New Novel – The Instructional Materials Committee is recommending approval of the novel A Loss for Words, the Story of Deafness in a Family by Lou Ann Walker and published by Harper & Row for use in American Sign Language classes at Aberdeen High School. 2. Legislative Update – Superintendent Henderson will discuss two bills sponsored by local lawmakers – House Bill 2237 and Senate Bill 6075 – intended to more equitably fund property poor districts such as Aberdeen. Enclosure 6 3. Title IX Compliance – Superintendent Henderson will provide an update on compliance with federal law in follow-up to a student demonstration at AHS. 4. Staffing Update – Superintendent Henderson will provide an update on staffing for 2020-2021. 5. Drug Free Schools – Superintendent Henderson will discuss various initiatives that will take place this year to prevent substance abuse and enforce a drug-free environment in our schools.

New Business 1. Policy 4130 Parental Involvement – Teaching and Learning Director Traci Sandstrom will present an update to a Title 1 policy, 4130 Parental Involvement, for first reading. Enclosure 7 2. Bus Purchase – The district has a need to purchase a new special education bus. The specifications and quote are enclosed. Enclosure 8 3. Clinical Agreement – CTE Director Lynn Green will present an affiliation agreement with Grays Harbor Health and Rehabilitation for the Professional Medical Careers program through the Skills Center to conduct clinical experiences at the center. Enclosure 9 4. Beyond Survival Agreement – CTE Director Lynn Green will present an agreement with Beyond Survival to have its staff work with students at Aberdeen High School on development of a curriculum to assist with healthy, positive decision-making for students. Enclosure 10 5. Surplus Library Books – The library at Miller Junior High School is recommending that the books described in the enclosed inventory be declared surplus as they are no longer used or needed due to age or condition. Enclosure 11 6. Next Meeting – The next regular meeting of the Board is set for 5 p.m. Tuesday, January 21, 2020, in the Community Room at Aberdeen High School.

Minutes of the Regular Meeting of the Board of Directors – December 10, 2019

President Sandra Bielski convened the regular meeting of the Aberdeen School CALL TO ORDER District Board of Directors at 5 p.m. Tuesday, December 10, 2019, in the library at Miller Junior High School. Directors present were Jennifer Durney, Bill Dyer, Jessica Jurasin and Suzy Ritter, along with student representative Madi Niemi, Superintendent Alicia Henderson and 23 patrons, staff and students.

The meeting began with the Flag salute.

On a motion by Jennifer Durney and seconded by Bill Dyer, the Board approved CONSENT AGENDA the Consent Agenda, which included the minutes of the regular meeting on November 19, 2019; November payroll vouchers 828641 through 828685 totaling $3,662,364.25, General Fund vouchers 828716 through 828800, 828802 and 828805 totaling $587,854.08; ASB Fund vouchers 828691 through 828715, 828803 and 828806 totaling $101,105.47; Capital Projects Fund vouchers 828686 through 828688 and 828801 totaling $254,465.40, and Private Purpose Trust Fund vouchers 828689 through 828690 and 828804 totaling $1,078.80, and a gift to the district of a baby grand piano donated by Ann Koski-Smith for use at Aberdeen High School.

Superintendent Henderson administered the oaths of office for newly elected OATHS OF OFFICE directors Jessica Jurasin and Suzy Ritter and re-elected director Jennifer Durney.

President Bielski opened nominations for the annual election of officers. ELECTION OF OFFICERS On a motion by Bill Dyer and seconded by Jennifer Durney, the board in a roll call vote unanimously elected Sandra Bielski to serve as president.

On a motion by Jennifer Durney and seconded by Suzy Ritter, the board in a roll call vote unanimously elected Bill Dyer to serve as vice president.

On a motion by Bill Dyer and seconded by Jessica Jurasin, the board in a roll call vote unanimously elected Jennifer Durney to serve as the representative to the Washington Interscholastic Activities Association. Jennifer Durney, WIAA representative.

Directors Jennifer Durney, Sandra Bielski, Suzy Ritter and Jessica Jurasin offered COMMENTS FROM comment about how valuable they found the sessions they attended at the annual BOARD MEMBERS WSSDA Conference.

Jennifer Durney reported that she was able to attend the celebration of life for River Barclay and offered condolences to the students and staff at A.J West Elementary School who were close to her. Aberdeen School Board Minutes December 10, 2019

Student Representative Madi Niemi provided the student report. She noted STUDENT Winter sports have begun, which includes wrestling, basketball, boys swim, and REPRESENTATIVE girls bowling; that the cheerleaders have started their Foodball celebrations with REPORT the winning grade school classes, that music students are preparing for their upcoming concerts, and that PBIS (Positive Behavior, Interventions and Supports) continues to be a focus area.

Miller Principal Lisa Griebel welcomed the board and those in attendance to MILLER JAZZ BAND Miller Junior High School. She shared information about the positive impact on the music program of 6th Grade moving to Miller. Following the principal’s presenting, the Miller Jazz Band, under the direction of Nicholas Barene, performed.

Following a presentation by Executive Director of Business and Operations RESOLUTION Elyssa Louderback, on a motion Bill Dyer and seconded by Jennifer Durney, the 2019-15 LEVY board unanimously, on a roll call vote, approved Resolution 2019-15 to place ELECTION Proposition 1, a four-year Enhancement Levy on the February 11, 2020, ballot and replacing Resolution 2019-12. Superintendent Henderson noted that if approved by voters, the levy will be for four years, and will continue the 2020 tax rate of $2.50 per $1,000 of assessed property value while generating up to $5.2 million per year to support local programs and activities not funded by the state.

Superintendent Henderson thanked Miller Junior High School staff for hosting SUPERINTENDENT the School Board meeting, the Miller Jazz Band for its performance and the Sixth REPORT Grade for opening the new building for the community to walk through.

Superintendent Henderson updated the board on the work taking place to provide BOND AND LEVY information to the community about the bond and levy elections scheduled for UPDATE the February 11, 2020, ballot.

Superintendent Henderson discussed the work taking place on a proposal for the LEGISLATIVE upcoming legislative session to enhance funding for property poor districts like UPDATE Aberdeen that did not benefit under the new state funding formula. Representatives Brian Blake and Jim Walsh and Senator Dean Takko are introducing legislation.

Teaching and Learning Director Traci Sandstrom presented the Teaching and TEACHING AND Learning Report for December. Her presentation included discussion about the LEARNING REPORT new science curriculum, a computer science grant for K-3 devices, trainings for PBIS and Behavior/Social-Emotional Learning, supports for the MTSS framework, technology and digital teaching and learning, the Master Schedule Task Force, and the catch-up work being done now that the new Miller 6th Grade Building is open, the new printer system is installed, the new intercom is installed at Miller Junior High and student Chromebooks are distributed.

