[The Canonical Prescription of the Anglican ]

Canon IV ELECTION OF A ORDINARY

1. Whenever a vacancy in the Episcopate of the Anglican Military Ordinariate has occurred, or an event has occurred that will result in such a vacancy, the provisions of General XXIII and this Canon shall apply.

2. Having shown good cause, the Bishop’s Council may, with the concurrence of the Primate, alter or dispense with any part of this Canon with respect to that particular Episcopal election.

Notice of a Meeting and Appointment of a Search Committee

3. Not earlier than 30 days to the date upon which a vacancy in the Office of the Bishop Ordinary shall occur, nor later than 30 days after the occurrence of the vacancy, the shall

(a) cause to be issued a notice calling a meeting of the members of the Electoral College to fill the vacancy, and

(b) appoint members from the Anglican Military Ordinariate to the Search Committee.

4. The chair of the Search Committee shall be appointed by the Bishop’s Council. All other members of the Search Committee shall be nominated by members of the Ordinariate, lay and clerical.

(a) Nominations shall be submitted to the Canon Secretary not later than seven days prior to the opening of the annual meeting of clericus or at such other date as may be determined by the Bishop’s Council, at which time nominations shall close. Nominations shall be accompanied by the biography and consent of the nominee.

(b) There shall be three lay members and three clerical members, one of whom shall be a member of the Primary Reserve. Those having the highest number of votes shall be the members and those receiving the next highest votes shall be the alternates in case of need.

(c) The names of the elected members shall be held in reserve for a two-year term and not appointed to the Search Committee until within the timelines set out in section 3 of this Canon.

Electoral College

5. There shall be an Electoral College for the Anglican Military Ordinariate which shall be composed of:

(a) The Primate, who shall be a non-voting member (or in his or her absence, a bishop appointed by the Primate).

(b) The Archdeacon (or in the event that he or she is nominated, or is otherwise unavailable, a Canon of the Bishop’s Council shall be appointed by the Bishop’s Council),

(c) Three Canons appointed by the Bishop’s Council (Bishop’s Council may appoint members of Clericus to complete this requirement in the event that the Canons are nominated or are otherwise unavailable),

(d) Five members of the clericus, one of whom shall be a member of the Primary Reserve, and five members of the laity who shall be representative of the diversity of the Canadian Forces. These members of the Electoral College shall be nominated by members of the Ordinariate, lay and clerical. Nominations shall be submitted to the Canon Secretary not later than seven days prior to the opening of the annual meeting of clericus or at such other date as may be determined by the Bishop’s Council, at which time nominations shall close. Nominations shall be accompanied by the biography and consent of the nominee.

6. The function of the Electoral College shall be to carry out such elections as may be assigned to it by the Canonical Prescriptions of the Anglican Military Ordinariate or the Canons of the General Synod of the Anglican Church of Canada.

7. A quorum of the Electoral College consists of a majority of the Order of and a majority of the Order of Laity.

8. The work of the Search Committee and the Electoral College, including the vote, may be conducted electronically.

Election by Electoral College

9. Where the Bishop`s Council of the Anglican Military Ordinariate has determined that the Electoral College will elect the Bishop Ordinary, it shall set the date and place for the election.

10. The Canon Secretary shall send a notice of the meeting of the Electoral College to all members of the College at least 30 days in advance of the day set for election.

11. The Canon Secretary shall send to all members of the College a curriculum vita for each of the clergy eligible for election.

12. The Primate (or in his or her absence, a Bishop appointed by the Primate) shall chair the meeting of the Electoral College. The Primate may delegate any or all of his or her functions under this Canon.

13. The Primate shall instruct the Canon Secretary to keep the minutes of the proceedings of the College.

14. The Primate shall appoint a committee of three to act as a credentials committee to examine and report upon the credentials of the members present and the existence of a quorum. The credentials committee shall not form part of the Electoral College.

15. The Primate shall designate two scrutineers to count the votes in the election, one from the Order of Clergy and one from the Order of Laity. The scrutineers shall not form part of the Electoral College.

16. Candidates wishing to remove their names shall do so by contacting the Primate prior to the commencement of voting or may do so after each successive ballot.

