To quantify these you may decide to undertake a more detailed assessment through the recommendation(s) set out below. 1. We recommend regulatory consultation with the Local Authority Environmental Health and Planning Departments to include a review of planning records for the Site, details of any past Site investigations/remediation work, relevant information concerning the Authorities strategy under Part IIA of the Environmental Protection Act 1990 and any other information regarding ground conditions. Argyll Environmental would be pleased to undertake this review for £200 excluding VAT and any local authority charges. In addition, the following natural or mining related hazards have been identified in the immediate vicinity of the Site: Extreme Flooding, Coal Mining 1. More detailed information regarding flooding is provided in the Technical Data section of this report. Further information and guidance is available from the Environment Agency. 2. As the Site lies within a Coal Mining area, it is recommended that a Commercial Coal Mining Report is obtained from the Coal Authority. Contact details are provided at the end of this report. Although outside the scope of this assessment we would draw your attention to the Additional Considerations detailed later in this section of the report. Please refer to the attached letter from Argyll Insurance Services that provides information about Risk Transfer Options. www.argyllenvironmental.com 0845 4585250 Bespoke Site Solutions iii Executive Summary Site use The Site was developed as a depot c.1980 with a number of small ancillary buildings. By c.1989 the Site is no longer indicated as a depot but is shown as part of Portwood Industrial Estate. Data indicates that the Site was used as a licensed waste management facility until c.2001. It was permitted to receive industrial non-hazardous waste and building materials. We have been informed by the client that the Site is currently in light industrial use. The historic and current use of the Site therefore presents a moderate risk. Regulatory Compliance The following authorisations, licences, consents or enforcements have been identified at or within 25m of the Site: Type Details Local Authority Pollution Prevention 1. Licence Holder: North West Water Ltd, Licence Reference: 01144, Site Category: Transfer The Local Authority Pollution Prevention Control Enforcement noted above is not considered likely to relate to the Site, as data indicates that it has never held such a consent. Surrounding area use A number of historic or current potentially contaminative uses were identified in proximity to the Site. These include but are not limited to; a gravel pit 10m to the east c.1872; a gas works 300m to the south west 1895 – 1938 (the gasometers remain); a cotton mill 10m to the south of the Site c.1895 – 1955 (subsequently a works c. 1959 and a foundry by 1972) and a plastic works/unspecified works adjacent to the Site c. 1975 – 1989 (subsequently a garage that currently operates a paint spraying process regulated by the Local Authority). By 1989 the surrounding buildings are indicated as forming part of Portwood Industrial Estate. According to trade directories, current or recent operations in proximity to the Site include garage services, furniture manufacturers, printers and metal finishing services. Data indicates the factory 30m to the north operates a coating process regulated by the Local Authority. In addition the buffer zone of a registered landfill site licenced to accept inert/non hazardous waste was noted 49m north west. The historic and current use of the surrounding area is therefore considered to present a moderate risk to the Site. www.argyllenvironmental.com 0845 4585250 Bespoke Site Solutions iv Environmental sensitivity Soils of high leaching potential and a major aquifer have been identified beneath the Site. The nearest licensed groundwater abstraction is located 618m south west of the Site for manufacturing and the nearest licensed surface water abstraction is located 681m to the west of the Site for cooling. The River Goyt is located 50m south east of the Site. Residential properties are located 70m north east. The Site is therefore considered to have a moderate to high environmental sensitivity. Conclusion In our opinion, there is a moderate risk of soil and groundwater contamination from on-site sources. As regards off- site sources, the risk is considered as moderate. These potential sources of contamination have been considered in light of the Site’s moderate to high environmental sensitivity. In conclusion, in the context of this assessment and assuming a non-sensitive end-use, Potential Liabilities have been identified under Part IIA of the Environmental Protection Act 1990 (or where appropriate, equivalent requirements under the planning regime) and/or the Water Resources Act 1991. To quantify these you may decide to undertake a more detailed assessment through the recommendation(s) set out on page iii. Sources of Information No additional materials have been used in this assessment. www.argyllenvironmental.com 0845 4585250 Bespoke Site Solutions v Additional Considerations Whilst this assessment is primarily a desktop assessment of potential soil and groundwater liabilities, the following environmental compliance considerations have been identified in relation to the infrastructure and/or occupation of the Site. Operational Such liabilities may arise if the site is in commercial/industrial use and both the Site and the compliance business are being purchased, or the Site is to be purchased as an investment with an operational business as a tenant. The operational standards of businesses vary greatly. To assess the Site it would be prudent to undertake an environmental due-diligence audit. Please contact us for a quotation. Asbestos If the buildings at the Site were constructed or renovated during the period between 1950 and 1999, then the fabric of these buildings may contain asbestos in a variety of forms. Buildings constructed from 1950 to 1970 are most at risk. The Control of Asbestos at Work Regulations 2002 and HSE Guidance note MDHS 100, in respect of non-domestic premises, require the confirmation of the absence of asbestos or the management of asbestos through an Asbestos Register that records the location, type, condition, inspection regime and responsible persons. Such action was required by 21st May 2004. The maximum penalties for non-compliance are an unlimited fine and/or up to two years imprisonment. A Type II Asbestos Survey may therefore be required. Please contact us for a quotation. Oil Storage Oil storage facilities of greater than 200 litres capacity fall within the Oil Storage Regulations 2001. Under these regulations any above-ground storage facility should be provided with secondary containment to prevent spills or leaks. Existing oil stores had until September 2005 to meet these regulations. An inspection of any such facilities would therefore be prudent. Please contact us for a quotation. Interceptors Drainage from car parks or operational areas may discharge to Controlled Waters. This discharge is likely to require treatment prior to release, for example an oil/water interceptor. Without this treatment a discharge could allow polluting matter to enter Controlled Waters in breach of the Water Resources Act 1991 (WRA). The WRA also requires that a Discharge Consent is held by site owners/operators for discharges to Controlled Waters. It would be prudent to ensure that any discharge from large car parks (more than 50 parking spaces) or operational areas is treated prior to its release to Controlled Waters and that a valid Discharge Consent is held.
