First Question. 5240 LEGISLATIVE COUNCIL ─ 12 March 2008 Overtime Allowance for Staff of Government Departments and Subvented Organizations 1. MR MARTIN LEE (in Cantonese): Madam President, will the Government inform this Council: (a) of the expenditure of each government department on overtime allowance (OTA) in the past five years; (b) in the past five years, whether it had uncovered any cases of misuse of OTA, and how it ensures that various government departments and subvented organizations make good use of the allowance; and (c) whether the authorities will consider establishing a mechanism for returning the balance of the annual allocation for OTA to the Treasury? SECRETARY FOR THE CIVIL SERVICE (in Cantonese): President, the administration and control of overtime (OT) work undertaken by civil servants in government bureaux and departments (hereafter referred to as departments) are governed by the relevant Civil Service Regulations, Civil Service Bureau circulars or circular memoranda. Heads of Department (HoDs) have a responsibility to determine the staff complement required to deliver departmental services efficiently and effectively. OT work may be undertaken only when it is strictly unavoidable. It is an HoD's duty to ensure that OT work is kept to the absolute minimum compatible with operational requirements, and that it is strictly controlled and properly supervised. With regard to the subvented sector, the determination of remuneration and whether to provide OTA to staff working in subvented bodies are essentially matters between the subvented bodies as employers and their staff as employees. As in the case of other elements in the remuneration package, it would be up to individual subvented bodies to agree with their staff whether the OT work should be compensated and if so by what means. The Government has not mandated subvented bodies to follow the civil service practice in the administration and control of OT work undertaken by their own staff. That said, Controlling Officers (COs) are accountable for the proper use of public funds under their control, including the subventions allocated to their subvented bodies. Having regard to the diversified nature of the subvented bodies, COs have the discretion LEGISLATIVE COUNCIL ─ 12 March 2008 5241 to decide what financial control and monitoring system should be put in place to oversee the spending of public money by subvented bodies. While such monitoring systems may vary between subvented bodies in terms of design and substance, the focus nowadays has been moving away from control of itemized expenditure to an outcome-based approach. This is to preserve maximum operational and funding flexibility for the subvented bodies while ensuring that public funds have been properly spent by them for the intended purposes. Under the present subvention policy, most subvented bodies are allowed to accumulate in their reserve up to a specified limit any provisions which remain unspent at the end of a financial year. My replies to the specific questions with regard to government departments are as follows: (a) The expenditure of individual departments on OTA, and Disciplined Services Overtime Allowance (DSOA) for civil servants from 2003-2004 to 2007-2008 are tabulated in the Annex. (b) As reported by departments, only a handful of cases of misuse of OTA were uncovered from 2003-2004 to 2007-2008. To ensure sound administration and control of OT work undertaken by civil servants and proper use of the relevant allowances, we have promulgated the following general rules on OT management: (i) OT work may only be undertaken when it is strictly unavoidable, that is, the duties to be performed at the time are essential, the duties must be performed at that time and cannot be deferred, and that the duties concerned cannot be performed by another officer at the time who will not be required to perform OT; (ii) Apart from exceptional circumstances which are unforeseen, OT must be authorized in advance by an HoD or an officer who is ineligible for OTA/DSOA and who has been nominated for this purpose by an HoD personally; (iii) To avoid habitual OT or accumulation of large amount of uncompensated OT hours by individual officers, HoDs should set a ceiling for the OT hours which an officer may undertake 5242 LEGISLATIVE COUNCIL ─ 12 March 2008 in a month and the maximum amount of uncompensated OT hours accumulated by an officer at any one time. The general guidelines are that each officer should not work more than 60 hours of OT per month and the accumulated uncompensated OT hours for each officer should not exceed 180 hours; (iv) Cases where an officer is required to undertake OT work beyond the stated ceilings should be justified on exceptional or emergency grounds, these cases are subject to approval by an officer at directorate level; (v) OT work should normally be compensated by time off in lieu on a one-for-one basis subject to exigencies of service.

    Bills Committee on Road Traffic Legislation (Amendment) Bill 2000 Speed Limits Introduction This paper reports on – (a) the outcome of the Administration’s consideration of suggestions made by the public in 1999 and 2000 concerning the review of speed limits of certain road sections; (b) the standards and existing policy on the provision of regulatory signs showing the maximum speed limit of roads and other warning signs showing the change of speed limit; and (c) the breakdown of enforcement statistics on speeding offences in 1997 – 1999 with reference to the speed limits of road sections. Review of Speed Limits 2. In 1998 and 1999, Transport Department conducted a comprehensive review on speed limits of major road sections in Hong Kong. Over 40 major road sections were reviewed and the speed limits of 18 of them have been relaxed. The results of the review are summarised at Annex A. 3. In 1999 and 2000, the Administration received suggestions from the public, including Members of the Legislative Council and the transport trade, to review the speed limits of 18 road sections. Review on 16 of the road sections have been completed. The speed limit of one of the road sections has been relaxed while that for the remaining 15 sections remain unchanged. As regards the remaining 2 road sections, no review was conducted as there were either drainage or road works going on or planned for that particular section, such that traffic would not be moving at its normal speed. A summary of the results of the review is at Annex B.

