Sub : Processing of Customs Transit Declaration (CTD) for transit of bound import containers in Indian Customs Electronic Data Interchange(EDl) System (ICES) - Res. ** ** **

1. Attention of Nepal Importers, Custom Brokers, Shipping Lines, Steamer Agents and all other concerned is invited to the Public Notices issued by Port Commissionerate, Custom House, Kolkata from time to time dealing

with the procedure for movement of goods in transit to Nepal. The procedures stand modified with effect from 19.09.2020.

2. The Customs Transit Declaration (CTD) shall be filed online and will be processed online, in the Indian Customs EDI System (ICES). However,

certain import documents (detailed in S1.No.6) shall continue to be presented at the Nepal Bhutan Unit, Custom House, Kolkata and Docks/CFS for clearance of transit goods. Till remote filing (RES) is activated, filing of the crD shall be done at the Service centre, custom House, Kolkata.

3. : Shipping Lines/ Agent should Y / register themselves in ICES. No re-registration is required for those Shipping Lines/ Agent, who have already registered themselves in the ICES. The Shipping Lines/ Agent should declare the cargo destined to Nepal and the port of final discharge in Nepal in the Import General Manifest as Transit Cargo (TC).

a. : The Nepalese importer or his authorized agent (CB) shall submit the Data Sheet duly filled in, containing the particulars of consignments under transit. A copy of the said data sheet is enclosed as Annexure A. The data entry at the Service Centre shall be chargeable, as per Public Notice no. 3912015 dated 29.09.2015. various charges for printing and data entry, excluding GST, for the digitization of manual documents getting data entry done at Service Centre, will be same as applicable for Bill of Entry/ Shipping Bill. 5' The Service Centre operator(s) shall enter the data on the basis of Data Sheet (format in Annexure A), submitted by the Nepalese importer/ Customs Broker (CB). The Data entry operator shall not make any amendment after generation of the Check List and before submission in the Systems, unless the corrections made by the Nepalese importer/ Customs Broker are clearly indicated on the Check List against the respective fields and are signed by Nepalese importer/ Customs Broker. 6. srb*isio, of -urdutory do.u*.rtr urd ch".k Lirt ut Qr.to* Horr.: The Nepalese importer/ Customs Broker shall present the Check List procured from the Service Centre, Custom House, Kolkata to the Superintendent of

7.1 The Superintendent of Customs, Nepal Bhutan Unit, Custom House, will assess online the CTD vis a vis the Check List and other documents submitted by CB. He shall enter the Examination report and Departmental comments in ICES, if any, and forward the same to the AC/DC, Nepal Bhutan Unit- The mandatory documents viz. LOA, LCICGN letter, Invoice, Packing List etc. shall be endorsed as 'VERIFIED' by the Superintendent of Customs (Preventive). The particulars of the Insurance/Bank Guarantee have to be entered in the Systems, if the same is not reflected in Check List.

7.2 The Bond/ Undertaking can be registered against the pAN of the registered Indian Customs Broker acting on behalf of Nepalese private importers.

7.3 The AssistantlDeputy Commissioner of Customs, Nepal Bhutan Unit, Custom House, after online assessment of the CTD vis a vis the Check List and other documents submitted by CB and forward the same to the Docks/cFS. The ACIDC has an option to raise a query to Neparese importer/CB and return back the online CTD to the Superintendent for reassessing andl or to modiS. the CTD to his satisfaction.

S. : After CTD has been assessed online by the Assistant/ Deputy Commissioner of Customs, Nepal Bhutan Unit, Custom House, it shall move to the designated Preventive Officer at Docks/CFS

designated 8'1 The Preventive Officer, for goods registration at Docks/CFS, shall register the CTD and pass the same to preventive Officer, in charge of inspection/ examination.

Page 4 of 8 8.2 The Preventive Officer, in charge of Inspectionl Examination at I Docks/CFS shall veriff the Container number vis-a-vis the Shippers seal and submit the Verification report in the system accordingly. He will further affix Customs One Time Bottle Seal/ ECTS seal on the container and pass the CTD to the Superintendent at Docks/CFS for giving 'Out of Charge'.

8.3 The Superintendent at Docks/CFS will enter the Vehicle details after verifring the vehicle particulars submitted by the Nepalese importer/CB and

save them in the System. Thereafter, giving out of charge, the CTD will be

marked to CPO on the systems.

8.4 The Preventive Officer (posted at gate of Docks/CFS) shall match the vehicle number, Container number and Seal numbers at the exit point and will pass the CTD to the designated border (Land Customs Stations) or the railway station, as the case may be, on the System. He will print two copies of CTD and hand them over to the Superintendent of Customs (Preventive), who will put his signature and stamp on the copies of CTD. Both the copies of printed CTD shall be handed over to Nepalese importeriCB for accompanying the transit goods.

8.5 In case of discrepancies in Container number and/or Shippers seal number, detected during examination being carried out in presence of the AC/DC Docks, the comments are recorded in file and the Superintendent at DocksiCFS will enter Examination Report giving file reference.

9. Progess at Border (Land Customs Stations): On arrival of transit goods at the border LCS/ Railway Station, the Nepalese importerlCB, shall present the original copy of the CTD duly endorsed by the Superintendent of Customs

(Preventive) as mentioned in para 8.4 above. The Indian Customs Officer at

Page 5 of 8 border (Land Customs Stations) or the Railway Station, as the case may be, shall veriff the same on the System and allow onward transit, to Nepal, if found in order. g.l The Inspector at the Indian Customs exit point (LCS/ Railway Station)

after veri1ring the vehicle number, container number and seal numbers, shall give his report in the System and pass the CTD to the Superintendent of LCSRS for closing and acknowledgement of the CTD' g.2 In case of any discrepancy noticed in Vehicle number, Container number and/or Seal number, or there is a suspicion thereof, the Indian Customs authorities posted at border (LCS/ RS) shall examine the goods to check whether the same are in accordance with the CTD. However, in making such examination, avoidable delays should be curtailed to the utmost in order to expedite the traffic-in-transit. The findings may be reported in the System under Departmental comments and the CTD shall be forwarded to the Superintendent at Docks/CFS in Kolkata Port. g.3 The Superintendent at the Indian Customs exit point (LCS/RS) shall enter the date of 'Cross Border' certiffing the completion of the transit of the goods.

10. In the event of any diversion of transhipment cargo within India, the Principal Commissioner of Customs, Kolkata Port Commissionerate, may initiate necessary action against the carrier and make all possible efforts to ensure that the Customs duty, Interest, fine and penalty, due to the Government of India, is recovered. This is without prejudice to any other action that may be taken by the Principal Commissioner of Customs, Kolkata Port Commissionerate, against the Custom Broker and/or Carrier.

Page 6 of 8 1 1 . In the case of bulk cargo, LCL etc., the Customs Transit Declaration (CTD) will be processed manually, till necessary development is carried out in EDI f system. In exceptional cases, only after permission of the Joint Commissioner of Customs, Nepal Unit, the Customs Transit Declaration

(CTD) shall be processed manually.

12. Difficulties, if any, faced by the Nepalese importers, Custom Brokers, Shipping Lines, Steamer Agents and any other stake holder may be brought to the notice of the Assistant/Deputy Commissioner of Customs, Nepal Unit, Custom House, Kolkata.