The board accepted for first reading a recommendation from the Instructional NEW NOVEL FOR Materials Committee to approve use of the novel A Loss for Words, the Story of ALS CLASSES Deafness in a Family by Lou Ann Walker and published by Harper & Row for use in American Sign Language classes at Aberdeen High School.

On a motion by Jennifer Durney and seconded by Suzy Ritter, the board TBIP PLAN approved the plans for the 2019-2020 Transitional Bilingual Instruction Program in the district.

On a motion by Bill Dyer and seconded by Jennifer Durney, the board approved ASSESSMENT the plans from Robert Gray Elementary School and Miller Junior High School PARTICIPATION describing how each school will achieve 95 percent participation on assessments. PLANS

Executive Director of Business and Operations Elyssa Louderback presented the FISCAL STATUS Fiscal Status Report for November. She reported a negative cash flow of REPORT $1,331,680.53, which has resulted in a negative fund balance in the General Fund of -$366,116.13. She explained this is a cash flow issue due to the combined impact of the decreased levy (the levy cliff), changes in the state apportionment schedule and revenue for certain programs that has not yet been received. She added that Aberdeen is one of many districts experiencing this issue. She is working with the county Treasurer’s Office, ESD 113 and OSPI to address the issue. She reported the district still expects to end the year with a fund balance near 5 percent. In the other funds, she reported month-ending balances of $571,202.15 in the Capital Projects Fund, $3,484,400.84 in the Debt Service Fund, $379,232.97 in the Associated Student Body Fund and $348,124.15 in the Transportation Vehicle Fund.

Following a presentation by Executive Director of Business and Operations RESOLUTION Elyssa Louderback, on a motion by Jennifer Durney and seconded by Bill Dyer, 2019-16 the board approved Resolution 2019-16 requesting OSPI approval of a $700,000 APPORTIONMENT advance on state apportionment to address the cash flow issue described in the Fiscal Status Report.

Athletic Director Aaron Roiko presented the 2019 Fall/Winter Athletic Report. ATHLETIC The report included information about teams recognized for academic DIRECTOR’S achievement, participation rates at AHS and Miller Junior High School, REPORT elementary intramural girls’ basketball, and season outcomes for fall sports. In addition, he shared a letter from the South Sound Football Officials Association presenting the Aberdeen Bobcat Football Team with the season’s sportsmanship award among 4A/3A/2A schools and noted that the Girls Swim and Dive team, under the leadership of Coach Jan Simons, captured its seventh consecutive District 4 title.

The board accepted for first reading an update to Policy 3241 Student Discipline, POLICY 3241 which incorporates new state requirements and replaces Policy 3000. STUDENT DISCIPLINE

The board accepted for first reading an update to Policy 3115 Students POLICY 3115 Experiencing Homelessness detailing district responsibilities and the rights of HOMELESSNESS students experiencing homelessness.

On a motion by Bill Dyer and seconded by Jessica Jurasin, the board approved QUINAULT TANF renewal of the agreement with the Quinault Indian Nation to provide Temporary AGREEMENT Assistance to Needy Families in the district who qualify.

On a motion by Jennifer Durney and seconded by Suzy Ritter, the board RETIREMENT approved a retirement incentive of $2,000 for certificated teaching staff who INCENTIVE notify the district by January 24 of their intent to retire at the end of the school year. Superintendent Henderson explained that advance knowledge is a planning tool that can help the district in budgeting for staffing needs, rather than finding out after a budget is adopted which teachers aren’t returning.

On a motion by Jennifer Durney and seconded by Bill Dyer, the board declared as SURPLUS surplus certain equipment stored at the Stewart Building, including old wrestling EQUIPMENT mats and music stands that are no longer used due to age or poor condition.

The next regular meeting of the board is set for 5 p.m. Tuesday, January 7, 2020, NEXT MEETING at Stevens Elementary School.

At 6:22 p.m., President Sandra Bielski recessed the meeting for an executive EXECUTIVE session expected to last 20 minutes under RCW 42.30.110 (g) (to evaluate the SESSION qualifications of an applicant for public employment or to review the performance of a public employee and to consider real estate matters. The session began at 6:25 p.m. The regular meeting reconvened at 6:45 p.m.

Under certificated matters, the Board approved the hiring of Carl Johnson to CERTIFICATED teach orchestra in the district effective Jan. 6, 2020, and approved the hiring of Michelle Sturges as a substitute in the district.

Under classified matters, the board approved the hiring of Mirsa Ortuno as the CLASSIFIED office coordinator at Robert Gray Elementary School effective Jan. 6; approved a change of assignment for Robert Allen as a para-educator at Miller Junior High School to para-educator at Stevens Elementary School effective December 2, 2019; approved leaves of absence for Brooke Bowman, a para-educator at A.J. West Elementary School effective December 20 to Jan. 10, for Shannon Harris, a para-educator at Aberdeen High School, effective Dec. 5-29, and for A

STUDENT DISCIPLINE

The Aberdeen School District will assure a positive, progressive learning environment in which all individuals develop their potential to succeed.

“Discipline” means any action taken by the school district in response to behavioral violations. Discipline is not necessarily punitive, but can take positive and supportive forms. Data show that a supportive response to behavioral violation is more effective and increases equitable educational opportunities. The purposes of this policy and accompanying procedures include: • Engaging with families and the community and striving to understand and be responsive to cultural context; • Supporting students in meeting behavioral expectations, including providing for early involvement of parents; • Administering discipline in ways that respond to the needs and strengths of students and keep students in the classroom to the maximum extent possible; • Providing educational services that students need during suspension and expulsion; • Facilitating collaboration between school personnel, students, and parents, and thereby supporting successful reentry into the classroom following a suspension or expulsion; • Ensuring fairness, equity, and due process in the administration of discipline; • Providing every student with the opportunity to achieve personal and academic success, and • Providing a safe environment for all students and for district employees.

The superintendent shall establish and make available rules of student conduct, designed to provide students with a safe, healthy, and educationally sound environment. Students are expected to be aware of the district’s rules of student conduct, including behavior standards that respect the rights, person, and property of others. Students and staff are expected to work together to develop a positive climate for learning.

All students who attend the district’s schools shall comply with the written policies, rules and regulations of the schools, shall pursue the required course of studies, and shall submit to the authority of staff of the schools, subject to such corrective action or consequences as the school officials shall determine.

