The philosophical work being done here arises from asking the interaction question: what is the interaction between moral and aesthetic judgment and value? Some questions are asked regarding the possible interaction between ethical de(merits) and aesthetic (de)merits; for instance, can an ethical flaw ever count as an aesthetic flaw in an artwork? While the work done here has paid off in interesting new positions and has also enlightened the long debate between the possible legitimacy of the ethical criticism of art, much of the work misses out on a more primary question. This dissertation, while at the intersection between ethics and aesthetics, will buck the interaction question in favour of the structural question: what, if any, structural features are shared between moral and aesthetic judgment? I believe there are three such structural similarities. The first is that ethical and aesthetic reasons share a common metaphysics: holism of reasons is true in both ethics and aesthetics. Ethical and aesthetic reasons are capable of changing their evaluative polarity across cases. The second similarity is that, given holism, the particular should be given priority when making appreciative moral and aesthetic judgments. Our appreciative judgments should be informed by the particulars of the case before us. Third, moral and aesthetic emotionism is true: ethical and aesthetic concepts are essentially related to the emotions. Given these three structural similarities, this dissertation argues that the skill of fine discernment is required in order to make appreciative judgments. Lastly, my family, particularly my parents, whose support of me throughout my life runs the gamut of all the possible ways in which support can be given. vi For Budders and Mother Dearest vii Chapter One: Introduction The first chapter of Art, Emotion and Ethics, Berys Gaut’s book on the intersection between moral and aesthetic judgment, begins with the “long debate,” and indeed, the issues involving art and morality have a long history. Plato, in book ten of The Republic, famously banishes the mimetic poets from his ideal city for fear that art morally damages and corrupts an audience. Even today some echo Plato’s thinking. Some artworks are criticized for being too morally outrageous and dangerous. After all, artists do seem quite happy to push the boundaries of what is morally acceptable in art. For example, Com&Com, a Swiss duo of dadaist–inspired artists, offered $10,000 dollars to a expectant couple if they would agree to name their baby “Dada.” David Wojnarowicz’s video work Fire in My Belly, which depicts ants crawling over a crucifix and assorted homosexual images and themes, was recently taken off view by the Smithsonian Institution as a result of pressure from members of the Catholic Church and some U.S. Congressmen. These are only two examples which show that the “long debate” is very much still alive and going. The issues revolving around art and morality have long gripped us and still do. That we are still in their grip is shown by work being done by philosophers. There is a lively debate currently at the intersection between moral and aesthetic value and judgment. Some of that debate concerns the question of whether or not censoring art is ever a moral good or morally required. This censorship debate harkens back to Plato and his concern for the moral character of the citizens living in his republic. However, much of the debate has focused on a different question: whether or not a moral defect in an artwork diminishes that artwork’s aesthetic value. This debate is concerned with the question of whether or not 1 ethical criticism is also a form of aesthetic criticism. Some philosophers think that the two spheres are distinct: that ethical

This paper provides an analysis of evil in corporations and organizations by presenting the concept of moral blindness in relation to business organizations and public administration on the basis of the concept of administrative evil as it has been developed by Hannah Arendt and her followers. After a discussion of the definition of the concept from Hannah Arendt’s to Philip Zimbardo’s social psychology, the paper gives a general definition of the concept as the basis for application and case studies in public administration and private business corporations. In contrast, in Bauman’s work ethical and moral problems have been recurrent concerns, and can be found in every aspect of his writing from his understanding of the Holocaust to later concerns about the transition of a solid to a liquid form of modernity, consumption, the Other and ambivalence. In his conversations with Michael Hviid Jacobsen and Keith Tester, Bauman explains that the ‘moral law inside me’ as identified by Immanuel Kant ‘is to me an axis around which all other secrets of the human condition rotate’ (Bauman, Jacobsen and Tester 2014:68). Bauman’s ethical concerns are Other directed in that whatever constitutes ethics should be beyond ourselves and our own desires and self-interest. Bauman’s ethical stance was most clearly outlined initially in Postmodern Ethics (1993) and Life in Fragments (1995) in which he identifies the place of contemporary of morality within what appears to be the post ethical, post-legislative postmodern/liquid modern condition. This paper examines the 'justice' and 'care' orientations in ethical theory as characterized in Carol Gilligan's research on moral development and the philosophical work it has inspired. Focus is placed on challenges to the justice orientation - in particular, to the construal of impartiality as the mark of the moral point of view, to the conception of moral judgment as essentially principle-driven and dispassionate, and to models of moral responsibility emphasizing norms of formal equality and reciprocity. Key Words: bioethical education, ethics of care, impartiality, moral judgment, moral psychology INTRODUCTION When Carol Gilligan published In a Different Voice in 1982, she claimed to hear a 'distinct moral voice7 in the reflections of the women subjects she interviewed for her research on moral development. Gilligan dubbed this 'voice' the 'voice of care' and contrasted it with the 'voice of justice' expressed in standard ethical theories rooted in Kant and the contractarians. Gilligan's research was designed in part as a corrective to the research of Piaget (1932) and Kohlberg (1981, 1984), whose studies of moral development initially excluded women, and later found women to be 'less developed' morally than men and who, in their research, equated morality with the 'justice' approach simpliciter.

This paper tries to offer an explanation for this, and then to critically engage with three versions of an ethics of care. The explanation consists firstly in the close affinities between nursing and care. The three versions identified below are by Gilligan (1982), a second by Tronto (1993), and a third by Gastmans (2006), see also Little (1998). It is concluded that where the ethics of care is presented in a distinctive way, it is at its least plausible; where it is stated in more plausible forms, it is not sufficiently distinct from nor superior to at least one other common approach to nursing ethics, namely the much-maligned ‘four principles’ approach. What is added by this paper to what is already known: as the article tries to explain, in spite of its being subjected to sustained criticism the ethics of care retains its appeal to many scholars. The paper tries to explain why, partly by dis- tinguishing three different versions of an ethics of care. It is also shown that all three versions are beset with problems the least serious of which is distinctiveness from other approaches to moral problems in health care.

    Agency and structure in Zygmunt Bauman’s Modernity and the Holocaust Shaun Best University of Winchester Abstract The article explores how in Modernity and the Holocaust to his liquid turn writings Zygmunt Bauman’s work assumes that people live in a deterministic world. Bauman fails to distinguish agency as an analytical category in its own right and as such fails to capture self-determination, agential control and moral responsibility. All of Bauman’s work is based upon the assumption that the individual loses their autonomy and the ability to judge the moral content of their actions because of adiaphortic processes external to themselves as individuals giving rise to agentic state in which the individual is unable to exercise their agency. In contrast to the argument in Modernity and the Holocaust this article suggests that the Nazis developed a distinct communitarian ethical code rooted in self-control that encouraged individuals to overcome their personal feeling states, enabling them to engage in acts of cruelty to people defined as outside of the community. In his post-2000 work where the emphasis is on the process of liquefaction there is the same undervaluing of human agency in the face of external forces reflected in Bauman’s concepts of ambivalence, fate and swarm. Keywords: Bauman, agency, Holocaust, agentic state, adiaphoric 2014 marks twenty-five years since the publication of Zygmunt Bauman’s most influential text Modernity and the Holocaust. The book established Bauman’s reputation as a critic of modernity and as a major European social thinker. In this book agential self-control has no role to play in Bauman’s explanation of the Holocaust and the undervaluing of human agency was to become a common theme in Bauman’s later postmodern and liquid turn.
