ELIZABETH THE SECOND, by the Grace of God, of the United Kingdom, Canada, and Her Other Realms and Territories, QUEEN, Head of the Commonwealth, Defender of the Faith PROCLAMATION To all to Whom these Presents shall come GREETING Neil McCrank, Deputy Minister of Justice and Deputy Attorney General WHEREAS section 29 of the Occupational Health and Safety Amendment Act, RSA 1980 c15 (Supp.), provides that that Act comes into force on Proclamation; and WHEREAS section 28 of the Occupational Health and Safety Amendment Act, RSA 1980 c15 (Supp.), provides that the Coal Mines Safety Act and the Quarries Regulation Act are repealed on Proclamation; and WHEREAS it is expedient to proclaim section 28 of the Occupational Health and Safety Amendment Act, RSA 1980 c15 (Supp.), in force and to repeal the Coal Mines Safety Act and the Quarries Regulation Act: NOW KNOW YE THAT by and with the advice and consent of Our Executive Council of Our Province of Alberta, by virtue of the provisions of the said Act hereinbefore referred to and of all other power and authority whatsoever in Us vested in that behalf, We have ordered and declared and do hereby proclaim section 28 of the Occupational Health and Safety Amendment Act, RSA 1980 c15 (Supp.), in force on March 30, 1996 and repeal the Coal Mines Safety Act and the Quarries Regulation Act on March 30, 1996. Edmonton, November 22, 1995 The Lieutenant Governor in Council makes the order in the attached Appendix. S. McClellan, Chair. APPENDIX WHEREAS section 11(2) and (3) of the Lloydminster Charter provide 11(2) Upon the request of the council of the city, any territory adjacent to the city may be annexed thereto by complementary orders in council. (3) Every annexation shall take effect upon such date, and on such terms and conditions, as the complementary orders in council may determine. AND WHEREAS the council of The City of Lloydminster has requested that the land in The County of Vermilion River No. 24 described in Schedule 1 be annexed to it; AND WHEREAS section 12(1) of The Lloydminster Charter provides 12(1) The ministers may appoint a special joint committee consisting of not more than three members appointed by each minister to determine and recommend a decision on the matter of an annexation proposal to the ministers. AND WHEREAS The City of Lloydminster has requested that the appointment of a special joint committee be waived as it owns the land described in Schedule 1, other than the road allowances, and as The County of Vermilion River No. 24 has consented to the waiver of the appointment of a special joint committee; AND WHEREAS The County of Vermilion River No. 24, by its resolution of August 21, 1995, approved the annexation request; AND WHEREAS it is desirable and in the public interest to authorize the annexation of the land described in Schedule 1 to The City of Lloydminster; 1. In this Order, "annexed land" means the land annexed under section 2. 2. The land described in Schedule 1 and shown in Schedule 2 is separated from The County of Vermilion River No. 24 and annexed to The City of Lloydminster on January 1, 1996. 2707 THE ALBERTA GAZETTE, PART I, DECEMBER 30, 1995 3. Any taxes owing to The County of Vermilion River No. 24 on January 1, 1996 in respect of the annexed land are transferred to and become payable to The City of Lloydminster together with the amount of any lawful penalties and costs levied in respect of those taxes, and The City of Lloydminster upon collecting those taxes, penalties or costs shall forthwith pay them to The County of Vermilion River No. 24. 4. The City of Lloydminster shall on January 1, 1996 pay to The County of Vermilion River No. 24 a one-time payment of $35,835. 5. The area of The City of Lloydminster, including the annexed land, is described in Schedule 3. 6. This Order in Council is complementary to an Order in Council of the Lieutenant Governor in Council of Saskatchewan that approves the annexation of the land described in Schedule 1 from The County of Vermilion River No. 24 to The City of Lloydminster. SCHEDULE 1 Lands to be Annexed to the City of Lloydminster from the County of Vermilion River No. 24 1. All those lands in the Province of Alberta in township fifty (50) in range one (1) lying west of the fourth meridian described as: (a) Lot 1, shown on Plan of Record in the Land Titles Office for the North Alberta Land Registration District as No. 8921960; (b) those portions of the south west quarter of section fourteen (14) and south east quarter of section fifteen (15) shown as road widening on a Plan of Record in the Land Titles Office for the North Alberta Land Registration District as No. 812- 1376; and (c) those portions of the north east quarter of section nine (9) and north half of section ten (10) shown as road widening on a Plan of Record in the Land Titles Office for the North Alberta Land Registration District as No. 5946 K.S. 2. All those lands in the Province of Saskatchewan in township forty-nine (49) in range twenty-eight (28) lying west of the third meridian described as: (a) all of sections twenty-six (26), fractional twenty-seven (27), fractional thirty-four (34) and thirty-five (35) and; (b) the west half of section thirty-six (36) excepting that portion of the south west quarter lying east of the westerly limits of the Canadian Pacific Railway Right-of- Way shown on a Plan of Record in the Land Titles Office for the Battleford Land Registration District as No. A.H. 1722. 2. All those lands in the Province of Saskatchewan in township fifty (50) in range twenty-eight (28) lying west of the third meridian described as: (a) the west half of section one (1); (b) all of sections two (2), fractional three (3), fractional ten (10) and eleven (11); (c) the west half of section twelve (12) and; (d) the west half and south east quarter of section thirteen (13). 3. All those lands in the Province of Alberta in township forty-nine (49) in range one (1) lying west of the fourth meridian described as follows: (a) all of sections twenty-five (25), twenty-six (26), thirty-five (35) and thirty-six (36) and; (b) the north east quarter of section thirty-four (34).