Minimizing exclusion, engaging with families, and supporting students Unless a student’s presence poses an immediate and continuing danger to others or an immediate and continuing threat to the educational process, staff members must first attempt one or more forms of discipline to support students in meeting behavioral expectations before imposing classroom exclusion, short-term suspension, or in-school suspension. Before imposing a long- term suspension or expulsion, the district must first consider other forms of discipline.

These other forms of discipline may involve the use of best practices and strategies included in the state menu for behavior developed under RCW 28A.165.035. The accompanying procedures will identify a list of other forms of discipline for staff use. However, staff members are not restricted to that list and may use any other form of discipline compliant with WAC 392-400- 025(9).

School personnel must make every reasonable attempt to involve parents and students to resolve behavioral violations. The district must ensure that associated notices, hearings, conferences, meetings, plans, proceedings, agreements, petitions, and decisions are in a language the student and parents understand; this may require language assistance. Language assistance includes oral and written communication, and further includes assistance to understand written communication, even if parents cannot read any language. The district’s use of suspension and expulsion will have a real and substantial relationship to the lawful maintenance and operation of the school district, including but not limited to, the preservation of the health and safety of students and employees and the preservation of an educational process that is conducive to learning.

As described in the procedures, the district will offer educational services to students during suspension or expulsion. When the district administers a long-term suspension or expulsion, the district will timely hold a reengagement meeting and collaborate with parents and students to develop a reengagement plan that is tailored to the student’s individual circumstances, in order to return the student to school successfully. Additionally, any student who has been suspended or expelled may apply for readmission at any time.

Staff authority District staff members are responsible for supervising students during the school day, during school activities, whether on or off campus, and on the school bus. Staff members will seek early involvement of parents in efforts to support students in meeting behavioral expectations. The superintendent has general authority to administer discipline, including all exclusionary discipline. The superintendent will identify other staff members to whom the superintendent has designated disciplinary authority. After attempting at least one other form of discipline, teachers have statutory authority to impose classroom exclusion for behaviors that disrupt the educational process. Because perceptions of subjective behaviors vary and include implicit or unconscious bias, the accompanying procedures will seek to identify the types of behaviors for which the identified district staff may administer discipline.

Ensuring fairness, providing notice, and an opportunity for a hearing When administering discipline, the district will observe all of the student’s constitutional rights. The district will notify parents as soon as reasonably possible about classroom exclusion and before administering any suspension or expulsion. The district will provide opportunities for parent participation during an initial hearing with the student. The district will provide parents with written notice, consistent with WAC 392-400-455, of a suspension or expulsion no later than one school business day following the initial hearing. As stated above, language assistance includes oral and written communication and further includes assistance to understand written communication, even if parents cannot read any language. The district has established

Policy No. 3241 Aberdeen School District No. 5 Students procedures for review and appeal of suspensions, expulsions, and emergency expulsions, consistent with WAC 392-400-430 through 392-400-530.

The district has also established procedures to address grievances of parents or students related to other forms of discipline, classroom exclusion, and exclusion from transportation or extra- curricular activity. The grievance procedures include an opportunity for the student to share his or her perspective and explanation regarding the behavioral violation.

Development and review Accurate and complete reporting of all disciplinary actions, including the behavioral violations that led to them, is essential for effective review of this policy; therefore, the district will ensure such reporting.

The district will periodically collect and review data on disciplinary actions taken against students in each school. The data will be disaggregated into subgroups as required by RCW 28A.300.042, including students who qualify for special education or Section 504. The data review will include classroom exclusion, in-school and short-term suspensions, and long-term suspensions and expulsions. The district will invite school personnel, students, parents, families, and the community to participate in the data review. The purpose of the data review is to determine if disproportionality exists. If disproportionality is found the district will take action to ensure that it is not the result of discrimination and may update this policy and procedure to improve fairness and equity regarding discipline.

Distribution of policies and procedures The school district will make its discipline policies and procedures available to families and the community. The district will annually provide its discipline policies and procedures to all district personnel, students, and parents, which may require language assistance for students and parents with limited-English proficiency under Title VI of the Civil Rights Act of 1964. The school district will ensure district employees and contractors are knowledgeable of the discipline policies and procedures.

The district may preclude a student from returning to the student’s regular educational setting following the end date of a suspension or expulsion for the purpose of protecting the victims of certain offenses as found in RCW 28A.600.460 (2)(3).

HOMELESS STUDENTS: STUDENTS EXPERIENCING HOMELESSNESS: ENROLLMENT RIGHTS AND SERVICES To the extent practical and as required by law, the district will work with homeless students and their families to provide stability in school attendance and other services. them with equal access to the same free, appropriate education (including public preschool education) provided to other students. Special attention will be given to ensuring the identification, enrollment and attendance of homeless students not currently attending school, as well mitigating educational barriers to their academic success. Additionally, the district will take reasonable steps to ensure that homeless students are not stigmatized or segregated in a separate school, or in a separate program within a school, on the basis of their homeless status.

Homeless students will be provided district services for which they are eligible, including Head Start and comparable preschool programs, Title I, similar state programs, special education, bilingual education, vocational and technical education programs, gifted and talented programs and school nutrition programs.

Homeless students are defined as lacking a fixed, regular and adequate night-time residence, including those students who are:

A. Sharing the housing of other persons due to loss of housing or economic hardship, or a similar reason;

B. Living in motels, hotels, trailer parks or camping grounds due to the lack of alternative adequate accommodations;

C. Living in emergency or transitional shelters;

D. Are aAbandoned in hospitals;

E. Awaiting foster care placement;

F. Living in public or private places not designed for or ordinarily used as regular sleeping accommodations;

G. Living in cars, parks, public spaces, abandoned buildings, substandard housing, transportation stations or similar settings; or

H. Are mMigratory children living in conditions described in the previous examples.

The superintendent will designate an appropriate staff person to be the district’s McKinney- Vento liaison for homeless students and their families. The liaison may simultaneously serve as a coordinator for other federal programs, provided that they are able to carry out the duties listed in the procedures that accompany this policy.

If the district has identified more than ten unaccompanied youth, meaning youth not in the physical custody of a parent or guardian and including youth living on their own in any of the homeless situations described in the McKinney-Vento Homeless Education Act, tThe principal of each elementary, middle, and high school building will establish a point of contact for such youth. The point of contact is responsible for identifying homeless and unaccompanied youth and connecting them with the district’s homeless student liaison. The district’s homeless student liaison is responsible for training the building points of contact.

