INTRODUCTION Vivisection, or the "act of operating or experimenting on living animals for medical or scientific research, ' 2 has often been de- scribed as a "necessary evil."3 While the moral justification for medical research conducted on live animals can be debated, the animals used in such experiments should undoubtedly be spared from as much suffering as possible. To further that end, Congress passed the Animal Welfare Act4 ("AWA"), which, on its face, is meant "to insure that animals intended for use in research facilities or for exhibition purToses or for use as pets are provided humane care and treatment." In the six- teenth century, Ren6 Descartes taught that animals are essentially machines--or automata-that do not feel pain.6 He endorsed ex- perimentation on animals without anesthesia; the animals' screams were not due to pain, according to Descartes, but were merely me- 7 chanical reactions to the procedures performed on their bodies. Some of Descartes' contemporaries disputed this view of animals, and later scientists and philosophers who recognized that animals were not simply machines championed for animals as well. 8 The Cartesian philosophy, however, continued to permeate 9 the scien- tific community. When Charles Darwin formalized the theory of evolution in the nineteenth century, it became nearly impossible for society to conceptualize non-human animals as separate and distinct from humankind; rather, humans were just one more link on the evolu- tionary chain.' 0 Instead of awakening a sense of camaraderie be- tween humans and non-human animals, the theory of evolution be- came an incentive for scientists to conduct a greater number of ex- periments upon animals due to the apparent biological similarities they shared with humans."I Undoubtedly, large portions of the scientific community are morally and philosophically concerned with the welfare of the animals on which they experiment. I I See id. 12 These tests are not recounted here gratuitously to stir the emotions; rather, it is essential to realize just what is being done to these animals behind laboratory doors to understand the depth of the need for greater regulation of the animals used in these experiments. SPRING 2006] ANIMAL EXPERIMENTATION For example, one of the most common laboratory tests is called the "Lethal Dose Fifty Percent Test," commonly known as the "LD50 test.""3 An LD50 test is an experiment whereby vivisectors admin- ister increasing doses of potentially toxic substances to groups of animals, typically via a test tube inserted through the esophagus leading into the stomach, to determine the dose that kills fifty per- cent of the test subjects within a specified period of time.1 4 Thus, in this common form of experimentation, animals are provided po- tentially toxic substances until fifty percent of those animals die. Normally, over 200 animals are used in each LD50 test.' 5 After the experiment is completed, the surviving animals used in the ex- periment are also killed.' 6 These experiments often involve com- mon household products, such as Procter & Gamble's Comet 17 bath- room cleaner. RESEARCH, POLICY STATEMENT (1982)). 182 BUFFALO ENVIRONMENTAL LAW JOURNAL [VOL 13 volume of the substances that the animals are forced to consume would be an unreasonably high amount for any human to ingest, or even if the substances are relatively harmless to humans, the ex- periments are nonetheless routinely conducted.2 ° Armed with the knowledge that animals undergo such bru- tal experiments, one would think that legislators and administrative officials would strive to ensure that these sentient beings are treated as humanely as possible. It is striking to note, however, that many species of animals are simply excluded from all legal protec- tions. For example, § 2132(g) of the AWA completely excludes birds, mice, and rats from the definition of "animal.",2 1 These ani- mals, therefore, are entirely at the mercy of researchers who act completely without legal limitations on their treatment of these animals. For those animals that do fall under the purview of the AWA, the government has established various safeguards to en- sure that the standards of the AWA are upheld. Each institution that conducts research on animals must establish its own Institu- tional Animal Care and Use Committee ("IACUC") "to oversee and evaluate all aspects of the institution's animal care and use program., 22 The IACUC must consist of "a Chairman and at least two additional members .... At least one shall be a Doctor of Vet- erinary Medicine, with training or experience in laboratory animal science and medicine... In the 1950s, especially in the United States, Freud and his successors stood at the center of all cultural expla- nations for psychological suffering. In the new millennium, we perceive such suffering as erupting no longer from a repressed unconscious but, instead, from a pathophysiology rooted in and caused by brain abnormalities and dysfunctions. Indeed, the normal as well as the pathological have become thoroughly neurobiological in the last several decades. In the process, entirely new vistas have opened up in fields ranging from neuroeconomics and neurophilosophy to consumer products, as exemplified by an entire line of soft drinks advertised as offering “neuro” benefits.

