue generated from cruise ship passengers. 1 The average daily per-capita spending for cruise ship passengers was $66.39 according to the ‘Economic & Fiscal Impacts and Profile of 2016 Catalina Island Visitors Final Report.” In Fiscal Year 2018-2019 cruise ship passenger counts totaled 262,347. To provide better context, if the City had to replace the annual $109 million in City taxes contributed by cruise ship visitors, the City would have to increase cross-channel wharfage by approximately 28 percent (from $6.00 to $7.67 roundtrip per passenger), or increase average nightly mooring rates by approximately 60 percent. It is important to note, this theoretical replacement revenue would only balance the City’s budget and have no effect on lost revenue for local small businesses or their employees. ROYALCARIBBEAN CRUISE LINEADDITION2021 -2022 In late summer 2019, after careful consideration, Harbor Master JJ Poindexter approved a vessel from Royal Caribbean Cruise Lines to begin calling on Avalon on Wednesdays during the months of June through September between 2021 and 2022. As this vessel is the only one scheduled from Royal Caribbean Cruise Lines and is only scheduled to call on Avalon 16 times a year, it will not receive a marketing incentive reimbursement. Assuming there are approximately 2,500 visitors aboard the vessel each time it calls on Avalon, the vessel is projected to generate approximately $200,000 in wharfage fees annually as well as additional revenue for the Island’s economy. The three anchorages provide better control and security over the increasing number of cruise ships visiting the island. The number and size of large passenger vessels visiting Santa Catalina Island along with visiting military vessels has increased and continued growth is expected. Usually only one cruise ship visited at a time, with less than 3,000 passengers. Today, we see multiple cruise ships visiting with over 2.000 passengers onboard each vessel. These numbers do not include the crew which may also go ashore and the increasing tourism from the mainland. The Avalon Harbor area, immediately adjacent to the anchorages, can be extremely busy with private recreational vessels, cross channel fast ferries, visiting cruise ships and water taxi’s moving the thousands of visitors and passengers to the island. The cruise ships are unloading and loading thousands of people in the morning and again in the afternoon. Close coordination is necessary to ensure a safe visit by all. The passage of the recent Maritime Security Regulations has increased the visibility of cruise ship visitations to coastal areas along with other vessels. The federal anchorages have been established to assist in this regard. The presence of small craft in the vicinity of the cruise ships. the presence of aircraft flying nearby and the potential for other security issues drives the need to accurately coordinate the arrival and departure of visiting vessels. Anchorage Assignment: The three federal anchorages offshore of Santa Catalina Island “A”. “B” and “C”, will be assigned by the Vessel Traffic Service, Los Angeles/Long Beach. The anchorages will normally be assigned using the following prioritization in order of priority: I. Length of time a particular cruise line and particular ship has been regularly calling at Avalon Harbor and has not broken this timing will be given the priority over which anchorage it is assigned. This will use actual arrival dates and number of calls per year. Reassignment priority will be given to these ships when weather or other schedule delays occur. 2. Secondly, the cruise line and individual ship who first submits a firm committed schedule for calling Avalon Harbor to the Vessel Traffic Service for coordination purposes. All proposed calls must be submitted by January 1 for the following year. Otherwise they will be on a first come first served basis. Committed schedules are demonstrated by having necessary contracts in place, agreements with the Avalon 1-larborMaster or others, and having sold passage on the vessel. 3. Lastly, an open anchorage is assigned on a first come, first served basis. 4. Any changes or modifications to the assigned anchorages are determined by the Vessel Traffic Service. Outer Port Subcommittee (HSC, OPS) is the coordination entity for this policy. The Avalon Harbor Masters office is the coordinating entity for cruise lines and other vessels desiring to visit Santa Catalina Island and discharge passengers in Avalon Harbor. Local entities provide support to the visiting vessels and must plan long in advance in order to meet the needs of visiting vessels. The Avalon Harbor Master works with ships agents and cruise lines in advance of their arrivals to ensure safety and the transportation of passengers ashore. Vessel Traffic Service (VTS) will assign all federally established anchorages at Santa Catalina Island to the ships upon checking into the Vessel Traffic System. Large vessels must always use the designated anchorages as opposed to random anchoring offshore. The Vessel Traffic Service will observe and monitor the three