Best interest determination According to the child’s or youth’s best interest, homeless students will continue to be enrolled in their school of origin while they remain homeless or until the end of the academic year in which they obtain permanent housing. Instead of remaining in the school of origin, parents or guardians of homeless students may request enrollment in the school in which attendance area the student is actually living. In making a determination as to which school is in the homeless student’s best interest to attend, the district will presume that it is in the student’s best interest to remain enrolled in their school of origin unless such enrollment is against the wishes of a parent, guardian, or unaccompanied youth.

Attendance options will be made available to homeless families on the same terms as families resident in the district, including attendance rights acquired by living in attendance areas, other student assignment policies, or intra and inter-district choice options.

If there is an enrollment dispute, the student will be immediately enrolled in the school in which enrollment is sought, pending resolution of the dispute. The parent or guardian will be informed of the district's decision and the reasons therefore, (or informed if the student does not qualify for McKinney-Vento, if applicable) and their appeal rights in writing. The district's liaison will carry out dispute resolution as provided by state policy. Unaccompanied youth will also be enrolled pending resolution of the dispute.

Once the enrollment decision is made, the school will immediately enroll the student, pursuant to district policies. However, enrollment may not be denied or delayed due to the lack of any document normally required for enrollment, including academic records, medical records, proof of residency, mailing address or other documentation. Additionally, enrollment may not be denied or delayed due to missed application deadlines, fees, fines, or absences at a previous school.

If the student does not have immediate access to immunization records, the student will be admitted under a personal exception. Students and families should be encouraged to obtain current immunization records or immunizations as soon as possible, and the district liaison is directed to assist. Records from the student's previous school will be requested from the previous school pursuant to district policies. Emergency contact information is required at the time of enrollment consistent with district policies, including compliance with the state's Address Confidentiality Program when necessary. However, emergency contact information cannot be demanded in a form or manner that constructs a barrier to enrollment and/or attendance at school.

Homeless students are entitled to transportation to their school of origin or the school where they are to be enrolled. If the school of origin is in a different district, or a homeless student is living in another district, but will attend his or her school of origin in this district, the districts will coordinate the transportation services necessary for the student, or will divide the costs equally.

The district's liaison for homeless students and their families will coordinate with local social service agencies that provide services to homeless children and youths and their families; other school districts on issues of transportation and records transfers; and state and local housing agencies responsible for comprehensive housing affordability strategies. This coordination includes providing public notice of the educational rights of homeless students where such children and youth receive services under the McKinney-Vento Act, such as schools, family shelters, and soup kitchens. The notice must be disseminated in a manner and form that parents, guardians, and unaccompanied youth receiving such services can understand, including, if necessary and to the extent feasible, in their native language. The district's liaison will also review and recommend amendments to district policies that may act as barriers to the enrollment of homeless students and will participate in professional development and other technical assistance activities, as determined by the state-level (OSPI) coordinator for homeless children and youth programs.

The superintendent will:

• Strongly encourage district staff, including substitute and regular bus drivers to annually review the video posted on the OSPI website on identification of student homelessness; • Strongly encourage every district-designated homeless student liaison to attend trainings provided by the state on identification and serving homeless youth. Ensure that the district includes in materials provided to all students at the beginning of the school year or at enrollment, information about services and support for homeless students (i.e., the brochure posted on the OSPI website). • Use a variety of communications each year to notify students and families about services and support available to them if they experience homelessness (e.g., distributing and collecting an annual housing intake survey, providing parent brochures directly to students and families, announcing the information at school- wide assemblies, posting information on the district’s website).

Facilitating on-time grade level progression The district will: 1. Waive specific courses required for graduation for students experiencing homelessness if similar coursework has been satisfactorily completed in another school district; or 2. Provide reasonable justification for denial of the waiver.

In the event the district denies a waiver and the student would have qualified to graduate from their sending school district, the district will provide an alternative process of obtaining required coursework so that the student may graduate on time.

The district will consolidate partial credit, unresolved, or incomplete coursework and will provide students experiencing homelessness with opportunities to accrue credit in a manner that eliminates academic and nonacademic barriers for the student.

For students who have been unable to complete an academic course and receive full credit due to withdrawal or transfer, the district will grant partial credit for coursework completed before the date of the withdrawal or transfer. When the district receives a transfer student in these circumstances, it will accept the student’s partial credits, apply them to the student’s academic progress, graduation, or both, and allow the student to earn credits regardless of the student’s date of enrollment in the district.

In the event a student is transferring at the beginning of or during their junior or senior year of high school and is ineligible to graduate after all alternatives have been considered, the district will work with the sending district to ensure the awarding of a diploma from the sending district if the student meets the graduation requirements of the sending district.

In the event a student enrolled in three or more school districts as a high school student, has met state requirements, has transferred to the district, but is ineligible to graduate from the district after all alternatives have been considered, the district will waive its local requirements and ensure that the student receives a diploma.

Informed consent for healthcare Informed consent for healthcare on behalf of a student experiencing homelessness may be obtained from a school nurse or homeless student liaison when: a. Consent is necessary for non-emergency, outpatient, primary care services, including physical examinations, vision examinations and eyeglasses, dental examinations, hearing examinations and hearing aids, immunizations, treatments for illnesses and conditions, and routine follow-up care customarily provided by a health care provider in an outpatient setting, excluding elective surgeries; b. The student meets the definition of a “homeless child or youth” under the federal McKinney-Vento homeless education assistance improvements act of 2001; and c. The student is not under the supervision or control of a parent, custodian, or legal guardian, and is not in the care and custody of the department of social and health services.

Upon the request by a health care facility or a health care provider, a district employee authorized to consent to care must provide to the person rendering care a signed and dated declaration stating under penalty of perjury that the employee is a school nurse, school counselor, or homeless student liaison and that the minor patient meet the requirements of RCW 7.70.065 (2) (b) listed above in this policy.

The district and district employee authorized to consent to care under this policy are not subject to administrative sanctions or civil damages resulting from the consent or non- consent for care or payment for care. Any declaration required by a health care facility or a health care provider described in the above paragraph must include written notice that the district employee is exempt from administrative sanctions and civil liability resulting from the consent or non-consent for care or payment for care.

