I examine a selection of formal legal and political theories that in different ways understand law as a totality of norms, communications or behaviors, how paradox emerges in these theories, and what implications their understanding of paradox has for the relationship between law and politics. I argue that these legal and political theories can be meaningfully and in a novel way grouped according to their orientation to legal totality and paradox. To my knowledge, there is no research systematically mapping orientations to paradox in legal theory. It is the objective of this dissertation to fill this lack. Paradox presents challenges for formal thought, i.e. thought that analyzes the logic of totalities. Law, considered as a totality or form, gathers a plurality of entities under a common denominator and into a legal order. It is in reflecting on such formalization that we encounter paradoxes. This work aims to contribute to a growing literature on the implications of formalism for contemporary social and political thought by providing a legal theoretical perspective hitherto missing in these discussions.

Zeichen-Kunst, Dinge und Orientierung Zeichen-Kunst ist notwendig, wenn Zeichen nicht für Dinge, sondern für Zeichen und zuletzt für Unbekanntes stehen. Setzt man Dinge, Ereignisse, Handlungen vor den Zeichen voraus, muß man doch einräumen, daß sie erst durch Zeichen mitteilbar und so auch erst allgemein bekannt werden.' Wenn Dinge, Ereignisse, Handlungen aber erst durch Zeichen mitteilbar und bekannt wer- den, ist der Bezug auf sie philosophisch zweitrangig; man wird sich dann vor den Dingen mit den Zeichen befassen müssen. Vielleicht wird es dann aber auch schon ausreichen, sich mit den Zeichen zu befassen. Josef Simons Philosophie des Zeichens macht das denkbar. Das Zeichen ist, so Simon, »vor den Dingen, indem es für eine wesent- lich nicht zu Ende kommende Bestimmung der Dinge steht..2 Dinge sind danach durch Zeichen und von Zeichen her bestimmt in einem Prozeß, der nicht zu Ende kommt und auch nicht zu Ende zu kommen braucht. Zeichen werden unmittelbar verstanden. Sind sie nicht unmittelbar verständlich, werden sie durch andere Zeichen verdeutlicht, so lange, bis die Zeichen hinreichend ver- ständlich sind, bis man zu wissen glaubt, was der andere »gemeint. hat. Aber man hat dann immer noch »nur seine Zeichen..3 Damit von Dingen die Rede sein kann, müssen die Zeichen nicht nach einer allgemeinen Regel verdeutlicht werden und auch nicht in einem allgemein bestimmten Zusammenhang untereinander stehen. Es genügt, daß im Prozeß der Verdeutlichung von Zeichen, so Simon, »Subjektivitäten. im Spiel sind, »die, als solche, Wege Vgl. Aristoteles, de int. 1, 16 a 3-8.

Haring Though personal authenticity is an organizing ideal of late-modern Western societies, it also is a site of some of our most contentious disagreements, lacks coherence in many of its formulations, is not fully understood in all of its implications, and is often unidentified in its function as a marker of social distinction. There is a need for conceptual clarification and deeper historical understanding of the ideal of authenticity. Scholarship on authenticity has argued that it was birthed by nineteenth-century Romanticism and popularized in the counter-culture movements of the 1960’s. On this understanding, authenticity is distinct from previous moral ideals, especially rationalist ones, exemplified by Immanuel Kant’s notion of autonomy. But pre-romantic moral rationalism was itself motivated by an ideal of authenticity. Authenticity is not a deviation from the ideal of rational autonomy. On the contrary, rational autonomy is one of a long series of attempts to generate philosophical and religious programs which meet the requirements of authenticity understood as a norm of validity applicable across diverse but analogous domains, such as aesthetics, metaphysics, semantics, and ethics.

"is thesis develops this conception further by providing a theoretical framework for conceiving designing and design objects as a mode of and media for philosophical inquiry. Design is regarded as a material philosophy that explores and re#ects philosophical issues by situating them in the concrete and particular reality of human life rather than in a generalised and abstract realm. Design objects are equipment and media that can be understood in terms of their contextual references and consequences as well as the way in which they mediate human action, thinking and existence, and thus in terms of the worlds that they open up.
