The new rules prohibit a driver from being on-duty for more than 8 hours without a 30 Championships Results minute break. A break is considered “off duty” time. A driver does not need to spend the time resting. Meal breaks or any other “off duty” time of 30 minutes will count as a break. The definition of “off duty” changed when the first round of the regulations came into effect. A driver can now log “off duty” while remaining in a commercial motor vehicle. However, this change does not alter the existing requirement to log time “on duty” when the driver has vehicle responsibility such as loading or unloading. In explaining the final rules, the FMCSA stated, “Unless a driver is released from all responsibility for the vehicle while waiting to be loaded or unloaded, time spent waiting is still considered on duty time.” All KMCA forms are available on our website: The regulations slightly retain the 34 hour restart. This is not a calendar week, but refers to the 168 hours that comprise a week (7 days times 24 hours).