3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

4 Sec. 1. RCW 28A.500.015 and 2019 c 410 s 1 are each amended to 5 read as follows: 6 (1) Beginning in calendar year ((2020)) 2021 and each calendar 7 year thereafter, the state must provide state local effort assistance 8 funding to supplement school district enrichment levies as provided 9 in this section. 10 (2)(a) For an eligible school district ((with an actual 11 enrichment levy rate that is less than one dollar and fifty cents per 12 thousand dollars of assessed value in the school district)), the 13 annual local effort assistance funding is equal to the school 14 district's maximum local effort assistance multiplied by a fraction 15 equal to the school district's actual enrichment levy ((rate)) 16 divided by ((one dollar and fifty cents per thousand dollars of 17 assessed value in)) the school ((district)) district's maximum 18 allowable enrichment levy. 19 (b) ((For an eligible school district with an actual enrichment 20 levy rate that is equal to or greater than one dollar and fifty cents 21 per thousand dollars of assessed value in the school district, the p. 1 SB 6075 1 annual local effort assistance funding is equal to the school 2 district's maximum local effort assistance. 3 (c))) Beginning in calendar year 2022, for state-tribal education 4 compact schools established under chapter 28A.715 RCW, the annual 5 local effort assistance funding is equal to the actual enrichment 6 levy per student as calculated by the superintendent of public 7 instruction for the previous year for the school district in which 8 the state-tribal education compact school is located, up to a maximum 9 per student amount of ((one)) two thousand five hundred ((fifty)) 10 dollars as increased ((by)) for inflation ((from the 2019)) beginning 11 in calendar year 2020, multiplied by the student enrollment of the 12 state-tribal education compact school in the prior school year. 13 (((d) For a school district that meets the criteria in this 14 subsection and is located west of the Cascades in a county that 15 borders another state, the annual local effort assistance funding is 16 equal to the local effort assistance funding authorized under (b) of 17 this subsection and additional local effort assistance funding equal 18 to the following amounts: 19 (i) Two hundred forty-six dollars per pupil in the 2019-20 school 20 year for a school district with more than twenty-five thousand annual 21 full-time equivalent students; TITLE I PARENTAL INVOLVEMENT

The Board recognizes that parent and family engagement helps students participating in Title I programs achieve academic standards. involvement contributes to the achievement of academic standards by students participating in district programs. The Board views the education of students as a cooperative effort among school, parents and community. The Board expects that its schools will carry out programs, activities and procedures in accordance with the statutory definition of parental involvement. Parental involvement means the participation of parents in regular, two-way, and meaningful communication involving student academic learning and other school activities, including ensuring that parents:

A. Play an integral role in assisting their child’s learning:

B. Are encouraged to be actively involved in their child’s education at school; and

C. Are full partners in their child’s education and are included, as appropriate, in decision- making and on advisory committees to assist in the education of their child.

The board adopts as part of this policy the following guidance for parent involvement. The District shall:

A. Put into operation programs, activities and procedures for the involvement of parents in all of its Title I schools consistent with federal laws. Those programs, activities and procedures will be planned and operated with meaningful consultation with parents of participating children;

B. Work with its schools to ensure that the required school-level parental involvement policies meet the requirements of federal law, including a school-parent contact;

C. To the extent practicable, provide full opportunities for the participation of parents with limited English proficiency, parents with disabilities, and parents of migratory children, including providing information and school reports in an understandable and uniform format in a language parents understand including alternative formats upon request; and

D. Involve the parents of children served in Title I, Part A schools in decisions about how the one percent of Title I, Part A funds reserved for parental involvement is spent.

District-wide Parent and Family Engagement

A. The District will do the following to promote parent and family engagement:

1. Host an annual meeting of parents of participating Title I students to explain the goals and purposes of the Title I program. 2. Give parents the opportunity to participate in the development, operation, and evaluation of the program. 3. Encourage parents to participate in planning activities, to offer suggestions, and to ask questions regarding policies and programs.

B. The district will provide the coordination, technical assistance, and other support necessary to assist and build the capacity of all participating schools within the district in the planning and implementation of effective parent and family involvement activities to improve student academic achievement and school performance.

C. The district will conduct, with the meaningful involvement of parents and family members, an annual evaluation of the content and effectiveness of this policy in improving the academic quality of all Title I schools. At that meeting, the following will be identified: 1. Barriers to greater participation by parents in Title I activities; 2. The needs of parents and family members to assist with the learning of their children, including engaging with school personnel and teachers; and 3. Strategies to support successful school and family interactions.

The district will use the findings from the annual evaluation to design evidence-based strategies for more effective parental involvement and to revise this policy if necessary.

The district will facilitate removing barriers to parental involvement.

D. The district will involve parents of Title I students in decisions about how the Title I funds reserved for parent and family engagement are spent. The district must use Title I funds reserved for parent and family engagement for at least one of the reasons specified in 20 U.S.C. § 6318(a)(3)(D).

E. The district and each of the schools within the district providing Title I services will do the following to support a partnership among schools, parents, and the community to improve student academic achievement: 1. Provide assistance to parents of Title I students, as appropriate, in understanding the following topics: a. Washington’s challenging academic standards; b. State and local academic assessments, including alternate assessments; c. The requirements of Title I; d. How to monitor their child’s progress, and e. How to work with educators to improve the achievement of their children.

2. Provide materials and training to help parents work with their children to improve their children’s academic achievement, such as literacy training and using technology, as appropriate, to foster parental involvement. 3. Educate teachers, specialized instructional support personnel, principals, and other school leaders, and other staff with the assistance of parents, in the value and utility of contributions of parents and how to do the following: a. Reach out, communicate with, and work with parents as equal partners; b. Implement and coordinate parent programs, and c. Build ties between parents and the school. 4. Coordinate and integrate parent and family engagement strategies, to the extent feasible and appropriate, with similar strategies used under other programs, such as: a. Head Start; b. Even Start; c. Learning Assistance Program; d. Special Education; and e. State-operated preschool programs. 5. Ensure that information related to the school and parent programs, meetings, and other activities, is sent to the parents of participating children. The information will be provided in an understandable and uniform format, including alternative formats upon request, and, to the extent practicable, in a language the parents can understand. (Describe how the district will provide the information, for example, school bulletin, website, beginning of school information, etc.)

School-Based Parent and Family Engagement Policies

A. Each school offering Title I services will have a separate parent and family engagement policy, which will be developed with parents and family members of Title I students. Parents and family members will receive notice of their school’s parent and family engagement policy in an understandable and uniform formant and, to the extent practicable, in a language the parents can understand.

Each school-based policy will describe how each school will do the following:

1. Convene an annual meeting at a convenient time, to which all parents of Title I students will be invited and encouraged to attend, to inform parents of their schools’ participation under Title I, to explain the requirements of Title I, and to explain the rights that parents have under Title I; 2. Offer a flexible number of meetings, such as meetings in the morning or evening; 3. Involve parents, in an organized, ongoing, and timely way in the planning, reviewing, and improving of Title I programs; and

4. Provide parents of Title I students the following: a. Timely information about Title I programs; b. A description and explanation of the curriculum in use at the school, the forms of academic assessment used to measure student progress, and the achievement levels of the challenging state academic standards; and c. If requested by parents, opportunities for regular meetings to formulate suggestions and to participate, as appropriate, in decisions relating to the education of their children, and respond to any suggestions as soon as practicably possible.