federal anchorages at Santa Catalina Island. Particular attention will be paid on the arrival of large cruise ships and naval vessels. VTS and waterway users will be observant of any suspicious activity and report anything suspicious to the Captain of the Port and to the vessels and local authorities. Additionally, while the ship is at anchor, waterway users and the Avalon Harbor Master will provide additional observation and reporting of suspicious activities. Violations: Violators of these procedures will be reported to VTS. VTS will be the authority to order vessels to move from the anchorages. The Avalon Harbor Master is the authority for vessels operating inside of Avalon Harbor. Pre-Arrival Planning Multiple Ships Visiting Santa Catalina Island Anchorages: The following procedures are designed to insure the safe movement of personnel and passengers to and from multiple cruise ships and other vessels anchored offshore of Avalon Harbor. The port presently is receiving multiple cruise ships and military vessels and each has different needs due to the port layout and vessel traffic. Coordination must be maintained between the cruise ships, water taxi’s &tenders, cross-channel ferries and recreational vessels. Therefore, the below listed list provides guidance on certain items that should assist in the coordination. Cruise Vessels: Cruise vessels should ensure that the following information is passed to all concerned parties including the Coast Guard, Vessel Traffic Service and Avalon Harbor Master no later than 3 days in advance of the vessels’arrival. 1. Generallnfo: Vessel names, lengths, number of passengers and crew 2. Arrival Schedule: Anchorage time and first water taxi arrival or first ships lighter departs for Avalon Harbor 3. Order of Events: Timeline of ship movement events; passenger disembarkation and embarkation and sailing time. Strong SE winds occur in the winter, and at times the sea is too rough for several days to permit the passage of small vessels. In the summer the winds in the channel are wholly different from those outside the islands and off the coast to the NW. Under the North shore, which is protected by the bold range of the Santa Ynez Mountains, the West winds do not reach far East of Point Conception with much strength but are felt towards the islands, a strong NW wind and heavy swell coming in from the open ocean. The climate in the Santa Barbara Channel, because of this blocking of the winds, is much milder than to the North along the coast. However, during NW weather boats crossing the channel from the mainland usually encounter heavier seas as the islands are approached. The belt of rough seas, locally known as Windy Lane, lies along the North shores of the islands and is about 6 miles (I km) wide. This sea condition is the opposite to that experienced in the crossing from Los Angeles-Long Beach to Santa Catalina Island. These W winds usually begin about 1000and grow progressively stronger until sundown. During heavy NW weather strong squally winds draw down the canyons between Point Conception and Capitan and pass directly offshore, causing a severe choppy sea. Heavy NW gales are often encountered off Point Conception on coming through Santa Barbara Channel, and great changes of climatic and meteorological conditions are experienced: the transition is often remarkably sudden and well defined. In the fall and winter, stiff northeasters are occasionally experienced at and near the F end of the channel. They come up without warning, usually at night in clear dry weather, and when the barometer is either high or rising rapidly. At such times small boats should be prepared to seek shelter at a moments notice. During the summer heavy fogs are a common occurrence in the Santa Barbara Channel and envelop the main shore, channel, and islands. Sometimes the mainland and channel are clear while the islands alone are hidden. At other times all are clear during the day, but wrapped in dense wet fog nights and mornings. This condition, the fog lying offshore during the day and enveloping the land at night, is characteristic of the whole southern California coast. The fogs occur mostly during calm weather and light winds, and are generally dissipated by the strong NW winds. Current Currents in Santa Barbara Channel are variable, depending to a great extent upon the wind. It appears that a weak non-tidal flow sets East in the spring and summer, and West in autumn and winter. It has been observed that a strong inshore set prevails on a rising tide in the deep waters of Hueneme Canyon. In general, there are conflicting currents, at times quite strong, around the slopes of the submarine valleys both here and off Point Mugu. In heavy NW weather, the current and heavy swells make into the South side of the West entrance to the channel and along the North shore of San Miguel Island. The currents in the vicinity of the Channel Islands frequently follow the direction of the wind. with eddies under the lee of the islands and projecting points. Tidal currents of about knot set through the passages between the islands.