It has been observed that existing translation studies literature appears to cater mainly for long texts. This suggests that there may be a literature gap with regard to short text translation. Investigating how short texts are translated would reveal whether mainstream translation theories and strategies are also applicable to such texts. Therefore, the objectives of the paper are two-fold. Firstly, it seeks to confirm whether there is in fact a gap in the existing literature on short texts by reviewing corpuses of leading works in translation studies. Secondly, it investigates how short texts have been translated by examining the translation theories and strategies used. This is done by way of a case study on street names in Hong Kong. The case study also seeks to remedy the possible paucity of translation literature on short texts by building an objective and representative database to function as an effective platform for examining how street names have been translated. Data, including street names in English and Chinese, are collected by way of systematic sampling from the entire data population.

    LC Paper No. ESC43/16-17(01) LEGISLATIVE COUNCIL ESTABLISHMENT SUB-COMMITTEE Proposed retention of two supernumerary posts of one Principal Government Town Planner (D3) and one Government Architect (D2) in the Works Branch of Development Bureau for four years and nine months with effect from 1 July 2017 to 31 March 2022 to continue taking forward the policy initiative of Energizing Kowloon East Follow-up Actions Arising from the Discussion at the Meeting on 18 January 2017 Supplementary information requested by the Establishment Sub-Committee on 18 January 2017 is provided below: (a) in respect of the establishments for art, culture and creative groups, compare their number, the rent and rental floor area over the past few years Under the Survey on Business Establishments in Kowloon East (May 2011) and 2014 Area Assessments of Industrial Land in the Territory (August 2015), both undertaken by the Planning Department and projected from the sampling data of over 40% of industrial and industrial-office buildings, the estimated number of arts, culture and creative groups in Kowloon East, which was over 400 establishments, had remained at a rather similar level over time. Given the objective of the 2014 Area Assessments was to provide an updated overview and trend analysis of industrial land utilization, particulars of the different establishments such as rents and floor area were not covered in the questionnaire. Hence, the information about rents and floor area of the establishments for art, culture and creative groups in the two studies cannot be compared. (b) the ratio of public housing and private housing in Kai Tak Development Area The Government reserved land for public housing and private housing development in formulating the Preliminary Outline Development Plan (PODP) through an extensive three-stage public consultation under the Kai Tak Planning Review from 2004 to 2006.

ECOLOGICAL IMPACT Introduction 3.1 This section presents the results of assessment of potential ecological impacts resulting from the Project. The aim of the ecological impact assessment is to provide sufficient and accurate ecological data to allow complete and objective identification, prediction, and evaluation of the potential ecological impact. 3.2 The assessment was based on field surveys and a review of existing literature, including survey and assessment reports of the study area. Ecological sensitive receivers were identified, and the ecological importance of habitats / species potentially affected by the proposed works was evaluated. The scale of possible ecological impacts resulting from the proposed works was assessed, and necessary mitigation measures were identified. Residual ecological impacts were assessed, and ecological monitoring and audit requirements were identified. Environmental Legislation, Standards and Guidelines 3.3 Guidelines, standards, documents and ordinances / regulations listed in the following sections were referred to during the course of the ecological impact assessment. 3.4 The Country Parks Ordinance (Cap. 208) provides for the designation and management of country parks and special areas. Country parks are designated for the purpose of nature conservation, countryside recreation and outdoor education. Special Areas are created mainly for the purpose of nature conservation. 3.5 The Forests and Countryside Ordinance (Cap. 96) prohibits felling, cutting, burning or destroying of trees and growing plants in forests and plantations on government land. Related subsidiary regulations prohibit the selling or possession of listed, restricted and protected plant species.

Bellisario College of Communications *Signatures are on file in the Graduate School iii ABSTRACT This research aims to study the propaganda and counter-propaganda strategies used in both a closed and an open society by conducting two case studies in mainland China and Hong Kong. Nationalist propaganda campaigns concerning four independence movements in Tibet, Xinjiang, Taiwan, and Hong Kong were compared and analyzed to explore the underlying mechanism of Chinese Communist Party’s propaganda strategies. The framing strategies employed in the four independence movements were also compared, which were significant different among the movements under study. The Hong Kong independence movement was used to demonstrate the framing contest in Hong Kong, while state propaganda faces different challengers. A hostile media effect and a third-person effect were revealed among mainland Chinese netizens. This research adds new evidence to the observation that the state-controlled media might change people’s behavior, but they could hardly change their beliefs.
