The court pointed out, however, that no heir at law was united in interest with executrix or the legatee,60 and that none of the three originally named heirs at law had ever been served at all, so that there was no need to determine whether service on one of them would have satisfied the statute as to the other two or as to those not even named. Furthermore, the statute only applies to defendants, and its plain provisions cannot be avoided by making defendants into plaintiffs, after the limitation had expired. -

Kaminski From 1763 until 1791, Americans debated the nature of govern- ment and how best to preserve liberty.' Halfway through this de- bate, most Americans decided that their liberties could best be pre- served outside of the British Empire.2 In rebelling against the British government, Americans did not turn their backs on government in general. On the contrary, they fervently believed that government was essential in protecting the rights of individuals. This captivation with government found its way into the fundamental documents of the new states.3 The propriety, and indeed, necessity, of a bill of rights protect- ing individual freedoms and liberties was a much less clear-cut issue during this time. -

p0138-139aspe-0205gs 10/16/02 3:54 PM Page 138 APHY OGR GE T SPOTLIG H The Land Ordinance of 1785 When states ceded, or gave up, their western lands to the United States, the new nation became “land rich” even though it was “money poor.” Government leaders searched for a way to use the land to fund such services as public education. The fastest and easiest way to raise money would have been to sell the land in huge parcels. However, only the rich would have been able to purchase land. The Land Ordinance of 1785 made the parcels small and affordable. The Land Ordinance established a plan for dividing the land. The government would first survey the land, dividing it into townships of 36 square miles, as shown on the map below. Then each township would be divided into 36 sections of 1 square mile, or about 640 acres, each. An individual or a family could purchase a sec- tion and divide it into farms or smaller units. A typical farm of the period was equal to one-quarter section, or 160 acres. The minimum price per acre was one dollar. Government leaders hoped the buyers would develop farms and establish com- munities. In this way settlements would spread across the western territories in an orderly way. FOREWORD The history of a township bears a similar relation to the history of a nation that the biography of an indi vidual bears to the record of human affairs. Occasionally an individual accomplishes a work which becomes an essential and abiding influence in the history of the world. Such persons however are rare, although a considerable number represent events which are important in the minds of relatives and friends. The story of only a few townships represents great historic events, but ac counts of the transactions in many localities are of im portance to the present and future residents of the place. Belpre township is only a small spot on the map of Ohio and a smaller speck on the map of the United* States. Neither is this locality celebrated for the transaction of many events of world-wide importance; at the same time the early history of Belpre exerted an influence on the well being of the State which makes an interesting stqpy for the descendants of the pioneers and other residents of the township. Within a very few months of the arrival of the first settlers at Mariettapfchey began to look for the most favorable places to locate jtheir homes. -

CHAIRMEN OF SENATE STANDING COMMITTEES [Table 5-3] 1789–present INTRODUCTION The following is a list of chairmen of all standing Senate committees, as well as the chairmen of select and joint committees that were precursors to Senate committees. (Other special and select committees of the twentieth century appear in Table 5-4.) Current standing committees are highlighted in yellow. The names of chairmen were taken from the Congressional Directory from 1816–1991. Four standing committees were founded before 1816. They were the Joint Committee on ENROLLED BILLS (established 1789), the joint Committee on the LIBRARY (established 1806), the Committee to AUDIT AND CONTROL THE CONTINGENT EXPENSES OF THE SENATE (established 1807), and the Committee on ENGROSSED BILLS (established 1810). The names of the chairmen of these committees for the years before 1816 were taken from the Annals of Congress. This list also enumerates the dates of establishment and termination of each committee. These dates were taken from Walter Stubbs, Congressional Committees, 1789–1982: A Checklist (Westport, CT: Greenwood Press, 1985). There were eleven committees for which the dates of existence listed in Congressional Committees, 1789–1982 did not match the dates the committees were listed in the Congressional Directory. The committees are: ENGROSSED BILLS, ENROLLED BILLS, EXAMINE THE SEVERAL BRANCHES OF THE CIVIL SERVICE, Joint Committee on the LIBRARY OF CONGRESS, LIBRARY, PENSIONS, PUBLIC BUILDINGS AND GROUNDS, RETRENCHMENT, REVOLUTIONARY CLAIMS, ROADS AND CANALS, and the Select Committee to Revise the RULES of the Senate. For these committees, the dates are listed according to Congressional Committees, 1789– 1982, with a note next to the dates detailing the discrepancy.
