All rights reserved. - i - Abstract Maritime piracy and armed robbery against ship are one of the contemporary challenges of the maritime industry. These two phenomena have a global impact on maritime trade and security. Nowadays, the Gulf of Aden and the Indian Ocean are considered high risk areas in terms of piracy and armed robbery against ships activities. In this regard, both the international community and the coastal States of the region have deployed every effort to try to find ways to address the problem. Being part of the region, Madagascar faces the same challenges like the coastal States of the Eastern Africa and the Western Indian Ocean region in terms of maritime piracy and armed robbery against ships threat level, and the organization as well as the response capacity to tackle these crimes. The following research paper proposes a piracy response model for Madagascar by analyzing the manifestation of the modern maritime piracy and armed robbery against ships, the existing international and national legal framework on the matter, the experiences of the international community and regional coastal States in addressing the Somalia case and the current operational arrangement Madagascar in addressing the issue. Considered to be at the basis of any solutions to maritime piracy and armed robbery against ships, the legal and the operational aspects are thoroughly discussed. The first part of the research paper analyzes the international legal framework on maritime piracy and armed robbery against ships, the national legislation models of Madagascar’s neighboring countries on the matter, and the existing Malagasy legal framework. Recommendations are proposed to reform the legislation and the necessity of improving the judicial capacity. The second part of the research paper focuses on how to improve the operational arrangement to combat maritime piracy and armed robbery against ships in Madagascar by looking at the international and regional operational initiatives in the Eastern Africa and Indian Ocean Region, assessing the current operational response of Madagascar and suggesting solutions for the improvement. It is acknowledged that without political will and support the legal and operational solutions will not be efficient and achieved. Throughout the research paper, the intricacy of addressing maritime piracy and armed robbery against ships and the necessity of federating and integrating several components are highlighted, moreover the value of coordination and cooperation at the national, regional and international levels is underlined. In this committee, we will be looking at the Golden Age of Piracy, a period of history that has captured the imaginations of writers and filmmakers for decades. People have long been enthralled by the swashbuckling tales of pirates, their fame multiplied by famous books and movies such as Treasure Island, Pirates of the Caribbean, and Peter Pan. But more often than not, these portrayals have been misrepresentations, leading to a multitude of inaccuracies regarding pirates and their lifestyle. This committee seeks to change this. In the late 1710s, nearly all pirates in the Caribbean operated out of the town of Nassau, on the Bahamian island of New Providence. From there, they ravaged shipping lanes and terrorized the Caribbean’s law-abiding citizens, striking fear even into the hearts of the world’s most powerful empires. Eventually, the British had enough, and sent a man to rectify the situation — Woodes Rogers. In just a short while, Rogers was able to oust most of the pirates from Nassau, converting it back into a lawful British colony.

In doing so, I examine piracy and illicit activities such as smuggling and shipwrecking through a new lens. They act as a form of economic engagement that could not only be used by empires and colonies as tools of competitive international trade, but also as activities that served to fuel the developing Caribbean-Atlantic economy, in many ways allowing the plantation economy of several Caribbean-Atlantic islands to flourish. Ultimately, in places like Jamaica and Barbados, the success of the plantation economy would eventually displace the opportunistic market of piracy and related activities. Plantations rarely eradicated these economies of opportunity, though, as these islands still served as important commercial hubs: ports loaded, unloaded, and repaired ships, taverns attracted a variety of visitors, and shipwrecking became a regulated form of employment. In places like Tortuga and the Bahamas where agricultural production was not as successful, illicit activities managed to maintain a foothold much longer.

This is due to national reporting systems failing to account for Illegal, Unreported and Unregulated (IUU) catches, including the non-commercial component of small-scale fisheries, which are often substantial in developing countries. Fisheries legislation, management plans and foreign fishing access agreements are often influenced by these incomplete data, resulting in poorly assessed catches and leading to serious over-estimations of resource availability. In this study, Madagascar’s total catches by all fisheries sectors were estimated back to 1950 using a catch reconstruction approach. Our results show that while the Malagasy rely heavily on the ocean for their protein needs, much of this extraction of animal protein is missing in the official statistics. Over the 1950-2008 period, the reconstruction adds more than 200% to reported data, dropping from 590% in the 1950s to 40% in the 2000s.

Twenty-six and a half per cent of the Indonesian Gross National Product was derived from the utilisation of coastal and marine resources in 2002.1 Fish and other marine resources make a significant contribution ot the supply of food, employment, and foreign exchange. More than 60% of animal protein consumed by the population is derived from the fisheries sector; and per capita consumption was estimated to be 21.7 kg per year in 2002.2 Employment in the primary fishing sector was roughly 1,805,470 people; and exports exceeded imports by just over US$ 1.6 million in 2000.3 The aim of this paper is to address problems of maritime law enforcement and compliance in Indonesia with particular reference to the management of marine and coastal resources, especially coral reefs.