17. If only one candidate is presented, the Primate shall cause a resolution naming that candidate as Bishop Ordinary to be put to a vote by orders, and the resolution shall be considered adopted only if the majority of votes cast in each of the two houses are in favour of the resolution.

18. If there is more than one candidate the Primate shall call for each member of the College to vote for one candidate by writing the name of the candidate on a ballot and depositing the ballot in a box designated for the purpose (or by the electronic equivalent if the vote is conducted by electronic means).

19. There will be one ballot box for the Order of Clergy and one for the Order of Laity.

20. The scrutineers shall count the ballots cast by the Order of Clergy separately from those cast by the Order of Laity.

21. An election shall require that the majority of votes cast by the members of the Order of Clergy and a majority of the votes cast by the members of the Order of Laity be for the same person.

22. The scrutineers shall report in writing the results of the ballot to the Primate who shall announce the results of the ballot to the College and declare whether or not there has been an election.

23. If after three ballots no nominee has been elected, then the nominee who has attained the fewest votes shall be dropped from each succeeding ballot until a nominee is elected or the number of nominees has been reduced to two.

24. If during the course of the electoral synod, the number of nominees on the ballot remains two throughout three successive ballots, then the chair of the Electoral College may, in his or her discretion, adjourn the Electoral College to a date within the next ensuing three months as appointed by the chair.

25. If no election shall have taken place after the fifth ballot a candidate who previously had declared that he or she did not wish to be a candidate may, with his or her permission, be included in the candidates for the next or any subsequent ballot.

26. After a member of the clergy has been elected, the Primate shall inform the Electoral College and the candidate, and the candidate will offer his or her acceptance to the Primate.

27. After the Primate has declared the election of a Bishop Ordinary, the scrutineers shall destroy the ballots.

28. Where it is impractical to comply with any provision of this part, the Primate in consultation with the Chancellor of the General Synod may designate an alternative procedure upon securing the approval of the Bishop`s Council of the Anglican Military Ordinariate, the Electoral College and the Metropolitans of the Anglican Church of Canada.

Consecration of the Bishop Ordinary

29. In the event that a member of the clergy who is not yet consecrated as Bishop should be elected, the Primate shall, with all convenient speed, proceed to consecrate and install the Bishop-elect.

30. Before the , the Bishop-elect, if a military serving member, shall have taken his or her release from the Canadian Forces, and be free to assume the duties and responsibilities of Bishop Ordinary to the Armed forces and civilian member of the Interfaith Committee on Canadian Military Chaplaincy (ICCMC).

31. Before the consecration, the Bishop-elect shall, in the presence of the Primate (or a Metropolitan designated by the Primate) make and subscribe such oaths and declarations as may be set out by canon.

32. Before proceeding to consecrate, the Primate (or a Metropolitan designated by the Primate) shall cause to be read publicly in the Church where the consecration is to be held, a duly attested certificate of the election of the person therein named to the office of Bishop, and shall state that no constitutional or canonical impediment to his or her consecration exist and the Primate shall further cause such certificate to be placed on record.

33. The travelling expenses, board and lodging of the Primate shall be borne by the office of the Primate. The travelling expenses, board and lodging of the presenting shall be paid under the authority of the Bishop Ordinary.

Eligibility for Election

34. A person shall be eligible for election as the Bishop Ordinary if that person meets the criteria laid out in General Synod Canon XXIII (2).

Confirmation of Elections.

35. The of election shall be conducted as follows:

(a) The Chair and Secretary of the Electoral College shall, within seven days after the election, certify the election to the Primate.

(b) When a bishop is elected the Primate shall forthwith notify the other Metropolitans of the Anglican Church of Canada.

(c) Each Metropolitan shall, within seven days after being notified of the election, inform the Primate that he or she concurs with, or objects to, the election.

Commissary

36. In the absence of the Bishop Ordinary the Primate of the Anglican Church of Canada may appoint the Archdeacon of the Anglican Military Ordinariate to act in the capacity of Commissary until the Bishop Ordinary is in office.

Coming into Force and Amendments

37. This canon of the Anglican Military Ordinariate shall not come into force or be amended without prior written approval by the Primate of the Anglican Church of Canada.