B. Each school-based policy will include a school-parent compact that outlines how parents, the entire school staff, and students will share the responsibility for improved student academic achievement and the means by which the school and parents will build and develop a partnership to help children achieve state standards. The compact must do the following: 1. Describe the school’s responsibility to provide high-quality curriculum and instruction in a supportive and effective learning environment that enables Title I students to meet Washington’s challenging academic standards and describe the ways in which each parent will be responsible for supporting their children’s learning, volunteering in their child’s classroom, and participating, as appropriate, in decisions relating to the education of their children, including the positive use of extracurricular time; and 2. Address the importance of communication between teachers and parents on an ongoing basis through the following: a. Annual parent-teacher conferences in elementary schools during which the compact will be discussed as the compact relates to the individual child's achievements; b. Frequent reports to parents on their children's progress; c. Reasonable access to staff, opportunities to volunteer and participate in their child's class, and observation of classroom activities; and d. Ensuring regular two-way, meaningful communication between family members and school staff, and, to the extent practicable, in a language that family members can understand.

THIS CLINICAL AFFILIATION AGREEMENT (“Agreement”) is made and entered into by and between Twin Harbors, a branch of New Market Skills Center, a consortium of eleven high schools in ten school districts in Washington located at 410 North G Street in Aberdeen, Washington (“the Skills Center”) and Grays Harbor Health and Rehabilitation Center, located at 920 Anderson Drive, Aberdeen, Washington (“GHHR”).

The purpose of this Agreement is for GHHR, which is committed to training health care professionals, to provide desirable clinical learning experiences and facilities for the Skills Center’s students who are enrolled in the Professional Medical Careers (“PMC”) program at the Skills Center and for the Skills Center to provide students who desire to obtain clinical learning experiences as a Nursing Assistant-Certified. The sole PMC program associated with this contract is a Nursing Assistant-Certified program.

GHHR’s provision of clinical learning experiences and facilities for the Skills Center’s students enrolled in its PMC program shall be referred to as a “Clinical Education Program” and will be in compliance with the Skills Center curriculum, in accordance with written objectives provided by the Skills Center to the Training Site, in compliance with the standards and recommendations of the Washington State Department of Social and Health Services and the Washington State Department of Health, and in accordance with Training Site policies and procedures.

In consideration of the mutual covenants and agreement contained herein, the Skills Center and GHHR agree as follows:

I. GENERAL PROVISIONS

A. Clinical areas, dates, times, and numbers of students shall be mutually agreed upon at the beginning of each academic term. Maximum student to instructor ratio will be 10 to 1 in accordance with Washington State Department of Health and Washington State Department of Social and Health Services requirements.

B. The Skills Center and GHHR will instruct their respective faculty, staff, and students participating in the Clinical Education Program, to maintain confidentiality of student and patient information as required by law and by the policies and procedures of both The Skills Center and GHHR.

C. There will be no payment of charges of fees between the Skills Center and GHHR.

D. There will be no discrimination against any program participant or applicant covered under this agreement because of race, color, religion, national origin, age, handicap, status as a Vietnam era or disabled Veteran, sex, or sexual orientation, employment, or personnel policies.

A. Upon request, the Skills Center will provide information to GHHR concerning its curriculum and the professional and academic credentials of its faculty for the students at GHHR. The Skills Center faculty members supervising students will be licensed to practice where so required in the State of Washington. The Skills Center will designate an appropriately qualified and credentialed faculty member to coordinate and be on-site at GHHR at all times that their students are present. The Skills Center shall have the final responsibility for grading students.

B. The Skills Center shall ensure that all students are current on their immunizations (prior to clinical experience), which shall include measles (rubeola), mumps, Rubella (or a positive Rubella titer), and chicken pox (Varicella). Hepatitis B vaccination is encouraged or a signed waiver declining the vaccine. Upon request the Skills Center will provide information to GHHR regarding student status concerning the above requirements. In no event shall the Skills Center enroll a student for the clinical experienced who they have reason to believe has contracted a communicable disease and is in the communicable period.

C. The Skills Center will assign to GHHR only those students who have satisfactorily completed the prerequisite didactic and skills training portions of the curriculum and who have evidence of completion of a CPR course based on the American heart Association or American Red Cross guidelines and related to the age groups with whom they will be working.

D. The Skills Center agrees to request a criminal background check for all students. Upon request, the Skills Center agrees to provide GHHR with a copy of the criminal background check results provided pertaining to each student considered for placement at GHHR. The Skills Center acknowledges that placement of each student at GHHR is contingent upon provisions of the background check information dated less than two months prior to the commencement of the clinical education placement. GHHR acknowledges that the Skills Center is not responsible for the accuracy of the information provided through this background check and that the Skills Center’s provision of this background check information does not relieve GHHR of any of its legal obligations related to these background checks. GHHR understands and agrees that any information forwarded to it by the Skills Center has been procured through this process. GHHR does not certify the veracity of the records provided and, furthermore, the obligation to conduct appropriate background checks and the liability for non-compliance therewith remains the responsibility of GHHR.

E. The Skills Center shall support and comply with all policies and procedures of GHHR that pertain to students and faculty participating in the Clinical Education Program at GHHR. The Skills Center will notify each student of his/her status and responsibilities pursuant to this agreement.

The Skills Center will encourage each student participating in the clinical education program to acquire comprehensive health and accident insurance that will provide continuous coverage of such student during his/her participation in the Clinical Education Program. The Skills Center will inform students that they are responsible for their own health needs, health care costs, and health insurance coverage.

III. GHHR RESPONSIBILITIES

A. GHHR will work cooperatively with the Skills Center and faculty assigned to GHHR in order that students have a positive and productive clinical education experience within the scope of health care services provided by GHHR.

B. GHHR agrees to provide the Skills Center with the necessary paperwork and to process the criminal background checks for all the Skills Center students.

C. GHHR will make available basic supplies and equipment necessary for care of patients/ clients/residents and the Clinical Education Program.

D. GHHR retains full responsibility for the care of the patient, and will maintain the quality of patient care without relying on the students’ clinical training activities for staffing purposes.