    APPENDIX I A. LISTING OF ANIMAL PROTECTION ORGANIZATIONS For the sake of brevity, the terms "animal rights," "animal welfare" and "animal protection" are used as follows. "Animal rights" refers to individuals or groups who have fundamental objections to both animal killing and animal suffering. "Animal welfare" refers to individuals or groups who have fundamental objections to causing animal suffering but who are prepared to accept the painless killing of animals for "necessary" human ends. "Animal protection" is a more general, collective term for all groups (including the two just described) inter­ ested in promoting the well being of animals.     NEWS Animal rights activists try a more creative legal tactic At a monthly meeting last year, Eric Sandgren, the director of animal resources at the University of Wisconsin-Madison, mentioned that some sheep being used to study decompression sickness, what divers call ‘the bends’, had died during an experiment. The comment set off a flurry of action by a local animal rights group, the Alliance for Animals. And, a few months ago, the alliance partnered with People for the Ethical Treatment of Animals (PETA) to file a joint lawsuit against the scientists involved with the sheep research. As Nature Medicine went to press, the groups were trying to get the state to prosecute the researchers for violating a law that prohibits the use of decompression chambers for killing animals. Many states have similar laws, but they were designed to prevent animal shelters from using decompression as a form of euthanasia. The University of Wisconsin case marks the first time the legislation has been used against istockphoto researchers. "The fable as a form explores those regions where human and animal overlap" (648). Indeed, Aesop is said to have been an animal. Probably a baboon, granted speech by Isis and art by the Muses because of an act of kindness he had displayed (Howe 649). A number of the fables, like “The Apes and the Two Travellers,” feature Apes (Chapter 200, Russell Ash Aesop’s Fables: 210).     The Brock Review Volume 12 No. 1 (2011) © Brock University The Myth of “Animal Rights Terrorism” John Sorenson Abstract: Animal rights advocacy is frequently presented as being linked with terrorism. This paper questions that linkage, suggests that accusations of violence are greatly exaggerated and argues that the terrorist image is the product of corporate propaganda. The paper examines some of the main institutional sources of such propaganda. Addressing Serious Issues The prevention of terrorism is a serious matter, especially if we look to the original use of the term to describe violence conducted by states against civilians, as in the Reign of Terror during the French Revolution. There is no shortage of significant examples from recent times: aerial bombing of cities and civilians in WW2, notably the use of atomic bombs on Hiroshima and Nagasaki, the US campaign against Cuba from 1959 to the present, US-backed coups in Guatemala in 1954, Brazil in 1964, Chile in 1973 and support for dictators and death squads throughout Latin America, US efforts to depose the Sandinista government in Nicaragua, including mobilization of a proxy army, assistance with anti-Communist massacres in Indonesia in 1965, and support for other murderous regimes elsewhere. If we limit the scope to terrorist activities by non-state actors, and focus on those committed by groups opposed to the foreign policies of western states, we still find many serious crimes from recent years: the July 2010 bombings at the Kyadondo Rugby Club and the Ethiopian Village restaurant in Kampala, the 2002 and 2005 Bali bombings, the 2004 Madrid train bombings, the 2001 World Trade Center bombing, all attributed to Islamist groups such as al Qaeda, Jemaah Islamiyah and al Shabab.

Animals in Testing: How the CPI is Handling a Hot Issue In the classic LD50 (lethal dose 50%) test, a dose of a test substance is gradually increased in the diets of 40-100 animals until half of them die. It's that kind of treatment of animals in laboratories that has the American Anti-Vivisection Society looking for a chemical company to sue. "We're doing a legal search with our lawyer in New York," says Michael Ware, assistant to the organization's president. "It may be over the LD50 or maybe one of the other animal tests. We haven't yet made a public determination of which company it'll be." Although a lawsuit will be a new tactic for groups that support animal rights and welfare, the company it is directed at is likely to face rough sledding. Animal rights activists have steadily grown more sophisticated and effective in challenging the animal testing practices of cosmetic, pharmaceutical and chemical companies.