E. GHHR has the right to terminate a student’s practicum experience and use of its facilities, equipment, or supplies where flagrant or repeated violations of their rules, regulations, policies or procedures occur. Such actions will not normally be taken until the charges against the student have been discussed with the appropriate representative of the Skills Center. However, GHHR reserves the right to take immediate action where necessary to preserve the quality of patient services and to maintain operation of its facilities free from interruption. The Skills Center will not reassign the individual to GHHR without their prior approval, which will not be unreasonably withheld.

F. In the event a student or faculty member requires emergency medical care or first aid for accidents while on the premises of GHHR, GHHR will provide such care as reasonably able. Any costs will be charged to, and the responsibility of, the student or faculty member.

IV. STUDENTS’ STATUS AND RESPONSIBILITIES

A. Students will have the status of learners and will not replace GHHR department personnel. Any service rendered by students in incidental to the educational purpose of the Clinical Education Program.

C. Students will wear appropriate attire and name badges and will conform to the standards and practices established by the Skills Center during their Clinical Education Program at GHHR.

D. Students assigned to GHHR will be and will remain “Students of the Skills Center” and will in no sense be considered employees of GHHR. Students will not be entitled to any monetary or other remuneration for services performed by them at GHHR, nor will GHHR otherwise have any monetary obligation to the Skills Center or its students by virtue of this agreement.

V. RESIDENT RIGHTS

A. Residents will be informed by GHHR of the Skills Center students in training at their facility. Students will also inform the residents as they work with them.

B. Residents have the right to confidentiality. Information regarding residents will be kept private by both the students and the faculty.

C. Residents have the right to privacy. Every effort will be made on the part of each Skills Center student to honor their privacy, as learned in the course of the PMC curriculum, i.e. knocking before entering, avoiding exposure and embarrassment, etc.

D. Residents have the right to courtesy, dignity, and personal choice.

VI. LIABILITY COVERAGE PROVISIONS

A. During the term of this agreement, the Skills Center shall keep in full force professional liability insurance in the amount of $1,000,000.00 per claim and $3,000,000.00 in the aggregate which shall extend to the activities contemplated under this agreement and undertaken on GHHR premises, covering both faculty and students. Upon request, the Skills Center will provide proof of coverage.

B. The Skills Center agrees to hold GHHR harmless from claim or injuries or damages to persons or property that arise out of the terms and conditions of this agreement which result from any act or omission of the Skills Center and its faculty or students enrolled in the practicum program. GHHR agrees to hold the Skills Center harmless from claims or injuries or damages to person or property that arise out of the terms and conditions of this agreement that result from any act or omission of GHHR and its employees.

A. This agreement will become effective on the last date noted on the signature page and shall remain in effect continually, unless terminated by either party.

B. This agreement may be terminated by either party by written notice given to the other party at least thirty (30) days in advance of such termination. Any students enrolled in the Clinical Education Program at the time of the notice shall be allowed to complete his/her practicum experience.

VIII. PROVISIONS REGARDING BLOOD-BORNE PATHOGENS

A. The Skills Center certifies that it has trained each student it sends to GHHR in universal precautions and transmission of blood-borne pathogens and that it will send to GHHR only those students who have been trained in and have practiced using universal precautions. GHHR will provide personal protective equipment that is appropriate for the tasks assigned to the Skills Center students.

IX. MISCELLANEOUS PROVISIONS

A. Entire Agreement. This Agreement constitutes the entire agreement between the parties, and supersedes all prior oral or written agreements, commitments, or understandings concerning the matters provided for herein.

B. Amendment. The Agreement may be modified only by a subsequent written Agreement executed by the parties. The provisions in the Agreement may not be modified by any attachment or Letter Agreement as described elsewhere in this Agreement.

C. Governing Law. The parties’ rights or obligations under this Agreement will be construed in accordance with, and any claim or dispute relating thereto will be governed by the laws of the State of Washington.

D. Notices. Each party may designate change of address by notice in writing. All notices, demands, requests, or communications that are not hand-delivered will be deemed received three (3) days after deposit in the U.S. mail, postage prepaid; or upon confirmation of successful facsimile transmission.

E. Survival. The Skills Center and GHHR expressly intend and agree that the liability coverage provisions of this Agreement will survive the termination of this agreement for any reason.

F. Inspection. GHHR will permit, on reasonable notice and request, the inspection of clinical and related facilities by agencies charged with responsibility for accreditation of the Skills Center and/or the Professional Medical Careers program.

Affiliation Agreement 5 Twin Harbors/Grays Harbor Health and Rehabilitation Center January 2020 G. Licenses, Permits, and Warranty. GHHR warrants that it has the requisite training, skill, and experience necessary to provide the services under this agreement and is appropriately accredited and licensed by all applicable agencies and governmental entities. GHHR shall be responsible for maintaining any and all licenses, permits, or other requirements for doing business or providing services under this agreement.

H. Indemnification. GHHR agrees to defend, indemnify, and hold harmless the District and its employees from and against any and all claims, losses, damages, liabilities, costs, and attorneys’ fees and other legal expenses arising out of GHHR's breach of the terms of this agreement. The provisions of this paragraph shall survive the expiration or termination of this agreement with respect to any event occurring prior to such expiration or termination. It is further specifically and expressly understood that the indemnification provided herein constitutes GHHR’s waiver of immunity under Industrial Insurance, Title 51 RCW, solely for the purposes of indemnification. This waiver has been mutually negotiated by the parties. The provisions of this section shall survive the expiration or termination of this Agreement.

I. Dispute Resolution Process. When a dispute arises concerning the terms of the agreement, the parties agree to the following process to address the dispute. i. GHHR and the Aberdeen School District shall meet in an attempt to resolve the dispute through informal means. ii. If the informal meeting process does not result in resolution, the CEO or designee shall meet to resolve the dispute. iii. If the process results in dissatisfaction by either part, the agreement will be revisited and may be terminated by either party with a 30 day notice.

J. Relationship Between the Parties. The parties agree that this Agreement is not intended and shall not be construed to create a relationship of agent, employee, partnership, joint venture, or association between the Skills Center and GHHR and any student.

Affiliation Agreement 7 Twin Harbors/Grays Harbor Health and Rehabilitation Center January 2020 Memorandum of Understanding Between Behavioral Health Resources and Aberdeen School District For the period of September 2019 to June 2020.

This Memorandum of Understanding (this "MOU") is offered by Beyond Survival to Aberdeen School District.

Whereas, the parties have recognized the opportunity to partner to broaden access to Social Emotional curriculum services designed to help adolescent students.

1. Duration: a. This MOU is effective for the entirety of the 2019-20 school year. (January 2020 to June 2020).

2. Target Population: a. Students of the Aberdeen School District who selected by staff. b. Students who are authorized to receive services AND who have signed a parent permission form.

3. Staff Assignment: a. As BEYOND SURVIVAL is fully accountable for these services, BEYOND SURVIVAL will determine the level of staff resources that is available for these services. b. BEYOND SURVIVAL staff assigned to specific schools will comply with all Aberdeen School District Human Resources requirements prior to working in the schools. c. Aberdeen School District will communicate with BEYOND SURVIVAL when concerns arise regarding the performance of any school assigned staff. d. Should staffing challenges occur for BEYOND SURVIVAL, there may be a temporary disruption of services provided at the school until the staffing challenges can be resolved.

4. Services to be provided by the Aberdeen School District: a. Access to a space for small group curriculum delivery. b. Access to school district internet/Wi-Fi in order to services. c. Access to a printer in order to print documents required to provide to students.

5. Services to be provided by BEYOND SURVIVAL: BEYOND SURVIVAL will provide prevention programming through the curriculum, “Things to know, before you say Go!”.

6. Communication: a. All communication between BEYOND SURVIVAL and Aberdeen School District will be guided by applicable federal and state laws including the Health Information Privacy and Portability Act and the Family Educational Rights and Privacy Act.

7. Confidentiality: In providing services under this MOU, BEYOND SURVIVAL may have access to personally identifiable education records and confidential information regarding District students or staff (collectively referred to as “Confidential Information”). BEYOND SURVIVAL agrees that it and its personnel will maintain the confidentiality of Confidential Information. The use of disclosure of any Confidential Information for any purpose not directly connected to BEYOND SURVIVAL’s services under this MOU is strictly prohibited except where required of authorized by law.

8. Independent Contractor: a. BEYOND SURVIVAL shall perform all duties pursuant to this MOU as an independent contractor. The District shall not control or supervise the manner in which this MOU is performed, except as expressly provided herein. Nothing in this MOU shall be construed to create a partnership, agency relationship, or employer-employee relationship between the District and BEYOND SURVIVAL or its personnel. Neither party may incur debts or make commitments for the other party. b. BEYOND SURVIVAL acknowledges that the District is not paying Washington State unemployment, industrial insurance, or any other taxes on behalf of BEYOND SURVIVAL or BEYOND SURVIVAL’s personnel. BEYOND SURVIVAL shall be solely responsible for the payment of any taxes imposed by any lawful jurisdiction as a result of the performance and payment of this MOU. c. BEYOND SURVIVAL and its personnel shall not represent itself or themselves as an employee, representative, or spokesperson for the District.

9. Nondiscrimination: The District is an equal opportunity employer. By entering into this MOU, BEYOND SURVIVAL assures the District that BEYOND SURVIVAL complies with all laws and regulations pertaining to nondiscrimination. No person shall, on the grounds of race, creed, religion, color, national origin, sex, sexual orientation including gender expression or identity, age, marital status, veterans’ status, disability, or use of a trained guide dog or service animal by a person with a disability, be excluded from participation in, be denied the benefits of, or be otherwise subject to discrimination under and activity performed pursuant to this MOU.

10. Background Checks: a. BEYOND SURVIVAL will perform a background check, through the Washington State Patrol for each employee or agency of BEYOND SURVIVAL before assigning any such employees or agents to work at a District site where students are present. b. BEYOND SURVIVAL will complete this record check prior to the commencement of services by any new or existing employee or agent for which said record check has not been completed or for whom said record check is more than two (2) years old. BEYOND SURVIVAL shall pay any costs associated with the record check. BEYOND SURVIVAL shall keep and maintain record check files and make said information available to the District upon request. c. BEYOND SURVIVAL shall prohibit any of its employees or agents from working at any District site where students are present if the employee or agency has pled guilty to or been convicted of a felony crime involving the physical neglect of a child under chapter 9A.42 RCW, the physical injury or death of a child under chapter 9A.32 or 9A.35 RCW (except motor vehicle violations under chapter 46.61 RCW), sexual exploitation of a child under chapter 9.68A RCW, sexual offenses under chapter 9A.44 RCW where a minor is the victim, promoting prostitution of a minor under chapter 9A.88 RCW, the sale or purchase of a minor child under RCW 9A.64.030, or violation of similar laws of another jurisdiction. d. Failure to comply with this section shall be grounds for the District to immediately terminate this MOU. Termination based on this section shall supersede any other termination clause in this MOU.

11. Licenses, Permits, and Warranty: BEYOND SURVIVAL warrants that it has the requisite training, skill, and experience necessary to provide the services under this MOU and is appropriately accredited and licensed by all applicable agencies and governmental entities. BEYOND SURVIVAL shall be responsible for maintaining any and all licenses, permits, or other requirements for doing business or providing services under this MOU.

12. Compliance with Law: BEYOND SURVIVAL agrees to comply will all applicable laws, orders, rules, regulations and ordinances.

13. Insurance: See Addendum A

14. Indemnification: BEYOND SURVIVAL agrees to defend, indemnify, and hold harmless the District and its employees from and against any and all claims, losses, damages, liabilities, costs, and attorneys’ fees and other legal expenses arising out of BEYOND SURVIVAL's breach of the terms of this MOU. The provisions of this paragraph shall survive the expiration or termination of this MOU with respect to any event occurring prior to such expiration or termination. It is further specifically and expressly understood that the indemnification provided herein constitutes BEYOND SURVIVAL’s waiver of immunity under Industrial Insurance, Title 51 RCW, solely for the purposes of indemnification. This waiver has been mutually negotiated by the parties. The provisions of this section shall survive the expiration or termination of this Agreement.

15. Termination: This Memorandum of Understanding may be terminated by either party without cause with a 30 day written notice.

17. Entire Agreement and Modification: This written MOU constitutes the entire agreement between BEYOND SURVIVAL and the District. No alterations or variations of the terms of this MOU shall be effective unless reduced to writing and executed by both parties.

18. Severability: Each numbered clause of this MOU stands independent of all other numbered clauses. If any clause of this MOU or the application thereof to any persons or circumstances is held invalid, such invalidity shall not affect other terms, conditions, or applications which can be given effect without the invalid term, condition, or application. Should any clause be adjudged invalid, that judgment shall not invalidate the total MOU; only clauses judged invalid shall not be enforced.

19. Governing Law: Any legal action that may arise from this MOU shall be governed by the laws of the State of Washington.

In witness whereof, the parties hereto caused this Memorandum of Understanding to be executed by the dates and signatures herein affixed. The persons signing this MOU on behalf of the parties represent that each has authority to execute this MOU on behalf of the party entering into this MOU.
